BAYOU BARATARIA RV PARK
RV SITE SERVICES AGREEMENT AND PARK RULES
For Short-Term (Nightly and Weekly) and Long-Term (Up to 30 Days) Guests

GENERAL: Bayou Barataria RV Park (BBRVP) management assumes no responsibility for accidents, injuries, or loss from any cause, including fire, theft, flood, wind, or acts of God. We maintain a no refund policy, subject to special circumstances at management’s discretion. BBRVP will not tolerate any onerous, noxious, or offensive activity that could interrupt or adversely affect the enjoyment of other guests. In the event of such activity, as determined by management, responsible parties will be required to leave immediately without a refund, in accordance with Louisiana law (La. R.S. 9:2798.1, limiting liability for recreational activities).
SHORT-TERM GUESTS (NIGHTLY AND WEEKLY STAYS)
RATES
- Rates for nightly and weekly stays are published on our website (Open Road Resorts).
- Nightly rates include electricity.
- Nightly and weekly rates require a one night deposit.

CANCELATION FEES
- We recognize that plans change, but there needs to be some limits to avoid depriving others from staying with us. For RV sites, we require a one-night deposit to secure your reservation. If you cancel prior to 15 full calendar days before your scheduled arrival, you will be refunded your deposit on your credit card, less a $30 cancellation fee per site. If you are within that 15-day time you will forfeit the entire deposit. Reservations made for 30 or more days require a 25% non-refundable deposit.
REGISTRATION
- All guests and visitors must register at the office with a valid driver’s license or alternative ID upon arrival, per Jefferson Parish regulations (JPCO Chapter 17.5).
INDEMNITY AND WAIVER OF LIABILITY
Customer shall indemnify and hold BBRVP, its officers, owners, employees, and agents harmless from any claims, demands, costs, or expenses, including reasonable attorney’s fees, arising from damages or injuries caused by fire, water, wind, civil strife, acts of God, or customer actions/inactions (or those of their employees, agents, or invitees). This applies regardless of negligence by BBRVP parties, consistent with Louisiana’s recreational use immunity statute (La. R.S. 9:2795).
THEFT OF SERVICE LAW
Under Louisiana Revised Statutes 14:67.16, any guest who leaves without paying for site services or refuses to pay when due is subject to criminal prosecution for theft of service. BBRVP requires full payment in advance and will prosecute violations.
LONG-TERM GUESTS (UP TO 30 DAYS)
RATES AND CHARGES
- BBRVP provides services to the assigned RV site and reserves the right to relocate the user to a substantially equivalent site with 24 hours’ notice.
- The agreement term begins on the Effective Date and continues for up to 30 days or until terminated in writing by either party.
- Monthly rent is due in advance on the first day of each month, without demand, payable to BBRVP at the address provided.
- Rates may increase with advance notice to the user.
- Monthly rates require a 25% deposit.
- If payment is not received by the 3rd day after the due date, a $30.00 late fee will be charged. Partial payments are not accepted.
- Monthly rates include electricity.
- Per Jefferson Parish regulations, short-term rentals (including RV park stays up to 30 days) must comply with JPCO Section 33-5.3.12.5(7) and Chapter 17.5, which may include registration and safety compliance.

