WAIVER AND RELEASE FROM LIABILITY FOR INDIVDUAL OWNER FOR USE OF LAND AND CAMPING

 I HEREBY WAIVE AND RELEASE, indemnify, hold harmless and forever discharge CROOKED OAKS RV PARK LLC from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages and liabilities, of every kind and nature, whether known of unknown, in law or equity, that I ever had or may have, arising from or in any way related to my camping activities on the premises of land owned by BENTON RENTALS LLC in the County of HORRY, in the state of SC provided that this waiver of liability does not apply to any acts of gross negligence, or intentional, willful or wanton misconduct.

I understand that the activities in which I will participate are inherently dangerous and may cause serious of grievous injuries, including bodily, damage to personal property and/or death; that injuries can occur because of the condition of the land, and that the land may pose such dangerous conditions due to snakes, insects, spiders, ditches, erosions, sharp rocks, culverts, fallen trees, branches, snow, mud, or other natural and man-made hazards. On behalf of myself, my heirs, assigns and next of kin, I waive all claims for damages, injuries and death sustained to me or my property that I may have against the aforementioned release party to such activity.

By this Waiver, I assume any risk, and take full responsibility and waive any and all claims of personal injury, death or damage to personal property and real property owned by BENTON RENTALS LLC including but not limited to camping and building a campsite on the land, using the land in any manner, form or fashion, including swimming, hiking, crafts sports, field trips, fishing, campfires, and engaging in any outdoor activities or other related activities on and off the premises.

This WAIVER AND RELEASE contains the entire agreement between the parties, and supersedes and prior written or oral agreements between them and concerning the subject matter of this WAIVER AND RELEASE. The provisions of this WAIVER AND RELEASE may be waived, altered, amended or repealed, in whole or in part, only the prior written consent of all parties.

I have read, understand and fully agree to the terms of this WAIVER AND RELEASE. I understand and confirm that by signing this WAIVER AND RELEASE I have given up considerable future legal rights. I have signed this Agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to me. My signature is proof of my intention to execute this complete and unconditional WAIVER AND RELEASE of all liability to the full extent of the law. I am 18 years of age or older and mentally competent to enter into this waiver. This agreement and its terms and provisions will include any minors who accompany me or are under my care. I further agree that I shall assume responsibility for watching and caring for minor’s safety and guarding against all hazards, natural or man made, whether expressly mentioned in this WAIVER AND RELEASE or otherwise.

Crooked Oaks RV Park LLC Policies & Rules

Check-In Time: 1:00 PM Check-Out Time: 11:00 AM

1. Tenants and Guests assume responsibility for any damages or injuries caused by themselves, their children, and/or pets.
2. Tenant acknowledges and accepts all associated risks, agreeing to hold the Landlord harmless and indemnify against any such occurrences.
3. The resort disclaims liability for personal injuries, as well as loss, theft, or damage to personal property or vehicles.
4. The management reserves the right to evict any individuals not adhering to the established rules and policies.
5. All guests and visitors must register at the office upon arrival or at the Guard Shack after hours.

