KENTUCKY LAKE GLAMPING LLC. CUSTOMER SITE SERVICE AGREEMENT (AGREEMENT)

Kentucky Lake Glamping LLC. (KLG) is located at 45 Riverside Road, New Concord, KY.  This Agreement is between KLG and the Customer using KLG facilities and incorporates the Rules and Regulations, Indemnification and Waiver of Liability, Cancelation and Refund Policies below.  

RULES AND REGULATIONS

These rules and regulations were established at the resort of Kentucky Lake Glamping LLC, (KLG) to maintain high standards of cleanliness, safety, and maintenance, and to ensure a positive experience for all glampers.  Your compliance is very much appreciated and will ensure a pleasant stay for all guests. Check-in time is 4:00 PM. Check-out time is 10:00 AM.

·         Refunds/Prorating - No prorating or refunds for early departures. No refunds due to uncontrollable acts of nature.

·         Children - Children under age 12 must be accompanied by an adult while in the common areas of KLG.     

·         Visitors - All visitors must check-in at the office and comply with KLG rules/policies. Please be respectful of registered paying guest by limiting your visitors to no more than 4 at a time. No overnight visitors.

·         Common courtesy - Common courtesy shall prevail between all persons at KLG. Respect the privacy of guests. Profane, abusive, harassing, threatening language or actions directed at KLG personnel or other guests is unacceptable and could result in eviction.

·         NO SMOKING in any of our rentals, bathhouse, or camp store. You must be 10 feet away from any entrances when smoking. Thank you

·         Noise control - No generators, fireworks, or loud music. Quiet time 10:00 PM – 8:00 AM.

·         Emergency and safety - No illegal drugs. All weapons shall be kept in compliance with state/federal laws. No discharge or use of firearms on KLG premises. No smoking in or around KLG buildings. Speed limit 10 mph. If you observe any activity you believe to be of concern, please contact the office.

·         Vehicles and site occupancy - Two passenger vehicles per site. Utility/car/boat trailers must be parked in areas dedicated for trailer parking (additional fee required).  No parking on grass, or adjacent/vacant sites. No vehicle repairs or maintenance may be done unless approved by management.  Do not drive vehicles on grass or any areas other than gravel roads and parking spaces.

·         Firepits - Please only use designated firepits, no ground fires on the property. Please, ensure you do not leave the fire unattended for the duration of your stay. All fires must be put out by midnight.  Please keep the height of flames reasonable and manageable such that there is not a threat to nearby facilities or vegetation. 

·         Sites - Cleanliness of KLG is important to everyone. All trash should be bagged and taken to the trash container at your site. Do not leave trash outside of containers at any time.  Outdoor items should be neat and orderly. 

·         No outdoor appliances (i.e. freezer, refrigerators) of any kind. No storage of tires on site. Hazardous materials shall not be disposed of in KLG trash containers and should be discarded properly. Please treat KLG facilities respectfully and leave them in the same condition as you found them.  If they need attention, notify the office.

·         Portable grills – Please use the charcoal grills that are provided on site.

·         Outdoor structures - No sheds, porches, decks, tents, tarps or utility buildings allowed. 

·         Laundry - No clotheslines or hanging laundry outdoors. Do not share your KLG laundry room key with other guests or visitors of KLG.

·         Solicitation/peddling/business enterprise - No peddling, soliciting or business enterprise is allowed at KLG. Signs for the sale of products or services are not allowed.

·         Damages and personal liability - Any guest or visitor that willfully and/or negligently damages or destroys KLG property, landscaping or equipment will be held liable for the value to repair or replace the damaged items and/or property. The responsible party(s) may be evicted for willful and/or negligent damage.

·         Guest property - Guests use KLG facilities at their own risk. Secure your valuables. Management assumes no liability for loss or damage to guest property and/or injury to person, pet, or party arising due to use of resort facilities or caused by others on the premises. KLG is not responsible for loss or damage due to fire, accident, theft, weather or catastrophic events.

·         Right to refuse/evict/deny access – KLG is a privately-owned resort. Management reserves the right to refuse services, evict or deny access to anyone, under any circumstances it deems necessary, in accordance with applicable local, state and federal laws. There will be no

      refunds.

·         Policy changes - Since every contingency cannot be covered in a set of rules, from time to time, modification may be necessary. Management reserves the right to make changes deemed necessary to these rules and regulations at any time, without prior notice.

·         Indigenous animals – KLG has been developed in an area where nature is

prevalent.  As you are enjoying KLG, please be mindful of wild and plant life such as waterfowl, raccoons, snakes, spiders, and poison ivy.  Please be aware of your surroundings and do not provoke or feed any wildlife.

Pet Policy

·       Dogs only. No other pets allowed.

·       There is a $50 flat fee for one pet and a $75 flat fee for two pets. No more than two pets per reservation.

·       Dogs are only allowed in our pet friendly rentals, no exceptions. We appreciate your understanding

·       Dogs must be on a leash at all times. It must be no longer than 6 feet long.

