RULES AND REGULATIONS

Appearance- The overall, neat appearance and natural serene beauty is what all campers enjoy most, and important to us. Sites are to be kept clean and orderly, as determined by management. This includes keeping power cords, water lines, and sewage hoses tucked neatly alongside campers on gravel. Cleanliness of the park is important to us.  Tarps are not allowed to cover items or block off areas of site. Sites are to be kept clean and orderly, as determined by management.  Satellite dishes are not allowed to be put into the ground with a post. They must be on tripods. If new dishes are found to be installed in the ground, removal will be immediate.

Bicycles/recreational modes of transportation- All bicycles and non-motorized wheeled modes of transportation must be back at your site by dusk. Mopeds, Minibikes, ATV’s, UTV’s, Side-by-sides ARE NOT permitted. Motorcycles must be registered to be driven on public roads with current tags, and registered at the front office, with operators must be at least 18 years of age with a valid driver’s license.

Campers/Parents- Campers/ Parents are responsible for the safety and behavior of their children, friends of their children, and their guests at all times. Our goal is to make your camping experience safe, relaxing, and a lot of fun. We look for your cooperation to attain that goal. Children under 18 cannot be left to occupy the campsite overnight without adult supervision. Children under the age of 12 must be accompanied by an adult at all times. Parents will be held responsible for the actions of minor children.

Campfires- Fires are limited or prohibited at certain times.  All fires are to be contained within the fire ring or pit. We reserve the right to monitor and control the size of all campfires. Do not place materials other than firewood in the fire ring.  Fire rings or pits are not to be moved without prior approval from the management. No fires shall be left unattended and must be extinguished before retiring or leaving the site. Dumping of charcoal or ashes in the woods is strictly prohibited.  Do not put hot coals or ashes into the dumpster. Live trees are not to be cut down for firewood or for any other reason. Please refrain from burning leaves at any time.

Check In- Check-in time, for all campers, is no earlier than 1:00pm. Check in time for all campers is no later than 6pm (summer hours) or 5pm (winter hours), this allows for safe parking during daylight hours. Special accommodations can be made for arrival time if notice is given in advance. Check-in before or after scheduled time may require the payment of an additional fee.

Check Out- Check out time, for all campers, is no later than 11:00am. Sites must be vacant and clean, or site cleaning fee may apply. For a later checkout time, if the site is available, may require the payment of an additional fee.

Firearms/Drugs/Alcohol- The use, display and possession of firearms, bow and arrows, air arms, paintball guns, fireworks, explosives, weapons, and illegal drugs or substances is strictly prohibited. Violation of this rule will result in immediate termination of reservation without refund.  The tossing, throwing, etc. of 

rocks, stones or other objects not intended to be thrown is prohibited. Underage drinking will not be tolerated and will result in immediate termination of reservation. Drug use is prohibited and can lead to termination of reservation. In keeping with the family environment, excessive use of alcoholic beverages will not be tolerated. Violators will be requested to leave the park. For the protection and benefit of all campers and guests, anyone who willfully or negligently destroys or defaces the property of another camper or campground property will be held liable for the full value of replacement cost and may be subject to non-renewal of reservation.  Further, any individual who violates these guidelines, or by their actions or words disturbs the peace, creates conflict, or otherwise creates a situation not in keeping with the family environment, will be engaging in improper behavior, and may be instructed to leave the park.

Golf Carts- Golf carts are allowed with prior approval from Management. Insurance information must be on file. Licensed operators only. Must abide by the same 5mph speed limit. No gas-powered golf carts allowed. No driving of golf carts during quiet hours (9:00pm-8:00am), with exception of staff.

Gravel- NO personal hauling of stone/dirt from our stockpile is permitted.

Gray Water- State law prohibits the discharge of gray or black water (sewer) on the ground or stored in containers. The camper agrees that he/she shall not cause or allow black or gray water to be emptied on the ground. All sites have sewer connections.

Laundry/Clothesline- The laundry room is open from 9:00am – 9:00pm for transient guests and monthly guests 24 hours with provided code.  Do not wash clothes, food, dishes, or personal items in the bathrooms. Please clean the washers after use and remove lint from the dryers.  For the safety of all campers, clotheslines are not permitted on sites.

