Spacious Skies Campgrounds Rules and Regulations

Welcome to Spacious Skies Country Oaks! We are so happy to have you here and look forward to hosting you. To help make all our campers as happy as possible, we ask that you please observe the following rules: 

GENERAL INFO: 

All guests and visitors must check-in at the main office upon arrival, and all guests must agree to and sign a copy of these terms & conditions (e-signature is encouraged in advance of arrival).  

CHECK-IN: 

2pm for RV/Tent 

3pm for Cabins/Lodging

**Early check-in is not guaranteed. If you arrive before check-in time and early check-in is available, your account is subject to an early check-in fee of $25

Early check-in is prohibited at Spacious Skies Bear Den (Spruce Pine, NC) due to Blue Ridge Parkway activity.

If arriving after office hours, please call ahead to make arrangements.

CHECK-OUT: 

11am for all site types 

**If you leave after check-out time, your account is subject to a late check-out fee of $50. In addition, should you fail to leave by Noon of your check-out day, you will be deemed a “Holdover Occupant” subject to additional liability as described below.

Late check-out is prohibited at Spacious Skies Bear Den (Spruce Pine, NC) due to Blue Ridge Parkway activity.

Quiet Hours are from 11:00pm - 8:00am. Wind-down begins at 10pm.

CHILDREN:

All children under the age of seventeen (17) must be accompanied by an adult.. Guests are responsible for the behavior of their children or any children visiting them at the park. The Campground staff are NOT RESPONSIBLE for watching or supervising minors at any time.

Battery operated cars for minors are strictly prohibited.

DAY AND OVERNIGHT VISITORS OF CAMPING GUESTS: 

Occupancy is limited to the occupants specified at the time of booking. Additional day and overnight visitors may be added subject to availability and maximum person limitations as we determine in our sole discretion. The following fees and guidelines apply: 

Adults (18 and over): 

$10/pp for day

$15/pp for overnight

Children (6-17): 

$8/pp for day

$12/pp for overnight

No charge for children under the age of 5 

Day visitors of camping guests must leave the park by 10:00pm wind-down. 

Guests of the park are responsible for the behavior of their visitors, and all visitors must adhere to the Campground rules at all times. Visitor vehicles must be parked in visitor parking lots.

GUEST CONDUCT:

As a Unity Blaze certified campground, we operate under the principle of “Treat Everyone, Everywhere, Equally.”

To uphold that commitment, guests who enter our campground agree to refrain from any behavior, use of language, or display of any objects, symbols, imagery, or phrases affixed to their vehicles, RVs/campers, golf carts, or put on view on their campsite that would serve to offend, intimidate, attack, harm, or discriminate against another guest or guests in any way based on another’s race, age, gender, orientation, religion, or any other personal identifier.

Prohibited actions on the campground include, but are not limited to: use of racist, sexist, or otherwise discriminatory language against another guest; aggressive or violent behavior that is motivated by prejudice on the basis of race, ethnicity, religion, orientation, or similar grounds.

Prohibited items on the campground include but are not limited to: flags, stickers, garden displays, or site décor that are political in nature, use profanity, or use imagery or phrases that have been identified as hate symbols or exist for the general purpose of inciting discomfort or fear in others.

Items that are welcome on the campground include but are not limited to: flags, stickers, garden displays, or site décor that are meant to celebrate personal identity in a non-aggressive manner.

If a guest fails to respond accordingly to team member instruction upon witnessing any behavior or physical display described above, it will result in an immediate ejection with no refund offered.

AMENITIES:

Registration as a camper at Campground includes use and access to all amenities including but not limited to the jumping pillow, playgrounds, recreational fields, horseshoe pits, community fire pits, picnic area and recreation room.

All guest and visitor use of the Campground amenities voluntarily and at their own risk. The Campground is not responsible for any injuries that may be sustained by guests and anyone in their care, including children or guests, in their use of amenities.

Hours are from 8:00 a.m. until 8:00 p.m. or dusk (when pole lights come on)

No pets allowed on mulch or stone in playground area.

Please play safely and respectfully of others.

Swimming:

The swimming facilities at the Campground are NOT SUPERVISED by a lifeguard or other responsible person of the Campground. In place of on-site supervision provided by Campground, Campground has established a series of safeguards that must be followed by all guests.

