Rules, Regulations, Waiver of Liability, and Assumption of Risk Agreement

Effective Date: April 6, 2025

Legal Entity: Judas Creek Marina Inc. (“the Marina”)

1. AGREEMENT TO TERMS

  • This agreement (“Agreement”) is made between the undersigned individual or entity (“Guest”, “Tenant”, or “User”) and Judas Creek Marina Inc., a Yukon corporation. By signing this Agreement and/or by entering upon or using the facilities at Judas Creek Marina and Campground, you agree to comply with all terms and conditions contained herein and any rules or signage posted by the Marina.
  • This Agreement shall be binding upon your heirs, executors, legal representatives, successors, and assigns.

2. WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK

  • Acknowledgment of Risk: The User acknowledges that use of the Marina’s facilities involves risks, including but not limited to injury, death, drowning, damage to property, wildlife encounters, fire, or acts of other users.
  • Assumption of Risk: The User knowingly and voluntarily assumes all risks, whether foreseeable or not, arising from use of the Marina’s property, campground, docks, moorage, trails, buildings, or other facilities.
  • Waiver and Release: To the fullest extent permitted by law, the User hereby releases, waives, and discharges Judas Creek Marina Inc., its owners, employees, contractors, agents, affiliates, insurers, and successors from any and all claims, liabilities, demands, damages, actions, or causes of action whatsoever, including for negligence, that may arise from use of the facilities.
  • Indemnity: The User agrees to indemnify, defend, and hold harmless Judas Creek Marina Inc. and its agents from any loss, liability, damage, or costs (including legal fees) arising out of Users or User’s invitees’ use or misuse of the facilities.

3. USE OF FACILITIES

  • Users agree to use the facilities only for lawful purposes and in accordance with all applicable laws, bylaws, and this Agreement. Users are responsible for the conduct of their guests and any damage they cause.
  • The Marina reserves the right to revoke access or terminate tenancy without refund for any violations of this Agreement or for conduct deemed unsafe, illegal, or disruptive.

4. CAMPGROUND RULES

  • Guests shall only consume alcoholic beverages and cannabis at their registered campsite. Consumption is not authorized in public spaces.
  • Guests shall only use permitted fire-pits provided by the Marina for campfires. Guests agree not to collect firewood from the forest. Firewood can be purchased from the Marina.
  • Camping is only allowed in designated campsites.
  • Occupancy: One RV, Trailer, Camper or other “sleeping unit” other than tents, and one vehicle per site. Max 6 persons per site. Check-out is 11:00 AM check in is 2:00 PM. 
  • Driving & Safety: Drive slowly. Watch for pedestrians and wildlife.
  • Guests are not allowed to interfere with others’ quiet enjoyment of the campground during any part of the day or night. This includes loud music and shouting in campgrounds, and/or in day use areas
  • Noise & Quiet Hours: 11:00 PM to 7:00 AM. No loud music, shouting, or generators.
  • Pets must be leashed at all times and must not be left unattended. Guests must clean up after their pets including picking up excrement and disposing of it in garbage containers.
  • Garbage & Recycling: Guests agree to help keep the Marina and campground clean and to use provided garbage bins only. Do not leave food or refuse unattended. Violation of this rule WILL result in Guests being removed from the property.
  • Wildlife: Do not feed wildlife. Store food in secure containers. Violation of this rule WILL result in Guests being removed from the property.

5. MARINA RULES

  • Tenants shall not throw, deposit, discharge, pump or otherwise place any refuse, garbage, debris, oil, spirits, paint, sewage, flammable material or any other pollutants of any description upon the floats or water of the marina. Any governmental fines, including the cost of cleanup, resulting from the actions of the Tenant shall be the sole responsibility of the Tenant. 
  • Tenant’s vessels, while inside the Marina, beginning at the breakwater shall create no wake. Maximum speed in the Marina is four knots or no wake, whichever occurs first.
  • There shall be no barbecues, welding equipment, burning torches or any other open flame apparatus used within the marina. Gas barbecues securely mounted within the boat are acceptable.
  • All boats shall be moored in a safe and secure manner on cleats with strong mooring lines. 
  • Chafing gear, bumpers, floats, and dock boxes shall not be attached to the plastic docks.
  • Except for entering or leaving the slip, main engines, power generating equipment or other noisemaking equipment shall not be operated between the hours of 11:00 p.m. and 7:00 a.m.
  • If any vessel sinks within the marina, the Tenant must immediately take action to remove the vessel. If the Tenant fails to take immediate action, the Marina will do so, and Tenant shall pay all costs incurred in such removal.
  • Children under ten (10) years of age must wear a “Personal Floatation Device” and be accompanied by an adult at all times while on the docks or by the water.
  • Dock Conduct: Keep docks clear. Unattended items may be removed at your expense.
  • All docks and finger piers must be kept clear at all times to permit easy access by Marina staff and other users. The Marina reserves the right to confiscate any items left on the docks and finger piers at any time and to dispose of these items immediately at the cost of the tenant.  Storage of any confiscated items will also be at the cost of the tenant.
  • All moorage fees are non-refundable. However, at the discretion of management, seasonal moorage can be transferred.
  • Extended usage or “live aboard” situations must be approved by Marina management. No substance or material whatsoever, including human waste, may be discharged into the water. Portable toilets are considered unacceptable as a sewage treatment or storage system. As live aboard Vessels raise concerns regarding water quality, the Marina shall have the right upon reasonable notice to inspect the interior of the Vessel to verify compliance with this condition.
  • Alcohol can not be consumed outside in any public areas.  Alcohol must be confined to the Tenant’s boat and the immediate dock area surrounding the boat.

 

6. STORAGE TERMS (Boat, RV, Trailer)

  • Valid government-issued ID, registration, and proof of insurance may be required.
  • Any Vehicle/RV/Boat deemed inappropriate by management will be prohibited from use of storage space.
  • Storage space shall not be used for any illegal or unlawful purpose. The User understands that any flammable, combustible, explosive, chemical, odorous, corrosive, perishable, or other inherently dangerous materials are prohibited.
  • The Marina may terminate the use of storage space for non-payment, and the User will have 10 days to collect their property, failure to do so shall be conclusively presumed to be abandoned.
  • Unauthorized use or storage constitutes trespass.
  • Abandoned property may be disposed of after 10 days.
  • Storage space is rented on a license basis only; no tenancy is created.
  • The User understands and agrees that they may be held liable for any damage or loss to Judas Creek Marina Inc that is caused by their negligence, willful misconduct and/or fraud.
  • Rates are subject to change with 30 days’ written notice.
  • The User agrees to notify the Marina of any change of contact information or ownership.

7. LIMITATION OF LIABILITY

  • To the fullest extent permitted by law, Judas Creek Marina Inc. shall not be liable for any personal injury, loss, theft, damage, or destruction of property, whether on land or water, whether caused by negligence, act of God, theft, or third-party actions.

8. ENTIRE AGREEMENT AND GOVERNING LAW

  • This Agreement contains the entire understanding between the parties and supersedes any prior oral or written agreements. It shall be governed by the laws of the Yukon Territory. Any disputes shall be resolved in the courts of Yukon.

9. SIGNATURES AND CONSENT

I, the undersigned, have read, understood, and voluntarily agree to be bound by the terms of this legally binding Agreement. I certify that I am at least 19 years of age and that I am authorized to sign for all parties I represent.