Payments- Refunds subject to cancellation fee. Notice Deadlines (fee associated): 15 days or more for site daily site rentals or weekly site stays ($25), less than 14 days but more than 7 days for daily site rentals including weekly stay) half of amount paid plus $25 fee, 7 days or less for daily site rentals including weekly stay, forfeit deposit. Monthly stays cancellation (prior to arrival) requires a 2 week notice with a $100 fee, 1 week notice with $150 fee, less than a week notice forfeit deposit. If Monthly stay date of arrival changes and is over a month after original date, then cancelled deposit will be forfeited.  Annual stays cancellation (prior to arrival) forfeit deposit. Monthly stays cancellation (after arrival) must give 2-week notice of departure date or deposit will be forfeited. If 2-week notice is given, then refund will be issued after deduction of final balance. Annual stays cancellation (after arrival) refund minus balances due if departure date is after the 365 initial stay length. If before the deposit is forfeited. Balance is due on arrival. Late Payments WILL BE IMPOSED per agreement. Good Sam/Military discount 10% to daily or weekly site fee only (excluding holidays).

 

  1. Security Deposits- All security deposits will be made with a credit card.  Checkout refund policy: Monthly guests must provide a 2 week notice of departure, or the cancellation fees (prior to arrival) will be applied towards refund. This is at managers discretion. Checkout refunds will be processed and returned to the card used for deposit.
  2. Autopay- If I prefer to set up auto-pay for my monthly site fees, I will sign the Recurring credit card payment authorization form. This form will stay on file and active until I give written notice to stop.
  3. Pay by Phone- If I prefer to call my payments in by phone, I will sign the Phone-in credit card payment authorization form. This form allows office staff to process my payment with a card on 
  4. file when I call in to make my payment. This form will stay on file and active until I give written notice to stop.
  5. Cash/Check/Money Order- Any payments made by cash, check, or money order will be processed by office staff and a written receipt will be provided to me.
  6. Fees:  Any checks that are processed and come back as “Insufficient Funds” will incur a $40 processing fee. After the 2nd time Broad River RV Park, LLC has the right to refuse future payments by check. Any credit cards that are declined due to “Insufficient Funds” will incur a $40 processing fee. Monthly late fees: if payment is not received by the 10th a late fee of $50 will be added. Each additional day payment is late will be $10 (each day). Ex. guest pays site fee/electric on the 14th, balance due is site fee plus $80 late fee ($50 initial late fee, $10 x 3). Early or late checkin fee is $25, subject to management approval.

Personal Property- All Personal property brought into the campground is at the Registered Camper’s risk and campground management shall bear no responsibility for the damage, loss, or theft of such property. All campers assume the responsibility of maintaining proper insurance on their camper and personal property. WE are not responsible for any damage to any camper or personal property for any reason including an act of God (i.e., wind, lightning, hail, fallen branches, trees, embers that drift onto property, etc.), accident, fire, or vandalism.

Pets- Pets, that are breed approved, are welcome but are required to be leashed and under the control of the pet owner at all times.  Maximum two (2) pets per site unless prior approval from management. (A $5 fee for additional pets may apply.)  All pets must be currently vaccinated. All pet litter must be picked up immediately. Campers who do not pick up after their pets will be asked to leave- with NO refunds. No exceptions. No pets allowed in the playground area or to roam around freely at ANY time. Small dog pens or tie-outs on site must be approved by management and must be moved or marked for mowing as needed. Pets are not to be left unattended outside overnight. Growling or aggressive dogs will not be tolerated (including service animals). On complaints of aggressive dogs, one warning will be issued.  In the event roaming or other infractions continues, the Registered Camper shall either remove the pet from campground or shall leave the campground immediately. No visiting guests of Camper allowed to bring pet(s) without prior approval from management. We want everyone to enjoy his or her camping experience, pet owners and non-pet owners alike. Broad River RV Park, LLC shall be held harmless and assumes no liability, implied or otherwise, for animal bites or injury. You, as a pet owner, specifically agree to carry your own insurance and agree to indemnify Broad River RV Park, LLC to cover any injury or damage, which may incur.