Campground is required to notify you of these rules to ensure that water rescue equipment is at the swimming pool and that the swimming area is maintained in a sanitary manner. In the interest of your safety and that of your guests, you are required to follow these rules. Please read the safety rules located at the entrance and outlined in this document. If you have any questions, we are happy to discuss them with you. You must agree to all rules before use of the swimming area.

NEVER SWIM ALONE. A minimum of two (2) adults, age eighteen (18) years or older, must be present whenever this swimming facility is in use. At least one (1) adult must be on the pool deck.

THERE IS NO SUBSTITUTE FOR ADEQUATE SUPERVISION. Children under eighteen (18) years of age must be accompanied by a parent, guardian or other responsible adult to supervise their safety and behavior.

IN AN EMERGENCY, DIAL 9-1-1 AND THEN THE CAMPGROUND OFFICE.

SWIMMING FACILITY HOURS ARE SUNDAY THROUGH THURSDAY 10:00 A.M. UNTIL 7:00 P.M., and FRIDAY AND SATURDAY 10:00 A.M. UNTIL 8:00 P.M. but may differ at management’s discretion in the interest of health and safety.

  • No alcohol containers.
  • No tobacco products at the pool, including smoking and vaping.
  • No food or beverage allowed on pool deck.
  • No glass containers.
  • No pets allowed in the swimming area.
  • No diving, pushing, dunking anyone under water, running, jumping from the side or rough play allowed.
  • No inflatable flotation devices allowed.
  • If there is a fecal accident, report it to staff immediately.
  • First aid supplies are available at the office.

If weather conditions or other potentially dangerous conditions arise, Campground management will alert all guests to clear the swimming area. Everyone must file out in single file through the gate. When it is determined safe, an announcement will be made on the loudspeaker that the swimming area is safe to re-enter.

If a person is reported missing, Campground management will alert swimmers for a swimmer count. If it is determined that someone is still missing, the swimming pool will be cleared, and a search will be conducted. Nobody will be allowed to re-enter the swimming pool until it is determined that nobody is in danger.

Campground management will conduct swimming pool checks several times per day to determine the number of swimmers using the swimming pool at any time.

Injuries can be prevented, and safety is everyone’s responsibility. Please notify Campground management at once if you encounter any problems with water quality or the absence of safety equipment.

Jumping Pillow:

The jumping pillow at the Campground is NOT SUPERVISED by any Campground staff or other responsible person. In place of on-site supervision by Campground, Campground has established a series of safeguards to be followed by all guests.

In the interest of your safety and that of your guests, you are required to follow these rules. Please read the safety rules located at the entrance and outlined in this document. If you have any questions, we are happy to discuss them with you. After you have read this document, please sign the following page and return it to us before use of the jumping pillow.

JUMPING PILLOW HOURS ARE WEEKENDS 10:00 A.M. UNTIL 6:00 P.M. OR DUSK, and weekdays by request, weather permitting, but may differ at management’s discretion in the interest of health and safety.

  • No alcohol containers.
  • No tobacco products, including smoking and vaping.
  • No food, gum or beverage allowed.
  • No glass containers.
  • No flips, somersaults, pushing, shoving, racing around or rough play allowed.
  • No objects such as footballs, frisbees, etc.
  • Remove jewelry and empty pockets prior to jumping.
  • No cell phones.
  • No shoes allowed, but socks are required.
  • Place shoes along fence away from gate.
  • Keep off edges.
  • Jump at arm’s length from others.
  • No wet clothes or feet.
  • No sitting in groups.
  • No pets allowed in the jumping pillow area.
  • Exit with caution.
  • First aid supplies are available at the office.

If weather conditions or other potentially dangerous conditions arise, Campground management will blow whistle to alert all to clear the jumping pillow. Everyone must file out in single file through the gate. When it is determined safe, an announcement will be made on the loudspeaker that the jumping pillow area is safe to re-enter.

CAMPFIRES:

Campfires must remain inside your fire ring and campers should not use wood containing nails.

For the safety of our flora and fauna, please do not bring off-site firewood onto the Campground. We sell firewood at the camp store/office.

Do not move the fire ring. Campers who remove the fire ring will be charged for the replacement value of the item.

VEHICLES: 

The speed limit in the park for all motor vehicles is 5 MPH at all times. 

All vehicles, including golf carts, must only be driven on roads. 

Parking is permitted in designated parking areas or at your reserved site.  

Up to 2 motor vehicles are permitted at each site, depending on the size.  Upon request, vehicle information must be provided to management.

