VISITORS ACKNOWLEDGMENT OF RISKS

In consideration of the services of Hidden Treasure Charters, LLC a Wyoming Limited Liability Company, and Gerald Mark and Kimberly L. Garrison, individually it’s officers, agents, employees, and members, managers, and all other persons or entities associated with those businesses (hereafter collectively referred to as “Hidden Treasure”) I (we)agree as follows:

Although Hidden Treasure has taken reasonable steps to warn me of the potential dangers associated with camping so I can enjoy an activity for which I may not be skilled, Hidden Treasure has informed me this activity is not without risk.  Certain risks are inherent in each activity and cannot be eliminated without destroying the unique character of the activity.  These inherent risks are some of the same elements that contribute to the unique character of this activity and can be the cause of loss or damage to my equipment, or accidental injury, illness, or in extreme cases, permanent trauma or death.  Hidden Treasure does not want to frighten me (us) or reduce my (our) enthusiasm for this activity, but believes it is important for me (us) to know in advance what to expect and to be informed of the inherent risks.  The following describes some, but not all, of those risks:

Insect and snake bites and subsequent infection, dehydration, sun burn, infection, cuts, scrapes, bruises, 1st, 2nd, or 3rd degree burns, broken bones, extreme exposure to the elements on or in the water and on land, maiming, hypothermia, brain injuries, dismemberment and drowning.

I am aware that camping in the Horseshoe Bend and/or Trail Creek/Barry’s Landing Campgrounds entail risk of injury or death to any person.  I understand the description of these inherent risks is not complete and that other unknown or unanticipated inherent risks may result in injury or death. I agree to assume and accept full responsibility for the inherent risks identified herein and those inherent risks not specifically identified.  My participation in this activity is purely voluntary; no one is forcing me to participate, and I (we) elect to participate in spite of and with full knowledge of the inherent risks.

I acknowledge that engaging in this activity may require a degree of skill and knowledge different from other activities and that I have responsibilities as a participant.  I acknowledge that the staff of Hidden Treasure has been available to more fully explain to me the nature and physical demands of this activity and the inherent risks, hazards, and dangers associated with this activity. 

I certify that I am fully capable of participating in this activity.  Therefore, I assume and accept full responsibility for myself, including all minor children in my care, custody, and control, for bodily injury, death, or loss of personal property and expenses as a result of those inherent risks and dangers identified herein and those inherent risks and dangers not specifically identified, and as a result of my negligence in participating in this activity.

I understand that the campground rules are posted at the bathroom kiosks in this NRA at Horseshoe Bend and Barry’s Landing Campgrounds, respectively and I agree to follow all said posted rules and regulations posted thereon.  I fully understand that should I violate any such rule or regulation, my camping permit may be revoked and I must vacate the Area.

I have carefully read, clearly understand, and accepted the terms and condition stated herein and acknowledge that this agreement shall be effective and binding upon me, my heirs, assigns, personal representative, and estate and for all members of my family, including minor children.  By booking this campsite as indicated I further agree that there is good and sufficient consideration, in hand paid, to bind me (us) to these terms and conditions.

 

Additional Notes:

All dock slip rentals are final and not subject to a refund of any type.  Unless other arrangements are made, late check in must be made before noon on the following day to settle up all charges for the length of stay.

All campground sites and rentals are subject to our cancellation policy.  If you arrive after 6 p.m. you may lose the reserved site to another user.  If so, you must take another open spot  and check in with the Marina staff before noon the following day to receive another campsite space assignment or indicate which one you are occupying.
