EAGLE'S NEST CAMPGROUND
LICENSE, RELEASE, AND INDEMNITY AGREEMENT
Welcome to Eagle's Nest Campground! We are pleased to host you and your party. This agreement outlines the terms and conditions for your stay and is designed to ensure a safe and harmonious environment for all. By signing this agreement, you acknowledge and agree to be bound by the terms herein, as well as by all park rules and policies.
1. Offender Policy
Eagle's Nest Campground maintains a strict no-offender policy. No registered offenders are permitted to reside in the community. A background search will be conducted at the time of reservation to ensure compliance.
2. Nature of Occupancy: Temporary License and Extended-Stay Tenancy
This Agreement begins as a revocable, temporary license for recreational camping. The Licensee's use of the RV site and facilities is non-exclusive and subject to all park rules. The Licensee understands that Eagle's Nest Campground is a temporary recreational facility and not a residential community.
However, the Licensee and the Owner agree that if the Licensee's stay extends beyond 28 consecutive days, the relationship will be deemed to have transitioned from a temporary license to a month-to-month tenancy for the purposes of complying with the North Carolina Residential Landlord and Tenant Act.
In the event this tenancy is established, the following terms shall apply:
The Licensee will be considered a tenant, and the Owner a landlord, as defined by North Carolina law.
The monthly rent will be the then-current monthly rate for the RV site.
The tenancy may be terminated by either the Owner or the Tenant by providing a written notice of termination. This notice must be given at least 30 days before the termination date, which shall be a periodic rent-paying date.
The Owner may terminate the tenancy for cause, including non-payment of rent or violation of this Agreement, by following the notice and eviction procedures set forth in the North Carolina Residential Landlord and Tenant Act. This includes, but is not limited to, the issuance of a ten (10) day notice for non-payment of rent.
The Licensee agrees that all other provisions of this Agreement will continue to apply as valid terms of the month-to-month tenancy.
The Licensee must maintain a separate permanent residence address for the duration of the stay.
3. Acknowledgment and Assumption of Risk
The Licensee is aware that outdoor activities and the use of park facilities carry inherent risks, including those related to natural occurrences (e.g., storms, wildlife) and the use of equipment (e.g., grills, campfires). The Licensee and their party hereby assume all risks of injury, loss of life, and damage to persons or property (including pets) and are responsible for taking all necessary precautions to ensure their safety and the security of their belongings.
4. Release of Liability and Indemnity
The Licensee and all members of their party agree to release, indemnify, and hold harmless the Owner, its members, managers, officers, employees, and agents from any and all claims, liabilities, demands, costs, or expenses arising from the Licensee's use of the property. This release extends to all claims caused by ordinary negligence, but it does not apply to claims resulting from the Owner's gross negligence, willful misconduct, or intentional acts. The Owner does not maintain insurance on the Licensee's property, trailers, or contents.
5. Pet Policy
Our pet policy is designed to ensure the safety and comfort of all guests. The ability to have a pet is a privilege, not a right, and may be revoked for non-compliance.
Pet Registration: All pets must be registered with the Lessor upon arrival and show proof of current rabies vaccination.
Restricted Animals: For the safety of our community, the following animals and/or breeds are not permitted: exotic or wild animals, and breeds (or their mixes) that may be deemed aggressive by some insurance providers. This list includes: Pit Bulls, American Staffordshire Terriers, Rottweilers, German Shepherds, Chow Chows, Huskies, Akitas, Wolf Hybrids, Doberman Pinchers, and Bull Mastiffs. The Owner reserves the right to prohibit any animal based on its individual behavior, regardless of breed.
Service and Assistance Animals: Legally recognized service animals are not considered pets and are welcome, subject to all park rules regarding behavior and control. For an assistance animal accommodation request, the Licensee must submit a request through PetScreening.com for review, as we will engage in the interactive process as required by the Fair Housing Act and other applicable laws.
Pet Conduct: Pets must be on a handheld leash at all times when outside the RV. They must not be left unattended outside. Excessive barking or other disruptive behavior is prohibited.
Waste Removal: Licensee is responsible for the immediate and proper disposal of all pet waste. A violation will result in a $25 fine.
Liability: The Licensee is fully responsible for their pet's conduct and any damage or injury caused by their pet.
6. Fees and Charges
All site fees are due in advance on the due date. If tenancy is established, site fees are due on the first of the month. A late fee of $50.00 will be applied on the sixth day of the month. If your credit/debit card on file is used to cover unpaid fees, damages, or cleaning charges after your departure, an itemized statement will be emailed to you. The Owner reserves the right to charge any designated payment method for all fees, expenses, or damages.
7. Guest and Vehicle Policies
Visitors: All visitors must register with the office upon arrival. The visitor fee is $3 per person. Visitors must abide by all park rules and policies.
Vehicles: Each RV site allows for one vehicle. All vehicles must be registered, parked on the designated pad (not on the grass), and in operating condition with current registration and insurance. No vehicle repairs are permitted on-site.
Mail: This address may not be used for official documents or bills. Any such mail will be returned to the post office.
8. RV and Site Maintenance
RV Condition: For extended stays (28+ days), RVs are subject to pre-approval and are generally required to be less than 10 years old. The RV must be well-maintained and kept clean.
Site Appearance: The site must be kept neat and free from clutter. Items creating a "sense of permanence" are not permitted, including refrigerators, sheds, clotheslines, and fences.
Termination of Agreement: Upon termination of this agreement, the Licensee agrees to surrender the RV site in a clean condition. The Owner may assess reasonable charges for cleaning or repairs and debit the card on file for these costs. Any items causing a negative impression of the site may be removed and discarded at the Owner’s discretion.
9. Emergency Preparedness
In an emergency, the Owner will use available communication methods (e.g., social media, email, phone, in-person) to provide information. The Licensee is responsible for staying informed about local conditions and should call 911 for all emergencies.
10. General Provisions
Governing Law: This agreement will be governed by the laws of the State of North Carolina.
Severability: If any provision of this agreement is found to be unenforceable, the remaining provisions will remain in effect.
Binding Agreement: This agreement is binding on the Licensee, their heirs, and assigns. The Licensee agrees to reimburse the Owner for any costs and reasonable attorneys' fees incurred in enforcing this agreement.
I/we have read and understand the terms of this License, Release, and Indemnity Agreement and agree to abide by them.
I/we also acknowledge and agree that my electronic signature is the legal equivalent of a hand-written signature and is legally binding.
