Terms of Service

Identification-A copy of a valid driver’s license and credit card are required for all rentals. Reservations must be made by a person 18 years or older.

Check-In/Check-Out- Check-in begins at 12:00 noon. Prior arrangements must be made if checking in after 6:00pm (office closes at 6:00pm daily, and at 7:00pm on Fridays & Saturdays druing peak season) Check-out is 11:00am. If you are floating the day of your departure, you must check-out and move your vehicle to the visitor’s day parking area before your float trip.

Site Occupancy- Up to 6 occupants per site. $7 fee per night for additional guests. 1 RV per site & one vehicle. Other vehicles should park in designated parking areas. 2 tents permitted per campsite. Primitive camping area does not have drive-up parking.

Quiet Hours- Quiet hours are daily from 10:00pm – 7:00am. Please be considerate of others. No loud noises such as radios, music, voices, generators, or loud vehicles. Minors must be at their campsite. No tolerance. Speed Limit- 5 miles per hour through-out the park.

Vehicles/ATVs/Golf Carts- Must stay on paved or gravel areas. No off-road parking or driving.

Children- Guests are responsible for the behavior of all children. All children under the age of 12 should be accompanied by an adult at the playground, restrooms and throughout the park.

Pet Policy- Pets must always be on a leash, including the swimming area. All pets must be noted upon check-in. No pets shall be left unattended at any time. Pets should not be left in the cabins or yurt while on float trips. Pet Fee $25.00 (non-refundable) for cabins/yurt rental. Maximum of 2 pets. Animals shall not disturb the peace or be a nuisance to other guests. No vicious dogs or aggressive breeds such as Pit Bulls aloud. Exotic animals/pets are prohibited. Horses are welcome in designated areas.

Glass Containers- Glass containers are not permitted inside the park or on the river.

Fireworks- No fireworks. No exceptions.

Picnic Tables & Fire pits- Only 1 picnic table & 1 fire pit per campsite. Do not move fire pits. If an additional picnic table is desired, please contact the office with request.

Campfires/Firewood- No outside firewood will be permitted inside the park. Fallen branches may be gathered from within the park and used. Cutting of standing trees or green limbs is strictly prohibited. Campfires should not be left unattended. No treated lumber, plywood, or other materials (such as cans or trash) should be burned. Management reserves the right to regulate the size and location of fires and ban campfires when conditions warrant.

Trash- Please place trash in designated dumpsters.

Safety After Dark- It is recommended to use a flashlight when it is dark walking to the bathhouse and throughout the park. No bike or scooter riding after dark. ATV’s, golf carts and all vehicles must use headlights.

Visitors- Visitors are welcome. Visiting hours are 8:00 am to 10:00pm. Maximum of 6 overnight guests per campsite.

Disposal of Gray Water & Wastewater- Dump station is located near park entrance/exit.

No Smoking- No smoking inside the cabins, yurt or bathhouse at any time. Cleaning fee of $100.00 will be charged.

Electrical Connections- Campsites are rated at specific amperage. It is the camper’s responsibility to stay within the supply available. Damage to the camper’s equipment and/or Caplinger Wood’s electrical system will be the responsibility of the camper. Multiple taps on the post and/or connecting to more than one electric service box is not permitted.

Damaged or Missing Items- Cabins & Yurt include furniture, small appliances, mattresses, mattress protectors & décor. Damage to such items/structure is subject to fees which will be billed to the credit card on file.

Cleaning Fee- an additional cleaning fee may be charged in the event the cabin/yurt is left in an unsatisfactory condition. Please dispose of all trash in the trash can provided. This includes fire-pits. Fire pits are for burning wood, not trash.

Floating- All person’s floating must sign An Assumption of Risk & Waiver Agreement. It is recommended that everyone wear a life vest. Each person over the age of 7 must have a life vest easily accessible on board. Children 7 years of age and younger must wear a USCG approved life vest at all times. Each person is responsible for returning rental items and gear in the condition it was loaned. This includes canoes, kayaks, paddles, seats, and life vests. Do not use life vests to tie canoes, kayaks or tubes together. Fees for damaged items listed on the Assumption of Risk & Waiver Agreement. Under Missouri law, an outfitter is not liable for an injury to or the death of a participant in paddle sport activities resulting from the inherent risks of paddle sport activities pursuant to the Revised Statutes of Missouri. Chapter 537 RSMO revised to 537.327

Swimming- Swim at your own risk. No lifeguard on duty.

Fishing- Fishing is allowed along the riverbank. Be courteous of others and no crossing through occupied campsites. All Missouri fishing regulations must be followed. Visit https://huntfish.mdc.mo.gov/fishing for permits, regulations, and seasons. A copy is located at the office. We do not sell permits. You may purchase a permit online.

Hunting- Hunting is prohibited.

Conduct- No illegal drugs, public intoxication, possession of alcohol by minors, public displays of nudity and disorderly conduct will be tolerated.

Management- Caplinger Woods is a private campground. We reserve the right to deny service to any person and to ask anyone to leave the premises at any time. No refunds will be given. Management is not responsible for lost or stolen items.

Cancellation Policy

  • Cancel your reservation 14 or more days prior to arrival and receive a full refund, minus a $10 processing fee.
  • Cancel your reservation 8 - 13 days prior to arrival and receive a full refund minus a 25% processing fee.
  • Cancel your reservation 3 - 7 days prior to arrival and receive a full refund minus a 50% processing fee.
  • Cancel your reservation less than 3 days prior to arrival and forfeit a refund of any kind.

