Dear Guests,
Please follow these rules so that everyone will enjoy their time at Beyond Hope Resort!

-Check in is at 12pm. Check out is 11 AM. Early check in is not permitted. We will not ask a guest to leave so that you can check in early. You have been assigned a specific site, if you wish to move please check with the office. Due to reservations, moving may not be possible. Please inquire before moving sites. No check-ins after 10pm.

-Quiet hours are from 11:00pm until 8:00am. Please be considerate of your neighbors and remember that sound carries.

-You are welcome to have 2 vehicles in your site (for example, your motor home and a tow vehicle). All other vehicles and trailers should be parked in the appropriate parking lot. Please do not park your vehicle, trailer, or boat in an adjacent site. Use of more than one site will result in additional charges. Boats and other watercraft may not be parked in RV or Tent sites.

-ATV’s, Dirt Bikes, Motorcycles, and Golf Carts are welcome onsite but must stay on designated roads. They may ONLY be used to get to and from your site. Please do not make laps around the park. Children are prohibited from operating OHV’s with out adult supervision.

-BHR does not offer sewer hook ups. There is a dump station on site for use with a $30 fee.

-For the comfort of all our guests, restrooms are open 24/7 with exception of temporary closing for cleanings through out the day. You will receive the door code upon check in. We ask for your help in keeping the restrooms clean, please. Guest under the age of 18 need adult supervision in the bathrooms and showers.

-The laundry room is open 24/7. Change is available in the office. Please do not leave your laundry unattended. Please do not move other guests belongings. We are not responsible for accidents or theft.

-Pets are welcome at the resort. Do not leave your pet unattended. Excessive barking is not tolerated and disturbs your neighbors. Please note that excessive barking may result in you being asked to leave without refund. Pets must be on a leash and you are required to pick up after them. Pick up and disposal bags are available through out the resort.

-Children are a joy, although they must be supervised. Remember that parents or guardians are responsible for their children. Riding bicycles without a parent and with in our event site is prohibited. Please take extra caution near the resort entrance for the safety of your children and our incoming RV guests.

-You must be 21 to consume alcohol at BHR. Anyone under 21 who is drinking alcohol will be subject to leave the park and may not be allowed to return.

-Docks are for the use of boat owners only. Do not swim in the marina, dive off the docks or allow children to play in this area. Please do not fish near watercraft. If you plan to fish during your stay with us please follow our posted rules. Everyone should take special care near the water.

-WiFi is available for purchase. Please see the attached directions on how to connect.

-Outdoor carpets will damage the lawns. Please help us keep the park green by refraining from using carpets or large mats. Door mats are welcome.

-Fires are permitted in designated areas only. There is a fire pit on the beach for the use of all park guests. Fires are allowed in the beach fire pit until 11pm with adult supervision. Please do not leave the fire unattended. Small portable fire pits and charcoal BBQ’s are allowed at each site only if there are no fire restrictions in place. Please dispose of ashes in designated can near trash recepticols.

-Fireworks and firearms are strictly prohibited in our park. The prohibiting of fireworks includes sparklers, smoke bombs, aerials, and firecrackers. The prohibiting of firearms includes all guns including air soa, BB, and pellet guns. If these items are seen outside of your RV, you will be asked to leave immediately without a refund.

-Garbage cans, for your household trash, are located near the restrooms. Dumpsters are located in the parking lot near the entrance to the resort.

-Beyond Hope Resort is located on a game preserve. Wildlife abounds in our campground and through out the peninsula. Please don’t feed “Junk Food” to the wildlife.

 

POLICIES, DISCLAIMERS, GENERAL RELEASE, LIABILITY WAIVER, AND PUBLICITY RELEASE

I agree that the use of the Beyond Hope Resort by myself and any minor/children identified (the “Minor/Children”) shall be subject to the terms and conditions set forth in this General Release and Liability Waiver.

BEYOND HOPE RESORT. The term “Beyond Hope Resort” means Beyond Hope II, LLC, a Wyoming limited liability company, registered and authorized to transact business in the state of Idaho.

THE RESORT. The term “The Resort” means the Beyond Hope Resort and all buildings, facilities, fields, grounds, or other lands owned, leased, or used by Beyond Hope Resort.

CANCELLATION FEE: Cancellations and changes to reservations must be made at least 14 days prior to the scheduled arrival date (“Cancellation Period”). If I choose to cancel or change the reservations within the Cancellation Period, then a full refund will be issued less one night of stay. If I choose to cancel my reservation after the Cancellation Period (within 14 days of the arrival date), I authorize Beyond Hope Resort to charge my credit-card with a Cancellation Fee of one hundred-percent (100%) of my total rental fee. There will be no refunds for early departure.   

