Country Pines RV Park
RV PARK RULES, TERMS AND CONDITIONS
●Quiet Time: 9:00 p.m. – 7:00 a.m. Please be considerate of others. No loud music at any time.
●Check-in Time is after 1:00 p.m. Payment is due upon check-in, no partial payments, no exceptions.
●Check-out Time is 12:00 p.m.
●Speed Limit: Please observe a speed limit of no more than 10 mph throughout the park.
●Sewer: Sewer connection - a positive sewer seal at both ends of sewer hose is required. Texas law requires that a sewer hose must be fastened using a connector or a rubber donut.
●Guests: Maximum number of guests per space is six (6).
●Visitors: Guest shall be responsible and liable for the conduct of his/her visitors. No visitor may stay longer than five
(5) days without written approval from Park Management. Additional fees may apply.
●Parking: Two (2) vehicle limit per RV Space, if your space is large enough. Please park parallel to your RV out of the main drives. Parking in vacant RV spaces is prohibited. Additional vehicles, trailers, motorcycles, etc. beyond two (2), may be stored at alternative park locations only with park management’s prior written approval (additional fees may apply).
●Pets: Two (2) pet limit per RV Space. Guest is responsible at all times for their pet; including injury, destruction and annoyances. Pets are not to be left unattended outside of the RV and must remain on a leash at all times. Guest must clean up after their pets. Guest agrees that if pet waste is not disposed of properly or in a timely manner, additional fees per violation will apply. Absolutely no pets other than service animals are allowed in the office or laundry! Country Pines RV Park, LLC or Park Management shall not be liable for any loss, damage or injury of any kind whatsoever caused by the pet. No Aggressive Breed Dogs Are Allowed In The Park.
●Trash: Dumpsters located in the park are for personal trash only. No building material or other heavy material is allowed. All garbage must be bagged and tied, boxes broken down. DO NOT leave trash outside by your RV. If dumpsters need attention, please notify park management.
●Water: Pressure regulators are recommended for your water connection. Washing vehicles using park water is prohibited and additional fees per violation will apply.
●RV/Space Appearance: All RV’s must be in operational condition. No RV’s older than 15 years from current year are allowed on park premises. Any RV considered not abiding by these guidelines will be ordered to vacate the park premises immediately without refund. RV space is to remain neat and orderly at all times. Vehicles/RV’s leaking oil or fluids are prohibited in the park and must be repaired off park premises. Any damage created by leaking vehicles will be repaired at guests' expense. Guest may not at any time disassemble, build, rebuild, or repair any vehicle motor, transmission, or other vehicle parts upon park premises. No tires, drums, generators, refrigerators, freezers or other storage containers allowed in space. Storage containers under RV are allowed, if maintained and kept orderly. Keep all cords, cables and hoses coiled and bundled. Overall, the RV should look and function as it was originally designed. While we can’t provide a list including every possible scenario, following are a few examples that should be helpful: Doors, shrouds, panels, windows and coverings, etc. should be intact and not unsightly, exterior should be not unsightly, and should be free of obvious, poorly-repaired damages, tarps cannot be used for weatherproofing and awnings should be in good condition, Air conditioning units should not be added through the walls or windows, all hoses, wires, etc. should route through ports as originally designed, exterior should be free of duct tape, repair tape, excessive caulk, etc. Isolated minor issues are generally acceptable, provided multiple issues aren’t combined to substantially deteriorate the appearance of an RV: minor body damage which has been properly repaired but is still visible, fading of decals and/or paint, minor window cracking, although replacements should be scheduled, damage from traveling that has just happened, especially if you have a repair plan.
●No Fireworks Allowed. No Open Firearms Displayed.
●Fires: No open flames, ground fires or camp fires of any type are allowed at any time. Small personal BBQ Grills are allowed.
●Children: Country Pines RV Park, LLC or Park Management shall not be liable for children’s safety or welfare. Guest is responsible for their conduct and financially responsible for any damages incurred by their children.