Vehicles may only be parked in designated parking areas. 

Management approval is required for any exceptions to the parking guidelines. 

All vehicles, including recreational vehicles, trailers and motorcycles, must be registered and have current tags. 

All vehicles must be driven safely and responsibly.

GOLF CARTS / ATVs: 

ATV rules ONLY applicable where ATVs ARE allowed:

Spacious Skies Balsam Woods (Abbot, ME)
Spacious Skies Belle Ridge (Monterey, TN)
Spacious Skies Walnut Grove (Alfred, ME)

Campers must provide proof of liability insurance and a valid driver’s license for anyone who will be driving the vehicle.

Anyone driving a golf cart/ATV on Campground property must have a valid driver’s license.  

Manufacturer’s seating requirements must be followed. 

Use of ATVs on Campground property is limited to traveling directly to and from ATV trailheads. If the Campground you are staying on has designated ATV parking, you may use it rather than park at your campsite. You may not operate ATVs under any other circumstance on Campground property.  

Golf carts/ATVs may not be driven after dark unless outfitted with working headlights and tail/brake lights. They also may not be driven during quiet hours. 

Only 1 golf cart is permitted per site. Up to 2 ATVs are permitted per site (if designated ATV parking is not available). (MAX 3 altogether) 

All vehicles must fit in your space (cannot encroach on other spaces) and cannot be parked on roads or in visitor parking lots. 

TRASH: 

Please take your trash to the dumpsters located in the park.  

All trash must be in trash bags and tied up.  

Do not leave trash out at any time. 

Dumpsters are only for daily Campground trash. Household trash or large items are prohibited. Guests may be charged for any bulk pick-up trash placed in or near the dumpster.

SEWAGE:

No draining of gray water onto the ground is allowed.

Black tank valve is not to be left open. Empty sewer tanks with LOTS OF WATER.

Use of Back Flush connection with hookup to water supply is not permitted.

If a guest illegally dumps gray or black water on their site, they may be reported to the Department of Health.

No washing of RV or any vehicles on Campground if your reservation is less than 140 days long.

SITES: 

It is the registered party’s responsibility to keep their site clean and uncluttered at all times. 

Guests must leave their site as they found it and be sure to clean up all debris at their site before departing. This includes leaving all landscaping, trees, wooded areas, and the like on the property undisturbed.

Cutting down tree limbs or chopping down trees on the property for any use, especially as firewood, is strictly prohibited.

The state of each site is recorded prior to arrival and after departure. Fees related to damage done to property, including but not limited to environmental fees, may be charged to the registered party if applicable. Such fees will include all losses actually incurred or reasonably expected to be incurred, together with an administrative fee, including those in excess of required damage deposits.

Use RV-appropriate septic chemicals and RV/Boat toilet paper ONLY. Regular home toilet paper is not permitted and will negatively affect our septic system.

Nothing other than RV/Boat toilet paper is permitted to be flushed into our septic system, including but not limited to diapers, feminine products, textiles, trash, or cigarettes. Black water tanks must be kept closed and only emptied when full.  

Moving from site to site is prohibited unless prior arrangements have been made with management. 

In case of emergency, management reserves the right to move vehicles or belongings without notice or liability. 

Alcohol may be consumed in moderation at your site. Possession or use of illegal drugs is strictly prohibited. 

All RVs are required to have an approved sewer ring or sewer donut for sanitation purposes. 

Campfires are permitted in designated fire pits / fire rings only and must be attended at all times. Only firewood may be burned in fire rings. Fire rings may not be moved from their positions; they are in their location to avoid utilities underground. If the fire pit/fire ring is removed, we reserve the right to charge the card on file.

Smoking is not permitted in any Campground building or common area. Cigarette butts must be disposed of immediately in the appropriate receptacles.  

Firearms, bows and arrows, or fireworks (or items similar to these items) are not permitted on the Campground.  

You must be able to remove your recreational vehicle (motorhome, travel trailer, pop-up, etc.) from your site with your own vehicle at any time staff requests for reasons that include safety.

Spacious Skies is not responsible for any mail or packages delivered to the Campground in the name of our guests. Guests who wish to receive mail while camping would be best served to find an external source to receive mail (local PO box, local UPS, local locker, etc). In the event a guest has no other option than to receive a piece of mail at the Campground, Spacious Skies Campgrounds and team members do not bear responsibility for receiving, delivering, or potential loss or theft of said item(s).

