BASS LAKE CAMPGROUND POLICIES, RULES AND REGULATIONS

 

PLEASE READ THESE BASS LAKE CAMPGROUND POLICIES, RULES AND REGULATIONS CAREFULLY BEFORE YOUR STAY AT BASS LAKE CAMPGROUND, OWNED AND OPERATED BY DILLON BASS LAKE LLC, A SOUTH CAROLINA LIMITED LIABILITY COMPANY (“PARK” OR “CAMPGROUND”). BY STAYING AT THE PARK, YOU AGREE TO COMPLY AND ADHERE TO EACH AND EVERY ONE OF THE BELOW BASS LAKE CAMPGROUND POLICIES, RULES AND REGULATIONS. THE BASS-LAKE CAMPGROUND POLICIES, RULES AND REGULATIONS ARE NOT INTENDED TO ADDRESS ALL SITUATIONS THAT MAY ARISE. THE CAMPGROUND IS INTENDED FOR VACATION AND TRANSITIONAL PURPOSES ONLY AND IS NOT A PERMANENT RESIDENCE TO ANY GUESTS. DISREGARD OF ANY OF THE BELOW RULES AND REGULATIONS WILL RESULT IN IMMEDIATE DISMISSAL FROM THE PARK WITHOUT A REFUND. Notice: Giving of Credit Card information constitutes an agreement between customer and Business, customer agrees to the full amount charged, with no refunds unless the rules written below are followed.

 

 

Check-In Time:

·       Begins at 3:00 pm for all sites. If you are arriving after 6pm please call to ensure that arrangements are made to assist you and you understand how to proceed. Check-ins after 6pm will be recorded the following morning, you are welcome to come in at any time after 3pm. Please be sure and click the link below and accept the terms and conditions, then check-in online. The office will be open the next day at 9:00 am for late check-ins. A fee of five dollars ($5.00) per hour will be applied to early check-in. Early check-in will incur a charge of five dollars per hour.($5.00)

Check-Out Time:

§ 1:00pm for all sites. Failure to depart on time will incur a full day additional fee. The late check out is not an option if your site is reserved the same day. Please contact the office for further details. The Late departure time will be charged at 1:05pm (this does not mean you will be able to stay on that site).

Maximum Stay:

§ One (1) month. Bass Lake Campground is intended for vacation and is not a permanent residence for any guests. All Guests must provide a credit card, valid phone number, Mailing address and email address. Late payment will incur a $35.00 late fee for every 10 days it is late.

Cancellation Policy:

Cancellations made at least 1 to 10 days in advance prior to the arrival date will receive a 60% refund. (booking fee.is nonrefundable) Cancellations made 11 to 20 days prior to the arrival date will receive full refund minus booking fee.

Refund Policy:

§ There will be no refunds for weather conditions, failure to show up, voluntary departures, acts of nature, or dismissals or evictions from the park. Any refund processed will be refunded in the same form that the sum originally paid. All refunds processed via credit or debit card, will be processed back to the original credit or debit card used with no exceptions

No Show Policy:

§ Any guests that have not arrived after their arrival date and check in time, and have not made prior arrangements with the park, will be considered a no-show reservation and will be charged the full amount of their reservation/stay.

Occupancy:

§ All rates include two (2) guests only. An extra charge of five dollars ($5.00) per person/per night will apply if there are more than two (2) people per site. Children under four (4) years of age stay free. Maximum of 8 people per site.

The monthly rate includes water, sewer, minimum Wi-Fi and a maximum of $72.00 per month of electricity. Anything over this amount will be charged to the credit card on file.

Wi-Fi for watching movies, tv or gaming available at $5.00 per night or $35.00 per Month

Wi-Fi is on your site, it is not guaranteed to be inside your unit.

 

Campsite:

§ Guests must keep their campsites clean, neat and tidy always. Do not walk through or dive through other sites. Doing so will constitute an agreement that you have chosen to use that site also and you will be charged the daily rate for the use of it.

