PARK RULES
- Weekday Quiet Hours are from 10 PM to 7 AM
- Weekend Quiet Hours are from 10 PM to 7 AM
- All campers, guests, day visitors, etc. must register before entering the park.
- Please respect your fellow campers and guests. If there are any problems, please call: 360-985-2495 and report all violators to the Store Manager onsite.
- Parents/Guardians are responsible for the conduct of their children and/or visiting children at all times.
- Alcohol is permitted, but there is to be no minor consumption on the premises. Absolutely no form of illegal drugs will be tolerated on these premises.
- Charcoal grills may not be placed or used on our picnic tables.
- Please do not dump charcoal or firewood ashes on the ground.
- Do not place trash outside overnight as animals will spread it. No trash in firepits. Please put it in the designated garbage cans.
- Pets are your responsibility. Pets may not be tied to poles, trees, shrubs, etc. Please keep them on a leash no longer than 8ft and clean up after them. Barking dogs will not be tolerated, and we reserve the right to ask you to leave the premises if your dog cannot be contained. We reserve the right to ask for vaccination records. Pets may not be left outside your camper unattended and should be kept inside your tent or RV at night.
- Fireworks are not permitted anywhere on the property.
- Fire rings / grates may not be moved. Campfires are allowed in fire rings only. No cutting of brush, trees or downed debris is allowed.
- Picnic tables cannot be removed from another site without permission.
- On departure you are responsible for cleaning your site and disposing of your trash in the dumpster. Please leave your site as you found it.
- No Smoking on or around playground.
- Keep restroom and showers clean and report any problems or maintenance issues to the Store Manager.
- Children under the age of 7 must be accompanied by an adult when in the restrooms.
- No washing clothes, dishes or other items in the sink or shower.
- No smoking inside or around the restrooms.
- No loitering around the restrooms.
- Pets are not allowed inside the restrooms.
- Do not remove anything from the restrooms, including benches.
- By entering the premises, you agree to release Barrier Dam Campground, including all officers and employees, of all liability for injuries caused by, but NOT LIMITED TO, the following activities: CAMPFIRES, HIKING, FISHING, SWIMMING, PLANNED EVENTS, DOGS, SHOWERS, BICYCLE OR MOTORCYCLE USE, GOLF CARTS, ELECTRIC SCOOTERS AND ENCOUNTERS WITH WILDLIFE.
Cancellation Policy
A full refund less a $10 processing fee for cancellations made at least 7 days prior to the reservation start date.
For cancellations made within a 7-day period, we can offer in store credit less a $10 processing fee to be used for future camping trips or store purchases.
WAIVER OF LIABILITY & RELEASE
All guests of Barrier Dam Campground LLC (“BDC” or “Property”) will be required to be checked in and out upon arrival/departure and agree to follow BDC’s rules and regulations. Each part of this agreement must be completed and signed before using BDC facilities or participating in BDC activities.
Notice: This legally binding Waiver of Liability & Release of certain legal rights is enforceable
between the undersigned user and Barrier Dam Campground LLC (“BDC” or “Property”), including BDC’s owners, affiliates, their respective partners, agents, operators, managers, employees and representatives (the “Released Parties”). Any reference to “I”, “my” or “you” below, includes any third party on whose behalf you are signing. Only legal parents or guardians may sign on behalf of and waive their child’s rights as set forth below. You have the right to seek legal advice if you do not understand any term within this document.
I. Assumption of Risk
Use of BDC Property and participation in activities on BDC Property creates risks that may result in injury and loss potentially arising from the action, inaction, conduct, or negligence by you, the BDC, or others; the rules of play; adverse weather conditions; or the condition of the Property or equipment. Risks may cause physical injury, disability, death, loss of use or damage to personal property, severe social and economic losses, and more. BY ENTERING BDC’s PROPERTY YOU VOLUNTARILY AND FREELY ASSUME ALL RISKS AND DANGERS THAT MAY OCCUR PURSUANT TO YOUR USE OF AN PARTICIPATION IN ACTIVITIES ON THE PROPERTY, INCLUDING THE RISK OF SERIOUS INJURY, DEATH, OR PROPERTY DAMAGE.
b. I acknowledge that camping has many hazards and that there are risks that cannot be eliminated, particularly in a wilderness environment. I hereby acknowledge that BDC is not responsible for any theft, loss or damage incurred during my stay. My signature below confirms that I have read and agree to abide by all rules and policies at BDC, which may be updated from time to time and are subject to change. I also understand that I can be asked to leave the property, without refund, for failure to follow the rules and policies, which are posted at BDC. Non-compliance may result in the denial of entry, participation, or use of activities, facilities, or the Property at BDC’s discretion.
