WAIVER AND RELEASE FORM
In consideration of myself and all persons entering under my SUPERVISION, being permitted
to participate in the activities at The Woods at Bear Creek (WABC), I hereby KNOWINGLY AND
INTENTIONALLY WAIVE AND RELEASE, INDEMNIFY AND HOLD HARMLESS The Woods at
Bear Creek, Bear Creek Entertainment LLC, Castle Campus LLC, and all respective employees,
for injuries caused by, but not limited to, the following activities: Campfires, hiking, fishing,
swimming, boating, wagon rides, planned events, dogs, showers, basketball, tennis, volleyball,
zip-line, any type of bicycle, golf carts, electric scooters, and encounters, with wildlife. I
acknowledge that camping has many hazards and risks that cannot be eliminated, particularly
in a wilderness environment.
I understand the use of the area involves the danger of encountering both known and unknown
hazards and risk which could result in injury, paralysis, death, illness and disease, physical or
mental damage to myself, to my property, or to spectators or other third-parties. I hereby
accept and assume all risk and dangers and all responsibility for any and all losses and/or
damages, whether caused in whole or in part by the negligence of The Woods at Bear Creek,
Bear Creek Entertainment LLC, and Castle Campus LLC or the landowners.
I acknowledge that I am aware of the dangers, and even so, I do hereby, on behalf of myself,
my personal representatives and heirs, voluntarily agree to RELEASE, WAIVE, DISCHARGE,
HOLD, HARMLESS, DEFEND AND INDEMNIFY The Woods at Bear Creek, Bear Creek
Entertainment LLC, and Castle Campus LLC and the landowners from any and all claims,
actions of losses for bodily injury, property, wrongful death, loss of services otherwise which
may arise out of my use of the land or my participation in any activities thereon.
INDEMNIFICATION AGREEMENT: For and in consideration of being permitted by Bear Creek
Entertainment LLC, The Woods at Bear Creek, and Castle Campus LLC or the landowner’s to
use the area, I agree to this WAIVER, RELEASE, AND INDEMNIFICATION; the undersigned
joins in this WAIVER AND RELEASE and stipulates and agrees to SAVE AND HOLD
HARMLESS, INDEMNIFY, AND FOREVER DEFEND BEAR CREEK ENTERTAINMENT LLC, THE
WOODS AT BEAR CREEK, AND CASTLE CAMPUS LLC and the LANDOWNERS from and
against any and all claims, actions, demands, expenses, liabilities (including attorney’s fees)
and NEGLIGENCE made or brought by the undersigned or by anyone on behalf of the
undersigned, as a result of the undersigned’s use of the land.
RELEASE: In consideration of the services and/or property provided, I, for myself and any
minor children for which I am the parent, legal guardian, or otherwise responsible, any heirs,
personal representatives, or assigns do hereby release Bear Creek Entertainment LLC, The
Woods at Bear Creek, and Castle Campus LLC from any liability and waive any claim from
damages arising from any cause whatsoever.
SURVIVABILITY: If any portion of this contract for use, release of liability and waiver is held
invalid, it is agreed that the remainder shall not withstanding, continue in full legal force and
effect. By signing this form, I have agreed to Bear Creek Entertainment LLC, The Woods at
Bear Creek, and Castle Campus LLC and the landowners, Risk, Responsibility and Liability
Policy and have read the entire document, understand it completely and agree to be bound to
its terms. I have read, understand and agree to abide by the attached rules and regulations of
Bear Creek Entertainment LLC, The Woods at Bear Creek, and Castle Campus LLC.
BY SIGNING BELOW:
• I ACKNOWLEDGE I HAVE CAREFULLY READ, CLEARLY UNDERSTAND AND
VOLUNTARILY SIGN THIS WAIVER AND RELEASE AGREEMENT FOR MYSELF AND MY
FAMILY.
• I ACKNOWLEDGE I have received, read and understand the swimming pool rules
mandated by NYS and the Cattaraugus County Health Department.
• I hereby consent photographs and videos may be taken of me and all parties under my
supervision during our stay at The Woods at Bear Creek for purposed of event
documentation and promotion of WABC. No names published.
• I acknowledge that WABC is not responsible for any loss of damage incurred during my
stay. 
• I acknowledge that I have read, understand and agree to abide by all policies/rules posted
at WABC. A copy was provided to me at signing of this license and is also available upon
request or online at www.woodsatbearcreek.com.
• I acknowledge my signature below constitutes my agreement to comply with all WABC
rules and policies. Failing to do so, I will be asked to leave, permanently, without any
refund.
• I acknowledge that my RV can be removed for nonpayment of fees and I will be responsible
for all costs.
• I acknowledge that WABC has the right to terminate this license at any time without any
refund.

 

RULES & REGULATIONS
General
• No fire arms are allowed on the property.
• No pets are allowed on property, unless otherwise permitted by campsite management.
• No vehicles are to be driven into the tent area. All cars must remain in the upper parking
area.
• No glass bottles or containers are permitted in the tent areas.
• Lifejackets must be worn at all times while boating, kayaking, canoeing, etc.
