Terms of Service

Camping has inherent risks associated with outside activities. We are not responsible for injuries or damages occurring as part of the inherent risks of any camping/water park environment. This property is privately owned. The camper accepts camping/water park privileges with the understanding that he or she does hereby release the owner of Jellystone Park™ Mark Twain Lake  d/b/a Great Escapes Mgmt., LLC, its officers, family members, volunteers, fellow campers, and employees of all liability for the loss or damages to property and injury to his/her person arising out of his/her use of its camping/water park facilities and agrees to indemnify the campground, its officers, family members, volunteers, fellow campers and employees, against claims resulting from loss or damage to the property or injury to the person(s) or visitor(s) of any member of the family of the camper, arising out of the use of its camping/water park facilities and activities, games, or events sponsored by Jellystone Park™ Mark Twain Lake  d/b/a Great Escapes Mgmt., LLC. I agree to pay for any damages to campground property, sites, buildings, facilities, equipment, or loss of equipment, which may occur due to the actions of myself or my party. I also agree to immediately report any accident, injury, or property damage to the manager or staff. If a hazard or dangerous situation exists on the premises, the said camper will notify the management or staff immediately. I also agree to take full responsibility for myself and all the people in my party, including minors and visitors, and will require them to read and comply with all campground/water park POLICIES and GUIDELINES as posted in the office, rentals, or on the grounds, as well as the terms and conditions as set forth in this registration form. (POLICIES/GUIDELINES FOR LODGING/CABINS ARE POSTED IN EACH UNIT.)

I HEREBY GIVE PERMISSION TO Jellystone Park™ Mark Twain Lake d/b/a Great Escapes Mgmt., LLC, and its affiliates, subsidiaries, licensees to use my name and photographic likeness in all forms and media for the purposes of advertising, promotions, trade, and any other lawful purpose.

WIFI Notice: Customer’s Use of Jellystone Park™ Mark Twain Lake d/b/a Great Escapes Mgmt., LLC Internet Access Network: You agree that the Service may only be used for lawful purposes. Transmission of any material in violation of any federal or state statute or regulation is prohibited. This includes, but is not limited to, copyrighted material, material legally judged to be threatening, indecent or obscene, or material protected by trade secret. You agree not to use the Service, including but not limited to, the modem and power supply for any illegal, abusive, or fraudulent purpose, or to achieve unauthorized access to any computer systems, software, data, or other copyright or patent-protected material. If you do, you acknowledge that you may be referred by Jellystone Park™ Mark Twain Lake d/b/a Great Escapes Mgmt., LLC to the appropriate law enforcement agencies. This internet access is not intended to be used for downloading movies, etc. nor can it be used to operate your own business or attend online classes.

RELEASE OF LIABILITY

Aquatics

RELEASE OF LIABILITY: In consideration of being allowed to use the facilities and participate in the Aquatic Facilities and other activities provided by using MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE, the Participant and/or the Participant's parent or legal guardian (if the Participant is a minor) do hereby agree as follows:

I, the undersigned Participant, am using MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE equipment and participating in activities including, but not limited to, aquatic facilities, playground and jumping pillow, at my own risk. I understand and acknowledge that there are inherent risks involved with the Activities, including, but not limited to, bruises, scrapes, lacerations, burns, sprains, fractured or broken bones, as well as other head/brain, face, neck, back/spine injuries, up to and including drowning and death. I am also aware that using or participating in the Activities requires physical exertion and such exertion on the body may reinjure or aggravate pre-existing physical injuries, conditions, or congenital defects. I voluntarily assume these risks by signing below and participating in the Activities.

