GENERAL RULES AND POLICIES - Subject to change at any time during the course of your stay (by signing a new agreement)

 

• Quiet hours: Daily 9:00 PM-8:00 AM. No loud music, no idling vehicles and please be considerate of others.  Anyone playing loud music or not following the rules for idling vehicles will be warned only once and then asked to leave without a refund.

 

• Conduct: Loud, obnoxious, disorderly, boisterous, drunkenness, drug use, unlawful, belligerent behavior, obscene language or rowdy behavior and any acts of terrorism that disturbs or threatens the nights, comfort, or convenience of others in or near the Property will not be tolerated and will be grounds for immediate removal from the property and WITHOUT REFUNDS.  Please be considerate of fellow campers and respect their privacy.

 

• No offensive language is allowed to be displayed on your RV or vehicle.

 

• The following flags are allowed to be displayed at your site and throughout the campground, National, Military, including Air Force, Army, Marine Corps, Navy, Coast Guard, POW, MIA, and veterans, sports and decorative flags such as holiday, seasonal or garden. Any other flags are not permitted.

 

• Guests must obey all federal, state, and local laws regarding the ownership and possession of firearms. No display, discharge or possession of a gun, knife or other weapon in any way that may alarm others is allowed. Firearms are not permitted in any property buildings or common areas. The only exception is that guests may have a firearm in a locked, private vehicle in parking areas if permitted by law. The discharge of firearms, BB guns, air guns/rifles, or similar devices is strictly prohibited.

 

• Open fires are not allowed in our park. Fires must be in a Park Manager approved Fire pit OR in the park’s wood burning fire pit in the common area next to the pool.

 

• Every monthly guest will be charged $.155 per kilowatt hour used each month in addition to their monthly space rent

 

• There is a $150.00 Deposit at move in for site cleanup, damages, or unpaid fees at checkout.

 

• Violence or the threat of violence will not be tolerated.

 

• The storage of hazardous materials on the RV Site or anywhere on the Property is prohibited.

 

• No Fireworks may be set off in the park. The prohibiting fireworks includes sparklers, smoke bombs, aerials, and firecrackers. If these items are seen outside of your RV, you will be asked to leave immediately without a refund.

 

• Please always observe our park speed limit of 5 miles per hour. This policy is to keep you, your children, and your pets safe. Exceeding this speed limit will result in a warning. Multiple warnings will require us to ask you to leave. Safety is our number one priority for our guests.

 

• The possession, sale, or manufacture of illegal drugs or drug paraphernalia on the RV Site or anywhere else on the Property is prohibited.

 

• The operation of a business on the RV Site or on the Property is prohibited.

 

• Cutting of trees and plants is prohibited.

 

• ATV’s, Dirt Bikes, Motorcycles, and Golf Carts are welcome onsite but may not be used within the park. ONLY to get to and from your site. NO JOY RIDING.

 

• Drones are not permitted in our park. There are several local area parks where drones are permitted for your enjoyment.

 

• No major repairs are to be conducted to your RV’s in this park. We are happy to recommend a local Mobile RV Repair service who can help get your RV to their shop.

 

• No automotive work may be performed in our park. (Such as Oil changes, dismantling of vehicles, etc.)

 

• No un-operative vehicles are allowed to be stored at your RV Site, nor stored in the Park at any time.

 

• All vehicles must be current with their registration and licensed.  Please give a copy of your registration and proof of insurance to the Park Manager to keep in your file.

 

• Prior Guests who have been evicted from Lake Livingston RV Resort and Propane are NOT allowed to use any of the Park’s/Resort’s Facilities at any time whether accompanied by a paying guest of the park or not.  These facilities and amenities include the grassy areas by the picnic tables, the fire pit, the picnic tables, the pool, the laundry room, the shower and bathroom, dog park, playground or participate in any recreational activities on the Park’s property.

 

EVICTION RULES

 

• Nonpayment of space rent or NOT abiding by the park rules is grounds for IMMEDIATE REMOVAL from the park.  This is not a landlord/tenant agreement and can be terminated at any time.

 

LAUNDRY

 

• The laundry room is open 24/7. Change and Vending is available.  Please do not leave your laundry unattended and if so, you do so at your own risk. We are not responsible for accidents, thefts, or clothing being removed from others or tampering with your clothes while they are washing.

