Big Water Marina & Campground
Terms: In this Site Rental Agreement (hereinafter “Agreement”), “Camper” shall mean the person(s) whose name(s) and address(es) are shown as such above. “Camper” shall indicate the singular and the plural. “RV” shall indicate the Recreational Camping Vehicle or Trailer identified above or any substitute vehicle or trailer agreed upon by the parties in writing. Camper warrants that they are either the Camper of the RV or that they are duly authorized by the Camper of the RV to enter into this Site Rental Agreement as agent for the Camper and to bind themselves, the Camper, and the RV to the terms and conditions stated herein. “Campground” shall mean Big Water Marina & Campground, located 320 Big Water Marina, Starr, SC 29684.
Site Assignment: Camper shall have the sole and exclusive right to use the Site assigned to Camper by Campground, provided Camper is not in default under any provision of this Agreement. The Site shall be used solely for the purpose of storing the RV (one vehicle) within the Site. Camper acknowledges that no business of any kind may be conducted from the Site. Camper acknowledges that the Site may not be sublet nor may this Agreement or any rights hereunder be assigned by Camper without the prior consent of Campground. Campground may move the RV to any other Site in the Campground if it is deemed necessary by Campground at its sole discretion and at any time. Prior to moving the RV, Campground will make a reasonable attempt to contact the Camper. Camper agrees that they will promptly comply with any request made by Campground that Camper remove the RV and all personal property from the assigned Site. In the event it is necessary for Campground to remove the RV and/or Camper’s property from the Site, Camper agrees to pay all charges for moving, towing, and storage, as invoiced by Campground.
Compliance: Check-in time is 1:00 PM. Check-out time is 11:00 AM. Camper agrees to use and occupy the Site strictly in accordance with the terms and conditions of this Agreement and the Campground Rules, which may be published or modified by Campground at any time, and at the sole discretion of Campground. Camper acknowledges that they have received and reviewed a copy of the Campground Rules in effect at the time of signing this Agreement. The Campground Rules in effect at any given time shall include, but are not limited to, the following requirements: (a) Camper shall not leave any portable electrical appliances operating unattended aboard the RV, especially space heaters, drop lights, heating strips, and the like; and (b) Camper accepts primary responsibility to ensure that their guests and invitees are familiar with the Campground Rules and shall ensure that Camper’s guests always adhere to the Rules; In the event that it is determined by Campground that the RV or the conduct of Camper or any guest is not in compliance with the Campground Rules or the terms of this Agreement, Campground may terminate this Agreement for cause.
Duties of Campers/Condition of Vehicle: The Campground Manager shall have the authority to set standards of appearance and serviceability for RVs stored within the Campground, as well as the Site. Camper agrees to maintain his RV and Site in accordance with such standards and the Campground shall, at the sole discretion of the Campground Manager, have the right to expel any RV from the Campground which does not meet standards of appearance, maintenance, or safety. Camper agrees that the RV shall be properly registered and show all required markings/decals/license plates and Camper agrees to promptly provide Campground with a copy of the RV’s registration, title, and documentation upon request by Campground. Camper agrees that it is Camper’s sole duty to keep the RV properly secured at all times; to keep the RV roadworthy; to keep the RV in good operating condition and repair; to keep the RV neat, clean, and free of rust, mildew, peeling paint, rot, blistering, and flaking; and to keep the RV with a neat and aesthetically pleasing appearance. Camper’s compliance with the standards referred to in this paragraph shall be determined at the sole discretion of Campground. In the event it is determined by Campground that Camper or RV is not in compliance with the requirements of this paragraph, Campground may terminate this Agreement for cause.
