TERMS AND CONDITIONS FOR EXTENDED STAYS:
This Agreement is herein agreed to by and between Great Escapes RV Resorts L.L.C., d/b/a Bryan / College Station RV Resort (hereinafter referred to as “Camp-Resort”) and the party(s) signatory hereto (hereinafter referred to as “Extended Stay Camper”). Said Extended Stay Camper herein agrees to all the terms and conditions of this agreement as follows. Extended Stay Camper agrees to be bound by the rules and regulations of the Camp-Resort on behalf of the party's signatory hereto, as well as for all children, guests, and visitors of said Extended Stay Camper. All overnight guests and visitors must register immediately upon arrival on Camp-Resort property and pay all fees. Extended Stay Camper acknowledges that he or she is not a tenant but a licensee on a day-to-day basis and that Extended Stay Camper has no property or possessory interest in the site being rented to Extended Stay Camper.
All guests at Great Escapes Bryan / College Station RV Resorts LLC. are considered licensees. All rights granted to registered guests in our park are through a revocable license which may be revoked at any time for any reason without refunds. Under no circumstance should any registered guest consider themselves a tenant with a lease. Guest Initials___________________
 

Term: This Agreement shall be effective from ________________, 20____, to ______________, 20____. The anniversary date of your reservation will be the effective date for all Monthly Extended Stay Camper Site Agreements.


The terms of payment shall be as follows:
Payment in full is to be received by Camp-Resort no later than the effective date of the agreement. There shall be a late fee of Twenty-Five Dollars ($25.00) for all payments not received within five (5) days of being due. If site and electric fees are unpaid after five (5) days, said Extended stay Camper will be asked to vacate the premises. A deposit of One Hundred Fifty Dollars ($150.00) shall be held in escrow, as surety, by the Camp-Resort until the agreement terminates. No interest will be paid to Extended Stay Camper for monies held in escrow. The refund of the deposit is based upon all bills being paid in full, all camping equipment and other personal property timely removed, and the campsite in undamaged and clean condition. The deposit will be refunded and mailed upon final inspection by the Camp-Resort.


For Monthly Extended Stay Camper Site Agreement: Notification of extension of the agreement must be made by the 15th of the preceding month. Failure to make such notification shall be construed as a cancellation of the Extended Stay Camper Site Agreement. The Extended Stay Camper(s) signatory hereto shall pay in full all bills pending and remove all camping equipment and other personal property, leaving the campsite in a clean condition on the agreement termination date. In the event of any default under this Agreement by Extended Stay Camper, said Extended Stay Camper shall pay on demand the reasonable attorney's fees incurred by Camp-Resort because of such default.

Obligation to Update Information: Extended Stay Campers agree to attain a post office box where mail and packages can be received. The office does not accept mail or packages for campers. Packages received in the office will be returned to the sender. This is a business and cannot be used by anyone as a permanent address. They also agree to keep Camp-Resort Management apprised of all phone numbers, and other necessary information, including the ages of dependent children. Guest Initials____________
 

Dependents: An Extended Stay Camping Family shall be interpreted to be two adults and their dependent children in this agreement. It is further agreed that dependent children will NOT be given access to the Camp-Resort without their parents unless they have provided written notification and obtained Camp-Resort permission before their arrival. Parents are responsible for their children's actions. Children are to be accompanied to washrooms and pools. All children under 18 are to be at your site during quiet hours. Camp-Resort Management retains the right to deny entry and eject any dependent children from Camp-Resort, in the event permission has not been given or for other good cause. For this agreement's purposes, a dependent child is defined as your child 18 years of age or younger, unless they are a full-time student, and then it is 21.
Gate Codes: One (1) gate code allowing entry to Camp-Resort will be issued for each agreement executed.
Extended Stay Camper acknowledges and accepts that Camp-Resort is private property and that ingress and egress from the Camp-Resort are at the option of Camp-Resort Management. Any Extended Stay Camper found to be conveying the gate entry code and/or bringing in unregistered guests shall be found to violate this Extended Stay Camper Site Agreement and will be cause for immediate termination of the same. Motor Vehicles: An Extended Stay Camping Family shall be allowed to have up to two (2) motor vehicles on the Camp-Resort property at one time. An Extended Stay Camper must request permission from the Camp-Resort to bring more than two (2) motor vehicle(s) onto the Camp-Resort property. The Camp-Resort reserves the right to charge a fee for each vehicle more than the first two (2). Suppose permission is granted for an additional vehicle to be brought onto the property of the Camp-Resort. In that case, each vehicle shall be registered at the front gate immediately upon arrival at the Camp-Resort.

