ARROWHEAD PARK - TERMS AND CONDITIONS OF USE

PLEASE READ THESE TERMS AND CONDITIONS OF USE CAREFULLY

By accessing or otherwise using this website or the campground, you agree to be contractually bound by these Terms and Conditions of Use (the "Terms"). If you do not agree to these Terms, you are not permitted to use this site.

Parties

The parties to these Terms and Conditions are you and Arrowhead Park. All references to "we", "us", "our", or this "website" will be construed to mean this website and Arrowhead Park, LLC. Campground will be construed to mean Arrowhead Park in Cascade, Idaho, and the lots therein.

Use And Restrictions

Subject to these Terms, and our other online policy documents and the online policy documents on https://www.campspot.com/, you may use the public areas of this website, but only for your own internal purposes. You agree not to access (or attempt to access) this website or the campground by any means other than through the channels we provide, unless you have been specifically allowed to do so in a separate agreement. You agree not to access (or attempt to access) this website through any automated means (including the use of scripts or web crawlers). You are not authorized to: (1) Resell, sublicense, transfer, assign, or distribute the website, the campground, its services, the lots, or content; (2) Modify or make derivative works based on the website, its services, or content; or (3) "Frame" or "Mirror" the website, its services, or content on any other server or Internet-enabled device.

You further agree not to use the website or campground: (1) In any way that violates any applicable federal, state, local or international law or regulation; (2) For the purpose of exploiting, harming or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information or otherwise; (3) To transmit, or procure the sending of, any advertising or promotional material without our prior written consent, including any "junk mail", "chain letter" or "spam" or any other similar solicitation; (4) To impersonate or attempt to impersonate us, our employees, other users or occupants, or any other person or entity; or (5) To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the website or campground, or which, as determined by us, may harm Arrowhead Park, us, or other users of the website or campground or expose them to liability.

You additionally agree not to: (1) Use the website or campground in any manner that could disable, overburden, damage, or impair the website or campground or interfere with any other party’s use of the website or campground; (2) Use any robot, spider or other automatic device, process or means to access the website for any purpose, including monitoring or copying any of the material on the website; (3) Use any manual process to monitor or copy any of the material on the website, or for any other unauthorized purpose without our prior written consent; (4) Use any device, software or routine that interferes with the proper working of the website; (5) Introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful; (6) Attempt to gain unauthorized access to, interfere with, damage or disrupt any parts of the website or campground, the server on which the website is stored, or any server, computer or database connected to the website; (7) Attack the website via a denial-of-service attack or a distributed denial-of-service attack; and (8) Otherwise attempt to interfere with the proper working of the website or campground.

YOU REPRESENT THAT YOU ARE AT LEAST 18 YEARS OF AGE. The website and campground are not intended for use by unaccompanied minors.

CAMPGROUND TERMS

Lot and Occupancy You acknowledge, that your occupation of the lot as purchased through the website is only for the durations stated therein. You agree to vacate the space at the end of that term. Any extension of that term must be executed by a separate transaction or agreement. While we will do our utmost to ensure your purchased lot is ready for occupation, we cannot make guarantee that the lot purchased will be available (see the Force Majeure section of these Terms), if your purchased lot is not available or becomes unusable during your stay, we will provide a new lot or site. You agree not to make any exterior improvements on a lot without prior written approval by Arrowhead Park. You agree to leave the lot in better or substantially the same condition as upon taking occupancy.

Payment. Payment will be collected through our online portal at this website, or by cash and separate written agreement in person at the campground, if staff is available. While refunds may be issued for cancelations made with adequate notice some funds are nonrefundable administrative fees, you acknowledge you are not entitled to a full refund. We direct you to the Campspot Refund Policy and Cancellation Policy: https://www.campspot.com/book/arrowheadpark/refund-policy; and https://www.campspot.com/book/arrowheadpark/cancellation-policy. You acknowledge will not be refunded for days not used if you arrive late or depart early from the campground. You acknowledge that if you holdover a lot past your purchased term without express written permission you will pay a monthly holdover rental rate of 1.5 times the quoted rental rate, prorated for each day you holdover. Such holdover does not entitle you to continued occupancy and we reserve the right to enforce any right hereunder or under the relevant unlawful detainer statutes of the State of Idaho.

Utilities. For long-term rentals, when applicable, you will be billed for electricity usage each month in addition to your rent payment Such bill will be for at-cost reimbursement only, with no surcharge by us.