Common Areas: Provided Camper complies with their duties and obligations hereunder, Campground hereby grants Camper a non-exclusive license to use of the grounds, walkways, paths, parking areas, picnic areas, restrooms, lounge facilities, and other common areas within the Campground which are designated for general use by Camper and Camper’s guests, subject to the Campground Rules and requirements set forth in this Agreement. Camper agrees that neither they nor their guests or invitees will place or leave any objects upon the Site, grounds, or other common areas of the Campground without the express permission of the Campground Manager. Only equipment and decor approved by Campground may be placed on the sites or grounds. Campers may not install anything on/in the sites or make any alterations to the grounds or any other common area of the Campground.
Vacancy: Whenever Camper expects their assigned Site to be vacant for more than 48 hours, Camper shall notify the Campground Manager Campground shall have the right to rent or use the Site for its own purposes at any time it is not occupied by Camper’s RV.
Termination Without Cause: Campground may elect, at its sole option, to terminate this Agreement at any time. In such event, once Camper has removed the RV from the Site, Campground shall refund to Camper the pro-rated charges from the date of termination to the end of the current term of this Agreement (after deducting any amounts due by Camper to Campground). In the event Camper does not remove the RV from the Site within 24 hours after Campground communicates the notice, Campground may remove, tow, haul, and store the RV at Camper’s expense and sole risk of loss/damage, and at Campground’s then effective daily transient rate.
Termination For Cause: Campground may at its sole discretion, terminate this Agreement for cause, and without any refund to Camper, in the event that Camper fails to pay any of the rental or other fees due under this Agreement when due; in the event Camper breaches any of the terms and conditions of this Agreement; in the event Camper or Camper’s guests, invitees, or contractors fail in the sole judgment of the Campground, to abide by the Campground Rules or the terms of this Agreement; or should Camper behave in a manner which, in the sole judgment of Campground, is disorderly, might injure or endanger other persons, damage property, or harm the reputation of Campground. In the event Campground exercises its right to terminate this Agreement for cause, notice will be given in person and via email. In the event the defaults are not corrected within said time, in the sole judgment of Campground, this Agreement may be terminated.
Duties Upon End of Term: At the end of the term of this Agreement or upon the termination of this Agreement for cause, Campers agree (1) to return the Site to Campground in its original condition, clean and free of debris; (2) to immediately pay all amounts due to Campground; and (3) to immediately remove the RV and all of Campers’ personal property from the Campground. Until the RV is removed from the Campground, Campers agree to pay Campground Site rental at the daily transient rate then in effect at the Campground. In the event Campers shall fail to remove the RV from the Campground within three (3) days of the end of the term or of the termination for cause becoming effective, Campers authorize Campground to board the RV and take possession of any of Campers’ other property in or about the Campground, and to remove such RV or other property at the expense of Campers. Campground may remove the RV or other property and relocate to any other storage facility selected by Campground. Campers agree to pay all costs and expenses of such removal and continued storage and to reimburse Campground for all such costs and expenses advanced. Campers further assume all risks of loss or damage to the RV and its contents incurred in connection with such removal and/or storage, and hereby release and agree to hold Campground, its agents, employees, officers, directors, and representatives harmless from any liabilities, costs, and expenses incurred in connection therewith, regardless of the nature of the damages, and arising from any cause whatsoever, including but not limited to the negligence (but not gross negligence or willful misconduct) of Campground, its agents, employees, officers, directors, and representatives. In the event this Agreement is terminated for cause, as set forth above, Campers shall continue to be liable to Campground for all sums remaining payable for the term of this Agreement; and any sums prepaid by Campers to Campground shall be forfeited by Campers and be deemed the sole property of Campground.