§ It is prohibited to store gas, oils, paints, other chemicals, or hazardous materials outside RV.

§ Do not leave your pet food or water bowls outside your unit, do not feed the cats or other animals in the park. This will lead to immediate dismissal with no refunds

 

§ General storage (expressing, excluding the storage of gas, oils, paints, other chemicals, or hazardous materials) under an RV is permitted, in the sole discretion of the park, so long as items stored are placed in bins with secure lids.

§ Only items intended for outdoor patios can be placed outside an RV. Such items must be kept to a minimum. The placement of refrigerators, freezers, gyms, generators and the like are not permitted outside an RV

§ No litter, trash or unsightly objects (for example, trash cans), can be placed or left on a campsite. This will incur a $35.00 cleanup charge

§ Pet cages, pet fencing or pet pens are permitted on any campsite but will incure a fee of $10.00 per cage or pen fee.

§ No structures or obstructions, (for example, sheds), are allowed on RV sites. Tent-camping guests can be pitched on site at a cost of $25.00 extra per tent plus the $5.00 per person over the 2 allowed on site.

§ The use of a neighboring site’s electrical, water or sewer services is strictly prohibited, and guests will be required to leave immediately.

§ Repairs or alterations of electric, water or sewer services provided by the park, or of any other Park property is strictly prohibited. Guests must adhere to all applicable legal and governmental requirements when connected to utility services.

§ The use of rack-style clotheslines attached to the back of an RV is permitted only for drying of towels, swimsuits and smaller items that require air drying. All dried items must be promptly removed from the clothesline. And the front of your rv.

Use of dump station after staying on a partial hookup site will incur a $15.00 Charge

  • Parking is designated to the front of rv only. Parking anywhere else on your site will incur a $5.00 per night charge added to your account. Driving through your site or parking along the side it will incur a $50.00 charge per day. 
  • Sites are for one unit only, parking another unit (example: cargo trailer or boat) on site will incur a daily charge.

Campsites are pull through where rv parks only, please do not drive through your site or park past the front of rv.

Do not pull your RV so close to the road that you cannot park in front of it. (the front of a Trailer or 5th Wheel is considered where it attaches to your vehicle)

Please be sure you are not parking so close to the electrical box that we cannot get to it for service. (keep RV at least three foot (3') away)

Laundry Facilities:

§ The laundry facilities must be used for items that can be placed in a washer or a dryer. The laundry sink can be used for washing clothes that require handwash only. The use of dyes or stains in the laundry rooms or bathrooms is strictly prohibited. Leaving your clothes in a machine after the machine has stopped is permitted to be removed by customers waiting to use machines.

Picnic Tables:

§ Moving picnic tables from a campsite without permission from Campground management is strictly prohibited. The use of picnic tables for storage or display of items is strictly prohibited. Picnic tables can be used only for dining and socializing purposes.

Displays:

§ Digging, planting or installing objects in the ground is strictly prohibited. The display of garden flags is permitted in the Park’s sole discretion under the following conditions: (i) such display must not create a hazardous condition, (ii) such display must not require any invasive installation or digging into the ground, (iii) such display must not leave open holes into the ground, (vi) such display must not interfere with Campground maintenance and landscaping.

§ The placement of any object of any kind around or near an electrical box, sewer, or water services and/or facilities is strictly prohibited.

§ Placement and/or installation of nails, screws, or any other object in trees is strictly prohibited. Displays on trees shall be permitted only with the prior approval of Campground management.

Campfires:

§ Open campfires are permitted only on designated sites. Only firewood can be used in the firepits. Guests are prohibited from bringing wood from another state into the park. Treated lumber is NOT considered firewood and the use of treated lumber in the firepits is strictly prohibited. Never leave a fire unattended. Do not move fire rings. If trash is left in the fire pit a cleanup charge of $35.00 will be added to your site.