7. Parking passes must be prominently displayed by all guests and visitors while on the property.
8. Motorhomes, RVs, or Travel Trailers must be maintained in good working order and appearance.
9. The management retains the right to deny access to guests with vehicles deemed unacceptable.
10. Tent camping is permitted exclusively on designated tent sites.
11. Tents are limited to a maximum of two per site, with an additional nightly fee of $10 per tent.
12. Our Rates are valid for a maximum of 6 guest. Limited to 4 adults. 
13. A maximum of 12 people are allowed at a site at any given time. (For Gatherings)
14. Visitors are welcome between 9 am and 10 pm, provided they register at the office beforehand.
15. Overnight stays for visitors are prohibited; all visitors must vacate the premises by 10:00 PM.
16. All visitors must check in. Please have them resigister at the Welcome Center, or if after hours, at the guard shack upon arrival. Visitors must pay a $8 visitor fee per visit and sign necessary waivers.
17. Overnight parking or storage of trailers is not permitted unless approved by management.
18. Tiki torches are strictly prohibited on the premises.
19. Propane grills and propane fire pits are permitted.
20. We do not allow rugs or screen canopies on the grass for an extended period of time.
21. Blowup mattresses, sleeping bags, and cots must remain indoors; outdoor usage is prohibited.
22. Maintenance on RVs or vehicles is only allowed in the case of a camping-related event or with management approval.
23. Washing of RVs or vehicles on the property requires prior approval from management. We will only allow Detailing Monday through Thursday 9:00am to 4:00pm.
24. Use of any paint products or chemicals is prohibited.
25. Clotheslines are not permitted.
26. Hanging of items from trees is prohibited.
27. All sites must be maintained in a neat and clean condition throughout the duration of the stay.
28. Each site allows for 1 RV and a maximum of 2 additional vehicles, unless otherwise approved by management.
29. Trash should be disposed of in tied trash bags at the end of your site or in the Dumpster, boxes must be broken down. 
30. Trash must not be left out after 12:00 PM or overnight; curbside pickup is scheduled daily by 12:00 PM.
31. It is strictly prohibited to charge any electric vehicle except golf carts within the premises or areas where this policy is enforced.
32. Unauthorized use of electrical outlets or charging stations for charging electric vehicles is prohibited.
33. Any modification or tampering with electrical infrastructure to facilitate charging electric vehicles is strictly prohibited.
34. Only golf carts, traditional peddle bicycles, tricycles, push scooters, and E-Bikes with pedals are permitted on the premises. No other self-propelled vehicles are allowed unless approved vehicles for medical purposes.
35. Golf carts must be operated by persons 16 years or older.
36. All vehicles must be equipped with functional lights at both the front and rear for safety purposes.
37. Users of all permitted vehicles must adhere to designated pathways and speed limits to ensure the safety of pedestrians and other vehicles.
38. Guests are required to operate vehicles responsibly and comply with all posted rules and regulations.
39. Violation of these rules may result in the revocation of riding privileges.
40. Boats, boat trailers, cargo trailers, or car dollies must be accommodated on the concrete pad of the rented site; parking on grass or other sites is prohibited.
41. The use of drones or remote-controlled machines is strictly prohibited on the property.
42. Crooked Oaks RV Park LLC is situated within a natural wildlife habitat; guests are advised to supervise pets and small children due to the presence of coyotes, birds of prey, and reptiles.
43. Landscaped, rocked, or designated natural areas are off-limits to guests.
44. While pets are permitted, we require that they are never left outside unattended, and owners are expected to promptly clean up after them.
45. Additionally, all pets must be on a leash or in a fenced-in area to ensure their safety and the safety of others.
46. By signing the Terms and conditions, you are stating your pet is not known to be aggressive.
47. All mail or packages received after check out will be returned to sender unless other arrangements are made. 
48. Pool hours are 9:00am to 10:00pm. Children under 14 years of age must be accompanied by an adult over the age of 18. Proper swimwear is mandatory. Children who require a diaper must wear a swim diaper while swimming or in the splash pad. It is important to note staff members are not trained or designated lifeguards. Glass items are strictly prohibited inside the pool area. 

1. Monthly Rent Reminder: Payment for your monthly reservation is due prior to your next month of stay. Please ensure your full rent payment is submitted on time to avoid any further action, including possible legal fees and/or removal from the park.
2. Maintain a Clean and Tidy Site
   Please keep your RV space neat and free of clutter. Outdoor items should be organized, and no trash or debris should be left around your site.
3. Dispose of Trash by 12:00 PM Daily
   All trash must be bagged and placed in the designated collection area before noon each day to help keep our park clean and pest-free.
4. Honor the Weekly Mowing Schedule
   On your scheduled mow day, please move any outdoor pet fencing, rugs, furniture, and other items off the grass by morning. This allows our team to maintain the grounds properly.
5. Respect the Visitor Policy
   All visitors must be called in to the front office and they must sign a waiver and pay an $8 fee per visit. It is your responsibility to make sure your guests are checked in properly before entering the park.
6. Keep Your RV Looking Presentable
   RVs must be in good repair, clean, and free of visible damage or deterioration. Please promptly fix any issues that affect the appearance of your site.
7. Prevent Leaks and Vehicle Damage
   Leaky vehicles or RVs are not allowed. Please address any oil, coolant, or water leaks immediately to prevent damage to park grounds and driveways.
8. Obey All Speed Limits
   For the safety of everyone—especially children and pets—please follow the posted speed limit signs throughout the park. This applies to all guests and visitors.
9. Follow Our Pet Policy
   All pets must be on a leash at all times and supervised when outside. You are responsible for cleaning up after your pets immediately. No exceptions.
