EAGLE’S ROOST RV RESORT

General Policies & Liability Waiver for Eagle’s Roost RV Resort and Carver, LLC

WARNING – Under Georgia law, an agritourism provider is not liable for an injury to, or the death of, a participant in agritourism activities at this location if the death or injury results from the inherent risks of agritourism activity.  Inherent risks of agritourism activities include risks of injury inherent to lane, equipment, and animals as well as the potential for you to act in a negligent manner that may contribute to your injury or death, or for other participants to act in a manner that may cause you injury or cause your death. You are assuming the risk of participating in this agritourism activity.

POLICIES – 

Check in – 2pm Check out – 12 noon Late Check out – 6pm Early Check in – If available

All campers and visitors must check in at the main office upon arrival

LATE ARRIVALS & DEPARTURES – For late arrival arrangements or to check on early arrivals, please contact us during normal business hours. If arrangements have not been made in advance for late departures and if the guest has not departed the site by the appropriate check out time, then there will be an additional day charged to the account.

SITE CHANGES – You have been assigned a specific site. If you wish to make a change, please check with the front desk during normal business hours and we will do our best to accommodate. 

SPEED LIMIT – The Speed limit is 10 MPH. Drive slowly and watch for children.  Guest is responsible for Guest’s visitors, invitees and family members’ compliance with the speed limit in the Campground. Guest is not allowed to have an unlicensed person operate a vehicle on the Property or in the Campground.

VEHICLES (ATVs, UTVs, GOLF CARTS, DIRT BIKES, OFF ROAD MOTORCYCLES) – No recreational vehicles are permitted on the property. No bicycle riding after dark. Helmets are recommended. 

SITE & PARK NAVIGATION – Please be respectful of your neighbor and do not walk between sites when navigating the park. Please use main roads and public paths to walk around the campground.

WIFI – Our WIFI service is available throughout the property. However, we cannot guarantee WIFI reception at each site. The Campground’s Internet Access Network may only be used for lawful purposes. Transmission of any material in violation of federal or state statutes/regulations is prohibited.

WASHING – Washing RVs or vehicles is allowed at your site with a $10 charge. Please coordinate this with our front office. 

LAUNDRY – Washers and dryers are available for a fee in our Laundry Area. Please do not leave your laundry unattended.  You are not allowed to wash or dry pet bedding, extra large items, anything containing dangerous chemicals or anything out of the ordinary.  Laundry supplies are available to purchase in our Gift Shop.

CLOTHESLINES – Clotheslines are not permitted to be hung on trees or shrubbery.

FISHING – Fishing is not allowed in Ocean Pond.  This is a private pond and access is strictly prohibited.

QUIET TIME – Quiet time is 10pm until 7am. Any noise disruptions including loud music will be warned once then asked to leave without a refund.

TRASH - Trash must be bagged and left at the curb in the morning.

CANCELLATION POLICY - Cancellations 30 days or less before arrival will incur a $25 fee. Cancellations 72 hours or less before arrival forfeit the deposit (no refund). We will offer you a voucher to redeem for a future stay to avoid the cancellation fee. We do not offer refunds for weather-related events unless we are under a mandatory evacuation by local, state or federal agency. 

PETS -  A guest may have no more than two pets on the Property. All pets on the Property or in the Campground must be leashed at all times. Guests must clean up after Guest’s pet(s). Guests are responsible for all proper up-to-date vaccinations and be able to provide proof. Guest is responsible for any claim, loss or damage caused by Guest’s pet(s). Park Management, at any time, may request a pet be removed from the Property or the Campground. Pet owner agrees to the “Pet Policy” agreement. Barking or aggressive dogs will be required to leave the park if they become a common nuisance to the other guests. Dogs may not be kept leashed outside without an owner present with them. No dog kennels or houses on RV sites. Notice to guests.NO AGGRESSIVE DOG BREEDS ALLOWED. NO PIT BULLS, NO DOBERMANS, NO ROTTWEILERS,NO GERMAN SHEPHERDS.