Quiet Hours- Quiet hours are from 9:00pm to 8:00am. The quality of rest and relaxation is important to all campers so please refrain from loud noises and disturbances during this period.  The volume level for all stereos, radios, TV, instruments, or other noise-making devices must be at a minimum during this time. Gauge: if you can hear it outside from your camper, it’s too loud!  If a neighbor camper is disturbing you, please notify the campground host. Minors must be on their site and/or under direct adult supervision by dusk.

Repairs- No Guest shall attempt repairs to campground equipment (faucet, drainpipes, electric outlets, etc.)  It can lead to repair fees and/or termination of reservation. Any personal repairs on units that require an outside source to come in must be reported to the office. Only businesses with proof of licenses and bonding will be allowed, this is to protect our guests from scams. Repairmen, Towing companies, and/or anyone coming onto grounds must report to the office before entering campground. If the office is closed (Sunday, Wednesday, Holidays, or after hours) then they must call the office number at 803-749-9100 

before driving through the campground. Guests will be responsible for any damages done to the campground.

Restrooms/showers- to avoid accidents or injury in these areas, it is required that an adult accompany children under the age of 12 years of age to all restrooms/showers.

Sale of Trailers- Management must be notified before displaying any signs or advertisement for the sale of a trailer. We will help you by displaying the information, picture, and site number you provide us. Prospective buyers must be informed that the sale of the trailer is separate from the site and must report to the office or call office before coming onto campground and going to site. Management determines future use of the site and new rates. Sites can NOT be rented out to unregistered guests. One “For Sale” sign will be permitted (after approval) but not to exceed 12’x18’, units for sale will be displayed on the resale bulletin board located at the office. Prior to the resale of your unit a pre-sale inspection request must be submitted to management, who will inspect the unit and determine whether it may remain in the park, and if so, what conditions must be met. Management also reserves the right, in its sole discretion, to deny approval of any proposed transfer. All campers selling their units may post a “For Sale” ad (3’x5’ in size) on the resale board located at the office. In addition, your name and unit will be added to a resale list and distributed to potential buyers, visitors, and persons requesting resale information in the campground.

Monthly CAMPERS – Monthly campers agree with all the Rules and Regulations set forth herein. Monthly campers also agree with these additional rules as follow:

             CAMPER WASH - You may wash your camper once a month in the spring with prior management approval. Preferably weekdays only (unless arrangements have been made). No mobile wash detailing service allowed unless approved by management.

Steps / Platforms/Propane tanks - All platforms and steps require management approval.  Any site improvements must be pre-approved in writing by management.  Any structures become the property of the campground. Company installed propane tanks that are larger than 50lbs are no longer allowed.

ELECTRICITY – All sites have electric meters. Refrigerators, electric heaters, air conditioners, party lights, etc. all use electricity. Note: Your transformer uses power 24/7. We suggest using these high-energy consumption units to a minimum. The policy is as follows: Monthly Campers will be charged a monthly fee according to usage multiplied by the going rate (at our costs) that is published at the Office. All accounts shall be paid in full by the 10th of each month. A late fee of $50 will be added on the 11th if not paid in full and a fee of $10 each additional day will be added if not paid in full. If not paid by the last day of month Camper will forfeit deposit and reservation will not be renewed. Campers will have 24 hours to vacate the site.

SCREEN ROOMS – Only temporary screen rooms are allowed. Wooden add-a rooms are prohibited. Screen rooms must be commercially manufactured / approved by Management.

SHEDS – Management must approve Rubbermaid storage containers before set-up / installation.  No wooden sheds / carports. Sheds must be portable when emptied and broken down. 

TREES / FLOWERS – The cutting or pruning of any tree is forbidden. Nails are prohibited from nailing in trees. Please use bungee cords. Don’t kill our trees. Planting of flowers must be approved by management, unless in pots. Do not pull dead trees, fallen trees or branches, out of wood line to burn without prior approval from management (some may contain poison ivy, oak, or sumac which can cause severe breathing issues to those allergic).