POOL OR NATURAL BODY OF WATER: 

All guests and visitors of guests swim at their own risk.  

There is no lifeguard on duty.  

All minors must be accompanied by an adult in the swimming area.  

All diapered children must wear a swim diaper and are prohibited from entering the swimming area in a regular diaper or if they are undiapered.

All posted rules for the pool area or a natural body of water must be followed at all times.  

No glass containers are permitted in or around the pool or any body of water. 

If boating is offered, lifejackets must be worn at all times.  

OTHER FACILITIES AND AMENITIES (if applicable): 

Onsite amenities are not monitored. Use at your own risk.  

All minors must be accompanied by an adult at all onsite amenities.  

All posted rules for amenities must be followed at all times.  

Amenities are subject to closure for any reason. There is no guarantee that any particular amenity or amenities will be available for use.

PETS: 

We allow up to 3 pets per RV or tent site, and up to 2 pets per lodging accommodation. 

Pets are limited to cats and dogs; no wild or exotic animals are permitted. 

All pets must be well-behaved and non-aggressive and current on their vaccinations. We reserve the right to exclude or require proof of insurance for aggressive breeds.

You must provide a copy of your pet’s current rabies certificate at the time of check-in.

Pet fees are as follows: 

Cabins and Lodgings (excluding Retro RV rentals): $25 per pet, per reservation 

RV and Tent Sites: No fee 

Retro RV Rentals: Pets NOT ALLOWED

Pets must be accompanied by their owner at all times. 

Pets must always be on a leash. 

Pets are not permitted in pools, lakes, or other natural bodies of water on the Campground. 

Please clean up after your pet - bag up and throw away dog waste in the designated trash bin.

DAMAGE POLICY:

Your site or lodging will be inspected upon your check-out. In the case of vandalism or damage to property your card-on-file may be charged for the cost of the necessary repairs.

HOLDOVER OCCUPANCY:

We reserve the right to take such steps as may be necessary to remove any Holdover Occupant from the applicable RV Site, Cabins/Lodgings or other accommodations, and to assist any other person(s) who may be affected by the Holdover Occupant’s failure to vacate in finding comparable alternative accommodations (as determined solely by us) during any such holdover period. The Holdover Occupant shall be responsible for the following “Holdover Charges”: (a) the cost of any alternate accommodations secured for the person(s) affected by the Holdover Occupant’s failure to vacate or, if such alternate accommodations cannot be secured or are not desired by the affected person(s), the affected person(s)’ entire occupancy (plus all applicable taxes and fees); plus (b) any other costs which we may incur due to the Holdover Occupant’s failure to vacate; plus (c) an administrative fee of $200 to cover our internal costs.

WIFI:

If WiFi is offered at the resort, there are no guarantees either expressed or implied as to the reliability, availability or security of the network. From time to time, there may be system outages due to upgrades, equipment issues or problems beyond our control. We do not supply technical support in connecting to the network. You agree that you will not use WiFi for illegal purposes.

PHOTOGRAPHY AND MARKETING MATERIALS:

Your signature below grants Spacious Skies Campgrounds permission to use your likeness and that of your guests in a photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, without payment or other consideration. Spacious Skies Campgrounds has permission to edit, alter, copy, publish, or distribute these photos for any lawful purpose without inspection or approval of the finished product wherein your or your guest(s)’ likeness appears. Additionally, the right is waived to royalties or other compensation arising or related to the use of the photo. EMERGENCY:

In case of an emergency, please call 9-1-1 and contact the Campground office immediately.

FIREARMS/HUNTING:

Firearms are strictly always prohibited on the Campground.

Hunting is strictly prohibited on the Campground.

FIREWORKS:

Fireworks ways prohibited on Campground property.

DISCLAIMERS: 

All guests and their visitors use of the Campground and park facilities at their own risk. Guests and visitors agree to hold harmless and indemnify the Campground from and against all loss, liability and expense that may be incurred by the camper, their family, visitors and other members in their party. 