Guests & Day Visitors: Guests of an Extended Stay Camper staying overnight at Camp-Resort must register immediately upon arrival and be charged $35.00 per night per person. If staying just for the day, the charge is $25.00 per day per person.  Day visitors must register immediately upon arrival and either utilize a visitor pass supplied by the Extended Stay Camper or pay the current day-use fee. Visitors staying overnight must re-register the next day and pay the overnight camping fee. Failure to re-register on subsequent days may result in a visitor being asked to leave Camp-Resort.

Pets: Pet owners agree to clean up after their pets and keep said pets under control from excessive barking and/or bothering other campers. In the event complaints are registered with the Camp-Resort Management, after notification to the pet owners, the Camp-Resort Management or its representatives may ban the pet from the property. Portable Fencing is not allowed in the campground. Portable fencing cannot enclose an RV site Patio.

Electricity: Each campsite is supplied with an electric meter owned by the Camp-Resort. Monthly bills will be emailed to the Extended Stay Camper by the Camp-Resort. They will reflect the actual cost of the electrical service as provided to the Camp-Resort by the local power company. All bills are due in full as specified in the monthly statement. There shall be a late fee of Twenty-Five Dollars ($25.00) for all payments not received in full within five (5) days of being due. In the event an Extended Stay Camper requires electrical upgrading, it shall be performed by the Camp-Resort, and any costs incurred in equipment and/or labor will be paid by the Extended Stay Camper requesting same. All equipment becomes the property of the Camp-Resort. Camp-Resort Management reserves the right to terminate electrical service due to non-payment.
It is strongly recommended that guests purchase and use a surge protector prior to plugging into the power pedestal. In the event of a power surge, Great Escapes Bryan / College Station RV Resorts, LLC will not be held responsible for damages. Guest Initials________________

Conformity with Codes: All camping units shall be kept in conformity with all national, state, electrical, plumbing, and health codes/standards. Any camping units that are not properly maintained may be subject to inspection and not allowed on an extended stay site.
Site Construction: Any changes to your site must be pre-approved by management. Alterations done to the Extended Stay Camper’s site become property of Great Escapes RV Resorts, LLC and cannot be removed without permission from management.
 

Decks: Decks, casitas and screen houses are not allowed. Permanent fixtures are prohibited on all RV sites.

Sheds: Are not allowed.
 

Fires: All fires must be of reasonable size to not endanger anyone or anything and be extinguished when unattended. You must follow any requirements of an active burn ban issues by any local/state agencies or by management.
 

Firewood: You MUST only use firewood purchased from our Camp Store. Stored firewood must not be excessive or unsightly or you will be asked to remove it.
 

Storage: All storage must be maintained so as not to distract from the view of neighbors. No storage will be allowed on the off-door side of the camping unit. Additional storage of any boats, trailers, campers, or other items is prohibited. Camp-Resort management reserves the right to remove the above items to the storage area and assumes no liability for any damage incurred. Further, Extended Stay Camper agrees to pay removal and storage costs.
 

Permanent Improvements: Permanent improvements such as trees, shrubs, flag poles, or other similar items must first be approved by Camp-Resort Management before their installation and become the property of the Camp-Resort when the Extended Stay Camper Site Agreement is terminated.

Site Condition: Site condition is the sole responsibility of the Extended Stay Camper. Extended Stay Camper shall maintain said site in a clean and orderly fashion and maintain all camping equipment. Sites are not to be used for vehicle repair (including oil changes), construction, auto mechanics or remodels of vehicles or trailers. Clotheslines, refrigerators/freezers are not allowed on sites.
Portable Fencing is not allowed in the campground. Portable fencing cannot enclose an RV site Patio.