SEWER HOOKUPS – All sites have sewer hookups. All campers shall use toilet paper designed for recreational vehicles. Paper clogs can be avoided. All sewer hoses must be properly supported to avoid unintentional breakage or disconnection that can lead to sewage spill. Allow your tanks to fill up to ¼ full to allow solids to “float”. Gate valves must not be left open on the black water tank until you are ready for purging. Do not dispose of paper towels, clothing, sanitary napkins, grease, dog/cat feces, pet litter of any kind, rocks, food scraps or anything that is not human waste or dish water in the sewer system. Any plumbing issues caused by the camper will be corrected at the camper's expense. Camper must have a secured closed connection between their sewage hose and our sewage connector on ground. Camper will be charged for any sewage spillage and cleanup.

SPEED LIMIT: A maximum speed of 5 miles per hour throughout the campground will be tolerated, including all vehicles, golf carts, motorcycles, scooters, or any other wheeled method of transportation. This is Strictly enforced and can result in termination of your contract.  Safety is our #1 concern!

TRASH – Garbage is not picked up at individual campsites. Please dispose of all trash in the trash containers provided. We have 3 locations for disposal of bagged household garbage and broken-down boxes: Phase 1 near maintenance sheds, Phase 2 past dog park, and Phase 2 on curve of entrance between sites 95 and 133. Dumpsters are emptied on Tuesday and Friday. BREAK DOWN ALL BOXES. This will help ensure that there is no overflow of trash between pickup days. Do not dispose of hazardous materials in trash containers. No burning of household trash is permitted.   Unsuitable materials, such as furniture-appliances-mattresses etc., should not be disposed of on campsites or near the dumpsters, but should be taken to recycling centers on Fire Tower Road. Call the office for directions. Trashcans at the playground and office are for loose trash only, not bagged trash.

UTILITIES- Campers are to connect to the utilities on their designated site only.  Plug-ins should not exceed the number of receptacles on each pedestal.  DO NOT pour any grease in drains.  No digging, no permanent satellite hook-ups may be installed, if found will result in immediate vacating with no refund. No outside appliances – washers, dryers, refrigerators, freezers, etc., unless prior approval from management with proper enclosure as described by management. October – March Heat tape or foam insulation must be used from the camper to the ground.  Failure to do so could result in immediate termination of your contract.  Guest’s will be charged a minimum $50 repair fee. 

VEHICLE - Registered vehicles only, must be tagged and in operational condition.  Limit two vehicles allowed per campsite unless prior approval from management and if space allows. Washing of motor homes or other vehicles is allowed with permission. No changing of fluid such as oil, gas or antifreeze shall be allowed on any area of campground. No repairs shall be made to vehicles except emergency repairs, approved through management. Do not park on other campsites without asking for availability.

VISITOR / GUEST - Any person or persons who are not named on the initial registration form as a “Registered Camper”, and who has entered the campground is considered a visitor. Registered Campers who have visitors that are not registered will be charged the visitor's fee for their guest according to the scheduled rates. Failure to register Visitors and / or Guests will result in a $10.00 penalty fee in addition to the regular fee. There will be no more than 6 people registered to one site at any given time, either on a transient basis or monthly basis, unless prior approval from management.  All day visitors must check out and leave the campground by 9 p.m. unless registered as an overnight guest and have paid the applicable fee. State Law requires us to know who is in the campground and on premises.

Miscellaneous- Do not feed stray animals. All campground buildings are non-smoking. No camper guest is to go on property that does not belong to the campground. It can be enforced as trespassing. For Clarification on areas allowed contact the front office at 803-749-9100.

Conduct:  Any disorderly conduct directed at staff, managers, guests, or other campers will not be tolerated and will result in IMMEDIATE termination of your camping privileges as well as removal from the campground without refund.

This document is in no way to be construed as a lease or creating a tenant landlord situation. The management reserves the right to amend or supplement the guidelines without notice. Violation of any of these rules can be cause for immediate termination of reservation.

All campers and their visitors are to obey all municipal, county, state, and federal laws and regulations.