Cabins
• All cabin keys must be returned upon check-out. A re-key charge of $35 will be applied for
any missing keys
• No pets allowed
• No cooking
• No smoking
• No grills allowed to be used in the cabin areas.
• Fires are only permitted in designated areas and will be lit by campsite personnel.
• Vehicles are not permitted by cabins (May-Nov)
• Vehicles should be parked under pavilion (Dec-Apr)
• Please do not drive or park vehicles on grass
• Only one golf cart can be issued per cabin
• No glass bottles or containers are permitted in the cabin areas
• Only one key can be issued per cabin
Golf Carts
• Operator(s) of the golf cart must be 16 years of age and have in their possession a valid
unrestricted driver’s license. All operators must have a copy of their license on file.
• Pedestrians always have the right of way.
• Guest is responsible for all actions of all passengers and persons operating the cart with
his express or implied permission.
• Under no circumstances may the operator be under the influence of any intoxicating
substance (I.e. drugs, alcohol, etc.)
• Golf carts cannot be operated during the hours of 12am - 5am.
• Golf carts must be operated properly. Horseplay, racing or other misuse of cart will not be
tolerated.
• Carts are to be operated on campground roads only. Golf carts are not allowed outside the
facility or on public highways, campsites, fields or in any undesignated areas etc.
• Golf carts shall not be operating carrying more passengers or weight than the
manufacturer’s specifications.
• Anyone found abusing the rules and regulations of a golf cart will immediately forfeit all golf
cart privileges.
• I certify that I have adequate insurance to cover any injury or damage I may cause or suffer
while operating the golf carts or I agree to bear the costs of such injury to myself or others.
• I have read, understand and agree to the terms of this Waiver, Release of Liability &
Assumption of Risk, and voluntarily sign the same and agree to no oral representations,
statements, or inducements apart from the foregoing written agreement have been made. If
or any reason any provision of this Agreement is found to be invalid, illegal or
unenforceable by a court of competent jurisdiction, the validity, legality and enforceability of
the remaining provisions shall in no way be affected or impaired thereby. I intend than this
agreement shall constitute complete and unconditional release of all liability of Bear Creek
Entertainment LLC, The Woods at Bear Creek, and Castle Campus LLC, its subsidiaries,
affiliates, agents, employees and volunteers to the greater extent of the law.
ATV Park
• Helmets are required at all times. All helmets must be approved by the New York State
Department of Transportation.
• Must obey all federal and local rules and regulations as they pertain to the operation and
riding of ATVs.
• No two wheelers or three wheelers.
• You must be 16 years of age or older to ride alone.
• Riders between the age of 10 & 15 years of age must have adult supervision or a course
certificate from a DMV approved training course.
• If you are under the age of 10, you may operate an ATV only with adult supervision.
• All of our trails are one way. There is no two way travel on any of our trails.
• Speed in public areas is 5mph, Speed on the road is 20mph.
• The trails close at dusk. There is no night riding.
• Please stay on marked trails only.
• No riding in unauthorized areas.
• All machines are required to have US Forest Service approved spark arrestors.
• All exhausts require baffles. No open pipes allowed.
• No dangerous objects allowed on machines.
• No alcohol is allowed in the ATV park.
• Ride at your own risk.
• If you are a witness to an emergency, please let us know immediately.
RV Park
- A sewer hose seal (rubber donut or threaded connector) for your sewer hose is REQUIRED
on all sewer hookups. Do not place your sewer hose all the way down into the inlet as it can
prevent flow from other sites and could stop up the line. If you do not have a sewer hose
seal, we do have them available in the office for purchase.
- Anything that can possibly leave dead areas on the lawn are NOT ALLOWED under any
circumstance. (I.e. Mats, Area Rugs, etc.)
- No parking on the lawn or in the roadways. If there is not enough room to park in your site,
you may use the side parking area beside the main building or the parking area in front of the
office.
- No trimming or wood gathering from trees. Firewood bundles are available for purchase in
the office. Please do not allow children to climb trees.
- Garbage should be in sealed plastic bags and placed in front of your site by 10:30 AM for
pick-up. Please do NOT use the trash bins located in the park for daily garbage. If you miss
the daily pickup, please wait to put your bags out the following morning, as we only pick up
once a day. Do not leave garbage outside overnight or thrown on top of bins.
- Children must be supervised at all times.
- Do not walk through occupied sites.
- No smoking in buildings, cabins or tents. This includes restrooms, showers and laundry
room. Please use proper receptacles when extinguishing cigarettes. Please do not throw
cigarette butts on the ground.
- Absolutely NO FIREWORKS.
- No Tents in RV sites. We have designated tent sites for tent camping.
- Only RVs are permitted to be placed on the RV Lot. Only one (1) RV may be placed on each
RV Lot. Placement of RVs shall be on the concrete pad provided. All RVs within the Park
must be properly licensed. All owners of RVs shall furnish to Park Management a copy of the
registration for the RV immediately upon its siting at the Premises and annually thereafter, or
if there is any change in the legal or registered ownership.
- Only fully self-contained trailers and motorhomes are accepted. No tents or pick-ups with
camper shells will be permitted.
- A certificate of insurance for the RV must be available to Park Management; the certificate of
insurance should indicate coverage for the duration of RV stay.