*****All sites must have a sewer-tight connection by either utilizing a rubber donut or plastic L-Connection on your sewer hose. ****
 

1. Moving: Moving on the Camp-Resort will only be allowed with the exclusive permission of Camp-Resort General Manager or Assistant General Manager and will be subject to the terms and conditions determined by Camp-Resort Management at that time. It shall be, and remains, the exclusive right of Camp-Resort Management to determine site assignments. Any cost incurred by the Camp-Resort in moving a camping unit will be billed to the Extended Stay Camper requesting same, at a rate of Forty Dollars ($40.00) per person-hour. Additional charges for Camp-Resort power equipment will be agreed to at the time arrangements are made.
 

Motorized Vehicle Policy:  Only state-licensed motorized vehicles are permitted in the resort. The use of Golf Carts, ATVS/UTVS, NEVS, Go Karts, motorized scooters, motorized bicycles, mini-bikes, utility vehicles, slingshot trikes, dune buggies etc., are generally not allowed. Low speed gas or battery powered vehicles (maximum of 15 mph from the factory) such as Segways and hoverboards, etc., are allowed if they meet the proper requirements. Management reserves the right to restrict any non-state licensed motorized vehicle for any reason at any time. Allowable motorized vehicles (gas or battery powered) can only be operated by a licensed driver and cannot be operated after dusk. Drivers of low speed gas or battery powered vehicles must obey the same traffic laws that apply to operators of motor vehicles and golf carts, including obeying the speed limit of 9 ½ mph, obeying traffic signs and signals, traveling in the same direction as the rest of the traffic, signaling turns, and yielding the right-of way. Off-roading is strictly prohibited. All street legal vehicles must be operated by a licensed driver. No permit drivers and no unlicensed drivers are allowed to operate a street legal vehicle on Camp-Resort property.
Personal mobility devices used by persons with disabilities are allowed.
This policy does not apply to children’s “toys” that are low-speed gas or battery powered such as low-speed hover-boards, electric scooters, and power wheels, but close attention must be paid to all other vehicle traffic. Parents are urged to teach their children safe operating practices and must always monitor their children’s activities. Use of low-speed motorized toys is strictly prohibited after dusk.

WI-FI: (COMING SOON) You agree that the service may only be used for lawful purposes. Wi-Fi is provided as-is, and speeds may vary.

Taxation: If any governmental regulatory body places taxation of any type upon a camping unit, it shall immediately become the responsibility of the owner of the camping unit to pay such fees and, further, to provide the Camp-Resort with proof of payment.
Extended Stay Camper acknowledges that this agreement is in full force and effect for the term in this agreement and accepts the obligation to pay, in total, all monetary debts for said term.

Termination: Extended Stay Camper shall have the right to terminate this agreement by written notice to Camp-Resort Management. Within ten (10) days of receipt of written notice of the same to Camp-Resort Management, Extended Stay Camper shall remove all personal property, including the camping unit. Said termination does not release the financial obligation of the Extended Stay Camper as specified in this agreement. In consideration of said written notice, Camp-Resort Management shall attempt to re-rent the site upon removal of the camping unit and, if successful, will pro-rate the remainder of this agreement. All fees incurred under this agreement must be paid in full before the removal of the camping unit.
If an Extended Stay Camper removes his camping unit from the Camp-Resort without proper written notice to Camp-Resort Management, the terms and conditions of this agreement shall remain in full force and effect for the duration of the agreement. Camp-Resort Management shall have the right, after ten (10) days of removing the camping unit, to declare the site abandoned, take ownership of all property remaining on the site, and rent the site to another camper. In the event there is a default under this paragraph by Extended Stay Camper, said Extended Stay Camper shall pay on demand the reasonable attorney's fees incurred by Camp-Resort because of such default.
Camp-Resort Management reserves the right to cancel or amend this agreement. If Camp-Resort Management terminates this agreement, Extended Stay Camper will remove all their personal property from the Camp-Resort within ten (10) days of the date written notice is mailed or emailed to Extended Stay Camper. If the property is not removed because of termination, expiration or abandonment, or non-payment of fees, the Camp-Resort shall have the right to remove said personal property and camping unit from the site and place the same in a storage area. The Camp-Resort shall charge fees for such removal at the rate of Forty Dollars ($40.00) per person per hour. The Camp-Resort shall charge storage fees in an amount equal to the current daily camping fee for a primitive campsite. The Camp-Resort shall not be held liable for any damage incurred in moving said camping unit or personal property, nor for its safekeeping. Any item left in storage sixty (60) days beyond this agreement's expiration date or from the date of notice of termination mailed to Extended Stay Camper shall be offered for public sale without further notice.