Disclaimer Acknowledgement: MONTHLY CAMPERS, FOR THEMSELVES, AND FOR ALL OF THEIR REGISTERED CHILDREN, AGREE AS FOLLOWS: BROAD RIVER RV PARK, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, MANAGERS, EMPLOYEES, AND AGENTS (“BROAD RIVER RV PARK PARTIES”) MAKE NO WARRANTY OR REPRESENTATIONS OF ANY TYPE, KIND OR CHARACTER, WHATSOEVER, AS TO CONDITIONS EXISTING OR THAT MAY HEREAFTER EXIST UPON THE BROAD RIVER RV PARK PREMISES, OR WITH RESPECT TO ITS EQUIPMENT OR FACILITIES , INCLUDING BUT NOT LIMITED TO CAMPSITES OCCUPIED BY OTHER GUESTS OR GUESTS’ PROPERTY. TO THE MAXIMUM EFFECT PERMITTED BY APPLICABLE LAW, ALL SUCH USE OF THE BROAD RIVER RV PARK AND ITS EQUIPMENT AND FACILITIES IS PROVEIDED  “AS IS” WITHOUT WARRANTY OR CONDITION OF ANY KIND, THE BROAD RIVER RV PARK PARTIES HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE USE OF THE BROAD RIVER RV PARK AND ITS EQUIPMENT AND FACILITIES, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A  PARTICULAR PURPOSE.

 

Acknowledgement of Risk and Limitation of Liability: MONTHLY CAMPERS AND THEIR LICENSEES, INVITEES, AND GUESTS ENTER UPON THE BROAD RIVER RV PARK AT THEIR OWN RISK, AND SPECIFICALLY ACCEPT BROAD RIVER RV PARK, ITS EQUIPMENT AND FACILITIES, IN ITS THEN EXISTING CONDITION, AND UNCONDITIONALLY RELEASE THE BROAD RIVER RV PARK PARTIES FROM ALL LIABILITIES, COSTS, EXPENSES, CLAIMS, AND DAMAGES FOR WHICH ANY OF THEM MIGHT OTHERWISE BECOME LIABLE BY REASON OF ANY ACCIDENTS, OR INJURIES TO, OR DEATH OF ANY PERSONS INCLUDING WITHOUT LIMITATION MONTHLY CAMPERS AND THEIR GUESTS, OR DAMAGE TO PROPERTY, OR BOTH, IN ANY MANNER ARISING OR RESULTING FROM, CAUSED BY, CONNECTED WITH, OR RELATED TO THE PRESENCE OF ANY SUCH PERSON OR PROPERTY UPON THE BROAD RIVER RV PARK, OR USE OF ITS EQUIPMENT AND FACILITIES, REGARDLESS OF HOW, WHERE, OR WHEN SUCH INJURY, DEATH, OR DAMAGE OCCURS, EVEN IF CAUSED BY THE NEGLIGENCE OF OTHER GUESTS, OR BROAD RIVER RV PARK PARTIES, OR DUE TO CONDITIONS ON OR DEFECTS IN THE BROAD RIVER RV PARK 

PROPERTY, ITS EQUIPMENT OR FACILITIES, OR THE PROPERTY OF OTHER GUESTS.

 

Indemnifications: Monthly Campers shall indemnify and hold the Broad River RV Park Parties harmless from and against any and all liability for damages, costs, losses, and expenses resulting from, arising out of, or in any way connected with, the occupation or use of Broad River RV Park, and its equipment and facilities, by Monthly Campers, or the licensees, invitees, or guests of Monthly Campers, or the failure on the part of Monthly Campers to perform fully all and singular Monthly Camper promises contained in this Agreement or in the Rules and Regulations of Broad River RV Park, which are incorporated herein by reference. The Broad River RV Park Parties shall not be liable to Monthly Campers if for any reason whatsoever Monthly Campers’ occupation or use of the property, its equipment or facilities under and pursuant to this Agreement shall be hindered or disturbed.

 

Mandatory Arbitration: In the event the parties are not able to resolve any dispute between them arising out of or concerning this Agreement, or an provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location within sixty (60) miles of the Broad River RV Park mutually agreed upon by the parties.  The arbitrator’s award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns this Agreement, the prevailing party shall be entitled to recover its costs and reasonable attorneys’ fees.  The parties agree to arbitrate all disputes and claims in regards to this Agreement or any disputes arising as a result of this Agreement, whether directly or indirectly, including tort claims that are a  result of thereof.  The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the arbitrator. This arbitration provision shall survive the termination of this Agreement.