·       Dogs can never be left alone inside your rental, not even in a crate.

·       Please pick up your dogs’ waste.

·       Good behavior is required. Dogs of any breed that are hostile or aggressive will be asked to leave the campground, along with their owners.

·       Remember manners. Constant barking bothers other campers. If your pet is too vocal, you'll need to find other accommodations.

·       Pets are only allowed on the patio at the camp store.

·         NOTE: RATES ARE SUBJECT TO CHANGE WITHOUT NOTICE.  KLG MANAGEMENT ASSUMES NO RESPONSIBILITY FOR ACCIDENTS, INJURIES OR LOSS FROM ANY CAUSE. KLG MAINTAINS A NO REFUND POLICY – SUBJECT TO “SPECIAL CIRCUMSTANCES”.

                 ·         Kentucky Lake Glamping LLC. at Kentucky Lake will not tolerate any onerous, noxious or offensive activity of any sort that could interrupt and / or adversely affect the enjoyment of other parties utilizing our facilities. In the event of such onerous, noxious or offensive activity, in the judgement of management, the parties responsible for such activities will be required to leave the KLC immediately, without a refund.

RELEASE, INDEMNIFICATIONA ND HOLD HARMLESS AGREEMENT

In consideration of participating in campground activities, and for other good and valuable consideration, I hereby agree to release and discharge from liability arising from negligence of KLG and its owners, directors, officers employees, agents, volunteers, participants, and all other persons or entities acting for them (hereinafter collectively referred to as "Releasees"), on behalf of myself and my children, parents, heirs, assigns, personal representative, and estate, and also agree as follows:

1.      I acknowledge that participating in KLG activities involves known and unanticipated risks which could result in physical or emotional injury, paralysis or permanent disability, death, and property damage. Risks include, but are not limited to, broken bones, torn ligaments, or other injuries as a result of falls; burns from campfires; drowning in pools or other bodies of water; falls from play equipment or caused by uneven surfaces; medical conditions resulting from physical activity; and damaged clothing or other property. I understand such risks simply cannot be eliminated, despite the use of safety equipment, without jeopardizing the essential qualities of the activity.

2.      I expressly accept and assume all of the risks inherent in this activity or that might have been caused by the negligence of the Releasees. My participation in this activity is purely voluntary and I elect to participate despite the risks. In addition, if at any time I believe that event conditions are unsafe or that I am unable to participate due to physical or medical conditions, then I will immediately discontinue participation.

3.      I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless releasees from any and all claims, demands, or causes of action which are in any way connected with my participation in this activity, or my use of their equipment or facilities, arising from negligence. This release does not apply to claims arising from intentional conduct. Should Releasees or anyone acting on their behalf be required to incur attorney's fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.

4.      I represent that I have adequate insurance to cover any injury or damage I may suffer or cause while participating in this activity, or else I agree to bear the costs of such injury or damage myself. I further represent that I have no medical or physical condition which could interfere with my safety in this activity, or else I am willing to assume —and bear the costs of — all risks that may be created, directly or indirectly, by any such condition

5.      In the event that I file a lawsuit, I agree to do so solely in the state where Releasees' facility is located, and I further agree that the substantive law of that state shall apply.

6.      I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.

7.      Customer shall indemnify and hold KLG, its’ owners, business associates and/or employees harmless from and against any and all claims, demands, costs and expenses, including reasonable attorney’s fees, arising from any and all damages or injuries caused by fire, water, wind, civil strife, or acts of God, owner and/or Customer actions or inactions (or those of their employees, agents, or invitees), or any other issue related to Customer’s use of facilities, regardless of whether such loss was caused by the negligence of any of KLG, its’ owners’, business associates and/or employees.

CANCELLATION POLICY

KLG values every guest and reservation.  If something changes with your travel plans and you must cancel your reservation(s), you must give us a call. Emails or voice messages will not suffice for a cancellation. We do not give credit or refunds for bad weather; the fun continues rain or shine. Our cancellation policy varies depending on the amount of notice given for the reservation dates. If you would like to change the dates of your reservation, we will be able to do this one time as a courtesy, depending on availability and it must be done 14 days prior to your arrival date. 

REFUND POLICY

For a full refund you must cancel 2 weeks prior to your arrival date, minus a $25.00 administration fee. Canceling after two weeks of your arrival date your full reservation amount will be forfeited.

AFFIRMATION

AS A CUSTOMER OF KENTUCKY LAKE GLAMPING AT KENTUCKY LAKE, I FULLY UNDERSTAND AND ACCEPT THESE RULES AND REGULATIONS, IDEMNIFICATION AND WAIVER OF LIABILITY, CANCELLATION AND REFUND POLICIES AND ANY OTHER ATTACHED GLAMPGROUND RULES.

I also agree to vacate the premises at the request of management if in violation, without a refund.

This agreement does not constitute a landlord / tenant agreement. Payment for sites is entirely

for services rendered UNDER A HOST / GUEST ARRANGEMENT.  By signing this Agreement, you are agreeing to abide by all rules and regulations of KLG.