Liability: Extended Stay Camper agrees to carry liability and comprehensive insurance on the site to protect against theft, pilferage, fire, windstorm, water damage, hail, tornado, vandalism, and other acts of nature or man. The Camp-Resort cannot, and will not, be held responsible for the loss of any kind. It is mutually understood that the Extended Stay Camper hereby releases Camp-Resort from all liability.
By entering the premises, I consent and authorize the camp-resort and anyone else it may authorize to film, tape, photograph, or otherwise record me and to use the photographs and/or motion pictures and video taken of me, including my name, likeness, and voice, as well as any testimonial statements made by myself, and all other aspects of my personality ("Publicity Items"), and any reproduction of them in any form, to publicize, promote and to advertise Camp-Resort's activities in any media now known or later developed, in perpetuity and throughout the world, without further compensation to me.

I further agree to release and hold harmless Camp-Resort, its representatives, affiliates, subsidiaries, agents, officers, directors, employees, successors and assigns, from any and all claims, demands, losses, costs, expenses or damages, including without limitation reasonable attorney's fees, which may arise out of or in connection with any claim by me or alleged to be on my behalf resulting from the use of the Publicity Items, the use of which I now knowingly and voluntarily grant to Camp-Resort, and the full ownership rights of which I now knowingly and voluntarily grant and assign to Camp-Resort.

Further, I acknowledge and agree that I assume all risks and dangers incidental to the activity of camping in a rustic outdoors environment located on the Premises including, without limitation, the danger of being injured by insects or other animals, of being injured while participating in recreational activities, such as hiking swimming or boating on the Premises or of being injured as a result of inclement weather conditions ("Risks"). I agree to release and hold harmless Camp-Resort, its representatives, affiliates, subsidiaries, agents, officers, directors, employees, successors and assigns, from all claims, demands, losses, costs, expenses, or damages, including without limitation reasonable attorney's fees, which may arise out of or in connection my undertaking of these Risks. Without limiting the preceding generality, I expressly acknowledge that Camp-Resort is not liable for injuries or property damages resulting from such Risks.

In the event of a medical emergency and/or accident, permission is herein granted for the term of this Extended Stay Camper Site Agreement to allow for emergency medical treatment of the undersigned and/or our children, as listed above. Said permission includes permission to treat for injuries and/or call for emergency services, transport the injured person(s) to a hospital, and allow for the emergency room of the said hospital to administer such treatment as it determines necessary. In consideration of the foregoing, I (we) hold harmless from any litigation and/or cost involved, Great Escapes RV Resorts L.L.C., d/b/a Bryan / College Station RV Resort, its owners, affiliates, members, stockholders, employees, and agents; and any other person(s), Fire and/or Ambulance Services; Emergency Medical Technicians or hospital personnel who may render assistance.

The entirety of Agreement:  Extended Stay Camper agrees to be bound by all the provisions stated in this agreement, including full payment of all indebtedness for rent, goods, or services provided by Camp-Resort Management. This agreement represents the entire agreement of the parties.

Time of the Essence: The time for the performance of the parties' obligations is of the essence of this agreement.

Entirety of Agreement: This Contract contains the entire agreement between the Camp-Resort and Extended Stay Camper. No other representations, warranties, promises or agreements have been made by either of the parties except as set forth herein. The parties expressly intend that all prior discussions, agreements, statements, promises, understandings, and representations by and between the parties, their agents, and employees are superseded by this agreement and merged herein and, unless outlined in writing in this agreement, all such prior discussions, agreements, statements, promises, understandings, and representations shall be unenforceable and of no force and effect. No modification, waiver, or amendment of this agreement's provisions shall be effective unless made in writing and signed by the parties hereto.
Failure to follow campground rules will result in termination of this agreement and expulsion from the property within 24 hours of written notice. Guest Initials__________________

Great Escapes RV Park in Bryan / College Station reserves the right to change these guidelines at any time and reserves the right to apply these guidelines at its sole discretion. Guests in violation of park rules more than 3 times will be asked to leave the park.