 

Governing Law: This Agreement shall be governed by, construed, and enforced in accordance with the laws of South Carolina without giving effect to any choice or conflict of law provision or rule (wether of the Courts of South Carolina or any other jurisdiction) that would cause the application of laws of any jurisdiction other than those of the Courts of South Carolina. If any provision in this Agreement is invalidated by any law, arbitrator or court order, the remaining portion of the Agreement shall continue to apply.

 

Not A Lease: Not a Residence:  This Agreement is a contract which is binding on both Broad River RV Park and the Monthly Campers. This Agreement is not a lease of real estate and does 

not convey any property right to the Monthly Campers. The Monthly Campers are not tenants. This Agreement is , for legal purposes, a license to use the property of Broad River RV Park on the conditions which are stated in this Agreement. Monthly Campers may not use Broad River RV Park as a permanent residence, voting address or other place of residence.

 

Termination: Broad River RV PArk reserves the right to terminate the permission granted by this Agreement at any time by giving Monthly Campers at least thirty (30) days’ written notice of such termination, except that Broad River RV Park may, at its election, terminate the permission immediately without such notice at any time if Monthly Campers shall fail to comply with or abide by each and all of the provisions of this Agreement or to keep all and singular Monthly Campers’ promises contained in this Agreement.

 

Removal of Property:  On revocation, surrender, or other termination of the permission granted by this Agreement, Monthly campers shall quietly and peaceably surrender the portion of the Broad River RV Park occupied by Monthly Campers in as good condition as such property was at the time of Monthly Campers entry on such property under this Agreement and shall remove all fixtures, equipment, and other things placed by Monthly Campers on such property, including but not limited to any recreation vehicles and other vehicles, and if Monthly Campers shall fail to do so, Broad River RV Park shall have the right  to make such removal at Monthly Campers’ expense, the amount of which expense Monthly Campers shall pay to Broad River RV Park on demand, and, if Broad River RV Park shall so elect, it shall have the right to take possession of and appropriate to itself without payment any property of Monthly Campers, or anyone claiming under Monthly Campers, the then remaining property on the above-described property.

 

Joint Licensees; Notices:  If this Agreement is with two or more persons as Monthly Campers, then the obligations of Monthly Campers shall be the joint and several obligation of each such Monthly Camper, and notice given to one of them shall be deemed notice to both or all. Any notice provided for or concerning this Agreement shall be in writing and shall be deemed sufficiently given when sent by certified or registered mail if sent to the respective address of each party. 

No Waiver: The failure of either party to this Agreement to insist upon the performance of any of the terms and conditions of this Agreement, or the waiver of any breach of any of the terms and conditions of this Agreement, shall not be construed as subsequently waiving any of the such terms and conditions,  but the same shall continue  and remain in full force and effect as if no such forbearance or waiver had occurred.

 

Entire Agreement: This Agreement, along with accompanying Monthly  Rate & Payment, and the Rules and Regulations incorporated by reference, shall constitute the entire agreement between the parties and any prior understanding or representation of any kind preceding the date 

of this Agreement  shall not be binding upon either party except to the extent incorporated in this Agreement, except for modifications to the Rules and Regulations which shall become upon adoption by Broad River RV Park from time to time. Monthly Campers are responsible for reviewing the Rules and Regulations from time to time as posted by Broad River RV Park or as otherwise communicated to the Monthly Campers by Broad River RV Park. Except for modifications to the Rules and Regulations, any modification of this Agreement or additional obligation assumed by either party in connection with this Agreement shall be binding only if placed in writing and signed by the party to whom such changes are intended to be binding.

 

Assignment of Rights: The rights of Monthly Campers under this Agreement are personal and may not be assigned or transferred to any other person, firm, corporation, or other entity without the prior, express, and written consent of Broad River RV Park.

 

Counterparts:  This Agreement may be executed in any number of counterparts, each of which shall be deemed to be an original, but all of which together shall constitute but one and the same instrument.
