Gulf Shores RV Park and Resort, San Leon, Texas
1. Parties
This Agreement ("Agreement") is entered into between Gulf Shores RV Park ("Park") and the undersigned guest(s) ("Guest").
2. RV Site Assignment
The Park provides RV site accommodations to Guest. The Park reserves the right, upon 24 hours' notice, to relocate Guest to a substantially equivalent site within the Park.
3. Term and Occupancy
Term: The Agreement commences on the check-in date and automatically renews every 28 days unless terminated by either party with appropriate notice.
Occupancy Limits: Rates are based on two (2) persons per site. Additional adults (18 years and older) are subject to a $5.00 per night fee. Maximum occupancy per RV is four (4) individuals. All minors under 16 must be accompanied by an adult at all times.
4. Rates and Payment
- Payment Schedule: Rent and electric fees are due at the beginning of each period, daily, weekly, biweekly or 4-weekly. Payments must be made in advance and without demand.
- Late Fees: A $25.00 late fee is assessed on the third (3rd) day past the due date, plus $10.00 per day thereafter until the balance is paid in full. Partial payments are not accepted.
- Payment Methods: Acceptable forms of payment include cash, credit card, money order, or digital transaction, like Zella, Venmo or Apple pay. Personal checks are not accepted.
- Security Deposit and Cleaning Policy: A refundable security deposit of $500 is required for all camper tenants. This deposit covers potential damages beyond normal wear and tear, as well as any necessary cleaning or repairs resulting from misuse.
- An additional $100 cleaning fee will be charged if the unit is not returned in a clean condition upon checkout.
- Deductions from the security deposit may be made for damages or excessive cleaning costs beyond normal wear and tear. Normal wear and tear refers to deterioration that occurs from the intended use of the dwelling and does not include damage resulting from negligence, carelessness, accidents, or abuse by the tenant or their guests.
- In accordance with Texas Property Code § 92.104, an itemized list of any deductions will be provided if applicable. The remaining balance of the security deposit, if any, will be returned within 30 days after the tenant provides a written forwarding address and surrenders the premises.
5. Utilities
Electricity: An electric deposit of $150.00 is required upon booking on sites. Electricity usage is billed at $0.10 per kWh, in accordance with TEX. UTIL. CODE § 184.034. The deposit, minus usage charges, will be refunded upon departure, provided there are no outstanding balances or damages.
Utility Disconnection: If Guest becomes delinquent in payment, the Park may withhold electric services until the delinquent amount is paid, pursuant to TEX. UTIL. CODE § 184.036.
6. Rules and Regulations
Guest agrees to comply with all Park rules and regulations, as well as all applicable federal, state, and local laws. The Park reserves the right to modify rules at any time without prior notice.
7. Termination
By Park: The Park may terminate this Agreement for any reason by providing a three (3) day written notice. In cases of default, no notice is required.
By Guest: Guest may terminate the Agreement by providing a three (3) day written notice. Early termination may result in forfeiture of any prepaid amounts.
8. Default
- Acts constituting default include, but are not limited to:
- Failure to pay rent or other charges timely.
- Providing false information to the Park.
- Violating Park rules or engaging in illegal activities.
- Remaining on the property after notice of termination.
9. Site Condition
Guest acknowledges that the RV site is in good condition upon occupancy and agrees to maintain it accordingly. Upon departure, the site must be left clean and free of debris. Failure to do so may result in additional charges.
10. Assignment
Guest shall not assign or sublet the RV site without prior written consent from the Park.
11. Attorneys' Fees
In the event of legal proceedings to collect unpaid charges, the Park may recover all reasonable costs and attorneys' fees incurred.
12. Notices
All notices under this Agreement shall be in writing and delivered to the addresses provided by the parties. Notices become effective upon mailing by certified mail.
13. Pets
Policy: A maximum of two (2) well-behaved pets are allowed per site. Aggressive breeds are prohibited. Pets must be leashed at all times and never left unattended outside. Guest is liable for any damage or injury caused by his or her pet. The feeding of nutrias and feral cats will not be allowed. Housing for feral cats also will not be allowed.
Responsibilities: Guest is responsible for cleaning up after pets immediately. Failure to do so may result in a $20.00 fee per incident.
Service Animals: Service animals must have official documentation.
14. Credit Card on File
Guest agrees to provide valid credit card information to be kept on file. The Park may charge this card for unpaid balances, damages, or additional fees, providing an itemized statement of charges.
15. Liability
Guest agrees to indemnify and hold harmless Gulf Shores RV Park, its owners, employees, and agents from any claims arising out of Guest's use of the RV site or Park facilities, except in cases of gross negligence by the Park.
16. Theft of Service and Criminal Trespass
Theft of Service: Under TEXAS PENAL CODE § 31.04, failure to pay for services rendered may constitute theft of service, subject to criminal prosecution.
Criminal Trespass: Under TEXAS PENAL CODE § 30.05, remaining on the property after notice to vacate may constitute criminal trespass, subject to prosecution.
17. Park Guidelines
Speed Limit: 5 MPH throughout the Park.
Quiet Hours: 10:00 PM to 8:00 AM.
Site Appearance: We reserve the right to refuse service to any rig based upon appearance and/or condition. RV’s 10 years or older are subject to management approval. It is mandatory that your sewer and gray water hose have a sewer connection (sewer collar/donut) attached to prevent sewer gasses from escaping. No skirting, or permanent structures allowed. Tent camping is NOT allowed.
Prohibited Activities: No campfires, fireworks, or illegal substances permitted. If we have to call the authorities once for a disturbance at your site or cabin, you will be required to leave. No loud music is allowed at any time.
Vehicle Parking: One vehicle per site. Additional vehicles require prior approval and may incur a fee.
GOLF CARTS must observe the speed limit. You must be a licensed driver to operate a golf cart on Gulf Shores RV Park property (absolutely no exceptions).
Mail: Guests may receive mail at the Park's address. Proper labeling with site number is required.
Your guests: You are responsible for your guests. Please advise them of Gulf Shores RV Park rules and guidelines.
Gulf Shores RV Park, its employees and/or agents, reserve the right in its sole discretion to increase rental, water, or electric rates at any time. Failure to observe and adhere to the Park guidelines may result in non-renewal of your site. Blatant disregard of resort guidelines and/or offensive behavior may result in premature termination of your stay with NO REFUNDS.
18. No liability –user hereby indemnifies, releases and holds campground, its officers, owners, employees and agents (the “campground parties”) harmless from any property damage, personal injury, claims, causes of action, damages, loss, expenses and/or liabilities (hereafter collectively, “loss”) arising out of or related to users use of the RV site/cabin, the property and/or any condition thereon, regardless of whether such loss was caused by the negligence of any of the campground parties.
19. GULF SHORES RV PARK, ITS EMPLOYEES OR AGENTS MAY AT THEIR DISCRETION REFUSE SPACE FOR RENT WITHOUT REASON AT ANY TIME. RENTER SHALL HAVE 24 HRS TO VACATE. FAILURE TO COMPLY WILL RESULT IN ALL UTILITIES AND ELECTRICITY TO BE DISCONNECTED IMMEDIATELY. ELECTRICITY AND WATER ARE THE PROPERTY OF GULF SHORES RV PARK. FAILURE TO PAY RENT DUE IS CONSIDERED “THEFT OF SERVICE” TEXAS PENAL CODE 31.04 & CRIMINAL TRESPASS 30.05
20. Acknowledgment: By signing below, Guest acknowledges receipt of this Agreement and agrees to abide by its terms and conditions.