ASSUMPTION OF RISK, WAIVER AND RELEASE AGREEMENT

Assumption of Risk:

• I understand and accept that canoeing, kayaking, tubing, camping, and cabin rental expose me to many hazards and that participating in a canoe/kayak/tube/camp/cabin trip entails unavoidable risks of death, personal injury, and loss of or damage to property. I voluntarily choose to participate in this trip in spite of these risks and hereby assume all risk of injury, disability, death, and loss of or damage to property. I fully understand that I will be traveling at my own risk. I agree to abide by the rules/regulations/safety warnings of Finch & Friends DBA Caplinger Woods RV & Campground (F&F) and its employees.

• I understand I should be in good physical health to participate in a canoe/kayak/tube/camp/cabin trip. I acknowledge that I have no health problems, physical disabilities or mental impairments that would preclude my participation. I acknowledge that I have sufficient skill and fitness to participate. I am not under the influence of drugs or alcohol and there is no reason why I lack the capacity to sign this document. I acknowledge that I have insurance that will cover the costs of emergency medical treatment and/or transportation related to canoe/kayak/tube/camp/cabin trips or that I am willing to bear these costs. I authorize F&F to secure emergency transport and/or medical care when F&F deems necessary, and I authorize F&F to release or share participant medical information with medical care providers.

 Inherent Risks:

• I understand that in signing this document for participation in a F&F canoe/kayak/tube/camp/cabin trip that certain risks and dangers exist, including inherent risks, and these risks include but are not limited to death, personal injury, and loss of or damage to property, changing water flow or currents, submerged and semi-submerged objects, varying wind and weather conditions, natural obstacles and their condition, the presence of other watercraft, the speed at which I travel, the stability characteristics of a watercraft, collision, upset, overturned and sinking can result in getting wet, injured, exposed to the elements, drowning, and personal property damage or loss, that for swimmers and non-swimmers, wearing a U.S. Coast Guard approved flotation device is a basic safety precaution, that I may suffer accidents or illnesses in remote places where there are no available medical facilities, my own negligence, and co participant behaviors. I acknowledge that these are just some of the known risks and that there are other inherent risks in this activity both known and unknown.

Waiver and Release:

• In consideration of F&F furnishing services to enable me to make this canoe/kayak/tube/camp/cabin trip, I for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY, INDEMNIFY, SPECIFICALLY RELEASE AND FOREVER DISCHARGE F&F AND ITS OFFICERS, AGENTS AND EMPLOYEES FROM ANY AND ALL LIABILITY OR CLAIMS FOR INJURY, ILLNESS, DISABILITY, DEATH AND LOSS OF OR DAMAGE TO PROPERTY THAT I MAY SUFFER WHILE PARTICIPATING IN THIS CANOE/KAYAK/TUBE/CAMP/CABIN TRIP. THIS RELEASE AND DISCHARGE SPECIFICALLY INCLUDES, BUT IS NOT LIMITED TO, LIABILITY OR CLAIMS FOR INJURY, ILLNESS, DISABILITY, DEATH, OR LOSS OF OR DAMAGE TO PROPERTY CAUSED BY THE NEGLIGENCE OF F&F OR ITS OFFICERS, AGENTS, OR EMPLOYEES. IT IS MY INTENT TO RELEASE F&F AND INDEMNIFY F&F AND HOLD IT HARMLESS FROM ALL LIABILITY FOR ANY SUCH PROPERTY LOSS OR DAMAGE, PERSONAL INJURY OR LOSS OF LIFE, WHETHER CAUSED BY THE NEGLIGENCE OF F&F OR BY ALLEGED BREACH OF CONTRACT, BREACH OF WARRANTY, OR ANY OTHER LEGAL THEORY.

 Indemnification:

• I hereby agree to bear all costs and fees incurred by F&F in defending themselves against the claims of mine, my heirs, assigns, personal representatives and next of kin.

• I acknowledge that F&F holds residency in Cedar County in the state of Missouri, and agree that any claims and litigations will be brought in and carried out in Cedar County in the state of Missouri.

• I expressly acknowledge and agree that if any part of the document is found to be void or illegal by a court the other parts will remain in full force and effect and will be given the broadest construction possible by the courts of Missouri.

IN SIGNING THIS DOCUMENT, I FULLY RECOGNIZE THAT IF INJURY, ILLNESS, DISABILITY, DEATH, OR DAMAGE OCCURS TO ME OR MY PROPERTY WHILE ENGAGED IN THIS CANOE/KAYAK/TUBE/CAMP/

CABIN TRIP, I WILL HAVE NO RIGHT TO MAKE A CLAIM OR FILE A LAWSUIT AGAINST F&F OR ITS OFFICERS, AGENTS, OR EMPLOYEES, EVEN IF THEY OR ANY OF THEM NEGLIGENTLY CAUSE MY INJURY, ILLNESS, DISABILITY, DEATH, OR DAMAGE.

 

I HAVE CAREFULLY READ THIS DOCUMENT AND UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS AN ASSUMPTION OF RISK, WAIVER, AND RELEASE AGREEMENT, AND I SIGN IT FREELY, VOLUNTARILY AND WITHOUT INDUCEMENT. I ALSO UNDERSTAND THAT I SHOULD NOT AND MAY NOT PARTICIPATE IN THIS ACTIVITY IF I AM UNDER THE INFLUENCE OF ALCOHOL OR DRUGS.