MANAGEMENT SHALL NOT BE LIABLE FOR AND DOES NOT ASSUME ANY LIABILITY OR RESPONSIBILITY FOR ANY LOSS, DAMAGE, DELAY, DEATH OR INJURY TO PERSONS OR PROPERTY ARISING FROM OR AS A RESULT OF THE ACTS OR OMISSIONS AND/OR REPRESENTATIONS (WHETHER ORAL OR WRITTEN) RELATING TO THE Campground REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT INCLUDING NEGLIGENCE, STRICT LIABILITY OR OTHERWISE. MANAGEMENT’S LIABILITY FOR ANY CLAIM ARISING FROM, IN CONNECTION WITH, OR AS A RESULT OF YOUR CAMPING STAY AND/OR THE ACTS OR OMISSIONS AND/OR REPRESENTATIONS (WHETHER ORAL OR WRITTEN) RELATING TO THE CAMPSITE SHALL BE AND HEREBY ARE EXPRESSLY LIMITED TO TOTAL AMOUNT PAID BY MEMBER TO MANAGEMENT FOR OCCUPANCY. IN NO EVENT SHALL MANAGEMENT BE LIABLE FOR SPECIAL, CONSEQUENTIAL, LIQUIDATED, INCIDENTAL, INDIRECT, EXEMPLARY, MORAL, OR PUNITIVE DAMAGES EVEN IF NOTIFIED OF THE POSSIBILITY OF SAME. THIS SECTION SHALL EXTEND TO, BENEFIT, AND EXPRESSLY APPLY TO MANAGEMENT AND ITS AFFILIATES, SUCCESSORS, ASSIGNS AND AGENTS.

We reserve the right to eject any person(s) without refund for violation of these Rules and Regulations and/or for conduct by the guest, their occupants and/or visitors is deemed by Management to be likely to endanger the welfare, safety, harmony or good reputation of us or our Campground(s). Management shall have the right to determine whether ejected guests and visitors will be permitted to return for a subsequent reservation upon paying the relevant occupancy fees. 

DISPUTE RESOLUTION/ARBITRATION:

PLEASE READ THIS PROVISION OF THESE TERMS OF USE CAREFULLY. IT PROVIDES THAT CERTAIN DISPUTES MUST BE RESOLVED BY BINDING ARBITRATION. IN ARBITRATION YOU GIVE UP THE RIGHT TO GO TO COURT, INCLUDING THE RIGHT TO A JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR SIMILAR PROCEEDING. IN ARBITRATION, A DISPUTE IS RESOLVED BY AN ARBITRATOR INSTEAD OF A JUDGE OR JURY. ARBITRATION PROCEDURES ARE SIMPLER AND MORE LIMITED THAN COURT PROCEDURES AND ARE SUBJECT TO VERY LIMITED REVIEW.

A.                 Dispute Resolution/Arbitration. Any Disputes relating to your use and occupancy of the Campground and/or these Rules & Regulations (and, as applicable, any Extended Stay Reservations: Rules & Regulations and/or Seasonal Camper Agreement, Payment Schedule and Information) shall be resolved as follows:

                                            i.               Purpose; Definitions of Disputes. Any Dispute shall be determined exclusively and finally by individual arbitration, unless you have exercised your opt-out right pursuant to clause (x) of this Dispute Resolution/Arbitration section and except as otherwise specified in such section. This Arbitration Provision shall be broadly interpreted. “Dispute” means any claim or controversy related to arising from your your use and occupancy of the Campground and/or these Rules & Regulations (and, as applicable, any Extended Stay Reservations: Rules & Regulations and/or Seasonal Camper Agreement, Payment Schedule and Information). The “Parties” means you and us.

                                           ii.               Neutral Arbitrator/No Jury. Any Dispute will be submitted to a neutral arbitrator, for a final and binding determination, known as an award. The arbitrator is an independent decision maker, appointed by the American Arbitration Association (“AAA”), who reviews and weighs evidence provided by all parties, and issues an award enforceable in court. Decisions by an arbitrator are subject to very limited review by a court. Except as expressly provided below in this Dispute Resolution/Arbitration section, you and Management waive and relinquish any and all rights to have a court or a jury resolve any Dispute. You and Management expressly waive any right to a jury trial.

                                          iii.               Individual Basis/No Class Actions. Any Disputes will be arbitrated on an individual basis. There will be no right or authority for any Dispute to be arbitrated or litigated in any way on a class, mass, or other collective basis, and you and Management waive any right to bring or join any representative or other claim brought on behalf of the general public, other users, or other persons similarly situated. Neither you nor Management may participate in a private attorney general proceeding in court or in arbitration with respect to any Dispute. No Disputes involving you and Management may be joined or consolidated with Disputes by or against any other person. Notwithstanding any language in this Dispute Resolution/Arbitration provision to the contrary, any dispute about the validity or effect of this clause (iii) shall be resolved by a court and not an arbitrator.