II. Understandings and Acknowledgements
a. If an accident occurs, I become ill or injured during use or stay on the Property, I consent to medical treatment. I will not be provided medical insurance benefits and will be held personally liable for any medical bills, including co-payments and deductibles, even if I have no such insurance.
b. I am in good physical and mental health, not suffering from any condition, disease, or disablement, which can or may potentially affect participation in activities or my use of the Property.
c. I acknowledge and agree that I am fully and solely responsible for any of my property and personal belongings that I bring onto the Property and that Released Parties will not be responsible for or provide any security for such belongings.
d. I acknowledge that the Released Parties make no representation as to the condition of the Property, facilities, and/or activities, or the safety of any structures or equipment that may be used thereon. I accept and shall use the Property, facilities, and/or activities in their “AS IS” condition. I acknowledge and agree that I am not relying upon any representation or statement by the Released Parties except to the extent such representations are expressly set forth in this agreement.
III. Waiver, Release and Indemnity
a. I hereby KNOWINGLY AND INTENTIONALLY WAIVE AND RELEASE, INDEMNIFY AND HOLD HARMLESS, Barrier Dam Campground, LLC including its owners, affiliates, their respective partners, agents, operators, managers, employees and representatives (the “Released Parties”) of all liability for injuries caused by, but NOT LIMITED TO, the following activities: CAMPFIRES, HIKING, FISHING, SWIMMING, PLAYGROUND EQUIPMENT, PLANNED EVENTS, DOGS, SHOWERS, SPEED BUMPS, BICYCLE OR MOTORCYCLE USE, GOLF CARTS, ELECTRIC SCOOTERS AND ENCOUNTERS WITH WILDLIFE.
b. I agree to give up certain legal rights and/or possible claims which I might otherwise assert or maintain against the Released Parties, including, but not limited to, rights arising from or claims for the acts or omissions, fault or negligence of the Released Parties. This applies to losses, damages, death or injury actually or allegedly caused in whole or part by the negligence of the Released Parties, including claims of stolen or damaged property, virus or illness, including COVID- 19, allergic reactions, bug or insect bites, and anything else that may occur while on the Property.
c. I, and any of my agents, children, kin, heirs, or representatives acting on my behalf promise and agree to the covenants to hold harmless and to indemnify the Released Parties against all damage which I may negligently or intentionally cause to third parties during my participation in or use of the Property and assume full responsibility and legal liability (including reasonable attorneys’ fees) for such claims.
d. I understand that this Waiver of Liability and Release is intended to be, and is, a complete release of any responsibility of the Released Parties for all personal injuries, temporary or permanent disability, death, and/or property damage sustained by me while on or using the facilities, Property, and/or engaging in activities.
e. I agree, for myself and my heirs, not to sue the Released Parties or initiate or assist in the prosecution of any claim for damages or cause of action against the Related Parties which I or my heirs may have because of any personal injury, death or property damage I may sustain while on or using the facilities, Property, and/or engaging in activities.
IV. Miscellaneous
a. This agreement is intended to be as broad and inclusive as is permitted by the laws of the State of Washington and shall be governed under the laws of Washington state. If a portion of this agreement is held invalid, the valid portions and intent of this agreement shall continue in full force and effect.
b. Any photographic images, video, or audio recording taken during your stay or use of the BDC shall be granted to the BDC for use and ownership.
c. Disputes/limitations. In the event of a dispute, the parties must confer in good faith and attempt to resolve the matter. Until resolution occurs, you agree not to post any disparaging comments, directly or indirectly, in any written format, including social media. If resolution is not achieved by conferring, and if an arbitration is filed arising out of this agreement, the prevailing party shall be awarded its attorney fees and costs plus expert fees, including appeals if any. The Parties agree to waive all rights to a jury trial. All claims exceeding $10,000 shall be submitted to binding arbitration under the Washington MAR Arbitration rules and process. Claims. All claims and causes of action against BDC are waived and forever barred unless filed within 12- months from the date of your checkout of the BDC property.
d. Attorney Fees. The prevailing party in any litigation or arbitration shall be entitled to its reasonable attorneys’ fees, arbitration costs and expert fees.
e. Waiver of Rights. Failure to enforce any rights hereunder shall not waive any rights in respect of other or future occurrences.
f. Representation on Authority of Parties/Signatories. Each person signing this Agreement represents and warrants that he or she is duly authorized and has legal capacity to execute and deliver this Agreement. Each party represents and warrants to the other that the execution and delivery of the Agreement and the performance of such party’s obligations hereunder have been duly authorized and that the Agreement is a valid and legal agreement binding on such party and enforceable in accordance with its terms.
g. Entire Agreement. This Agreement, and any posted (online or otherwise) Rules and Regulations (as may be amended) shall constitute the entire Agreement between the parties and no inducements, considerations, promises or other references shall be implied in this Agreement that are not expressly addressed herein.
Consent
I have carefully read and fully understand the effect of relinquishing the above stated rights, and voluntarily sign this Waiver of Liability and Release agreement without any inducement on my own behalf and on behalf of any minor child or guest(s) accompanying me. I acknowledge that prior to signing this agreement, I had the opportunity to consult with an attorney to review this agreement. I am at least 18 years of age and fully competent, and I execute this agreement intending to be fully bound by the terms thereof.