Limitation of Liability: By entering into this Agreement, Camper acknowledges that he or she is aware of the various types of risks involved in keeping an RV at a Camper accepts the Site, docks, piers, their appurtenances, and all common areas “as is” and agrees they are in satisfactory condition, safe and suitable for use by Camper and Camper’s guests/invitees. Camper agrees that use of the Site, Campground grounds/facilities, parking, and other common by Camper, Camper’s guests, and invitees shall be at their own risk of property loss/damage and/or personal injury/death, arising from any cause whatsoever. Camper further agrees that neither Campground, Big Water Marina, LLC, nor any of its agents, employees, officers, directors, or other representatives shall be liable for any loss, damage, or injury to the person or property of Camper or of Camper’s guests, invitees or servants, including any loss or damage to Camper’s RV, motor vehicle(s), or their contents or equipment, regardless of whether such loss, damage, personal injury or death be occasioned by fire, storm, theft, vandalism, collision, ice, sinking, an act of God, or any other cause or condition, including, but not limited to the negligence (but not gross negligence or willful misconduct) of Campground, Big Water Marina, LLC its agents, employees, officers, directors, or representatives, and including, but not limited to, any negligence of Campground or Big Water Marina, LLC in connection with providing voluntary first aid or assistance meant to save lives, treat or avoid injury; dockhand assistance, or mechanical repair. Camper further agrees to indemnify and hold harmless Campground, Big Water Marina, LLC its agents, employees, officers, directors, and representatives from and against any claim, action, fine, damages, attorneys fees, and costs (whether a suit is filed or not) arising from the use of the Site, the Campground grounds/facilities, the parking area, and any other common area at the Campground by Camper, Camper’s guests or invitees, arising from any cause whatsoever, including, but not limited to, the negligence (but not gross negligence or willful misconduct) of Campground, Big Water Marina, LLC its agents, employees, officers, directors, and representatives. The foregoing notwithstanding, Camper agrees that any judgment entered in favor of Camper against Campground or Big Water Marina, LLC shall be liquidated to the total amount of Rent received by Campground or Big Water Marina, LLC from Camper in the applicable year during which the subject claim arose. Camper agrees that any claims for losses, damages, or personal injuries/death arising out of Camper’s use of the Site, Campground grounds/facilities, parking area, other common areas or other services provided hereunder must be submitted to Campground and Big Water Marina, LLC in writing within sixty (60) days of the time the Camper knew or should have known of such claims, or such claims shall be forever barred against Campground, its agents, employees, officers, directors, and representatives. All lawsuits or legal actions against Campground, Big Water Marina, LLC its agents, employees, officers, directors, and representatives must be filed within one (1) year of the occurrence that gives rise to such lawsuit or legal action or be forever barred. Camper agrees that in the event Campground & Big Water Marina, LLC conveys its interest in the Site or assigns its interest in this Agreement, then Campground, Big Water Marina, LLC its agents, employees, officers, directors, and representatives shall be released from all liability or obligations which thereafter arises under this Agreement or activities related to the Campground and Camper shall look only to the transferee of the Site, or assignee of this Agreement for restitution or damages.
No Bailment: Campers acknowledge that the Sites, grounds, parking lots, and facilities of the Campground are not completely secure and that the RV and Campers motor vehicle(s) will not be under the exclusive control of the Campground at any time. Access to RVs and grounds in the Campground is unrestricted from the water, there are no controlled access gates. Campers acknowledge that Campground is not an insurer of the safety, security, or condition of the RV, the Campers’ vehicle(s), or their contents. Campers agree that Campground is not a bailee or warehousemen with respect to the RV, the Campers’ vehicle(s), or their contents.
Collection: In the event it becomes necessary for Campground to file suit or assign unpaid invoice(s) to an attorney, individual or firm for collection, Camper agrees to pay a reasonable attorneys’ fee or collection fee which is agreed to amount to one third (1/3) of the total outstanding balance due at the time said collection action takes place (but not less than $300.00), plus all applicable court costs and expenses of such collection efforts. Campground shall have a lien pursuant to all applicable state and federal laws.