                                          iv.               Certain Carve-Outs. Despite this arbitration provision, the you and Management reserve certain rights to proceed in court without waiving their right to arbitrate under this Dispute Resolution/Arbitration provision: (a) Management reserves the right to seek emergency injunctive relief from a court to address any circumstances or behavior, by you or any person that Management believes may present a risk or threat to the safety, security or reputation of any person, location, data system, or other feature or otherwise related to the campsite and its business; and (b) you shall have the right to file a Dispute in small claims court in your city of residence, as long as the matter remains in small claims court and proceeds only on an individual basis; and (c) no provision of this Dispute Resolution/Arbitration provision shall limit the right of either you or Management to seek and use any available remedies, judicial or otherwise, for the purpose of collecting upon or accelerating any debt involved in any Dispute. Any such collection and/or acceleration process shall be governed by applicable law and such procedures may occur outside the arbitration process you and Management so elects, and such election shall not be deemed a waiver of the right to arbitrate any other issue involved in a Dispute.

                                           v.               Applicable Rules/Location. This arbitration agreement is governed by the Federal Arbitration Act (9 U.S.C. § 1 et seq.). The arbitration shall be administered by the AAA under its Consumer Arbitration Rules, available online at www.adr.org or by calling the AAA at 1- 800-778-7879 (the “AAA Rules”) except that you and Management expressly agree that the AAA Supplementary Class Rules shall not apply, given the express class waiver above, and further agree that Rules 14(a) and 53 of the Consumer Arbitration Rules shall not authorize any arbitrator or court to find that any class, mass, collective or representative claim may be arbitrated. The arbitration shall be held in Somerset County, New Jersey, unless the Parties agree to another location in writing, or the arbitrator decides to hold a telephonic hearing to reach a decision based solely on the Parties’ submission of documents, or to designate another location reasonably convenient for the Parties. In the event of any conflict between the AAA Rules and these Rules & Regulations, the provisions of these Rules & Regulations shall be controlling.

                                          vi.               Stay of Proceedings. In the event that a Dispute involves both issues that are subject to arbitration and issues that are not subject to arbitration, you and Management unequivocally agree that any legal proceeding regarding the issues not subject to arbitration shall be stayed pending resolution of the issues subject to arbitration, except for any proceedings described in clause (iv) of this section above, which actions shall proceed without a stay.

                                         vii.               Final and Binding. The arbitration award shall be final and binding on the you and Management, except for any appeal right under the FAA. Judgment on the arbitrator’s award may be entered in any state or federal court of competent jurisdiction. To the extent this arbitration provision conflicts with any other agreement between you and Management, this arbitration provision shall govern.

                                        viii.               Payment of Fees. The payment of all fees for registration, filing and administration of the arbitration, and the payment of arbitrator fees, shall be governed by the AAA Rules and applicable law, unless otherwise stated in these Rules & Regulations. Each of you and Management shall bear their own legal fees and legal expenses for any arbitration proceeding.

                                          ix.               Notice and Good Faith Negotiation. Should you or Management intend to file an arbitration demand against the other, you and Management agree to notify the other at least thirty (30) days before filing. You and Management agree to attempt to negotiate a mutually agreeable resolution to resolve any such dispute or claim during this period. If the filer of an arbitration demand fails to provide that notice, the other party is entitled to seek a stay of the arbitration proceeding from the AAA for thirty (30) days and to participate in settlement negotiations during that period in good faith. Any written notice required or desired to be given hereunder shall be deemed given when personally delivered or after three (3) days deposit in the U.S. Mail, first class postage prepaid or one (1) day after acceptance by a nationally recognized overnight courier service, addressed to the address given herein or such subsequent address as is given by proper notice.

                                           x.               Opt out Right. IF YOU DO NOT WANT THIS ARBITRATION PROVISION TO APPLY, WITHIN 30 DAYS OF YOUR ACCEPTANCE OF THE RULES AND REGULATIONS YOU MUST SEND A SIGNED LETTER TO THE COMPANY AT SPACIOUS SKIES Campgrounds, 80 MORRISTOWN ROAD, UNIT 3B-272, BERNARDSVILLE, NEW JERSEY 07924 ATTN: ARBITRATION OPT-OUT STATING THAT THE ARBITRATION PROVISION DOES NOT APPLY. OPTING OUT OF ARBITRATION WILL NOT AFFECT ANY OTHER PROVISION OF THESE RULES & REGULATIONS BUT WILL VOID THE ARBITRATION PROVISIONS.