Landscape:

§ Trimming or cutting of trees or tree branches or any other vegetation is strictly prohibited.

Access to Sites:

§ Campground staff members and third parties authorized by the Campground’s management, may enter any campsite to perform duties necessary for the management, maintenance, repair, safety and operation of the park, in the Park’s sole discretion. Guests cannot refuse entrance to their site if such entry is necessary for the Park’s management, maintenance, repair, safety and operation, in the Park’s sole discretion.

 

 RVs and Other Vehicles:

§ All motorized vehicles, including golf carts, must have proof of insurance to be permitted on the property. Failure to provide valid proof of insurance will result in no entry into or use of such a vehicle in the park.

§ The use of personal golf carts or any other similar vehicles on Park property is considered to fall under the agreement of this form that the park or its representative cannot be held at fault for any accident or injury.

§ All vehicles must be parked within an allocated site or in designated areas only. Parking limit is two (2) vehicles per site, including golf carts, motorcycles, ranchers and all-terrain vehicles. Any extra vehicles and tow trailers must be parked in the storage area.  A fee of five dollars ($5.00) per vehicle/per night or twenty-five dollars ($25.00) per month shall apply. Parking on unoccupied sites is strictly prohibited, and vehicles will be towed away at the owner’s expense. Encroachment on another site is strictly prohibited.

§ Visitors of campground guests may park on the street/driveways in front of the park guest’s site/RV during daylight hours, if leaving room for passing vehicles.

§ Form-fitting bike/car covers are permitted. The use of tarps to cover vehicles or any other objects on the site is strictly prohibited. All covers must be secured. The park is not responsible or liable for keeping guests’ covers secure, nor for any other damage to or theft of guests’ property, RVs, or vehicles.

§ RVs and all other vehicles must be well-maintained and in good condition. RVs and vehicles must always be operable. Guests must be able and ready to move RVs, vehicles and any personal property quickly in case of an emergency, necessary site repairs, or possible evacuations. The Park reserves the right to require guests to move RVs and guest property for any reason deemed necessary by the Park’s staff and management.

§ The Park’s staff and management reserve the right to request guests to wash their RVs and other vehicles while in the park. There is a fee of ten dollars ($10.00) for the wash of each RV and a fee of five dollars ($5.00) for the wash of each car, truck, motorcycle, golf cart, and non-RV vehicle. Guests will be required to notify the office before washing their RVs or vehicles, which will be valid only for the day of purchase. Washings must be made during Park office hours. If guests hire a service to come to the park to wash vehicles, the washing fee still applies, unless the hired service provides its own water and utilities for the entire washing. Guests must inquire about the noise level of the washing services before hiring such service and must notify the management office of any hired washing services and the anticipated noise level of the same.

§ Oil changes and/or any other type of RV and/or vehicle maintenance or repairs are strictly prohibited on the Campground. Only minor necessary repairs of RVs and vehicles may be performed on the park grounds, such as flat tire repairs or bulb changes. The Park reserves the right to request Guests to make repairs to RVs or vehicles when such are an eyesore, specifically including but not limited to, repairs to RVs or vehicles containing excessive tape, broken windows, large dents, and any other repair the Park’s management deems appropriate or necessary. Any such Park-authorized or required repairs to RVs or vehicles must be completed in a timely manner, with a minimum noise level, and only during Park office hours. Guests who do not make diligent efforts to commence and/or complete Park-required repairs, or if the damage cannot be repaired, may be required to leave the Park. RV remodel on the park grounds is strictly prohibited.

Respect Your Neighbors:

§ Guests must keep noise to a minimum and always be respectful of neighbors.

§ Bright lights and/or headlights must be turned off when RVs or vehicles are not moving and during dark hours. Only dimly lit lights, which do not interfere with neighbors’ comfort, are permitted outside RVs during dark hours.