TERMS & CONDITIONS FOR REGULAR STAYS

Camping has inherent risks associated with outside activities. We are not responsible for injuries or damages occurring as part of the inherent risks of any camping/water park environment. This property is privately owned. The camper accepts camping/water park privileges with the understanding that he or she does hereby release the owner of Great Escapes Bryan/College Station d/b/a Great Escapes Mgmt., LLC, its officers, family members, volunteers, fellow campers and employees of all liability for the loss or damages to property and injury to his/her person arising out of his/her use of its camping/water park facilities and agrees to indemnify the campground, its officers, family members, volunteers, fellow campers and employees, against claims resulting from loss or damage to the property or injury to the person(s) or visitor(s) of any member of the family of the camper, arising out of the use of its camping/water park facilities and activities, games, or events sponsored by Great Escapes Bryan/College Station d/b/a Great Escapes Mgmt., LLC. I agree to pay for any damages to campground property, sites, building, facilities, equipment, or loss of equipment, which may occur due to the actions of myself or my party. I also agree to immediately report any accident, injury or property damage to the manager or staff. If a hazard or dangerous situation exists on the premise, the said camper will notify the management or staff immediately. I also agree to take full responsibility for myself and all the people in my party, including minors and visitors, and will require them to read and comply with all campground/water park POLICIES and GUIDELINES as posted in the office, rentals or on the grounds, as well as the terms and conditions as set forth in this registration form. (POLICIES/GUIDELINES FOR LODGING/CABINS ARE POSTED IN EACH UNIT.)

I HEREBY GIVE PERMISSION TO Great Escapes Bryan/College Station d/b/a Great Escapes Mgmt., LLC, and its affiliates, subsidiaries, licensees to use my name and photographic likeness in all forms and media for the purposes of advertising, promotions, trade and any other lawful purpose.

WIFI Notice: (When Available) Customer’s Use of Great Escapes Bryan/College Station d/b/a Great Escapes Mgmt., LLC Internet Access Network: You agree that the Service may only be used for lawful purposes. Transmission of any material in violation of any federal or state statute or regulation is prohibited. This includes, but is not limited to, copyrighted material, material legally judged to be threatening, indecent or obscene, or material protected by trade secret. You agree not to use the Service, including but not limited to, the modem and power supply for any illegal, abusive, or fraudulent purpose, or to achieve unauthorized access to any computer systems, software, data, or other copyright or patent-protected material. If you do, you acknowledge that you may be referred by Great Escapes Bryan/College Station d/b/a Great Escapes Mgmt., LLC to the appropriate law enforcement agencies. This internet access is not intended to be used for downloading movies, etc. nor can it be used to operate your own business or attend online classes.

PARK POLICIES AND GUIDELINES

CHECK-IN TIME: Cabins- 4:00 PM, Campsites- 1:00 PM CHECK-OUT TIME: Cabin- 11:00 AM, Campsites- 12:00 PM

QUIET HOURS: 11:00 PM – 8:00 AM. Please be courteous of neighbors. Please be at your site/cabin by 11:00 PM.

STATE LAW: All RV’s are required to have an approved sewer ring/donut to prevent spillage and odor.

HANGOUT RULES:  Children under 16 MUST BE Accompanied by an ADULT.  NO PETS inside the Hangout, unless a SERVICE ANIMAL.  Please DO NOT ENTER if WET.  If you use something, please put it back the way you found it or better.  If you use BBQ Grill please clean up after yourself.  The HANGOUT is for EVERYONE'S ENJOYMENT, please be curtious of each other.  NO OUTSIDE EQUIPMENT can be hooked up to the TVs.   

POOL RULES: Swim at your own risk. Lifeguards may not be provided at all Great Escapes Mgmt., LLC parks. All children under the age of 16 must be accompanied by an adult. Please follow the posted pool rules. No Glass containers.

