Golden Acres Park Waiver and Release of Liability Agreement

IMPORTANT: This Waiver and Release of Liability Agreement ("Agreement") is required to be read, understood, and signed prior to participating in any activities or utilizing the facilities at Golden Acres Park, a Minnesota based Limited Liability Company located at 15150 Square Lake Trail North, Stillwater MN 55082 ("Golden Acres"). By signing this Agreement, guests acknowledge and agree to the terms and conditions set forth below.

By signing this Waiver and Release of Liability (the "Agreement"), I, the undersigned participant, on behalf of myself, my heirs, assigns, personal representatives, and next of kin, hereby acknowledge, agree, and represent the following to Golden Acres, its agents, officers, directors, shareholders, employees, volunteers, manufacturers, participants, lessors, insurers, successors, and assigns (collectively referred to as "Releasees"):

1. Acknowledgment of Risks: I fully recognize and understand that there are risks and hazards, both known and unknown, inherent in the activities and use of the facilities at Golden Acres, including but not limited to the risk of physical injury, illness, property damage, or death. I voluntarily assume all such risks, both known and unknown, even if arising from the negligence of the Releasees or others and assume full responsibility for my participation and presence at Golden Acres.

2. Waiver and Release: I hereby release, waive, discharge, and covenant not to sue any and all of the Releasees from any and all liability to me, my heirs, and next of kin for any loss or damage, and any claim or demands on account of injury to my person or property or resulting in my death, arising out of, or related to, any and all activities, events, and occurrences at Golden Acres, whether caused by the negligence of Releasees or otherwise, except that which is the result of gross negligence or intentional misconduct of a Releasee.

3. Indemnification: I agree to indemnify and hold harmless Golden Acres from any loss, liability, damage, or cost they may incur due to my use of, presence in, or upon, Golden Acres’ property, including, but not limited to, competing, officiating, observing, working for, or for any purpose participating in any program at Golden Acres, whether caused by the negligence of the Releasees or otherwise.

4. Property Loss: I acknowledge that Golden Acres is not responsible for any personal property that is lost, stolen, or damaged at Golden Acres.

5. Use of Images: I consent to the use of my image and/or the images of my family/group in photographs, video recordings, and electronic images in any and all of Golden Acres publications, including web-based publications, without payment or any other consideration.

6. Emergency Medical Authorization: In the event of an injury or illness where I am unable to consent to medical treatment, I authorize Golden Acres and its representatives to seek emergency medical treatment on my behalf. I agree to be financially responsible for any medical bills incurred because of such treatment.

7. Minor Participants: If I am signing on behalf of minor participants (individuals under 18 years of age), I represent and warrant that I am their parent or legal guardian, and I agree to indemnify and hold harmless the aforementioned parties from any and all claims or liabilities which may arise as described in section 3 above.

8. Compliance with Law & Campground Rules: I agree to comply with all applicable laws. I further agree to comply with all rules and regulations established by Golden Acres. Failure to comply may result in my expulsion from the premises without a refund.

9. Supplements Terms: I agree that this Agreement is in addition to, and does not waive or amend, Golden Acres Park Seasonal Campsite Agreement or Golden Acres Park Nightly Campsite Agreement.

10. Acknowledgment of Understanding: I have read this Waiver and Release of Liability Agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily and intend by my signature to be a complete and unconditional release of all liability of Golden Acres and Releasees to the greatest extent allowed by law.

 

Golden Acres Park Nightly RV Campsite Agreement

This agreement is entered into by and between the undersigned, hereafter referred to as the "Renter," and Golden Acres Park LLC, A Minnesota based Limited Liability Company located at 15150 Square Lake Trail North, Stillwater MN 55082 hereafter referred to as “Golden Acres" The terms and conditions set forth in this document outline the agreement under which the Renter will utilize the services and accommodations provided by Golden Acres. By signing this agreement, the Renter acknowledges and agrees to comply with all terms, conditions, policies, and procedures as outlined herein. This agreement is non transferable.

Terms and Conditions

 

1.     FEES & PAYMENT SCHEDULE

RATES & FEES:

• Nightly rates are subject to change based on the day of the week, holidays, and special events. All reservations are subject to a booking fee, applicable credit card processing fees, and taxes.

 

PAYMENT SCHEDULE:

• 100% of payment is due at time of reservation.

 

2.     BOOKING AGREEMENT

• The booking must be made under the name of someone with a valid credit card and valid ID, and this person is the only one who can sign the rental agreement. Golden Acres can refuse a booking or agreement at its sole discretion

3.      CHECK IN & CHECK OUT

• Check in time is 3:00PM and Check out is 12:00PM.

4.      CANCELLATION POLICY

• 30-Day Notice: Renter must cancel at least 30 days before the arrival date. Cancellations less than 30 days prior to the arrival date will not be refunded. A handling fee of $15 will be deducted from the refunded amount.

• No Show Policy: Renters and guests failing to arrive without cancellation notification (no-shows) will be charged the full balance of their reservation.

• Early Check-Outs: No refunds will be issued for Renters and guests who decide to check out before the end of their reservation period.

• Weather: Refunds will not be provided for cancellations or interruptions due to weather.