§ Headlights on golf carts and other vehicles must be used when operating such vehicles during dark hours. No bikes or other recreational vehicles can be operated during dark hours without lights.

  Guest is not to drive or walk through other sites, do not drive your vehicle through your site it is drive through only where rv parks.

Quiet Time:

§ Our quiet time is from 10:00 p.m. - 8:00 a.m. daily. Guests must always keep noise levels at a reasonable volume, but especially during early check-outs, and when warming diesel engines. No loud talking, loud music, loud televisions, or other loud noises are permitted during quiet hours. Guests must be courteous to the other guests around them during all hours of the day. The use of generators is prohibited.

Speed Limit:

§ The speed limit is 5 mph on all park roads. All guests must abide by the speed limit.

Smoking and Alcohol:

Smoking is not permitted in any buildings or indoor facilities, including the laundry facilities, office or bathhouse. Guests must dispose of cigarette butts appropriately. Disposing of cigarettes on the ground, in the lake, or anywhere else on the Campground is strictly prohibited and will incur a cleanup fee of a minimum of $35.00

Alcohol consumption is permitted on a campsite, provided it is consumed in a responsible manner, by Guests over twenty-one (21) years of age. Guests must exercise caution and discretion when consuming alcohol on their site or anywhere in the park.

 

Dumpsters and Trash:

§ Only daily household trash is allowed in the dumpster. A disposal fee shall apply and will be charged to Guests for the disposal of large items, including but not limited to grills, chairs, carpeting, rugs, and the like, or if any such items are left on-site after the guest’s departure. Guests must bag and tie trash before placing it in the dumpster. Boxes must be broken down.

Campground:

§ Walking or driving through occupied or vacant sites is strictly prohibited. Guests should carry a flashlight when walking in the Campground during dark hours.

§ No guests or guest visitors are permitted to operate any business in the park.

§ Guests are not permitted to rent their sites to others. The guests registered at the park must occupy the site.

§ Abusive or disruptive behavior, whether directed at Park staff or other people, will not be tolerated and is strictly prohibited. If such behavior is observed, guests will be asked to leave the Park.

If you intend to argue with staff or management for any reason, you will be dismissed from park with no refund.

§ Guests are responsible for any damage or destruction of property and/or injury to persons caused by guests or guests’ family members, visitors, or pets. Missing sewer connections, broken water or cable lines, damage to landscape, and any debris (trash, cigarette butts, bottle caps, and the like) left on a site will result in a cleanup charge of thirty-five dollars ($35.00) per hour, with a minimum charge of one hour.

Wildlife:

§ As with any campground, there is wildlife on the property.

§ Feeding of wild animals, birds, or strays is strictly prohibited. Leaving pet food or water outside an RV is strictly prohibited and you will be dismissed with no refund.

§ There has been an alligator sighting in past years, but not in the last few. Please beware.

§ Hunting of any kind is strictly prohibited on the Campground.

Fireworks:

§ The possession of and/or use of fireworks, including sparklers, and explosives of any kind, is not permitted under any circumstances and is strictly prohibited at all times. Anyone caught in possession of fireworks will be asked to leave the Park without a refund.

Lake/Swimming:

§ Swimming or wading in the lake located on the Campground is not suggested and you take personal responsibility if you choose to do so.

§ The use of any personal kayaks, canoes, or any other water vessel in the lake is strictly prohibited unless the owners/guest  assume and is liable for any and all issues arising from the decision. 

Children and Guests’ Visitors:

§ Children twelve (12) years of age and younger must always be supervised by an adult. If older children are destructive or disruptive, Park staff may, at any time, always require adult supervision, and/or Guests may be required to leave.

§ Parents or guardians are responsible for the safety and behavior of their children.

§ Guests’ visitors must leave the park by 10pm. A nightly fee of five dollars ($5.00) per person will be charged for visitors who stay past 10pm. Guests are responsible for the actions of their visitors.