CREDIT AND CRIMINAL BACKGROUND CHECK AUTHORIZATION
- Users authorize BBRVP to conduct criminal and credit background checks in connection with the use of BBRVP property. All information will remain confidential.
RULES AND REGULATIONS
- Users, guests, invitees, and occupants must comply with BBRVP’s written rules and regulations (below) and all applicable Louisiana state and Jefferson Parish laws, including JPCO Chapter 17.5 for short-term rentals.
TERMINATION BY BBRVP
- BBRVP may terminate this agreement without cause by providing a 3-day written notice to vacate.
- Immediate termination without notice is permitted for Acts of Default (see below).
- Upon peaceful surrender of the RV site, BBRVP will refund any unused, prepaid amounts.
EARLY TERMINATION BY USER
- Early termination by the user obligates payment of the outstanding amount for the agreed term (up to 30 days).
DEFAULT BY USER
The following constitute Acts of Default:
- Failure to pay RV site rates or other charges when due.
- Providing false information on any application.
- Violating this agreement or committing serious misconduct or criminal acts.
- Remaining on the property after termination notice or expiration of the agreement term.
CONDITION OF RV SITE
- By signing, the user acknowledges the RV site is in good condition and suitable for use.
- Upon termination, the site must be returned in similar condition. Failure to do so will incur reasonable restoration charges.
ASSIGNMENT
- Users may not assign or sublet the RV site.
ATTORNEY’S FEES
- BBRVP may recover reasonable costs and attorney’s fees in legal proceedings to collect unpaid rates or electrical charges.
NOTICES
- All notices, including those under Louisiana Revised Statutes 14:67.16, must be sent via certified mail to the addresses provided, effective upon mailing.
PETS
- Users are responsible for pet behavior, waste, and noise. Pets must be leashed at all times (except in designated off-leash areas), and users are liable for any damage or injury caused by their pets, per Jefferson Parish animal control ordinances (JPCO Chapter 7). Aggressive dog breeds are not allowed.
NO LIABILITY
- Users indemnify and hold BBRVP, its officers, owners, employees, and agents harmless from all claims or liability arising from use of the RV site or property, regardless of cause or negligence, per La. R.S. 9:2795.
THEFT OF SERVICE AND CRIMINAL TRESPASS
- Theft of Service (La. R.S. 14:67.16): Guests who fail to pay for services after receiving notice are subject to criminal prosecution. Intent to avoid payment is presumed if the guest leaves without paying or refuses to pay when due.
- Criminal Trespass (La. R.S. 14:63): Guests who remain on the property after receiving notice to depart are subject to prosecution. BBRVP will enforce these laws.
PARK RULES (APPLY TO SHORT-TERM AND LONG-TERM GUESTS)
- Payment: Full payment is required at start of reservation. Monthly rates are due on the first of the month, prorated for the first month based on reservation date. No proration for early move-out. Late payments after the 3rd incur a $30 late fee. No partial payments or refunds.
- Occupancy: Maximum of three adults per RV but two adults are included in the base rate. Anything above two adults is an extra $50/stay. This is a family park, not a work camp.
- Speed Limit: Park speed limit is 5 mph. Watch for children and pedestrians.
- Quiet Hours: 10 PM to 7 AM. Be considerate of neighbors.
- Site Condition: Keep the RV site clean and unchanged without prior written management approval. No additions (e.g., steps, ramps, skirting, porches) are allowed without consent. Return the site in good condition upon departure.
- Fires and Fireworks: Wood-burning campfires and fireworks are prohibited, per Jefferson Parish fire codes (JPCO Chapter 12). Propane fire pits are permitted.
- Trash: Use designated receptacles at the front or middle of the park. Break down cardboard boxes. No furniture or bulky items in receptacles.
- Personal Items: No external appliances or indoor furniture outside.
- Vehicles and Storage: No trailers, boats, or off-road vehicles on the site. No inoperable or unregistered vehicles or vehicle repairs in the park.
- Structures: No decks, skirting, or structures without management approval and an additional deposit.
- Conduct: Violence, threats, or display/discharge of weapons is prohibited and will result in immediate eviction. Law enforcement involvement will lead to eviction.
- Drugs: Possession, sale, or manufacture of illegal drugs or paraphernalia is prohibited. The park is subject to random drug dog checks.
- Pets: Maximum of 2 dogs per site. Pets must be leashed (except in designated off-leash areas), and owners must clean up waste. Unattended barking or unleashed pets may result in eviction. Aggressive dog breeds are not allowed.
- Sewer: Sewer hoses must be elevated, secured, and use a “donut” or “L” connector, per Jefferson Parish sanitation requirements (JPCO Chapter 23).
- Parking: No parking in vacant sites. Each site allows two vehicles (including motorcycles/golf carts). Additional guest parking is available near the office.
- Facilities: Keep restroom/shower and laundry facilities clean and report issues immediately.
- Mail: The BBRVP address may not be used for personal or business mail. Packages may be received from delivery services.
- Subletting: No assignment or subletting of RV sites. This is a service agreement, not a landlord-tenant agreement, per Louisiana law.
- RV Condition: RVs must be less than 10 years old or approved by management. No FEMA units allowed.
- Compliance: Failure to comply with these rules or management requests will result in immediate eviction without refund, per La. R.S. 14:63.
- Jefferson Parish Regulations: All guests must comply with JPCO Chapter 17.5 for short-term rentals, including registration and safety standards.
- Louisiana Camping Regulations: Guests camping for 15 consecutive days must vacate for 7 days before resuming, per Louisiana State Parks policy.
