COVID-19 Policy

I, , “Releasor” or “I” on behalf of myself and the occupants of my camping unit (meaning any physical unit located in a campground), hereby release and indemnify Double G RV Park (“campground” and “releasee”, its owners, agents, servants  and employees from any liability regarding me or anyone staying in my camping unit relating to COVID-19 and any other viruses or illnesses that they may get as a result of staying at the campground. This Release, Disclaimer and Indemnification and Hold Harmless agreement is executed and made effective from today until I leave the campground. In consideration of the right to stay in the campground, I on behalf of myself and any occupants of my camping unit, for other good, valuable and legal consideration, the receipt and sufficiency of which are acknowledged, the parties agree as follows: I am aware that COVID-19 and other viruses and illnesses are contagious. I am aware that people with COVID-19 and other viruses and illnesses can be non-symptomatic, meaning that people may be sick and contagious without symptoms. I am aware that if I stay in this campground, I am doing it at my own risk and could be exposing myself and my occupants to COVID-19 and other viruses and illnesses. I am responsible for myself and my guests. If anyone in my camping unit gets sick, we will inform management who will inform the local Health Department and we will follow their advice on how to proceed. I am aware that I may be required to leave the campground if anyone in my camping unit displays illness. I will indemnify the campground from any claims no matter the source, due to exposure to COVID-19 and other viruses and illnesses on behalf of myself and the occupants of my camping unit. I will pay any legal fees, damages and costs related to claims either brought by the occupants of my camping unit or brought by other campers in the event someone gets sick in my camping unit or from me and my occupants. I agree that I and the people occupying my camping unit will wear masks at all times as long as this mandate is in place by the Governor and/or other health authorities when outside and keep at least 6 feet away from other campers as long as the State of Maryland and CDC require this. I am aware that if I or any of the people in my camping unit violate this and do not wear a mask outside or get within 6 feet of other campers, we will be required to leave immediately with no refund given.

 Assumption of the Risk: Releasor acknowledges the Activity (camping) may expose Releasor to COVID-19 and other viruses and illnesses and that injuries, death, property damage, or other harm could occur to Releasor or others. Releasor is voluntarily participating in the Activity (camping) with knowledge or the risks, hazards, and other dangers involved. Releasor hereby accepts any and all risks of injury (including death) to Releasor arising out of or in any way connected with the Activity (camping).
 

Release: Releasor hereby waives, releases, and forever discharges any and all claims for damages for personal injury, death, or property damage which Releasor and/or Releasor’s children, heirs, executors, assigns, parents, personal representatives, or estate may have or which may hereafter accrue as a result of staying in the campground. 

Indemnification: Releasor, to the fullest extent permitted by law, shall indemnify, hold harmless, protect and defend Releasees from and against any and all liabilities, claims, damages, losses, demands, lawsuits, costs, and expenses, including (but not limited to) attorney fees, arising out of or resulting from the negligence or misconduct of Releasor in connection with participation in the Activity (camping). Should any such claim, demand, or lawsuit arise or be asserted in any way whatsoever related thereto, whether arising under the laws of the United States, any state, or under any theory of law or equity, Releasor will indemnify, hold harmless and defend Releasees from any and all costs, expenses, or liability including but not limited to the cost of any settlement or judgment made or rendered against Releasees.

Financial Responsibility: In the event that Releasor should require medical care or treatment for illness or injury sustained as a result of participation in the Activity (camping), Releasor agrees to be financially responsible for any costs incurred as a result of such treatment. Releasor represents that adequate health insurance is in effect to cover any injury or illness suffered or damage caused while participating in the Activity (camping).

Severability: If any provision of this Agreement is held invalid, illegal or unenforceable by a court of competent jurisdiction, the remaining provisions of the Agreement will nevertheless be fully valid, enforceable, and unimpaired by such holding. 

Governing Law: The parties hereby agree that this Agreement is governed by the laws of the United States and the State of Maryland, without reference to rules governing choice of laws. If any dispute arises concerning this Agreement, venue shall be laid exclusively in the state and federal courts of the State of which shall have exclusive jurisdiction over such dispute and the Parties consent to the personal jurisdiction of such courts.

 

 IN WITNESS WHEREOF, The parties, by their authorized representatives, have executed this Agreement as of the Effective Date.