Guest visitors must check in at the office before going to the site. If guests do not stop and check in, the guest registered to that site will be charged the $5.00 per extra person fee and $5.00 extra vehicle fee

Pets:

§ Only two (2) pets are allowed per site. Additional pets will be charged three dollars ($3.00) per pet, per day. Upon check-in, please notify the office of any pets.

§ No dangerous, aggressive, or poisonous pets are allowed in the Park.

§ Pets must wear collars with names and contact numbers at all times.

§ Guests must immediately pick up after their pets. Failure to pick up waste after a pet will result in an immediate fine of thirty-five dollars ($35.00) for the first offense, and an immediate dismissal from the park upon the second offense.

§ Pets must always be on leashes, no longer than 6 feet. Extendable/retractable leashes are NOT allowed.

§ Pets are not allowed in any buildings, including any laundry or bathroom/shower facilities, or on any playgrounds or game areas.

§ Pets are the responsibility of their owners. Leaving pets unattended or alone outside of an RV or anywhere else on the Campground is strictly prohibited. If a pet is tied up outside an RV, the lease must be no longer than 6 feet and the owner must always be with pet and must assure that the pet cannot reach or interfere with a neighboring site or reach the road.

§ Pets must be walked on the Campground roads or common areas only. Walking pets on other sites is strictly prohibited. Pets are only allowed off their leashes while inside the dog park.

§ No excessive barking or other pet noise will be tolerated.

 

COVID-19

§ All guests must adhere to CDC guidelines for the reduction of the spread of COVID-19, and to all local governmental requirements related to COVID-19.

§ Any guest who has experienced COVID-19 symptoms (coughing, respiratory difficulty, loss of taste or smell) within the fourteen (14) days prior to his or her scheduled visit to the Park should cancel the visit.

Fees/Failure to Comply with the Bass Lake Campground Policies, Rules and Regulations

§ The Park has the right to: (i) charge fees for damage to or destruction of Park’s property caused by guests’ actions, inactions or omissions, (ii) charge fees pursuant to the Bass Lake Campground Policies, Rules and Regulations, and (iii) charge fees due to any violations of the Bass Lake Campground Policies, Rules and Regulations. The Park reserves the right to charge all such fees to the guest’s credit card or debit card, even if the damage or destruction of property, or violation of the Bass Lake Campground Policies, Rules and Regulations, is discovered after the guest’s departure.

§ Guests may be required to leave, without refund, for failure to comply with the Bass Lake Campground Policies, Rules and Regulations, or for engaging in any activity deemed not in the best interest of the Campground, in the Park’s sole discretion. Guests who refuse to leave as directed will be reported to law enforcement.

 

The Park reserves the right to update any Bass Lake Campground Policies, Rules and Regulations at any time without prior notice. Guests have the responsibility to inquire about and comply with any and all policies, rules or regulations.   The absence of a particular policy, rule or regulation from the published Bass Lake Campground Policies, Rules and Regulations is not grounds for the granting of an exception. The Park advises that Guests and their family members and visitors thoroughly read the Bass Lake Campground Policies, Rules and Regulations. Guests expressly agree to assume responsibility for their own behavior, actions, inactions, or omissions and for the behavior, actions, inactions, or omissions of any other guests and/or family members, including any outside visitors, staying on the guest’s site. The Park assumes no responsibility for accidents or injuries to people and/or damage to property.

 

RELEASE OF ALL CLAIMS, WAIVER OF LIABILITY,

ASSUMPTION OF ALL RISKS, AND HOLD HARMLESS AGREEMENT (the “AGREEMENT”)

 

 

            In consideration of DILLON BASS LAKE, LLC (“Dillon Bass Lake”) granting permission to enter and stay at the Property and/or engage in “Activities”, as hereinafter defined, and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the undersigned, individually and as parent or guardian of any minor child (if applicable), (hereinafter “the Guest”), agree(s) as follows:

 

1.         Acknowledgments.

 

            The Guest acknowledges that he/she has voluntarily chosen to enter and stay at the Property and/or engage in certain Activities as defined in this Agreement.  The Guest acknowledges the dangers associated with entering and staying at the Property and/or engaging in those Activities carries a risk of personal injury, death and/or property damage.  The Guest recognizes that those risks cannot be eliminated.

