Terms of Service


1. Guests are responsible for any damage or injury caused by themselves and/or their children.

2. All guests assume any and all risks associated with the foregoing and agree to hold Smoky Hollow, LLC, harmless from and indemnify us against the same.

3. The resort is not responsible for personal injuries or damage, loss or theft of any personal property or vehicle.

4. We reserve the right to evict any person(s) who does not comply with the rules and policies.

5. All guests and visitors must register in the office upon arrival.  There's a $10 parking fee for daily visitors and they will receive a parking pass. Visitors may not bring pets. Smoky Hollow reserves the right to limit the number of people visiting a site. Day visitors must depart by 10:00 pm EST. Please check with the office before inviting any visitors. Registered guests are responsible for ensuring their visitors are properly registered and that all campground rules are followed. Guest Vehicle Pass must be visible at all times please.

6. Smoky Hollow does not allow the delivery of mail or packages to any guests.  Guests must make arrangements to have their mail or packages delivered to a third-party location for pickup.

7. We reserve the right to refuse access to any guests whose vehicle is deemed to be unacceptable.

8. No tents are to be erected on our property.

9. Total number of guests in any space or rental unit cannot exceed the maximum capacity for that site.

10.Maximum of 6 people total at a site at any given time.

11.No overnight parking or storage of trailers, boats, jet skis or utility trailers are allowed on site.

12.Charcoal grills, deep fryers and tiki torches are PROHIBITED.

13.Blowup mattresses, sleeping bags and cots are not allowed outside.

14.Maintenance on vehicles on property is not allowed.

15.Washing vehicles on property is not allowed.

16.The use of any paint products or chemicals is prohibited.

17.Clotheslines are not allowed.

18.Guests may not hang any items from the trees.

19.All sites are to be kept neat and clean for the duration of your stay.

20.Only 1 vehicle is allowed per reservation unless stated otherwise. Each paid guest registration covers 1 vehicle. Please park in the gravel parking lot and do not park on our grass.

21.Trash cans are located throughout the park. Please tie trash bags completely closed and put your trash completely in the trash container. If the first can is full, please find another container. Please do not place your trash on the ground. Do not put loose trash in the cans. Please put it in a bagged can or bag it yourself. Wild animals of all kinds are around and are attracted to left out or disposed of food and while we think they are cute and wonderful animals, we don’t want you to find a surprise visiting racoon or bear at your site because of incorrectly disposed of trash! Do not dispose of wires, oil, furniture, mattresses, or any toxic waste or chemicals in our trash cans. Trash is emptied once per day. Times may vary due to maintenance scheduling requirements throughout the day.

22.Vehicles, Boats, boat trailers, cargo trailers or car dollies are not allowed on property. All vehicles must remain in the parking lot by Gists Creek Rd.

23.Drones or other remote controlled machines may not be used at any time on the property.

24.Smoky Hollow is in a natural wildlife habitat area.  There are coyotes, fox, black bear, bobcats, birds of prey and reptiles.  All guests should ensure small children are supervised at all times and do not leave food outside.

Late Check-Out Policy:

I understand and agree as follows:

  • At departure, the rental unit is to be left in a reasonably clean condition (broom swept), garbage is to be removed from the rental unit and placed in an outside trash can, all kitchens and kitchenettes are to be left clean, all dishes are to be washed and put away, and the microwave, fridge, stove and countertops are to be wiped clean; otherwise, Smoky Hollow Management may charge my credit card with a $125 cleaning fee.  I understand and agree that if I leave the rental unit in an unreasonably filthy condition, permit a pet to occupy a rental unit not designated as pet-friendly or smoke in a rental unit, Smoky Hollow Management may charge my credit card for the cost to professionally clean the rental unit ($250 minimum charge).
  • All damages to the rental unit, whether caused by myself, my children, guests or pets, will be disclosed to the registration office immediately or at checkout. All damages occurring to the rental unit during my stay will be charged to my credit card after a thorough inspection has been made by Smoky Hollow Management. Damages for which I will be responsible include, but are not limited to: lost key(s), broken/lost TV/DVD/AC remote controls, broken items, discharged fire extinguishers (if not used for a fire), damaged/dented/bent appliances, furniture, cabinetry or dishes, writing on walls, canvas or bedding, and ripped or torn mattresses or covers.

The front desk may be able to arrange a late checkout, if available. Additional fees may apply. In order to ensure availability for incoming guests, please plan prompt departures.


1. The use of Firearms of any kind is PROHIBITED in the Resort.

2. The use of archery, paintball, slingshots or air guns is PROHIBITED.

3. Fireworks of any kind are PROHIBITED.

4. Use of illegal drugs is PROHIBITED.

5. Obnoxious behavior of ANY kind is PROHIBITED.

6. Guests must be on foot or in a golf cart while going through the Resort.

7. Children under 16 must be always supervised by an adult. Riding bicycles is prohibited for the safety of your children and our incoming guests. The community center and game room close at 10pm. 