GENERAL SITE APPEARANCE - Please do not remove any trees, flowers, shrubs, foliage or any other similar item without prior written approval from Park Management. Portable air conditioners, electric hot water heaters, electric stoves, washing machines, dryers, dishwashers, generators and electric space heaters are not allowed to be used on the property. Yard décor may be disapproved at management discretion. All outdoor items must be in good repair, and may not be chipped, broken, faded or have peeling paint. Please avoid items that may be deemed offensive in nature. No sleeping in personal vehicles, or anywhere outside of RV.

FIRES & FIREWOOD - Guest must keep all fires within the designated fire ring. Guests must extinguish all fires prior to leaving the campfire and property. All fires must be safely maintained.  Firewood from outside sources is not permitted. Firewood can be purchased at the office.

ADDITIONAL GUESTS - Additional adults are $10 per adult per day, and additional vehicles may park for FREE in our overflow lot. Please check in with Management, register the vehicle and obtain a parking permit. Registration of all people, pets, and vehicles is REQUIRED upon arrival. Unregistered persons or pets found on property will be removed. There is a max of (1) camping unit and (1) vehicles on each site. Our base rate covers (1) camping unit, (1) vehicle, (2) Adults and (2) Children. Overflow parking is available.

SMOKING - Smoking is not permitted inside any building, cottages or cabins. Cleaning fees will apply.

CHILDREN - Guest must accompany AT ALL TIMES any children under the age of ten (10) on the Property or in the Campground. Guest is responsible for any claim, loss or damage caused by Guest’s children, guests, invitees or other family members.

POOL - All Guests must obey the pool rules.  Pool is only open during daylight hours. There is NO LIFE GUARD ON DUTY. Swim at your own risk. No pets and NO GLASS CONTAINERS are allowed in pool area. No running or diving.

DANGEROUS MATERIALS - Dangerous materials are not allowed on the Property or in the Campground. Guest shall not at any time have anything of a dangerous, flammable or explosive character on the Property or in the Campground. Fireworks are not allowed on the Property or in the Campground.

ALCOHOL & BEHAVIOR - Guest may not allow a minor to consume or possess alcohol on the Property or in the Campground. Unruly, rowdy, lascivious or intolerable behavior is not allowed on the Property or in the Campground. Guest and Guest’s visitors, invitees and/or family members are to conduct themselves in a respectable manner. Illegal or non-prescription drugs are not allowed on the Property or in the Campground.

SOLICITATIONS -  No soliciting of business is allowed on Campground property unless specifically permitted such as a Campground-sponsored event. Signs for the sale of products, services and RVs are not allowed.

SECURITY - Video cameras are in use in common areas of the property. These devices, or lack thereof, are not a guarantee of personal safety or protection of personal property and are not a guarantee against criminal activity. Security camera footage is owned by the Campground.

The Management assumes no responsibility for accidents, injuries, thefts or losses from any cause. Management is not responsible for lost, stolen or damaged articles. Please be sure to keep your valuables and bikes locked when not in use. Park Management reserves the right to eject any person from the Property or the Campground for any violation of these rules or regulations at any time. Those who are told to leave the campground must do so immediately with no refund.

If you need to call 911 and time allows, please call the Office so that staff can be prepared to escort the emergency personnel to your site. If you observe any activity you believe to be of concern, please call the Office.

If payment is made by credit card a 3.25% administrative fee will be added.

This property is privately owned. We reserve the right to refuse service to anyone and will not be responsible for accidents nor injury to guests or loss of money and/or valuables or property of any kind.

Carver, LLC dba Eagle’s Roost RV Resort.,its owners, agents, officers, employees, subsidiaries and or assigns will not be responsible for any bodily injury or property damage incurred by any wild or domestic animal. It is in your best interest not to contact, feed or pursue an animal in any way. 

Do not destroy or aid an injured animal that you may encounter. Call animal control. Pets must be on a leash at all times and must be cleaned up after. Please use the pet walk area.

Eagle’s Roost RV Resort Liability Waiver

 All Eagle’s Roost RV Resort guests must be checked in and out upon arrival and departure and agree to the resort’s following rules and regulations. Acknowledgment of risks, release, indemnification agreement and covenant not to sue.  Each part of this document must be completed and signed before using Eagle’s Roost RV Resort (referred to as Eagle’s Roost RV Resort from here on) facilities or participating in Eagle’s Roost RV Resort activities.