●Clothes Lines Are Not Allowed. Electric Space Heaters Are Not Allowed. Country Pines RV Park, LLC shall not be liable for any electrical components on RV’s.
●Conduct: Disorderly conduct, drunkenness, illegal drugs, obscene language, obnoxious, disruptive or vulgar behavior, including loud disruptive music, will not be tolerated. Person(s) caught in violation of this rule are subject to immediate eviction without a refund.
●Liability: All park facilities and equipment of the park is intended for the convenience of the guests. Any and all persons using the facilities do at THEIR OWN RISK and consent. Country Pines RV Park, LLC or Park Management shall not be liable for accident due to fire, theft, wind, flood, personal negligence, acts of God or other unfortunate circumstances. Guest is financially responsible for all individuals or pets at their rv space and for any and all damage to park premises. Any guest selling or giving their trailer to another must notify the new owner that they will not be allowed to live on the park premises without prior approval permission from the Lessor.
●Upon notice, Guests shall have 72 hours to vacate. Failure to comply will result in all utilities and electricity to be disconnected immediately and the recreational vehicle shall be towed for impound at your expense and/or Country Pines RV Park, LLC shall proceed against you as the law directs. Electricity and water are the property of Country Pines RV Park, LLC. Failure to pay any amount due is considered “Theft of Service” & “Criminal Trespass” Texas Penal Code 31.04 and 30.05.
These rules are for the health, cleanliness, legality and welfare of all. Park management reserves the right to evict or refuse service 1.) to any person or persons who break or disregard any rules without refund, 2.) to any rv based upon appearance and/or condition. Park management reserves the right to make changes to park rules and fees when necessary and without prior notification. This property is under 24 hour video surveillance. Equipment in use is to aid in the prosecution of any crimes committed against this business.
1.Payments: In accordance with Texas State Law, payment for services is required at the time of registration. There will be a $35 fee for any returned check and a $10 fee for credit card declines. If applicable, late charges will apply as well. Country Pines RV Park, LLC reserves the right to change all billable rates at any time and without prior notification.
2.Long-term/Monthly Guests: The monthly rate is based on a maximum of (6) guests per space. Payments are due on the (1st) of every month and no later than the (5th) of the month. A $40 late payment fee is automatically applied to a guest’s account on the (6th) day. Electric meters will be read prior to the (1st) of the month and the charge will be added to the guest’s bill at the current billable p/kWh rate. An electricity security deposit is required at time of reservation. If payments are not made by the (7th) day of the month, all outstanding charges will be automatically charged to the card on file and is subject to credit card decline fee if card is declined. Country Pines RV Park, LLC reserves the right to change all billable rates at any time and without prior notification.
3.Cancellations: Daily/Weekly: Canceled reservations will receive a full refund, less a $15 cancellation fee. Monthly: Reservations canceled more than 14 days from arrival date will receive a full refund, less a $50 cancellation fee. Reservations canceled less than 14 days from arrival date will receive a 50% refund, less a $50 cancellation fee. Country Pines RV Park, LLC reserves the right to change all billable rates at any time and without prior notification.
4.Refunds: No refunds will be given for early departures, "no shows", inclement weather, failure to follow the Park Rules and Terms or for mandatory evacuation order given by competent authority. Electricity Security deposits are refunded on monthly stays, upon move-out site inspection and the deduction of the last metered electric charge. Country Pines RV Park, LLC reserves the right to have discretion on all refunds. Refunds will be issued to the original payment used, no exceptions.
5.Credit Card Authorization: Guest agrees that by providing Country Pines RV Park, LLC a credit card; the credit card will remain on file and the guest understands that Country Pines RV Park, LLC may charge the saved credit card for any payment due.
6.Assignment and Subletting: Guest shall not sublet the RV Space or any part of the park premises.
7.Multiple Occupancy: It is expressly understood that this agreement is between Country Pines RV Park, LLC and each guest individually and severally. In the event of default by any one guest, each and every remaining guest shall be responsible for timely payment and all other provisions.
