CAMPGROUND RULES   

Relax and enjoy yourself!!!!

MEMBERS

1.     Only one family and one camping unit per site. Tents by approval 1 night only.

2.     All RV’s must be approved by management. RV must be maintained and fully functional. No dry camping permitted.

3.     RVs may not be used by anyone except the member.

4.     Your lot remains the property of Berkshire Campground. Your membership is non-transferable and ends at the time of the removal of your RV. There is no refund on any membership fees if you leave early.

5.     You must schedule a time for camper to be removed from lot. All items must be removed from lot prior to exiting including but not limited to decks, sheds and wood.  If any items are left on the lot, you will be charged $500.00 fee for cleaning and removal of items.

6.     Changing Sites- If you choose to change sites; the fee to move your RV will be $500.00 and your lot fees will be adjusted to the current rates. Please be sure to schedule your move with the campground office. RV’s will be moved Monday through Thursday.

7.     No more than 8 people permitted on your lot at a time.

8.     No residential address-campground lot address is not considered a permanent or residential address.

 

QUIET HOURS

1.     QUIET HOURS are observed from 11:00 PM until 8:00 AM. Please respect your neighbors.

CHILDREN

1.     Children under the age of 18 may not camp in the RV by themselves. Curfew for children is 10:00 PM. They must be back on their lot by that time. Parents are responsible for their children and any damages they may cause.

POOL

1.     Swim in the pool at your own risk. Campers acknowledge that the campground does not maintain a lifeguard on duty. Camper assumes full responsibility for their safety while using the pool and any other park equipment. All children age 12 or younger must be accompanied by a responsible adult over the age of 18 at all times. This includes, but is not limited to, restrooms, showers, the pool, and the lake.

SAFETY

1.     The speed limit is 5 MPH and will be enforced.

2.     Call before you dig for any reason.

3.     ATV’s, minibikes, scooters, guns, bb guns, fireworks, or bows and arrows are not permitted on the campground premises at any time.

MOTORCYCLES

1.     Motorcycles, including 3 wheelers, are not permitted beyond the gate to the seasonal/monthly area. A permitted parking area is located next to the shelter house.

GOLF CARTS

1.     Golf carts must be approved by management and may only be driven by members over the age of 16.  Must have a valid driver license and insurance. Visitors are not permitted to drive golf carts. Golf carts must be driven on roads and golf carts paths only. Please do not drive on the grass. All golf carts must be on your lot by 12:00 AM. Lot numbers must be affixed to golf carts. Passengers are limited to number of seats available on golf carts. Overloading of golf carts is not permitted. Consumption of alcohol while driving a golf cart is not permitted. No two stroke engine golf carts.

VEHICLES

1.     Each lot is permitted 2 vehicles for parking. The 2 vehicles must park on the assigned lot. Parking on a different lot is not permitted. Each vehicle must have a sticker. All vehicles must be operable and licensed.

2.     Storage of utility trailers, extra vehicles, boats, etc. on sites are not permitted. There is a storage area available for $60.00 per month.

3.     Visitor vehicles are not permitted past designated area.

MAIL

1.     USPS mail will not be delivered or accepted at the address. This address in not a residential address. Please rent a P.O. Box in Sunbury or Galena.

LAKE

1.     The lake is for fishing only. No swimming or boating. Please be sure to clean your area before leaving the lake. The lake is a catch and release only.

PETS

1.     Pets are permitted; however, pets must be always on a leash and under control of owner. Shots must be current. Dogs are not permitted to be chained outside or left unattended. Kennels and fences are not permitted. Please maintain barking dogs. Cats must be kept inside the RV. Please do not leave your pet in your RV unattended for extended periods of time. Please clean up after your pet. Pets are not permitted inside pool fence area. Limit 2 pets per site, no additional pets without prior approval.

SHEDS AND DECKS

1.     You are permitted to have one 8’ x 10’ x 8’ plastic or vinyl manufactured shed per site. The shed must be five feet away from any other camper. Decks and or patios are permitted, however management approval must be obtained prior to installation. Upon departing the campground sheds and decks must be removed and taken with you.

2.     Permanent structures are not permitted, including fences.

TREES

1.     Cutting trees, dead or alive, is not permitted. Tree wraps must be approved by management prior to installation. Nails, screws, or any attachments of any means to trees are not permitted.

ALCOHOL

1.     Public consumption of alcoholic beverages, drunkenness, or rowdiness will not be tolerated. You may drink alcohol on campsite only.