PETS: We welcome pets in campsites and pet-friendly lodging/cabins.  We have many sites that have Doggie Dens on them for our four-legged friends!  Pets should not be left outside unattended, please remember they are in an unfamiliar location to them. Kennels/pens are prohibited. Please do walk your pet on a visible leash no longer than 6 FT. while outside. As a reminder, please scoop your poop and dispose of in trash receptacles. Pets cannot go inside any park owned building or pool area. 

GUESTS: All visitors must stop at the office to register and pay a day-use fee for each person.

SPEED LIMIT is 9-1/2 MPH. Watch for children at play. Pedestrians have the right of way.

VEHICLES: Two vehicles per site (additional vehicles park in designated areas. Please display your car pass always while in the park. Washing vehicles is permitted for a fee, check with the office.

CAMPFIRES are allowed in fire pits only. No hanging of clothes, etc. outside of RV’s or on trees.

GARBAGE: Please use dumpsters located in RV park.

BICYCLES: For the safety of our children, bicycle riding is welcome during daylight hours only. Use of

PERSONAL motorized scooters, four-wheelers, golf carts, and drones are expressly prohibited.

ALCOHOLIC BEVERAGES: When drinking, we ask that you do so responsibly. This is a family-friendly campground, we have a zero-tolerance policy for public intoxication.

SMOKING: Smoking is prohibited in all Campground Buildings, Cabins, playground, or pool/water areas. Please dispose of butts in provided receptacles.

All site changes need to be approved by registration desk. Park management has the right to move vehicles or belongings without notice or liability in an emergency.

REFUNDS ARE NOT GIVEN FOR EARLY DEPARTURE OR FOR THE WHIMS OF MOTHER NATURE.

Management reserves the right to ask anyone to leave the park for breaking policies with NO refund.

THE AGREEMENT, OR AS POSTED IN THE OFFICE, IN RENTALS AND/OR ON THE GROUNDS OR

OTHERWISE STATED BY THE CAMPGROUND MANAGEMENT OR STAFF.

GREAT ESCAPES BRYAN COLLEGE STATION Aquatics and Wibit Waiver

RELEASE OF LIABILITY: In consideration of being allowed to use the facilities and participate in the Wibit Watersport Structure, the Aquatic Facilities and other activities provided by GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION, the Participant and/or the Participant's parent or legal guardian (if the Participant is a minor) do hereby agree as follows:

I, the undersigned Participant, am using GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION equipment and participating in activities including, but not limited to, the Wibit Watersport Structure, aquatic facilities, playground and jumping pillow, at my own risk. I understand and acknowledge that there are inherent risks involved with the Activities, including but not limited to bruises, scrapes, lacerations, burns, sprains, fractured or broken bones, as well as other head/brain, face, neck, back/spine injuries, up to and including drowning and death. I am also aware that using or participating in the Activities requires physical exertion and such exertion on the body may reinjure or aggravate pre-existing physical injuries, conditions, or congenital defects. I voluntarily assume these risks by signing below and participating in the Activities.

IN CONSIDERATION OF THE FEE PAID BY ME, AND IN FULL RECOGNITION OF THE INHERENT RISKS INVOLVED WITH THE ACTIVITIES, WHICH RISKS I VOLUNTARILY ASSUME, I HEREBY INDEMNIFY, HOLD HARMLESS AND RELEASE GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION, ITS MEMBERS, AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, OWNERS AND/OR OPERATORS (COLLECTIVELY, “GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION STAFF”), FROM ALL INJURIES, DAMAGES, CLAIMS, DEMANDS, AND/OR CAUSES OF ACTION (COLLECTIVELY, “CLAIMS”), FOR ANY LOSS, DAMAGE, OR INJURY, INCLUDING DROWNING AND DEATH, WHETHER SUSTAINED BY MYSELF, A MEMBER OF MY FAMILY OR MY PROPERTY HOWEVER CAUSED, INCLUDING, BUT NOT LIMITED TO, FAULT OR NEGLIGENCE (EXCEPT GROSS NEGLIGENCE, WILLFUL/WANTON OR INTENTIONAL CONDUCT, OR ILLEGAL ACTS) BY GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION AND/OR GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION STAFF IN CONNECTION, DIRECTLY OR INDIRECTLY, WITH THE ACTIVITIES. THIS RELEASE SHALL BE BINDING UPON ME, MY HEIRS, EXECUTORS, ADMINISTRATORS, AND/OR ASSIGNS.