IN CONSIDERATION OF THE FEE PAID BY ME, AND IN FULL RECOGNITION OF THE INHERENT RISKS INVOLVED WITH THE ACTIVITIES, WHICH RISKS I VOLUNTARILY ASSUME, I HEREBY INDEMNIFY, HOLD HARMLESS AND RELEASE MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE, ITS MEMBERS, AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, OWNERS AND/OR OPERATORS (COLLECTIVELY, “MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE STAFF”), FROM ALL INJURIES, DAMAGES, CLAIMS, DEMANDS, AND/OR CAUSES OF ACTION (COLLECTIVELY, “CLAIMS”), FOR ANY LOSS, DAMAGE, OR INJURY, INCLUDING DROWNING AND DEATH, WHETHER SUSTAINED BY MYSELF, A MEMBER OF MY FAMILY OR MY PROPERTY HOWEVER CAUSED, INCLUDING, BUT NOT LIMITED TO, FAULT OR NEGLIGENCE (EXCEPT GROSS NEGLIGENCE, WILLFUL/WANTON OR INTENTIONAL CONDUCT, OR ILLEGAL ACTS) BY MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE AND/OR MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE STAFF IN CONNECTION, DIRECTLY OR INDIRECTLY, WITH THE ACTIVITIES. THIS RELEASE SHALL BE BINDING UPON ME, MY HEIRS, EXECUTORS, ADMINISTRATORS, AND/OR ASSIGNS.

I understand and acknowledge that anyone under the age of 16 must be supervised by a parent or guardian (over the age of 18) while participating in aquatic facilities.  Parent or guardian is responsible for supervising minor child(ren) and making sure they follow all guidelines set forth by this agreement.

I further agree that I am personally liable and responsible for paying MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE for any and all damage to MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE property that I may cause, whether caused negligently, recklessly or intentionally, while using or participating in the Activities, including, but not limited to, damage to any MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE equipment or other MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE property, any loss of MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE equipment or loss of use of equipment, any claims for diminution in value of any MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE equipment, and/or the cost of repair or replacing any MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE equipment. I authorize MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE, at MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE’S discretion, to bill any such charges or costs directly to my credit card or to my account without further notice to me.

I understand and acknowledge that MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE and the Activities are self-guided, and that I am required to attend a mandatory safety rules video briefing prior to using or participating in any of the Activities. I understand that MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE Staff are available to answer any questions I may have regarding MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE equipment and/or proper use of such equipment. I further understand and acknowledge that I am required to wear a Coast Guard approved lifejacket at all times while using or participating in lake front aquatics activities. If I am unwilling or unable to follow the safety rules or wear a lifejacket while using or participating in the Activities, I understand and acknowledge that MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE, at MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE’s discretion, may immediately restrict my use of or participation in the Activities and/or require me to leave the MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE premises. I acknowledge that once I have completed the safety rules briefing, no refunds will be made for MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE or the Activities.

I also release MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE to use any and all photos taken that of me or my dependent while in MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE area. I understand that these photos will be used in future marketing or may be posted to MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE website. 

This Release shall be governed by the laws of the State of Ohio. I agree that any Claims I may bring against MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE shall be submitted to the jurisdiction of the courts of COUNTY AND STATE and that no Claims against MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE shall be brought in any other jurisdiction. I also agree that if any part of this Release is deemed unenforceable, all remaining parts shall remain in full force and effect. I agree that MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE has made no warranties, expressed or implied, to me beyond those, if any, contained in this Release.

RULES AND REGULATIONS: All persons must follow these rules while at MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE

 • Each guest or an authorized guardian for children under 18 years of age must complete a MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE Release of Liability form before participating in any activities

• Tobacco and alcohol are not permitted anywhere in the park or beach areas 

• No refunds will be granted.

• Anyone who appears to be under the influence of drugs or alcohol will not be allowed to participate in the MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE

• The Host reserves the right to remove anyone who disregards the safety rules. There will be no refunds if such action is required.

• MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE reserves the right to close the MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE without refund at any time due to inclement weather deemed unsafe for guests

• Failure to abide by posted MARK TWAIN LAKE JELLYSTONE PARK AND THE WATER ZONE rules may result in revoked privileges to participate 

I, THE UNDERSIGNED PARTICIPANT, HAVE READ AND UNDERSTAND THIS RELEASE OF LIABILITY. I UNDERSTAND THAT BY SIGNING THIS RELEASE AND USING OR PARTICIPATING IN THE ACTIVITIES THAT I HAVE WAIVED AND SURRENDERED CERTAIN LEGAL RIGHTS. I HAVE SIGNED THIS AGREEMENT VOLUNTARILY.