2.     No driving of golf carts with alcohol.

LITTERING

1.     Littering, including cigarettes butts on park grounds is prohibited.

2.     Dumpsters are for garbage only – NO dumping permitted in dumpsters.

3.     There will be a $250.00 fine for anything disposed of in dumpster except garbage.

LOT MAINTENANCE

1.    Campers are responsible for keeping their site and all personal property maintained in compliance with the board of health, all local ordinance & regulations as well as park standards, neat and safe conditions always. This includes regular lawn mowing and policing of the site. If you are unable to maintain your lot our crew will maintain it for you and you will be billed accordingly.

2.    Outside refrigerators, washers, and dryers, and outside clotheslines are not permitted.  

VISITORS

1.    Visitor’s fees: One day passes are $10.00, overnight pass is $20.00, also available are (5) day passes $40.00, and seasonal passes $100.00 per person for anyone over the age of 5.

2.    You are responsible for your guest and their actions.

3.    Visitors must be accompanied by a campground member.

4.    Campers will need to pre-register their guest at the store.

5.    Campers will need to prepay for guest $10.00 a day per guest and $20.00 per over night guest over the age of 5 at the store.

6.    Campers will be required to meet their guest at the entrance of the campgrounds.

7.    Guest will not be allowed in the campground without the registration camper being here.

8.    Guest will park their cars at the Party House. Guest are not allowed to take cars back thru the campground, not even to drop off or pickup any people or supplies.

NOTICES

1.    Berkshire Lake Campground regrets it cannot be held liable for the loss or damage to any personal property, including but not limited to RV, vehicle, ect. by interruption of electrical service, by theft or otherwise, by trees, bushes or other growing vegetation, or any wildlife within the campground.

2.    Management has the right to remove any belongings from the property including but not limited to RV’s, car trailers and personal items.

3.    Soliciting, political signs, offensive signs, For Sale signs or selling any items including RVs not permitted.

4.    Flagrant disregard of campground rules shall be reason for immediate termination of membership without refund.

5.    Management reserves the right to change or alter the rules at any time.

Berkshire Lake Campground reserves the right to refuse service to any person(s) at any time for any reason deemed necessary by the management.

CAMPER ACKNOWLEDGMENT OF CAMPGROUND’S RIGHTS TO REMOVE CAMPER

          

           I understand and acknowledge by signing the Campground Use Agreement and the Campground Rules, that Berkshire Lake Campground is not a Residential Premises under Ohio Revised Code Section 5321.01. I understand and further acknowledge the Berkshire Lake Campground can rightfully require that I vacate the campgrounds immediately, at any time, for any reason including but not limited to:

1.    Non-payment of camping.

2.    Violation of campground rules.

3.    For any other reason deemed necessary by Campground Management.

         The undersigned further understates and acknowledges that the camper is not a tenant under the Ohio Revised Code. The undersign further understands and acknowledges that Berkshire Lake Campground is not a landlord and therefore is not subject to the Landlord Tenant Act respect to evictions under the Landlord Tenant Act.

         The undersigned further understands and acknowledges that should Campground Management require that camper vacate the campgrounds for any of the reasons above, failure to adhere to the Campground Use Agreement and /or the Campground Rules, that camper will forfeit any and all fees they had paid up until the date they were required to vacate the campgrounds. Those fees will be non-refundable and will be retained by the Campground.

LICENSE AGREEMENT/WAIVER OF LIABILITY

 

Camper agrees that by entering the property, they assume the role of a licensee. Camper has no rights, and is owed no duties, over and above the duties, rights and obligations bestowed upon a license, under Ohio law.

Campground/Owner/Operator maintains the right to terminate the license at any time and for any reason.  Whether short term or long term, camper knowingly and voluntarily assumes the risk of all loss associated with or directly related to Acts of Nature or Acts of God. Acts of Nature and/or Acts of God are specifically defined to include, but not be limited to, the following: damage caused by wind, storm, hail; damage caused by lighting; damage or injury caused by animals or animal bites, bugs or insects, including termites; damage caused by fallen or falling trees or limbs. Camper agrees to hold Campground/Owner/Operator harmless from any and all such loss or injury. Campers, as a result thereof, are encouraged to maintain their own property and casualty insurance coverage in sufficient limits to cover any property on the premises, owner by Camper, pursuant to this license.

Camper understands that Campground/Owner/Operator assumes no liability or risk for any of the losses, injuries, damages, or claims more specifically described herein.