I understand and acknowledge that anyone under the age of 16 must be supervised by a parent or guardian (over the age of 18) while participating on the Wibit Watersport Structure.  Parent or guardian is responsible for supervising minor child(ren) and making sure they follow all guidelines set forth by this agreement.

I further agree that I am personally liable and responsible for paying GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION for any and all damage to GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION property that I may cause, whether caused negligently, recklessly or intentionally, while using or participating in the Activities, including, but not limited to, damage to any GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION equipment or other GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION property, any loss of GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION equipment or loss of use of equipment, any claims for diminution in value of any GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION equipment, and/or the cost of repair or replacing any GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION equipment. I authorize GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION, at GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION’S discretion, to bill any such charges or costs directly to my credit card or to my account without further notice to me.

I understand and acknowledge that GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION and the Activities are self-guided, and that I am required to attend a mandatory safety rules video briefing prior to using or participating in any of the Activities. I understand that GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION Staff are available to answer any questions I may have regarding GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION equipment and/or proper use of such equipment. I further understand and acknowledge that I am required to wear a Coast Guard approved lifejacket at all times while using or participating on the Wibit Watersport Structure. If I am unwilling or unable to follow the safety rules or wear a lifejacket while using or participating in the Activities, I understand and acknowledge that GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION, at GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION’s discretion, may immediately restrict my use of or participation in the Activities and/or require me to leave the GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION premises. I acknowledge that once I have completed the safety rules briefing, no refunds will be made for GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION or the Activities.

I also release GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION to use any and all photos taken that of me or my dependent while in GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION area. I understand that these photos will be used in future marketing or may be posted to GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION website. 

This Release shall be governed by the laws of the State of Ohio. I agree that any Claims I may bring against GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION shall be submitted to the jurisdiction of the courts of COUNTY AND STATE and that no Claims against GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION shall be brought in any other jurisdiction. I also agree that if any part of this Release is deemed unenforceable, all remaining parts shall remain in full force and effect. I agree that GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION has made no warranties, expressed or implied, to me beyond those, if any, contained in this Release.

RULES AND REGULATIONS: All persons must follow these rules while at GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION

 • Each guest or an authorized guardian for children under 18 years of age must complete a GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION Release of Liability form before starting the course

• Guests must wear a USCG Personal Flotation Device (Provided) and keep it buckled and zipped at all times while participating on/in Wibits

• Sharp objects (such as jewelry, hair pins, etc.) or other dangerous materials are not permitted

• Tobacco and alcohol are not permitted anywhere in the park or beach areas 

• No refunds will be granted.

• Anyone who appears to be under the influence of drugs or alcohol will not be allowed to participate in the GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION

• Pregnant women are prohibited from going on the GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION Wibit course

• The Host reserves the right to remove anyone who disregards the safety rules. There will be no refunds if such action is required.

• GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION reserves the right to close the GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION without refund at any time due to inclement weather deemed unsafe for guests

• Cell phones are prohibited on Wibit Watersport Structure. Please make appropriate arrangements for these and other personal items before entering the course. The Host may not be held responsible for lost or damaged personal items. Absolutely no one is allowed to dive under Wibit Watersport Structure to retrieve a lost item.

• Failure to abide by posted GREAT ESCAPES RV RESORTS BRYAN COLLEGE STATION rules may result in revoked privileges to participate 

I, THE UNDERSIGNED PARTICIPANT, HAVE READ AND UNDERSTAND THIS RELEASE OF LIABILITY. I UNDERSTAND THAT BY SIGNING THIS RELEASE AND USING OR PARTICIPATING IN THE ACTIVITIES THAT I HAVE WAIVED AND SURRENDERED CERTAIN LEGAL RIGHTS. I HAVE SIGNED THIS AGREEMENT VOLUNTARILY.