Emergency: Camper acknowledges that Campground has no duty or obligation to prevent damage to the RV or to prevent the RV from damaging the environment or the property of others. Camper agrees that Campground may enter and operate the RV if, at any time, in the sole judgment of Campground, this becomes necessary to protect persons, the environment, or property. Campground may disconnect electrical power to the RV and/or disconnect and remove any electrical apparatus associated with the RV that Campground considers in its sole judgment to be unsafe, unlawful, or a nuisance. Nothing contained herein shall impose any duty upon Campground to inspect the RV or its equipment, to ensure the RV’s safety, or to determine if it is a danger to itself, the environment, or to the persons and property of others. Ordinarily, Campground will first attempt to notify Camper should it observe adverse conditions that do not place the RV, the environment, or other property in imminent peril. However, if the RV should appear in imminent danger of damage from high winds, tides, floods, snow, ice, or tornado or if in the sole judgment of Campground the RV constitutes an imminent danger to itself, the environment, or other vehicles/property, Campground in its sole discretion, may take action itself or by hiring others, to move the vehicle, tow it and store it elsewhere, or take such other action as Campground may deem appropriate, without prior notification or further authorization from Camper. Under such circumstances, neither Campground, nor its agents, employees, officers, directors, or representatives shall be responsible for any costs, losses, or damages to the RV or to other property of Camper as the result of taking such measures. Camper agrees to pay immediately all reasonable charges billed by Campground or billed to Camper by others retained by Campground in connection with the same, including, but not limited to Camper’s proportionate share of expenses incurred by Campground or its contractors for the common protection of RVs and property in the Campground.
Headings, Severability, Gender, Time Entire Agreement: The paragraph headings are for reference only and are not a part of this Agreement. Campground agrees that the waiver of any term or condition of this Agreement by Campground shall not be continuing. In the event that one or more terms of this Agreement are determined to be unenforceable, such determination shall not affect the enforceability of the remainder of this Agreement, which shall continue in full force and effect. This is the sole Agreement between the parties with respect to the subject matter hereof, and all prior agreements, written and oral, are merged herein. No modification hereof shall be binding unless in writing and signed by both parties. The parties to this Agreement mutually agree that it shall be binding upon them, and their respective heirs, personal representatives, successors, and assigns. Camper agrees that the waiver of any term or condition of this Agreement by Campground shall not constitute a waiver of any other term or condition of this Agreement and shall not be continuing. Rights and remedies afforded to Campground under this Agreement are not exclusive but are in addition to all other rights and remedies available to Campground at law, in equity, or in admiralty. If Camper is a corporation, partnership, trust, society, or legal entity, the person executing this Agreement on behalf of Camper warrants that he/she is authorized to enter into this Agreement and to bind Camper. Except as otherwise expressly provided in this Agreement, time is of the essence.
Choice of Law/Venue: This Agreement is deemed to have been made and entered into in the State of South Carolina and shall be governed and interpreted by the laws of the State of South Carolina. Any legal action brought to enforce this Agreement must be filed in the appropriate South Carolina state court located in the County where the Campground is located, or in the United States District Court for the District of South Carolina except that an in proceeding against the RV may be brought in the U.S. District Court for the district where the RV may be found. Camper and Campground agree to submit to the personal jurisdiction and venue of said courts.
Site Size: No part or attachment may be protruding past the end of the outermost piling of the Site or over the main dock. If Camper’s RV is found to be longer than the assigned Site, Campground reserves the right to require that the RV be relocated to a larger Site at the increased rate for the term of this agreement or charge for the overhang in the existing site.
Utilities: From time to time the Campground may experience outages of its amenities that are out of Campground control. This may include but is not limited to utilities, electricity, fresh water, cable tv, and Wi-Fi. Outages, regardless of duration do not entitle the Camper to a refund.
Additional Terms for rental units
I understand and agree as follows:
RV Campground:
Parking
- There are two (2) vehicles permitted for each campsite – including your RV. The speed limit in the campground is 5mph. Parking in vacant sites is prohibited. Guests must park in the general parking area.
