Temporary RV Park Site License Agreement
 

This Temporary RV Park Site License Agreement (“Agreement”) is made and entered into to be effective as of ___________________ (the “Effective Date”) by and between the Kaibab Band of Paiute Indians (“Licensor” or “Tribe”) and ________________________________ (whether one or more, collectively, “Licensee”).

Licensee requests permission to occupy and receive services at the Kaibab Paiute RV Campground (“RV Site”). Based on Licensee’s request and promise to strictly comply with the terms and conditions stated in this Agreement and all RV Site Policies, which are incorporated herein by this reference, Licensor agrees to grant a temporary license authorizing Licensee to occupy and receive services at the RV Site.

 

=In consideration for Licensee’s promises below, Licensor agrees to grant a temporary license to Licensee, subject to the following conditions.

 

  • I. Your Licensed RV Site Space

 

    1. You only temporarily occupy this space. Subletting or assigning your RV Site space is not allowed. If you violate this policy, all occupants of the space will be asked to leave. Your license fee payment does not give you any tenancy or land rights; rather, in exchange for your license payment you are given a license to occupy the space that is revocable at any time at the discretion of the Licensor, subject to strict compliance with all terms and conditions referenced in this Agreement.

 

    1. All RV’s must have running water and a working sewer. Waterlines must be secure and free from leaks. Sewer lines must be securely attached to the Park’s hookup with threads or have a doughnut to prevent any leaks or fumes from escaping. Power cords must be in safe working condition.

 

    1. Fireworks, open fires, weapons, the display or use of firearms, and illegal drugs are prohibited.

 

    1. Loud parties, excessive drinking, offensive language, or other unacceptable behavior by guests is not permitted. In addition, illegal activities are strictly prohibited.

 

    1. When a situation requires Law Enforcement involvement for any reason, your license to occupy the space will be revoked and you will be evicted from the RV Park. Park Management will give no refund. All parties involved will be asked to leave regardless of the cause.

 

  1. Guests

 

    1. You are welcome to have guests come to visit your site, provided they comply with all terms and conditions referenced in this Agreement. Any guests staying for the day are welcome to park their vehicle within your space but must not block the roadway.

 

    1. Overnight guests are required to pay a $5 per night, per person immediately upon occupying the space. Any payments not collected will be included in the space fees of the Licensse (you).

 

    1. All overnight guests park their vehicle(s) in our parking lot by the clubhouse.

 

  1. Long-Term Stay (30 days or more)

 

    1. Any time an RV Site is occupied for 30 days or more a Long-Term Site License Agreement is required. If you know you will be staying that long when you arrive or at any time during your stay you must request and apply for a Long-Term Site License Agreement.

 

    1. If you are planning to stay longer than 30 days, or if you discover during your stay that you will be extending your stay past 30 day, you are considered a long-term occupant. As such, you must complete the Long-Term Site License Agreement and submit to a background check as required by Kaibab Tribal Council Ordinance.

 

    1. The fees associated with this background check are your responsibility.

 

    1. Anyone refusing a background check or having a background check that comes back with unacceptable irregularities will be asked to leave the park.

 

  1. Site License and Occupancy Fees

 

    1. Site License and Occupancy Fees must be paid on time, as set forth herein and according to the RV Rates schedule attached hereto.
    2. Timely payment of the fees is required and failure to pay results in automatic termination of your Temporary License.
    3. Fees are due and payable at the end of each pay period by cash or card.

 

 

  • V. Pets

 

    1. Pets must be leashed, tethered or in the off-leash dog park at the south end of the park.

 

    1. All pets must be monitored by you (the owner) at all times.

 

    1. Small temporary break-down fencing is allowed within the limits of your rented site upon request.

 

    1. We also ask that you clean up after their messes and not leave it for others to step in later. We provide you with extra bags throughout the park if you forgot yours.

 

  1. Trash

 

    1. Please only place bagged household trash in the dumpsters. Located at the north end of the park within the brown walls.

 

    1. Your site must be kept neat, clean, and free of boxes, litter, or trash. Do not let items accumulate. Do not store items under your RV as well. See the Park Manager for questionable items.

 

    1. Do not put large outside items such as awnings, tents, chairs, etc., in the dumpsters. Boxes are permitted if they are broken down as small as possible.

 

  1. Fires

 

    1. We have firepits available for your use. Only use these firepits.

 

    1. If there is no fire pit in a space, you may ask to have one moved to you. Do not attempt to relocate a firepit on your own.

 

    1. No matter the season you may never leave a fire unattended. Be sure to thoroughly extinguish all flames and hot embers before leaving the firepit.

 

    1. All fires are subject to any current local restrictions. Restrictions apply to all fireworks as well, which are not allowed unless you receive written permission from the Park Manager.

 

  1. Parking/Vehicles

 

    1. Our spaces can accommodate a 60-foot pull-through. Please park your camper and vehicle within the limits of your space and do not block the roadway.

 

    1. The site is for your RV and up to two other motor vehicle. Additional vehicles must be approved in writing by the office. The RV should be parked so that a car or truck may be parked in front of or behind your RV.

 

    1. If your vehicle cannot fit in the site with your camper/RV, you are welcome to park your vehicle in our parking lot at the clubhouse. No more than two working vehicles on-site.

 

    1. Parking on the street is not allowed unless you are loading or unloading

 

    1. The Park does not allow utility trailers, recreational equipment, repair/building projects, clotheslines, or structures of any kind. (You are free to use the designated areas with tables).

 

    1. We do not allow campers to repair or restore any vehicles on our campgrounds. If you have a problem with your vehicle, please transport it to another location or local shop to be fixed. Management is happy to help with finding the right place for your situation.

 

  1. General

 

  1. The RV Park Manager has absolute discretion to interpret Park Policies and your obligations under this Agreement at any time for any reason. You agree to abide by the Park Manager’s directions.
  2. If you have any questions, please check with the RV Park Manager.
  3. This Agreement is also subject to and incorporates herein by this reference all RV Park Policies, which are available at the office upon request and may be posted throughout the park. The Policies may be changed at any time for any reason and without notice.
  4. This Agreement and every term and condition herein apply to your license to occupy the Park. Violation of any term or condition is grounds for revocation of your license at the discretion of the Kaibab Paiute RV Park Manager and/or the Tribal Council.
  5. The Kaibab Paiute RV Park is safe and friendly, under 24-hour surveillance, and has regular patrols from our local officers. We do everything in our power to keep you and your RV safe. However, we are not responsible for lost/stolen or damaged items.
  6. The theft and vandalism (accidentally or purposefully) of any property belonging to another guest or the Kaibab Paiute RV Park is unacceptable.
  7. You are temporarily occupying a site on an Indian Reservation. The Kaibab Paiute Tribe is a Sovereign Nation and Tribal law dictates. Kaibab Tribal Law applies to your license and your stay at the Park.
  8. The Kaibab Paiute RV Park reserves the right to ask anyone to leave without notice and without refunding any remaining prepaid stay.  
  9. Nothing herein waives the sovereign immunity of the Tribe or the Kaibab Paiute RV Park. The Tribe, RV Park, Park Manager and all Tribal entities, employees, officers and agents are absolutely immune from suit or claim of any kind.
  10. By staying at the park and utilizing the temporary license to occupy the site, you are entering a consensual relationship with the Tribe and are agreeing that the Kaibab Tribal Court has exclusive jurisdiction over your activities while on the Reservation. This consensual choice of law and forum and recognition of the Tribe’s exclusive jurisdiction over you and your activities does not constitute a waiver of the Tribe’s absolute sovereign immunity