B.                 Complete Waiver of Jury Trial. TO THE EXTENT A CLAIM BY EITHER MANAGEMENT OR YOU AGAINST THE OTHER IS NOT SUBJECT TO THE ARBITRATION PROVISION OR TO THE EXTENT AN OTHERWISE ARBITRABLE DISPUTE IS LITIGATED IN COURT, YOU AND MANAGEMENT HEREBY UNCONDITIONALLY WAIVE ANY RIGHT TO A JURY TRIAL OF ANY AND ALL SUCH CLAIMS, DISPUTES, OR CAUSES OF ACTION, WHETHER NOW EXISTING OR HEREAFTER ARISING, OF ANY KIND. YOU AND MANAGEMENT HEREBY AGREE A COPY OF THESE RULES & REGULATIONS MAY BE FILED WITH ANY COURT AS WRITTEN EVIDENCE OF THE WAIVER OF ANY RIGHT TO TRIAL BY JURY.

C.                 Complete Waiver of Class Action. TO THE EXTENT A CLAIM OR DISPUTE IS NOT SUBJECT TO THE ARBITRATION PROVISION OR TO THE EXTENT AN OTHERWISE ARBITRABLE DISPUTE IS LITIGATED IN COURT, YOU AND MANAGEMENT AGREE TO WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS, MASS, OR OTHER COLLECTIVE ACTION, AND YOU AND MANAGEMENT WAIVE ANY RIGHT TO BRING, JOIN, CONSOLIDATE WITH, OR PARTICIPATE IN ANY REPRESENTATIVE OR OTHER CLAIM BROUGHT ON BEHALF OF THE GENERAL PUBLIC, OTHER WEBSITE USERS, OR OTHER PERSONS SIMILARLY SITUATED.

D.                 Governing Law, Jurisdiction and Venue.

                                       i.                    All matters relating to your use and occupancy of the Campground, shall be governed by and construed in accordance with the internal laws of the state in which the Campground is located (“Campground State”) without giving effect to any choice or conflict of law provision or rule.

                                      ii.                    These Rules & Regulations evidence a transaction or series of transactions, and a relationship, involving interstate commerce so as to ensure the applicability of the Federal Arbitration Act (“FAA”). Accordingly, this Arbitration Provision shall be governed by the FAA and not state arbitration laws, provided that Campground State law shall govern to the extent that state law is relevant under the FAA in determining the enforceability of the arbitration provision, and otherwise relating to use and occupancy of the Campground and/or these Rules & Regulations (and, as applicable, any Extended Stay Reservations: Rules & Regulations and/or Seasonal Camper Agreement, Payment Schedule and Information).

                                     iii.                    To the extent that a claim or Dispute is not subject to the arbitration provision, you and Management agree that any such claim or Dispute, to the maximum extent permissible under applicable law, shall be limited to exclusive personal jurisdiction in the courts of Somerset County, New Jersey.  Except as prohibited by law, you and Management waive any and all objections to the exercise of jurisdiction of such courts and to venue in such courts.

Incorporation by reference: These Spacious Skies Campgrounds Rules and Regulations, specifically including the dispute resolution provisions, are hereby incorporated into any Month-long/Extended Stay Reservations: Rules & Regulations and/or Seasonal Camper Agreement, Payment Schedule and Information applicable to you.

As used herein, “we,” “us,” “our” and/or “Management,” refer to [Spacious Skies Campgrounds, LLC], as well as its affiliates.

Acceptance of these terms and conditions indicates that the camping party, their visitors, and anyone using the property and amenities are responsible for reviewing, understanding, operating within these Rules and Regulations and all posted rules of the Campground.

These Rules and Regulations are subject to change from time to time by Management in its sole discretion, and acceptance of any such changes and/or your continued use of the Campground from and after the promulgation of any such changes (which may be done by posting on the Campground or Management website, communication to you or otherwise) shall constitute your acceptance of such changes.  If any provisions in these Rules & Regulations is invalidated by any law or court order, the remaining portion of these Rules & Regulations shall continue to apply.
