GENERAL PARK RULES AND LIABILITY WAIVER
HOMESTEAD RV PARK AND RESORT LLC

1. The Speed Limit is 5 mph.

2. Quiet Hours: 9 PM - 8 AM, Sun-Thurs, and 10 PM - 8 AM, Fri-Sat. Please be considerate of others and respect the Quiet Hours.

3: Fires: Must be contained and enclosed in an approved fire ring, grill, or camping stove. Fires must be covered with a screen or similar device to prevent embers from escaping and starting fires. Do not leave fires unattended. They must be extinguished before retiring or leaving the site. Fireworks are always prohibited. Guests assume full responsibility for any damages incurred from a fire being unattended or neglected, and causing damage to other campers, property within the park, or the surrounding area.

4. Trash/Gray Water: Do not litter. Keep trash picked up near your site and the dumpsters. State law prohibits discharging gray or black water on the ground or storing it in containers.

5. Laundry Facilities: Laundry and shower house facilities are for laundry only.
• No washing of pet materials, bedding, or bulky items.
• Do not overfill washers/dryers; wring out excess water before drying.
• Park is not responsible for lost/damaged laundry.
• No pets allowed in the laundry room.
• Please be gentle with machines and respectful of the facilities.

6. Motorized Vehicles: ATVs and side-by-sides are not permitted.

7. Maximum Stay Duration: Guest stays are limited to 6 months unless extended in writing by Management. 

8. Maximum Number of Guests: 4 adults, or 6 people total (including children), per RV site.

9. Cleanliness: Guests must maintain their RV site in a clean condition and return it in good condition upon departure.

10. Storage and Structures: No storage of materials or permanent structures without management approval. Approved: patio tables, chairs, grills, umbrellas, awnings. No tarps.

11. Guests’ Campers: Must be kept in good condition, regularly washed, and well-maintained.

12. Clotheslines: Not permitted.

13. Sewer Hookups: Guests must ensure a secure, closed connection between their sewage hose and the park's connector. Any plumbing issues or cleanup due to spills are at the Guest’s expense.

14. No Firearms/Drugs/Alcohol: Firearms, fireworks, explosives, weapons, and illegal drugs are strictly prohibited. Alcohol is allowed only inside the guest’s trailer. No outdoor drinking at RV sites or in common areas. Excessive drinking is not tolerated.

15. Vehicles: Limit of two vehicles per site (more only with management approval). No fluid changes or non-emergency repairs. Emergency repairs (e.g., flat tires) require approval. Do not park on other sites without permission.

16. Conduct: Disorderly conduct toward staff, guests, or other campers will result in immediate termination of camping privileges and removal without refund. Urinating outside is strictly prohibited. All buildings are nonsmoking. Respect your neighbors and the staff.

17. No Tenancy Rights: The Park provides transient occupancy for recreational or temporary camping only. Guests agree they have no tenancy rights under New Mexico law, including the Owner-Resident Relations Act (N.M. Stat. § 47-8-1 et seq.), and are transient Guests staying monthly. This agreement does not create a tenant-landlord relationship. Management may amend or supplement Park Rules or rental rates at any time. If a guest violates these rules, breaches this agreement, or is deemed no longer welcome by Management, the following steps will be taken: (1) issue a written notice to leave immediately for rule violations or a 3-day notice for non-payment; (2) contact law enforcement to remove the guest as a trespasser if they refuse to leave.

18. Stay At Your Own Risk: Guests agree their stay is at their own risk and release the Park from any and all liability for accidents, injuries, acts of nature, acts of God, or other incidents.

19. Pets:
• No aggressive dogs (any breed) allowed. Aggressive or excessively barking pets will result in removal without refund.
• Pets must be leashed at all times (except inside the pet park).
• Pets must not be left unattended.
• Clean up after your pet.
• Pets must be registered and vaccinated.
• Max of 2 pets per RV site. No pets (except service animals) in the office or laundry area.

PAYMENT POLICIES

20. Rent: Due on the first day of occupancy and the same day each following month. $20 late fee after 5 days. Non-payment after 10 days results in a 3-day notice to pay or leave.
Online Payments: Pay online through the Campspot app found at http://www.homesteadrvparknm.com or at the front office.

21. No refunds on month-to-month reservations. 

22. Transaction Fees:
• Credit card payments incur a 3% fee.
• ACH (direct debit) payments have no fee (covered by the Park).
• NSF reversals may incur a processing fee from Innago or Campspot that will be passed along to the guest and/or loss of direct debit privileges.
• We do not accept checks.

WAIVER OF LIABILITY, RELEASE, HOLD HARMLESS, AND ASSUMPTION OF RISK AGREEMENT

23. The undersigned (collectively, “Guest(s)”) recognize that there are inherent risks involved in recreational camping and the transient stay at the RV park and campground premises, including its facilities, sites, amenities, and guest areas. Guest(s) understand that they have a duty to exercise reasonable care for their own safety and that of those for whom they are responsible.

24. Release From Liability: In consideration of my use of the premises of Homestead RV Park and Resort LLC, I release and hold harmless Homestead RV Park and Resort LLC, its owners and its representatives from liability for any and all claims, including but not limited to claims for personal injury, death, property damage, or loss, arising from my stay at the premises.

25. Indemnification: Guest(s) agree to indemnify and hold harmless the released parties from any loss, liability, or damages, including attorney fees.

26. Notification: Guest(s) shall promptly notify staff of any and all accidents or damages occurring on the property.

27. Entire Agreement: This document constitutes the entire agreement and is binding on all parties.

28. Minors and Co-Guests: Each Guest signing is binding their co-guests and any minors attending with them.

29. Assumption of Risk: Guests acknowledge inherent risks and agree to assume them voluntarily.

30. Acknowledgement of Understanding: I have read, understood, and voluntarily accept the terms of this waiver and rules agreement.