8.Default: Any failure by guest to pay payment or other charges in full by midnight on the fifteenth (15th) day of the month, or failure to comply with any other terms, conditions or park rules shall, at the option of Country Pines RV Park, LLC, promptly terminate this tenancy, forfeit all rights of guest under this agreement and Country Pines RV Park, LLC shall automatically and immediately evict guest, his/her family and possessions from the park premises.
9.Abandonment: If guest removes or attempts to remove property from park premises other than in the usual course of continuing occupancy, without having first paid Country Pines RV Park, LLC all monies due, residence may be considered abandoned, and Country Pines RV Park, LLC shall have the right to store or dispose of any property remaining on park premises by guest. In the event Country Pines RV Park, LLC reasonably believes that such abandoned property has no value, it may be discarded. All property on the park premises is thereby subject to a lien in favor of Country Pines RV Park, LLC for payment of all sums due hereunder to the maximum extent allowed by law.
10.Damages: Guest agrees to pay for damages caused to the Country Pines RV Park, LLC park premises by guest and/or each guest individually.
11.Right of Access: Guest shall permit Country Pines RV Park, LLC or its agent to enter the rented RV Space to access utilities for maintenance or in case of emergency. Country Pines RV Park, LLC may enter at any time to protect life and prevent damage to the park premises.
12.Maintenance and Redelivery of RV Space: Guest shall always keep and maintain the RV Space in a clean and sanitary condition, and upon the expiration or earlier termination of the tenancy shall surrender the RV Space to Country Pines RV Park, LLC in as good condition as when received, ordinary wear and tear and damage by the elements excluded.
13.Indemnification: Guest shall indemnify, defend, and hold Country Pines RV Park, LLC harmless from any and all claims, demands, damages (including reasonable attorney’s fees and costs), costs, expenses, water, wind, civil strife, or acts of God, actions, both intentional or unintentional, of other guests, customers, invitees, or licensee of guests or any other guests actions or inactions (or those of their employees, agents or invitees), or any other causes related to guests use or occupation of the RV site. Guest shall further indemnify, defend, and hold Country Pines RV Park, LLC harmless from any and all claims and damages (including reasonable attorney’s fees and costs) arising from any breach or default in the terms or arising from any act, negligence, fault, or omission of guest and from and against any and all costs, reasonable attorney’s fees, expenses, and liabilities incurred on or about such claim or any action or proceeding brought on such claim. In case any action or proceeding shall be brought against Country Pines RV Park, LLC by reason of any such claim, guest, on notice from Country Pines RV Park, LLC, shall defend it at guests expense by counsel approved in writing by Country Pines RV Park, LLC.
14.Theft of Service Law: According to Texas Penal Code Section 31.04(b), any guest who leaves without paying for services rendered or who refuses to pay for site services when customarily due, is subject to criminal prosecution. Country Pines RV Park, LLC is providing service hook-ups for your RV. Country Pines RV Park, LLC requires payment in advance and will prosecute any violators under the “Theft of Services” law.
15.Right of Refusal: Country Pines RV Park, LLC reserves the right to refuse service at any time and to have a guest vacated from the property in the event of inappropriate behavior or infraction without refund.
16.Mandatory Arbitration: Any dispute under the terms and park rules shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect.
17.Governing Law: The terms and park rules shall be governed by, construed, and enforced in accordance with the laws of the state of Texas.
18.Waivers: Waiver by Country Pines RV Park, LLC of any breach of any covenant or duty of guest under the terms and park rules is not a waiver of a breach of any other covenant or duty of guest, or of any subsequent breach of the same covenant or duty.
19.Counterparts: If the terms and park rules are executed in multiple counterparts, all counterparts taken together constitute the terms and park rules. Copies of signatures to the terms and park rules are effective as original signatures.
By completing a reservation and by submission of payment; guest(s) acknowledge that they have read, understand, and agree to all Park Rules, Terms and Conditions as set forth in this document.
