Terms of Service

USAGE AGREEMENT AND WAIVER OF LIABLITY FOR NATURE ADVENTURES OUTFITTERS AND THE BISHOP JERDAN CONFERENCE CENTER

PLEASE READ BEFORE YOU AGREE TO TERMS!!

Bishop Jerdan Conference Center/Nature Adventures Outfitters Usage Agreement for Grounds and Facilities.

CHECK IN and CHECK OUT TIMES

Check in time is 12:00 pm for Campsites and 2:00 pm for Cabins, Check out times for all facilities unless otherwise stated is 10:00 am

WATERFRONT and LAKE USAGE

You are no allowed to access/swim in the waterway or lake without express permission.  The dock at the waterfront is accessible at your own risk. Fishing is allowed with a South Carolina fishing license.  Please be aware that alligators may be present in the lake, if you see one please leave it alone and alert a staff member

TRASH AND RECYCLEABLES

There will be Leave No Trace Ethics and usage.  You must put bag all trash and put those bags in the designated trash drop areas upon departure.  Recycling is encouraged, use clear bags, and put in designated recycling container.

WILDLIFE AND NEIGHBORS

This is a natural area with neighbors.  Please respect the area by following our “low noise” policy from 10:00 pm through 7:00 am.  Individual bug spray is allowed, but do not spray chemicals on the grounds without permission

PETS

Pets are allowed onsite if they are on a leash.  Pets are not allowed in the Conference Center buildings without permission.  We have one pet friendly cabin available upon request.

RESTROOM USE

Please utilize restroom facilities.  The Conference Center and Cabins are on a septic system, please only flush toilet paper down toilet and do not pour grease down kitchen sinks.  

PARKING AND DRIVING

There are specific designated roads and paths for vehicles and parking spaces.  Please drive slowly and use parking areas.  If there any damages to grounds that are marked “No Parking” you will be liable.

CAMPFIRES

Campfires are allowed but must be contained within a fire ring.

ALCOHOL

The sale of alcohol on the grounds is prohibited.  No alcohol can be in plain sight.

DRUG USE

Drug use is strictly prohibited.  If you are caught with drugs on property you will be asked to leave immediately without refund.

SMOKING

Smoking is prohibited inside and within 20 feet of any buildings on the property. Please dispose of cigarette butts and trash in the proper receptacles.

PHOTO POSTING

We encourage you to post anything on social media and tag Nature Adventures Outfitters.  However, we are a family friendly site and please do not tag any photos that do not follow those standards.  Also, any photos taken by our staff can be used for our own marketing purposes

CLEANING

We have cleaning lists posted in all buildings, please complete these lists before departure.  If you fail to complete the cleaning a $50 cleaning fee will be accessed per building that has to be cleaned.  Also please make sure the grounds are clean and free of trash before you depart.

COVID-19 POLICIES

For health and safety, we would like you to follow all current COVID-19 guidelines put on by state and local government.  If anyone has tested positive for COVID-19 or have symptoms they are not allowed on the property until they have successfully quarantined for the designated amount of time.  Everyone must have a mask with them at all times.  Masks must be worn inside facilities unless sitting at a table and eating or in a cabin with other family members.  For outdoor events, masks are not required to be worn unless you are within 4 feet of other individuals.  We encourage you to practice social distancing and wash/sanitize hands.

DAMAGES AND LIABLITY

During your stay, Nature Adventures Outfitters or the Reformed Episcopal Church Diocese of the Southeast are not liable for any injuries or damages to personal property.  The person/company in charge of booking will be liable for any of these damages.  The person/company that oversees booking is responsible for any damage to the facilities that are the result of negligence or violation of rules.

Nature Adventures Outfitters/Jay's Nature Tours, LLC Adult (18 and over) Waiver and Release of Liability

In consideration of being allowed to participate in any way in Nature Adventures Outfitters/Jay’s Nature Tours LLC paddling or hiking programs, and related events and activities, the undersigned agrees to the following:

 