8. All vehicles must park in designated parking lot at the corner of Gists Creek Rd and Gists Creek Cemetery Rd. Please do not park or drive anywhere else on the property unless in one of our rented golf carts. If you choose not to rent a cart you must walk.  Driving a vehicle on the walking/golf cart paths will result in eviction from the resort. Do not block roadways with your golf cart.

9.Only persons with a valid driver’s license and insurance may rent and operate a golf cart in the Resort. Smoky Hollow Golf Carts are to be driven only in our resort.  They are not street legal and should never leave the resort. They may be driven on the gravel golf cart paths. Do not drive them on the grass. They may be parked at your site and at the community center / bath houses. They are to be used to go to your site, parking lot, office/store and community center and bathrooms.

10.Vandalism of any kind by anyone in your group (regardless of age) may result in eviction from the resort and a minimum fine of $250.



1. Management is not responsible for lost, stolen, or damaged articles.  Keep your valuables locked up.

2. Report any problems with your site to the Main Office immediately.

3. We adhere to and maintain all state, county, and local laws on property.

4. If you need to call 911 for any reason, and time allows, please call the office at 865-446-2043 so the maintenance staff can be prepared to escort the emergency personnel to your site.


Quiet Hours:

1.  Quiet hours are from 10:00 PM to 8:00 AM.

2.  Please be courteous to other guests around you.

3.  Loud music or objectionable noise is not allowed at any time.

4.  Inconsiderate guests will be evicted from resort.

5.  Profanity or violence towards other guests or Resort staff will result in immediate eviction from resort.

6.  Guests violating rules that results in eviction notice will not receive any refunds for their stay.


Pet Policy:

1. No pets are allowed on property.

2. A service animal must be registered at the Front Desk upon arrival. It must be with their owner at all times and never left unattended. You must clean up after it and it must be on a leash at all times. The Resort does not allow ESA's.

3. Resort is not responsible for and will hold accountable the service animal’s owner for any injury or damage caused by the animal.


I HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE Smoky Hollow LLC, its owners and agents (collectively, Smoky Hollow Management), from any and all liability to me, my children, my invitees/guests, personal representatives, and heirs for any loss or damage on account of injury to person (including death) or loss or damage to property relating to, or arising out of, use and occupancy of the Smoky Hollow Outdoor Resort property, facilities, golf carts, amenities, games (collectively, the Premises) and any dangers and hazards associated with acts of nature such as changing weather conditions; high winds; thunder and lightning; temperature fluctuations; falling trees; tree limbs, ice; or encounters with wildlife.

I HEREBY AGREE TO INDEMNIFY, SAVE AND HOLD HARMLESS Smoky Hollow Management, and each of them, from any loss, liability, damage or cost (including attorney fees) they may incur due to injury (including death), damage or loss of property relating to use of the Premises by me, my children, and/or my invitees/guests or due to any incidents that may occur during my stay. I understand that, although Smoky Hollow Resort Management makes every reasonable effort to provide a secure environment, the security of my person, my belongings, and all persons registered in my party is my sole responsibility.

As a courtesy, our employees, if so requested and available, may assist with directing you to your designated campsite. It is your sole responsibility to ensure that the site will accommodate your specific needs and that you will not cut any branches, bollards, trees, etc. around your campsite. You agree to indemnify and hold Smoky Hollow, LLC, its owners and agents (collectively, “Smoky Hollow Resort Management”) harmless from any loss, liability, damage or cost (including attorney’s fees) that may result from an employee assisting or directing you onto a campsite. Furthermore, you release, waive, discharge and covenant not to sue Smoky Hollow Outdoor Resort Management for any and all liability, loss, or property damage relating to an employee assisting/directing you to your site.

I understand that I am and remain personally liable to pay the total amount of my reservation prior to my scheduled check-in date.  If I fail to pay the total due, I agree that Smoky Hollow, LLC may charge any remaining balance (in additional to any damage charges or other amounts owed under these Terms and Conditions) to any credit or debit card on file with my reservation. Any amounts due after 30 days will be subject to the maximum late charge permitted under state law.

The Premises are privately owned and THE SMOKY HOLLOW MANAGEMENT RESERVES THE RIGHT TO REFUSE SERVICE to anyone for any reason except for those prohibited by law. Smoky Hollow Management reserves the right to require any person or party it deems necessary, to leave the campground based on violations of Resort Rules or behavior management deems inappropriate or disturbing to others. Harassment or mistreatment of our staff or other guests, including but not limited to, racist comments or hate speech, will not be tolerated under any circumstances. I have read this notice and agree to it as well as all Smoky Hollow Rules and regulations. In addition, I understand that I am responsible for the actions of all persons registered in my party, including any children, and any guests that visit during my stay. On behalf of each person in my party, I grant Smoky Hollow and its affiliated entities and promotional partners the right to include any photographic, video and other visual portrayals of each person in my party in any medium and for any purpose.