 

            The Guest further acknowledges that he/she will be utilizing Dillon Bass Lake’s property, which is a wilderness property (the “Property), and that such Property presents inherent risks to users of the land, some of which are obvious and some of which may be less than obvious due to the wilderness conditions.

 

            The Guest further acknowledges that he/she has voluntarily chosen to enter and stay at the Property and/or engage in Activities while being fully aware of the risks related to COVID-19 (also known as “Coronavirus”).  The Centers for Disease Control (“CDC”) continue to warn of the health risks associated with COVID-19.  The CDC cautions that the virus is contagious, can be spread through in-person contact, and possibly through the air and contaminated surfaces.  COVID-19 can cause serious illness and even death.  Dillon Bass Lake cannot guarantee that Guest will not be exposed to or contract COVID-19 while Guest enters and stays at the Property and/or engages in Activities.  Guest acknowledges and understands that as a result of voluntarily entering and staying at the Property and/or engaging in Activities, Guest may be increasing his/her risk of contracting COVID-19 and spreading it to others, including family members.  Guest acknowledges that, due to their physical nature, Activities may carry a greater risk than other activities of exposure to COVID-19, and that, even when all reasonable precautions are taken, there is an unavoidable risk of exposure to COVID-19.

 

2.         Covenants by Guest.

 

            In consideration of and as a material inducement for Dillon Bass Lake to allow the Guest to enter and stay at the Property and/or participate in Activities, the Guest covenants as follows:

 

            a.         he/she is aware of the risks associated with entering and staying at the Property and the participation in Activities; 

 

            b.         he/she is in sufficiently good health to enter and stay at the Property and participate in the Activities afforded to him/her; 

           

            c.          he/she is aware of the risks associated with COVID-19 and that Dillon Bass Lake cannot prevent his/her exposure to or contraction of COVID-19 when he/she enters or stays at the Property and participates in Activities;

 

e.         he/she will follow and abide by all directions and rules and regulations imposed by Dillon Bass Lake or any Dillon Bass Lake representative with respect to stays or Activities at the Property and understands that failure to follow and abide by all such directions, rules and regulations, may result in being required to leave the Property without a refund;

 

f.          he/she acknowledges receipt and understanding of all Bass Lake Campground Policies, Rules and Regulations imposed by Dillon Bass Lake with respect to stays at the Property and any Activities, including, but not limited to, rules that prohibit swimming at Dillon Bass Lake and hunting on Dillon Bass Lake grounds;

 

g.         he/she will follow and abide by all Bass Lake Campground Policies, Rules and Regulations imposed by Dillon Bass Lake with respect to stays at the Property and any Activities, including, but not limited to, rules that prohibit swimming at Dillon Bass Lake and hunting on Dillon Bass Lake grounds, and understands that staying at Dillon Bass Lake and engaging in Activities will be conducted with Guest’s assumption of the risk (including, but not limited to, camping, canoeing and fishing);

 

h.         he/she has chosen to enter and stay at the Property and/or participate in any Activities as an act of his/her own free will and that he/she is not acting under any coercive affect or agent.

 

i.          he/she authorizes charges to his/her credit card for reservations, store purchases, amenities use, fees and other costs and charges incurred by Guest and any visitors hosted by Guest, including costs and expenses incurred by Dillon Bass Lake due to Guest’s and his/her visitors’ actions or inactions.

