RELEASE AND WAIVER OF LIABILITY AND ASSUMPTION OF RISK

This is a general and broad Release and Waiver of Liability and Assumption of Risk on behalf of the undersigned and the undersigned does hereby agree to the following in connection with this Release:

The undersigned does hereby release any liability whatsoever and assumes all risks associated with the recreational activities participated in at Cedar Lake Campground and associated with camping and/or residing at Cedar Lake Campgrounds, a campground located in Johnson County, Illinois.

This risk and assumption of liability is a full release of any liability, now or in the future, for any activity that is affiliated or associated with Cedar Lake Campground.

The undersigned accepts and acknowledges full responsibility for all activities regarding the campground and participation in any activities the undersigned becomes involved in associated with or permitted by Cedar Lake Campgrounds.

The undersigned hereby acknowledges all risks involved, assumes all risks, and in order to participate in the recreational activities permitted at Cedar Lake Campground, hereby releases Cedar Lake Campground, its affiliates, its agents, employees, representatives, contractors, owners, trainers, volunteers, its successors or assigns or anyone or entity affiliated with said company from any and all liability associated with the recreational activities associated with or permitted by the campground. Recreational activities include but are not limited to the following activities: CAMPFIRES, HIKING, FISHING, SWIMMING, PLAYGROUND EQUIPMENT, PLANNED EVENTS, DOGS, HORSES, SHOWERS, SPEED BUMPS, BICYCLE OR MOTORCYCLE USE, ATV USE, SIDE BY SIDE USE, DIRT BIKE USE, GOLF CARTS, ELECTRIC SCOOTERS AND ENCOUNTERS WITH WILDLIFE.

As a participant in permitted campground activities, the undersigned fully acknowledges that there is an inherent risk involved in the handling, possessing, carrying, loading, use, or other activities associated with a campground and that will be conducted or is conducted at the campground by the undersigned. By participating, the undersigned hereby fully agrees to assume all risks and the risk of others around them. This is intended to be construed as a broad release, waiver and assumption of risk of any liabilities known, unknown, foreseeable or unforeseen.

By signing, the undersigned participant attests that they are over the age of 18 years, fully understand this document and the nature of the releases, waivers and assumptions, are physically able to conduct the activities at the campground and have no other legal or physical restrictions that prohibit the undersigned from becoming a campground participant.

I acknowledge that camping has many hazards and that there are risks that cannot be eliminated, particularly in a wilderness environment. I hereby acknowledge that Cedar Lake Campground is not responsible for any theft, loss or damage incurred during my stay. My signature below confirms that I have read and agree to abide by all rules and policies at Cedar Lake Campground. I also understand that I can be asked to leave the property, without refund, for failure to follow said rules and policies. A copy of which is posted at Cedar Lake Campground.

MISCELLANEOUS

The undersigned agrees to obey all campground rules and regulations.

The undersigned is responsible for conduct of their guests, children and pets at all times.

The undersigned acknowledges golf carts must not be operated on the property by any person under the age of 18 years old unless accompanied by an adult. All drivers/operators of such machines listed here must maintain liability insurance and a valid driver’s license.

The undersigned acknowledges that only bagged trash is acceptable in, on, or around Premises dumpster. No furniture, carpeting, construction material, etc., is allowed. These items must be removed by the undersigned, at their sole expense, in a timely manner. The undersigned will refrain from leaving debris at campsite.

The undersigned acknowledges a 4-wheeler, dirt bike, golf cart, or ATVs must not be operated on the property by any person under the age of 18 years old unless accompanied by an adult. All drivers/operators of such machines listed here must maintain liability insurance and a valid driver’s license.

Undersigned shall comply with the following rules regarding pets:

1. All pets must be on a leash or kept at campsite at all times.
2. Pets must be accompanied at all times.
3. All pet waste must be removed, bagged and disposed of in the dumpster.
4. Undersigned’s guests shall respect campers in regard to pets.
5. Cedar Lake Campgrounds does not permit undersigned or undersigned’s guests to have stallions on the premises under any circumstances.
6. Undersigned must check with management to set up picket lines or pens for horses. DO NOT TIE YOUR HORSES TO THE TREES.
7. Helmets are required for children under 18 and highly recommended for adults. Any adult who chooses not to wear a helmet assumes the risk.
8. Current negative Coggins required for any horse entering Cedar Lake Campground.

The undersigned acknowledges boats and/or trailers shall be parked in the designated parking area when on Premises. Assigned parking spaces are NOT available in the designated area.

The undersigned acknowledges that no locks shall be allowed on trailers left within the campground. Trailer owners shall provide keys to said trailer lock for any and all trailers left outside the campground. For maintenance reasons, trailers may be moved if necessary.

All speed limits must be observed at all times by undersigned and undersigned’s guests.

The undersigned is responsible for maintenance and upkeep of immediate campsite/premises. Such upkeep includes, but is not limited to, trash removal and lawn maintenance with regards to directly around the undersigned’s camper. All other lawn maintenance is provided by Cedar Lake Campground.

All persons shall respect others quiet time. Quiet time as provided in this section occurs between 12:00 am and 6:00 am.

Undersigned shall keep their personal items and belongings safe and secure when they are not present at the campsite. Lessor and campground are not responsible for any lost or stolen property or items.

The undersigned further acknowledges that for safety reasons, Cedar Lake Campground has the discretion to suspend participation or use of facility at any time at Cedar Lake Campground’s sole and exclusive discretion AND WITHOUT REFUND.