 

5.      CAMPING AT YOUR OWN RISK

• The Renter accepts camping privileges with the understanding that they hereby release Golden Acres, its officers and employees, of all liability for loss or damage to property and injury to person, family and/or guests arising out of their use of Golden Acres Park and facilities, and agrees to indemnify Golden Acres Park, its officers and employees, against claims resulting from loss or damage to property or injury to the person or any member of the family or any visitor or guest of the registered camper arising out of the use of its camping facilities.

• Damages or losses caused by electrical outages, wind, rain, lightning, hail or any other weather conditions are not the responsibility of Golden Acres but to be covered under Campers insurance.

 

6.     CAMPSITES

• One unit, one family (two adults, children) per site. Maximum 6 people per site. ALL other arrangements must be cleared with campground management at the time of the reservation.

• To rent a campsite you must be 21 years of age or older.

 

7.      CONSIDERATION OF OTHER RESIDENTS AND CAMPERS

• Quiet hours are from 10 PM to 8 AM daily and will be strictly enforced.

• Seasonal guests are responsible to see that all guests on their campsites observe this rule.

• Large parties with excessive noise are not allowed nor is offensive or unseemly language.

•Camper agrees to be respectful to their neighbors

• Music must be unheard from more than 30 feet away.

 

8.     TRANSIENT BOAT SLIP USAGE

Assumption of Risks

Renter understands that certain risks are inherent in boating and docking, especially docking on a floating dock system such as that in place at the Community Dock, including but not limited to risks associated with getting in and out of the Boat especially in low light conditions, and rainy or stormy weather when the docks and boats may be especially hazardous or slippery. Renters assume all risks associated with boating and docking.

 

Insurance

Renter agrees to obtain and maintain throughout the term of this Agreement, at Renter’s sole expense, on Renter’s Boat, a watercraft liability insurance policy covering property damage and personal injury issued by an authorized insurer with policy limits of not less than $300,000 per occurrence. Licensee hereby waives any claim against Golden Acres Park that is covered by or would be covered by such insurance, including any loss or damage caused or alleged to be caused by the negligence of Golden Acres Park. Renter shall provide proof of such insurance coverage to Golden Acres upon request.

 

No Liability

The Renter assumes all responsibility for the proper attachment of the Boat to the dock and for any damage or loss resulting from the failure to secure the Boat including personal injury and damage to the property of others. Golden Acres shall have no liability for the condition, maintenance and handling of the Boat or any damage caused by storm, fire, theft, vandalism, or other cause.

 

Holding Over

If the boat is not removed by the Renter at the end of the rental agreement period, Renter shall pay a daily docking of $50.00 per day for each day and Golden Acres has the right to relocate or remove the boat.

 

9.      TRASH & RECYCLING

• Golden Acres provides trash & recycling bins near the front entrance for campers to dispose of their trash and recyclables.

• Renter agrees to abide by the rules posted on the front of the trash and recycling bins.

• Please put all trash in strong plastic trash bags that are closed at the top.

• Cut and flatten boxes to conserve space.

• Appliances, TV’s, building materials, lawn chairs, grills, equipment and similar items may not be placed in the dumpsters. Such items should be taken with you when you leave.

• Leaving unapproved items, as described above, will incur the fee to remove it plus $50.

 

10.   GOLDEN ACRES RULES

In exchange for use of Golden Acres facilities, Renter agrees to abide by the following rules, and will ensure guests also adhere to the rules and accept responsibility for their guests actions. Failure to comply with these rules and policies is a breach of this agreement and will result in termination of the Renter’s agreement without refund regardless of when the breach occurs. Termination of the agreement requires an immediate departure from Golden Acres property.

 

Safety

• The speed limit within Golden Acres is 5 MPH. For the safety of all guests—especially small children—and to help minimize dust throughout the park, a strict 5 MPH speed limit is enforced at all times within the RV park.

• All guests, service providers and visitors must be registered with the office prior to admittance.

• No gas or battery powered vehicles (golf carts, ATV’s Side by Sides, etc…) are allowed except for your personal passenger vehicles. Passenger vehicles are not meant to provide transport around the park but are to be used strictly upon entrance and exit of Golden Acres.

•Swim at your own risk, no lifeguard on duty at any time.

Campsites

• Only one family, one RV, are allowed per campsite.

• No use of fireworks or firearms are allowed in Golden Acres at any time.

• Do not leave trash at the campsite or in the fire ring. Trash is to be placed in sealed plastic bags and put in the dumpsters. The dumpsters are for scraps and garbage from daily living. Do not dispose of any other items without Golden Acres approval.

Pets

•Dogs are allowed at Golden Acres.

•Dogs deemed dangerous are not allowed at Golden Acres. If your dog displays dangerous behaviors, you will be asked to remove your dog and/or leave the resort with no refund.

• Dogs must be on a leash at all times. Barking dogs will not be tolerated. Barking dogs may be required to wear a bark collar or may not be permitted within the park. Do not leave your dogs outside, unattended, if you temporarily leave Golden Acres.

• Be respectful of others walking through Golden Acres. Clean up after your pet.

 

Consideration for other Campers

• Quiet hours are from 10 PM to 8 AM. After 10 PM, conversation and camping noise must be restricted to your campsite.

• Children under 16 must be at their campsite by 10 pm.

• Smokers must dispose of cigarette butts in trash containers

• No obscene language.

• Please act selflessly, with concern for your neighbor, with compassion and kindness in all interactions and situations.

 

 Violation of any of these rules allows Golden Acres to administer a $25 fine per occurrence and assert early termination of the agreement.