 

3.         Safety Rules and Practices.

           

Guest warrants and represents that Guest will listen to and follow any and all Bass Lake Campground Policies, Rules and Regulations.  Guest additionally warrants and represents that Guest will follow any safety protocols or instructions aimed at reducing exposure to COVID-19 implemented at Dillon Bass Lake.  Guest understands and agrees that adhering to all safety rules and practices is an express condition and requirement to Guest utilizing Dillon Bass Lake Property and participating in Activities at Dillon Bass Lake.

 

4.         Supervision of Minors.

 

Guest understands and acknowledges that minors are permitted to use the Property, but must be accompanied by an adult age 18 or older.

 

5.         Prohibited Activities.

 

            Guest understands and acknowledges that swimming and hunting are at all times prohibited at Dillon Bass Lake.  Guest agrees that he/she will neither swim nor hunt on Dillon Bass Lake grounds.  Guest further agrees that he/she will not engage in any other Activities prohibited at Dillon Bass Lake as outlined in the Bass Lake Campground Policies, Rules and Regulations.  

           

6.         Full Release and Waiver of Claims.

 

            In consideration of the opportunity to enter and stay at the Property and/or engage and/or participate in Activities on or about the Property of Dillon Bass Lake, the Guest, for himself/herself, heirs and assigns does hereby forever:

 

            a.         Release, acquit, discharge, waive, hold harmless Dillon Bass Lake from and covenant not to sue Dillon Bass Lake for any and all liabilities, claims, demands or causes of action whatsoever, including all costs, property damage, medical expenses and attorney fees associated therewith, that the Guest may have by reason of entering and staying at the Property and/or engaging in any Activities, including, but not limited to, any claims or losses arising by reason of Dillon Bass Lake’s passive or active negligence, or any hidden, latent, or obvious defects at or on the Property or in any equipment used whether or not supplied or inspected by Dillon Bass Lake, or any claims or losses arising by reason of Guest’s exposure to, contraction or spread of COVID-19.

 

            b.         Agree to indemnify, hold harmless and defend Dillon Bass Lake from any and all losses, liabilities, claims, damage, or costs, including attorney’s fees, that Dillon Bass Lake might incur as a result of the Guest engaging in Activities, whether caused by the negligence of Dillon Bass Lake or otherwise.

 

            c.         PROMISE NOT TO SUE DILLON BASS LAKE FOR ANY CAUSE OF ACTION WHATSOEVER, EVEN FOR CLAIMS ARISING FROM THE NEGLIGENCE OF DILLON BASS LAKE OR FROM HIDDEN, LATENT, OR OBVIOUS DEFECTS IN THE PROPERTY OR EQUIPMENT SUPPLIED OR APPROVED BY DILLON BASS LAKE, OR FROM GUEST’S EXPOSURE TO, CONTRACTION OR SPREAD OF COVID-19.

 

            d.         Acknowledge that this Agreement shall include ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER CAUSED BY THE NEGLIGENCE OF DILLON BASS LAKE, GUEST’S EXPOSURE TO, CONTRACTION OR SPREAD OF COVID-19, OR OTHERWISE, and any other damage or injuries, known or unknown, regardless of the severity of the injuries and damages, except that which is the result of gross negligence.

 

            e.         Acknowledge that this Agreement shall include ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER CAUSED BY THE NEGLIGENCE OF DILLON BASS LAKE OR OTHERWISE, related to or resulting from Guest’s use or storage of any recreational vehicles (“RVs”) on Dillon Bass Lake Property.

 

f.          Acknowledge that this Agreement shall include ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER CAUSED BY THE NEGLIGENCE OF DILLON BASS LAKE OR OTHERWISE, related to or resulting from Guest connecting an RV to Dillon Bass Lake infrastructure, including, but not limited to, electricity, water or sewage.

 

g.         Acknowledge that this Agreement shall include ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER CAUSED BY THE NEGLIGENCE OF DILLON BASS LAKE OR OTHERWISE, related to or resulting from the presence of Guest’s pet(s) on the Property, regardless of whether the pet is injured or inflicts injury on another person, pet or property.