  1. Acknowledgement of Risks 

The undersigned user ("User") hereby acknowledges and agrees that the use of the facility operated by Eagle’s Roost RV Resort has inherent risks. User fully recognizes and appreciates the dangers inherent with lakes, outdoor activities and general areas at Eagle’s Roost RV Resort. User is assuming the hazard of risk to User since User desires to use facilities at Eagle’s Roost RV Resort. User realizes that User is subject to injury from these activities and that no form of pre-planning can remove all the danger to which User is being exposed. User further represents and warrants to Eagle’s Roost RV Resort that User has full knowledge of the nature and extent of all risks associated with activities at Eagle’s Roost RV Resort and the use of equipment, including but not limited to risk of physical injury, disability, or death and risk of loss of use or damage to my personal property. Risks include but are not limited to weather-related hazards, animal, or insect attack, allergy or injury or death from plant life, drowning, the possibility of slips and falls, pinches, scrapes, crushing or jolts that could result in lacerations, fractures, burns, or even more severely debilitating or life-threatening hazards. I understand that injury or loss may result from unknown or unexpected risks, but may also result from environmental conditions, from the acts or omissions of others, or from the unavailability of immediate and/or adequate emergency medical care, the use of equipment, materials owned by, or facilities acquired by the Eagle’s Roost RV Resort, injuries resulting from the actions, omissions or negligence of Eagle’s Roost RV Resort or others; blatant or apparent defects or conditions in equipment or property supplied by Eagle’s Roost RV Resort; injuries resulting from the physical condition or actions, omissions, negligence in any degree of User; all manner of injuries resulting from falling off of bikes and hitting furniture or other items such as, but not limited to, tables, chairs, or the ground; injuries resulting from contact with other users of Eagle’s Roost RV Resort facilities and activities; injuries resulting from contact with Eagle’s Roost RV Resort Facilities including but not limited to ladders, doors, counters, windows, and furniture whether permanently or temporarily in place; first aid, emergency treatment or other services rendered by Eagle’s Roost RV Resort or others; and there is also the possibility that my engaging in such activities could cause injury or harm to a person other than myself. 

BY ENGAGING IN THESE ACTIVITIES, THE PARTICIPANT ASSUMES THE RISK OF SERIOUS INJURY OR DEATH. 

I understand that Eagle’s Roost RV Resort does not guarantee my personal health or safety at any point during my use of Eagle’s Roost RV Resort Facilities, nor does it protect me against risk of loss of my personal property. I understand the Eagle’s Roost RV Resort does not assume responsibility for the actions of others, for events that are not part of the Eagle’s Roost RV Resort, or that are beyond the control of the Eagle’s Roost RV Resort or its contractors, or for situations that may arise due to the failure of the User to disclose pertinent information. 

  1. Releases, Indemnification and Covenant Not to Sue 

User voluntarily releases and forever discharges and covenants not to sue Eagle’s Roost RV Resort, and all other persons or entities affiliated therewith, from any and all liability, claims, demands, actions, or rights of action, which are related to, arise out of or are in any way connected with User's attendance at Eagle’s Roost RV Resort or participation in any Eagle’s Roost RV Resort activity, including, but not limited to any and all negligence, of Eagle’s Roost RV Resort, its agents or employees, and all other persons or entities, for any and all injury, death, illness or disease, and damage to User or User's property. User further agrees, promises and covenants to hold harmless and to indemnify Eagle’s Roost RV Resort, its agents, workers, directors and employees, and all other persons or entities against all damage which user may negligently or intentionally cause to spectators or other third parties in the course of User's participation in any Eagle’s Roost RV Resort activity. User further agrees, promises and covenants not to use, assert or otherwise maintain any claim against Eagle’s Roost RV Resort, its agents, workers, directors and employees, and all other persons or entities, for any injury, death, illness or disease, or damage to User or User's property, arising from or connected to User's participation in any activity or from any claims asserted against User by spectators or other third parties. In signing this document, User fully recognizes that if anyone is hurt or dies, or property is damaged while. User is in Eagle’s Roost RV Resort facilities, User will have no rights to make any claim or file a lawsuit against Eagle’s Roost RV Resort, its agents or employees even if Eagle’s Roost RV Resort, its agents or employees, or any of them negligently caused the bodily injury or property damage. 