- All vehicles, trailers, golf carts, and other items must be contained within the bounds of your site. If you have questions about the site boundaries, please ask a staff member.
- Parking boats or boat trailers are not permitted on any site. If you bring your own boat, please let the office know when you check in so we can issue you a Parking Pass to park your vessel and trailer in the general parking area. The cost for a parking pass is $5/day. Parking your boat or trailer anywhere else on the property is prohibited.
Occupancy
- The maximum occupancy per campsite is 10 persons at a time.
- Children under the age of 12 must always be supervised by an adult over the age of 18. No children should be left unattended on docks, the boat ramp, the playground, or in the water. Children under the age of 18 are not permitted to operate motor vehicles of any kind – including golf carts.
- Campers are responsible for making sure their guests are aware and respectful of the rules and regulations of the campground.
Campfires
- You must use a self-contained fireplace to have a campfire at your site. All fires must be put out completely with water each night. No fire should be left unattended.
Waste Disposal
- The Health Department requires you to use a holding tank for all wastewater – it cannot run into the ground. A dumping station is located on the hill near the boat ramp. Dump station hours are limited. Please see the dump station sign for available times.
- Dumpsters are available for trash disposal. Large items you wish to dispose of (i.e., refrigerators, grills, furniture, etc.) are not to be disposed of at Big Water Marina. You are responsible for hauling away and disposing of these items.
- If additional cleaning at your campsite is required after your departure, Big Water Marina will charge a $100 cleaning fee, and an additional $50 for each large item that we must haul out of your space.
Important Times
- Check-in is from 1:00 pm – 3:00 pm on the date of your arrival. If you plan to arrive outside of this window of time, please contact the office so we may provide directions to your site.
- Check-out is at 11:00 am on the date of your departure. Please respect the check-out time so that the site may be vacant and cleaned up before the arrival of the next camper.
- Quiet hours are from 10:00 pm – 7:00 am unless a scheduled event is planned by the Marina. If there is a Marina Event, quiet hours will be adjusted to 11:00 pm-7:00 am. Please be considerate of your neighbors. Excessive noise and /or objectionable language will not be tolerated and can be cause for eviction and termination of your contract with the Marina.
Cancellation Policy & Late Fees
- Cancellation Policy (April-October): Reservations that are canceled less than 30 days prior to the arrival date will receive no refund. Reservations that are canceled 30+ days prior to the arrival date will receive a full refund less a $10 cancellation fee. If a reservation is canceled within 48 hours from the time of booking, guests can contact us directly at info@bigwatermarina.com or (864) 226-3339 to receive a full refund. Reservations may be transferred, if requested by the guest, at the discretion of the Big Water Marina & Campground staff.
- Cancellation Policy (November-March): Reservations that are canceled less than 14 days prior to the arrival date will receive no refund. Reservations that are canceled 14+ days prior to the arrival date will receive a full refund less a $10 cancellation fee. If a reservation is canceled within 48 hours from the time of booking, guests can contact us directly at info@bigwatermarina.com or (864) 226-3339 to receive a full refund. Reservations may be transferred, if requested by the guest, at the discretion of the Big Water Marina & Campground staff.
Pet Policy
- Pets must be leashed at all times when on the property and should not be left unattended. Please be considerate of other guests and clean up after your pet.
Tiny Cabin & RV Rental:
Age limitation. Renter must be at least 25 years of age.
Booking Minimum. Reservations require a 2-night minimum.
Max occupants. The number of occupants per cabin must not exceed 12 persons.
Check-in/Check-out. Check-in is at 4:00 pm. Check-out is at 11:00 am. All renters must register at the Marina office upon arrival. Renters will then receive a key for entry to the rental and a gate code for entry to the property after hours. Please be mindful that these resources are how we promote security. Do not give your key or the gate code out to others. For cabin or RV rentals, please refer to the steps below for the checkout policy. All keys must be returned to the Marina office upon checkout. There will be a $50 charge if the physcial key is lost/broken.