Termination by Us. We will only terminate your occupancy for one of the following reasons: (a) your substantial or repeated violation of these Terms or the Rules of the Community; (b) nonpayment of rental fees; (c) closure of the campground by a federal, state, or local authority; (d) the partial or whole taking of the campground by a government entity; (e) your abandonment of the lot; or (f) your fraudulent occupation of a lot, such as by having a vehicle or RV that is longer or distinct than the vehicle or RV identified in your booking details.

Modification

We reserve the right to modify these Terms at any time, and without prior notice, by posting amended Terms to the website that is always accessible through the Terms of Use link on this website home page. You should scroll to the bottom of this page periodically to review material modifications and their effective dates. YOUR CONTINUED USE OF THIS WEBSITE OR CAMPGROUND FOLLOWING OUR POSTING OF A MODIFICATION NOTICE OR NEW TERMS OF USE ON THIS WEBSITE WILL CONSTITUTE BINDING ACCEPTANCE OF THE MODIFICATION OR NEW TERMS OF USE.

Monitoring

Your use of this website may be monitored according with the privacy policy and other online policy documents of https://www.campspot.com/. Your arrival and departure times, and use of the campground may be monitored by us.

Separate Agreements

You may acquire products, services, and/or content from this website. We reserve the right to require that you agree to separate terms as a condition of your use and/or purchase of such products or services. Purchases of products and services from this website are subject to third-party processing terms and separate licensing terms.

Ownership

The campground is the sole property of Arrowhead Park. The material provided on this website is protected by law, including, but not limited to, United States copyright law and international treatises. The copyrights and other intellectual property in the content of this site are owned by Arrowhead Park and/or others with permitted use by us, including Campspot. Except for the limited rights granted herein, all other rights are reserved to their respective owners.

Warranty Disclaimers

EXCEPT AS MAY BE PROVIDED IN ANY SEPARATE WRITTEN AGREEMENTS SIGNED BY THE PARTIES, THE SERVICES, CONTENT, AND/OR PRODUCTS ON THIS WEBSITE AND AT THE CAMPGROUND ARE PROVIDED "AS-IS," AND NEITHER WE NOR ANY OF OUR LICENSORS MAKE ANY REPRESENTATION OR WARRANTY WITH RESPECT TO SUCH PRODUCTS, SERVICES, AND/OR CONTENT. Limitation of Liability

Any loss/or damage to your RV, person, personal property caused by natural occurrence or by a third party will be solely born by you, and you hereby release and discharge us (including Arrowhead Park’s owners, employees, agents, and assigns) from any and all liability related to such loss or damage, even if you have been previously advised of the possibility of such damages.

Arbitration

Except for actions to protect intellectual property rights and to enforce an arbitrator's decision hereunder, all disputes, controversies, or claims arising out of or relating to these Terms or a breach thereof will be submitted to and finally resolved by arbitration under the rules of the American Arbitration Association ("AAA") then in effect. There will be one arbitrator, and such arbitrator will be chosen by mutual agreement of the parties in accordance with AAA rules. Arbitration will take place in Boise, Idaho and may be conducted by telephone or online. The arbitrator will apply the laws of the State of Idaho, USA to all issues in dispute. The controversy or claim will be arbitrated on an individual basis and will not be consolidated in any arbitration with any claim or controversy of any other party. The findings of the arbitrator will be final and binding on the parties and may be entered in any court of competent jurisdiction for enforcement. Enforcements of any award or judgment will be governed by the United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards. Should either party file an action contrary to this provision, the other party may recover attorney's fees and costs up to $2500.00.

Jurisdiction and Venue & CONTROLLING LAW

The courts of Valley County, Idaho and the nearest U.S. District Court in the State of Idaho will be the exclusive jurisdiction and venue for all legal proceedings that are not arbitrated under these Terms. These Terms will be construed under laws of the State of Idaho, excluding rules regarding conflicts of law.

Severability

If any provisions of these Terms are declared invalid or unenforceable, such provision will be deemed modified to the extent necessary and possible to render it valid and enforceable. In any event, the unenforceability or invalidity of any provision will not affect any other provision of these terms, and these terms will continue in full force and effect, and be construed and enforced, as if such provision had not been included, or had modified as above provide, as the case may be.

Force Majeure

We will not be liable for damage for any delay or failure of delivery arising out of causes beyond our reasonable control and without our fault or negligence including, but not limited to, Acts of God, acts of civil or military authority, fires, riots, wars, embargoes, internet disruptions, hacker attacks, or communications failures.
