TERMS & CONDITIONS

I agree, and shall cause all members of my party, invitees and guests, to abide by the Rules & Guidelines published and available from the office, whereas a Snapshot of those published Rules & Guidelines are stated in our Service Guide, and any additional Rules posted throughout the Park, or otherwise communicated in any manner by Sonoran Desert RV Park employees.

I further understand and agree that the Sonoran Desert RV Park does not give credit or refunds due to the discomforts of nature. The Sonoran Desert RV Park refund policy varies, depending on the timing of the cancellation notice in advance of the reservation date, as follows:

Daily/Weekly: We require 48 hours or more notice before check-in date. Please let us know by 1pm two days before your arrival date. We will refund your depost less a $10 cancellation fee. If you cancel within 48 hours of your arrival date, the entire deposit becomes non-refundable.

Monthly Reservations: We require 2-months or more notice before your check-in date for a cancellation fee of $10. Within 2-months of arrival the one-month deposit becomes non-refundable.

As a participant in a recreation activity, I am responsible for acting within the limits of my ability and heeding all warnings regarding participation in the activity. I will maintain control of myself and any equipment while participating in the activity and will refrain from acting in any manner that may cause or contribute to injury to myself or to others.

I HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE North 78 RV Ventures, LLC dba Sonoran Desert RV Park, its owners and agents, from any and all liability to me, my children, my invitees/guests, significant other, personal representatives, and heirs for any loss or damage on account of injury to person (including death) or loss or damage to property relating to, or arising out of, use and occupancy of the Sonoran Desert RV Park property, facilities, amenities, pools, and any dangers and hazards associated with acts of nature such as changing weather conditions; high winds; thunder and lightning; monsoons; extreme heat; temperature fluctuations; falling trees; tree limbs, or encounters with wildlife such as venomous snakes and insects.

I HEREBY AGREE TO INDEMNIFY, SAVE AND HOLD HARMLESS North 78 RV Ventures, LLC dba Sonoran Desert RV Park, and each of them, from any loss, liability, damage or cost (including attorney fees) they may incur due to injury (including death), damage or loss of property relating to use of the Premises by me, significant other, my children, and/or my invitees/guests or due to any incidents that may occur during my stay. I understand that, although North 78 RV Ventures, LLC dba Sonoran Desert RV Park makes every reasonable effort to provide a secure environment, the security of my person, my belongings, and all persons registered in my party is my sole responsibility.

As a courtesy, our employees, if so requested, may assist with directing you to your designated RV Site. It is your sole responsibility to ensure that the site will accommodate your specific trailer/RV and that you will not hit any branches, bollards, trees, obstacles, etc. when positioning your RV on the campsite. You agree to indemnify and hold North 78 RV Ventures, LLC dba Sonoran Desert RV Park, its owners and agents (collectively, “Park Management”) harmless from any loss, liability, damage or cost (including attorney’s fees) that may result from an employee assisting or directing you onto a Site. Furthermore, you release, waive, discharge and covenant not to sue Park Management for any and all liability, loss, or property damage relating to an employee assisting/directing you to your site.

FIREARMS may not be worn in the park or openly displayed at any time except by sworn law enforcement personnel. Please ask our office for our Firearms Addendum for further information.

This property is privately owned and is on private property and has the right to evict or eject without notice any objectionable person(s) who may cause a disturbance or become a nuisance. The Sonoran Desert RV Park reserves the right to refuse service to anyone at anytime

DOGS:

I hereby agree to the following regulations and conditions relating to my dog while camping at North 78 RV Ventures, LLC dba Sonoran Desert RV Park (“Park”) with my dog.

Vaccinations. I represent and warrant that my dog is up to date on all vaccinations (including rabies and distemper), and Bordetella if using public dog park.
Assumption of Risk and Release. I understand that my permission to have my dog at the RV Park with me is a privilege and not a contractual right. Such permission is expressly conditional upon my adherence to the terms of these rules and other rules in effect at any given time. I understand that the RV Park may revoke such permission at any time for any reason. Additionally, I hereby assume all responsibility of risks, injury, damage, other harm that may occur while my dog is at the RV Park or caused by my dog. Further, I hereby knowingly and voluntarily expressly release and discharge the RV Park, its owner, its agents, its parent companies, members, managers, directors, officers and employees (“Released Parties”) from any and all claims, damages, liabilities, injuries, demands, or causes of action, both present and future, whether known, unknown, anticipated or unanticipated, that me or my guests or invitees may have against any of the Released Parties arising out of or incident to my dog’s presence in the RV Park, whether arising from any act or omission, whether negligent or otherwise, of me, my dog and/or any guest or invitee. I further agree to indemnify each of the Released Parties for any and all such claims, damages, liabilities, injuries, demands, or causes of action, including costs, expenses, and attorney’s fees arising as a result of or related to the presence of the dog at the RV Park. This provision shall be enforceable to the fullest extent of the law.

In light of the global pandemic associated with COVID-19, everyone shares in the obligation to observe certain requirements and guidelines to help keep themselves and others safe within our shared community. In particular, I represent that I have not tested positive for COVID-19 within the last two weeks and I have not been in direct personal contact with someone who has tested positive for COVID-19 within the last two weeks either. If I do test positive for COVID-19 or come into contact with someone who has, or if my temperature exceeds 100 degrees Fahrenheit and I experience other COVID-19-related symptoms, I agree that I will not seek to enter the RV Park until I am no longer symptomatic for three straight days, unless I am a monthly guests, I will not enter any public area and agree to stay at my assigned site. I agree to observe the safety requirements within the RV Park -- including wearing a personal mask when required, and observing required routes of circulation, occupancy limitations, social distancing and sanitization requirements.

The Sonoran Desert RV Park has enhanced our health and safety measures due to the COVID-19 pandemic in order to assist in protecting our guests and staff. Precautionary measures are taken in cleaning and disinfecting our facilities, however, there is always a risk of exposure to this highly contagious virus in any public place where people gather. The Sonoran Desert RV Park cannot guarantee the absence of COVID-19. You must follow all posted rules and guidelines concerning COVID-19 while a guest at our park. It is mandatory to wear a mask in all public areas where social distancing is not available (i.i. Laundry Room).

By entering the Sonoran Desert RV Park, you voluntarily assume all risks of exposure to the COVID-19 virus.

We reserve the right to restrict, limit, or close, any public areas or activities that the Federal, State, County, Local, or the park deem necessary in order to comply with such regulations or policies. By entering the Sonoran Desert RV Park, you are voluntarily assuming all risks of exposure to COVID-19.