  1. Prior to participating, I will inspect the facilities and equipment to be used, and if I believe anything is unsafe, I will immediately advise an instructor, guide or supervisor or other employee of such condition(s) and refuse to participate.
  2. I acknowledge and fully understand that I will be engaging in activities that involve risk of damage to personal property or serious injury, including permanent disability and death, and severe social and economic losses which might result not only from my own actions, inactions or negligence, by the actions, inactions or negligence of others, the rules of play, the condition of the premises, or of any equipment used.  Further, there may be other risks not known or not reasonably foreseeable at this time.
  3. I affirm that I am not under the influence of alcohol or illegal substances and will not use or consume these substances before or during any scheduled paddling or hiking program affiliated with Nature Adventures Outfitters/Jay’s Nature Tours, LLC or its employees or entities.
  4. I assume all foregoing risks and accept personal responsibility for all expenses, medical or otherwise, following any such damages, injury or permanent disability of death.
  5. I release, waive, discharge and covenant not to sue Nature Adventures Outfitters/Jay’s Nature Tours, LLC, its affiliated volunteers, independent contract employees and staff, their respective administrators, directors, agents, coaches, and other employees of the organization, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and leasers of premises used to conduct the event, all of which are hereinafter referred to as “Releasees”, from any and all liability to me, my heirs and next of kin for any and all claims, demands, losses or damages on account of injury, including death or damage to property, caused or alleged to be caused in whole or in part by the negligence of the Releasees or otherwise.
  6. This waiver may not be modified in any way.  If any part of this waiver is determined to be invalid by law, all other parts of this waiver shall remain valid and enforceable. 
  7. If renting equipment, I will be financially responsible for all damages incurred while in my possession, including replacement cost of equipment deemed necessary by Nature Adventures employees. 
  8. I also grant Nature Adventures Outfitters/Jay’s Nature Tours, LLC the unrestricted permission to use and publish photographs or video images of me, or in which I may be included, for any purpose authorized by , including but not limited to: website use, editorial publications, social media, catalog and advertising use. 

I HAVE READ THE ABOVE WAIVER AND RELEASE, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY AGREEING TO IT. BY AGREEING TO THIS I AGREE FOR EVERY ADULT IN MY PARTY.

 

Nature Adventures Outfitters/Jay's Nature Tours, LLC Minor (under 18) Release of Liability Parent/Gaurdian Permission Form

I hereby grant permission for my child to participate in kayaking, canoeing, hiking or camping with Nature Adventures Outfitters/Jays Nature Tours, LLC  and hereby agree as follows:

I fully understand and acknowledge that; (a) risks and dangers exist in my child’s use of kayaking, canoeing, hiking or camping equipment and my child’s participation in kayaking, canoeing or hiking or Day or Overnight Camp activities; (b) my child’s participation in such activities and/or use of such equipment may result in injury or illness or death or damage to personal property; (c) these risks and dangers may be caused by other participants, or by accidents, or by the forces of nature or other causes.  Risks and dangers may arise from foreseeable or unforeseeable causes including, but not limited to, selection of trail or river route, water level, weather conditions, risks of falling out of a kayak or canoe or off of a trail, and such other risks, hazards and dangers that are integral to recreational activities that take place in a wilderness, outdoor or recreational environment; and (d) I hereby accept and assume these risks and dangers.  These risks may also include wasp and or bee stings or cuts from oyster beds or boat ramps.  If my child is allergic to wasps or bees, I will provide instructions, provisions and permission to treat my child should this exposure occur to Nature Adventure Outfitters/Jay’s Nature Tours, LLC prior to the trip departure date. I also understand that any medical expenses beyond basic first aid given by Nature Adventures Outfitters/Jay’s Nature Tours, LLC will be my responsibility.   I also grant Nature Adventures Outfitters/Jay’s Nature Tours, LLC the unrestricted permission to use and publish photographs or video images of me, or in which I may be included, for any purpose authorized by , including but not limited to: website use, editorial publications, social media, catalog and advertising use. 

I have been advised that my child must wear an approved personal floatation device at all times while on the water.  I affirm that my child will not be under the influence of alcohol or controlled substance, and will not carry, use or consume these substances before or during her/his schedule activities.  Any claims or dispute arising from my child’s participation in Nature Adventures Outfitters/Jay’s Nature Tours, LLC. activities or use of Nature Adventures Outfitters/Jay’s Nature Tours, LLC. equipment shall be venued in the Charleston County Supreme Court of the State of South Carolina.  My child is in good health and is at or above the minimum age stated in Nature Adventures Outfitters/Jay’s Nature Tours, LLC. advertising for each activity in which he/she will participate.  I understand that strenuous physical exertion may be required and my child has no known physical disabilities or health problems, which will present any risk to her/his participation in the activities.  I release and agree to indemnify and hold harmless the Releasees from any and all liabilities incident to my minor child’s involvement or participation in these programs as provided above, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, to the fullest extent permitted by law.  The above agreement shall be binding on my heirs, successors, assigns, administrators and executors.

I HAVE READ THE ABOVE AND AGREE.  IT IS MY INTENTION TO GRANT PERMISSION FOR MY CHILD/CHILDREN TO PARTICIPATE IN NATURE ADVENTURES OUTFITTERS, INC. KAYAKING, CANOEING, HIKING OR CAMPING ACTIVITIES AND TO ASSUME AND ACCEPT ALL RISKS ASSOCIATED THEREWITH.