ACTIVITIES. The term “Activities” means any activity arising from or related to the use of The Resort, including, but not limited to, the following:

• Recreational Activities – Activity involving any agricultural, sporting, or other recreational endeavor such as camping, RV-ing, swimming, diving, fishing, canoeing, kayaking, boating, paddle boating, snowshoeing, cross country skiing, snowmobiling, sledding, tubing, ice skating, running, hiking, cycling, operating/riding any motorized/mechanized vehicle, exploring, sightseeing, picnicking, kite flying, bird watching, exercise, building campfires, and other physical activities.

RISKS OF ACTIVITIES AND USE OF THE RESORT. I understand and acknowledge, on behalf of myself and the Minor/Children, that: The Resort is a functioning resort in the mountains that is subject to risks arising from the rustic-nature of development in a natural environment subject to inconsistent physical conditions resulting from snow, ice, mud, rain and uneven terrain; participation in the Activities and use of The Resort involve encountering, interacting with, and being in close proximity with other individuals, including, but not limited to other guests and representatives of Beyond Hope Resort; participation in the Activities and use of The Resort involve the risk of personal injury, illness, disease, mental incapacity, disability, dismemberment, and death, as well as the risk of property damage and economic loss (collectively, the “Risks”); the Risks may result from: the inherent nature of the Activity; the actions, negligence, or failure to act of myself and others, including Beyond Hope Resort and other individuals participating in Activities; the condition of The Resort, natural hazards and weather conditions; the presence of animals, including wildlife; the presence of firearms, including firearms owned by parties other than myself; the operation, condition, maintenance, or failure of equipment, or other property used in connection with any Activity; exposure to viruses, contagions, infectious diseases, contagious diseases, or other diseases, including, specifically, novel coronaviruses such as COVID-19; and there may be other risks that are not known to myself or Beyond Hope Resort, and may not be foreseen or reasonably foreseeable at this time or the time of the Activities. 

ASSUMPTION OF THE RISKS.  As a material inducement for Beyond Hope Resort to allow use of The Resort and participation in the Activities, I hereby agree to assume all of the Risks on behalf of myself and the Minor/Children and further agree to accept personal responsibility for any personal injury, illness, disability, dismemberment, death, property damage, economic loss, or any other loss or harm that myself or the Minor/Children may suffer arising out of or in connection with participation in the Activities and/or use of The Resort. I hereby further understand on behalf of myself and the Minor/Children that Beyond Hope Resort does not provide lifeguard services for any of the Activities involving water.

ALCOHOL AND ILLEGAL SUBSTANCES.  I acknowledge and agree, on behalf of myself and the Minor/Children, to abide by the minimum drinking age of 21 years of age and not to use any illegal substance at The Resort. I understand the importance of responsible drinking and accept any and all responsibility on behalf of myself and the Minor/Children for risks and/or dangers related in any way to consumption of alcoholic beverages or drugs, legal or illegal, of any kind at The Resort.    

WAIVER AND RELEASE:  As a material inducement for Beyond Hope Resort to allow use of the Resort and/or participation in the Activities, on behalf of myself and the Minor/Children, and on behalf of our heirs, executors, insurers, administrators and next of kin, I hereby waive, release, covenant not to sue and forever discharge Beyond Hope Resort from any and all liabilities, claims, actions, damages, costs, or expenses of any nature, including those not otherwise limited by Idaho law, arising out of or in any way connected with the Risks, participation in the Activities and/or use of The Resort (collectively, the “Claims”).  I further agree that the released Claims include any subrogation or other claims asserted by any insurers of myself and the Minor Children.   

INDEMNITY: As a material inducement for Beyond Hope Resort to allow use of The Resort and participation in the Activities.  I agree to indemnify, defend, and hold harmless Beyond Hope Resort and any of its representatives from any Claims arising out of or in any way connected with the Risks, participation in the Activities and/or use of The Resort that may be asserted by the Minor/Children, any other person under my control or supervision and/or any of my guests or invitees. I agree to indemnify, defend and hold harmless Beyond Hope Resort and any of its representatives from all claims, disputes, litigation, judgments, costs and attorney fees resulting from loss, damage or injury to myself, the Minor/Children, my guests or licensees or their personal property.

GRANT OF PUBLICITY RIGHTS: I hereby grant to Beyond Hope Resort and persons acting for or through them, the right to use, reproduce, assign, and/or distribute images, photographs and video/sound recordings of myself and the Minor Children for such uses desired by Beyond Hope Resort, without need for approval, compensation or limitation.

GOVERNING LAW: Any legal disputes or actions arising out of or related to this General Release and Liability Waiver shall be commenced exclusively in a court of competent jurisdiction located in the State of Idaho and shall be governed by the laws of the State of Idaho.  If any provision of this document is ruled to be invalid or illegal, such ruling shall have no effect upon the remaining provisions which shall be considered legally binding and given full effect.  I specifically waive the right to a trial by jury on behalf of myself and the Minor/Children.  

BY CHECKING THE AGREEMENT BOX, I AGREE I HAVE READ AND UNDERSTAND THIS AGREEMENT ON BEHALF OF MYSELF AS PARTICIPANT AND/OR AS THE PARENT OR GUARDIAN OF THE MINOR/CHILDREN.