 

7.         Definitions.

 

            a.         “Activities” shall mean entering and staying at the Property, and any recreational undertaking which may be performed inside or outside of any building or structure, including without limitation, any activities or endeavors related to parking an RV, hooking up an RV with water, electric and sewer service, utilizing any facilities at Dillon Bass Lake (including the bathhouse, recreational room, laundry), lodging, camping, hiking, cooking, fire lighting, canoeing, kayaking, boating, paddle boarding, fishing, golf carting, rancher operation, all-terrain vehicle operation, animal interaction (including wildlife and domestic animals), exploring, exercising (including the use of any exercise equipment), sports, lawn games, consumption or provision of alcohol, smoking, and any and all other recreational activities and equipment used in connection with these activities or in any way relating to the above activities and endeavors, nature, or the outdoors.

 

            b.         “Guest” shall mean both the undersigned and any minor child for whom the undersigned is parent or legal guardian, and their heirs, estate, assigns, personal representatives, guardians, and next of kin.  “Guest” shall also include any family members of the undersigned or other persons who are traveling, entering and staying at the Property with the undersigned and any visitors hosted by the Guest at the Property, and their heirs, estate, assigns, personal representatives, guardians, and next of kin.

 

            c.         “Property” shall mean any and all property, whether real or personal, belonging to or under the control of Dillon Bass Lake, or upon which the Activities occur, exist or take place, whether or not subject to the ownership or possession of Dillon Bass Lake.  Property specifically includes 1149 Bass Lake Place, Dillon, SC 29536 as well as the adjacent lake.

 

            d.         “Dillon Bass Lake” shall mean Dillon Bass Lake, LLC, its owners, directors, shareholders, officers, members, officials, lessors, employees, agents, managers, insurance carriers, invitees, attorneys, and guests, or any of them.

 

8.         Enforceable Agreement.

 

a.         The Guest acknowledges that this Agreement is intended to be as broad and as inclusive as permitted by the law of the State of South Carolina.

 

b.         The Court of Appeals of South Carolina in McCune v. Myrtle Beach Indoor Shooting Range, Inc. 364 S.C. 242, 612 S.E. 2d 462 (App. 2005) upheld the enforceability of a similar waiver and release agreement, which was sufficient to release the defendant from all liability.

 

            c.         It is explicitly intended by the Guest that this Agreement will be construed and enforced as a waiver of liability and release agreement.  The Guest has executed this Agreement with the explicit intent to be bound by its terms.

 

            d.         This Agreement shall remain in full force and effect during any period and periods of involvement by Guest in any Activities on the Property until it is explicitly revoked in writing and the delivery of such revocation to Dillon Bass Lake, LLC,  2200 Victory Parkway, #2307, Cincinnati, OH 45206.

 

e.         This Agreement shall survive during any periods of time that Guest does not participate in any Activities on the Property; and be enforceable at such times as Guest does participate in Activities on the Property.

 

            f.          If any portion of this Agreement is held invalid, it is agreed that the balance shall continue in full legal force and effect.

 

            g.         THE GUEST HAS READ THIS RELEASE OF ALL CLAIMS, WAIVER OF LIABILITY, ASSUMPTION OF ALL RISKS, AND HOLD HARMLESS AGREEMENT, FULLY UNDERSTANDING ITS TERMS, UNDERSTANDS THAT THE GUEST HAS GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGNS IT KNOWINGLY, FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. The Guest acknowledges that no oral representations, statements or inducements apart from the foregoing written Agreement have been made by or on behalf of Dillon Bass Lake.

 

            h.         This Agreement shall not be subject to any claim of mistake of fact, and this Agreement expresses a full and complete waiver of all liability claimed and disputed, and regardless of the type of injury or damage, or circumstances concerning any injury or damage, this Agreement is intended to forever bar any claim the Guest might have, and is intended to be final and complete.