In the instance the check-out procedures are not followed, the renter will be charged a $100 fee to the card on file. The procedures are as followed:
- Place all used towels and bed linens in the bathtub and keep the comforters on the beds for cleaning
- All dishes must be washed and put away before checking out. You will find complimentary dish detergent and a sponge by the kitchen sink.
- Throw away/take out any trash and place it in the appropriate bin designated to your cabin
- Set the thermostat to 75 degrees
- Ensure all windows and doors are closed and locked
- Turn off all lights, electronics, and applicances
Quiet Times. Quiet time is from 10:00 PM to 7:00 AM unless a scheduled event is planned at the Marina. In this instance, quiet times will be adjusted to 11:00 pm. Please be considerate of your neighbors. Excessive noise and/or objectionable language will not be tolerated and can be cause for eviction.
Parking. There are two (2) vehicles permitted per cabin site or at the RV rental site. Guests and/or additional vehicles will need to park in the general parking lot. Vessels and trailers will need to be parked in the designated lot on the property. The speed limit in the marina is 5 mph. Please watch out for children and drive carefully.
Lost & Found. Any items found left behind by the customer will be held for one week. Management will contact the customer as soon as the item is found.
Prohibited. Uncased weapons, including bows and firearms, are prohibited from use at Big Water Marina. Powered motorbikes, including 3-wheelers, 4-wheelers, motorbikes, and go-carts, are prohibited. Fireworks and other explosives are prohibited.
Cancellation Policy. Reservations that are canceled less than 60 days prior to the arrival date will receive no refund. Reservations that are canceled 60+ days prior to the arrival date will receive a full refund less a $10 cancellation fee. If a reservation is canceled within 48 hours from the time of booking, guests can contact us directly at info@bigwatermarina.com or (864) 226-3339 to receive a full refund. Reservations may be transferred, if requested by the guest, at the discretion of the Big Water Marina & Campground staff.
Pet policy. Big Water Marina & Campground is a pet-friendly facility, however, pets are not allowed inside cabin or RV rentals.
Presence. Each renter is to maintain their cabin or RV rental in a neat and attractive manner. If left unmaintained at the time of checkout, Big Water management will charge a cleaning fee of $100 to the card on file.
Occupancy. Children under the age of 12 must be supervised by an adult, over the age of 18, at all times while on the property.
Campfires. You must use a self-contained fireplace to have a campfire at your site. All fires must be put out completely with water each night. No fire should be left unattended.
Temperature. Please feel free to adjust the temperature to your comfort level. The HVAC system should not exceed 74 degrees Fahrenheit or go below 68 degrees Fahrenheit.
Trash. Please dispose of trash in the designated bins outside of your cabin. It is against regulations to leave loose or visible trash outside. All trash must be properly bagged and put into the proper bins. You are also welcome to use the dumpsters indicated on the site map. Large items are not to be disposed of at Big Water. You are responsible for hauling any larger items off the property.
Laundry. Before your departure, please place all used towels and bed linens in the bathtub or shower for cleaning.
Property Amenities
Boat Ramp
- Campers are permitted to use the boat ramp during their stay. Please let the office know if you plan to launch your boat at Big Water Marina & Campground.
- The boat ramp is closed 7 am–10 pm on days of scheduled events at Big Water Marina
Kids Zone
- Children are not to be left unsupervised at the playground or in the hammock or tire swings. Play at your own risk. Playground hours are from 8 am to 8 pm
Prohibited Items
- Setting off fireworks is prohibited at Big Water Marina.
- Uncased weapons, including bows and firearms, are prohibited from use at Big Water Marina. No hunting is permitted on Marina property.
- Powered motorbikes and certain motor vehicles are prohibited at the Marina - including 3-wheelers, 4-wheelers, motorbikes, utility vehicles, riding lawnmowers, go-karts, and minibikes.