  1. Acknowledgment of Effect of This Release Agreement 

User Understands and acknowledges that by signing this document User has given up certain legal rights and/or possible claims which User might otherwise assert or maintain against Eagle’s Roost RV Resort, its agents, workers, directors or employees, and other persons or entities, including but not limited to rights arising from or claims for the acts or omissions, fault, or negligence of Eagle’s Roost RV Resort, its agents or employees or any other persons or entities. User understands and acknowledges that by initialing and/or signing this document, User has assumed responsibility and LEGAL LIABILITY for the claims or other legal demands, including defense costs, which may be asserted by third parties against User as a result of User's use of the Eagle’s Roost RV Resort. 

  1. Participant Insurance Benefits and Representation of Physical Condition

 User understands and acknowledges that no medical insurance benefits will be provided to User for injuries occurring while User is using Eagle’s Roost RV Resort. User certifies that User has sufficient health, accident, and personal liability insurance to cover bodily injury, property damage, or any consequences resulting from User's participation in Eagle’s Roost RV Resort activities. If User has no such insurance, User certifies that User is capable of personally paying for any and all expenses or liability. User further acknowledges that the undersigned is in good physical and mental health, not suffering from any condition, disease, or disablement, which would or could potentially affect participation in activities at Eagle’s Roost RV Resort. 

  1. Consideration 

In consideration of this agreement, Eagle’s Roost RV Resort will permit User to participate in Eagle’s Roost RV Resort activities, subject to user's compliance with all Eagle’s Roost RV Resort Rules, Regulations and Safety Policies, which may be amended from time to time. It is the responsibility of User to request to inspect all such Rules, Regulations and Policies. Eagle’s Roost RV Resort retains the right to deny entrance to its facilities or participation in its activities, to anyone in its sole discretion. User understands that this constitutes the entire agreement between undersigned ("User") and Eagle’s Roost RV Resort, its agents or employees, and that it cannot be modified or changed in any way by the representations or statements of Eagle’s Roost RV Resort, its agents, workers, directors, or employees or by User. User’s and Parents/Guardians’ signatures below indicate that they have read this entire document in full, understand it completely, and agree to be bound by its terms. This Waiver and Release is a Georgia contract and User consents to the jurisdiction and venue for any action relating to this Waiver and Release in Lake Park, Georgia regardless of User's residence or domicile. 

6. Acknowledgement of Responsibility 

○ I consent to medical treatment in the event of injury, accident and/or illness during my use of the Eagle’s Roost RV Resort. 

○ In the event I am injured or become ill while participating in this during my use of the Eagle’s Roost RV Resort, I understand and agree that I will accept responsibility for any medical bills, including co-payments and deductibles.  

 ○ In the event I am injured, or my property is damaged as a result of my use of the Eagle’s Roost RV Resort, I will not seek reimbursement from the Eagle’s Roost RV Resort.

 ○ In the event that while using the Eagle’s Roost RV Resort, I cause harm to another person or another person’s property I accept sole responsibility for my actions and indemnify the Eagle’s Roost RV Resort and hold it and its officers, directors, employees, contractors and assigns harmless therefrom. 

7. Photographic Releases 

As a User, I grant and convey unto the Eagle’s Roost RV Resort, all right, title and interest in any and all photographic images, video and audio recordings obtained during my use of the Eagle’s Roost RV Resort.

8. Covid-19 

I “Releasor” or “I” on behalf of myself and the occupants of my camping unit (meaning any physical unit located in a campground), hereby release, and indemnify Eagle’s Roost RV Resort(“campground” and “releasee”), its owners, agents, servants and employees from any liability regarding me or anyone staying in my camping unit relating to COVID-19 and any other viruses or illnesses that they may get as a result of staying at Eagle’s Roost RV Resort. 

In signing this release, I acknowledge and represent that: 

A. I have read the foregoing release, understand it, and sign it voluntarily as my own free act and deed; 

B. No oral representation, statements, or inducements, apart from the foregoing written agreement, have been made; 

C. I am at least eighteen (18) years of age and fully competent and 

D. I execute this Release for full, adequate, and complete consideration fully intending to be bound by same. 

E. I agree that in any action to enforce or interpret the terms of this Agreement, the prevailing party shall be awarded, in addition to any other remedy or compensation, its reasonable attorney fees and costs.