 

PARKING

 

• Each paid guest registration covers 1 RV per site plus 1 tow vehicle and 1 vehicle unless noted. Extra vehicles will need to be parked in additional parking spots at the top of the park and not occupying another RV Site. Please do not park on the grass. Ruts caused in your site due to additional vehicles will result in damage charges.

 

• Trailers, Boats, and additional vehicles will cost additional fees for camping. A nightly registration covers 1 RV plus 1 tow vehicle and 1 vehicle ONLY.

 

• No parking in common areas. Do not park in the middle of the road. Do not park in sites that you did not register for and do not block the office or the laundry room doors. Parking on the grass is not permitted at RV Sites.

 

POOL RULES

 

• All people under the age of 16 must have a supervising companion, to be in the pool and within the pool deck area. “Supervising companion” is understood to mean a person who is responsible for assuring that the child will comply with applicable rules and regulations.

 

• There is NO Lifeguard on duty. Please always supervise children and follow all posted signs and rules.

 

• All guests must be accompanied at the pool with a paid registered adult who currently resides at the park, which does not include children under the age of 18.

 

 

BEHAVIOR

 

• • We expect all guests to behave in a family-friendly manner.  Profanity, and unruly behavior are considered offensive behaviors and could result in the guest being ejected from the property without a refund.

 

DRESS CODE

 

• • Proper swim attire is required.  Swim-attire must be appropriate for a family environment.

 

• Inappropriate swim attire: Jeans, cut offs, under-garments, swim wear that is revealing or has messaging that depicts violence, nudity, vulgarity, or discriminatory language or graphics.

 

OUTSIDE FOOD AND BEVERAGES

 

• Food, drinks, and coolers are allowed in the pool area except glass, or bottles. Food and beverages are never allowed inside the pool.

 

PROHIBITED

 

• Pets are not allowed, except for working-service animals. Service animals must be always with their handler and may not be in the pool or in contact with the water.

 

• Smoking, vaping, or e-cigarettes are not allowed in or around the pool area.  · Firearms, ammunition, knives, and weapons of any kind are not allowed.

 

INCLEMENT WEATHER

 

• • For your safety, the pool may need to close during severe weather, such as electrical storms, heavy rain, or high winds. Please do not use the pool or stay on the pool deck during severe weather patterns.

 

SAFETY AND EMERGENCIES

 

• • Emergency Contact Information forms are required from all monthly guests. This information remains private and used only when a situation arises. We will only contact someone in the event of an emergency or if sought by law enforcement agencies. We never give personal information to others.

 

• • If you observe any activity you believe to be of concern, call (936)327-6810 (Polk County Sheriff’s Office) 24 hours a day.

 

• • If you need to call 911 for any reason, and time allows, please call the office (281)852-0882 so the Park Manager can be prepared to escort the emergency personnel to your site.

 

TRASH

 

• Place all household trash in the dumpster provided by the maintenance garage.

 

• Please do not place your trash on the ground. The Woodland areas have possums and raccoons and other wildlife which are attracted to left out or disposed of food and trash. While we think they are cute and wonderful animals, we don’t want you to find a surprise at night with a visiting raccoon at your site because of incorrectly disposed of trash!

 

• Please tie the trash bags completely closed and put your trash completely in the trash dumpster.

 

• No construction material, paint, solvent, tires, appliances, mattresses, or hazardous material is to be disposed of in the dumpster.
• FAILURE to follow this rule may result in charges for disposal fees.

 

VISITORS

 

• • Registered guests are responsible for ensuring their visitors follow all campground rules.

 

DISCLAIMER

 

I agree, and shall cause my children, invitees and guests, to abide by the Park Rules, including those rules and policies published at http://www.lakelivingstonrvpark.com, posted at the Premises or otherwise

communicated in any manner by Lake Livingston RV Resort Management.  As a participant in a recreation activity, I am responsible for acting within the limits of my ability and heeding all warnings regarding participation in the activity. I will maintain control of myself and any equipment while participating in the activity and will refrain from acting in any manner that may cause or contribute to injury to myself or to others.

 

I HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE JesMikJer Investments, LLC, d/b/a Lake Livingston RV Resort, its owners and agents (collectively, Lake Livingston RV Resort Management), from any and all liability to me, my children, my invitees/guests, personal representatives,

and heirs for any loss or damage on account of injury to person (including death) or loss or damage to property relating to, or arising out of, use and occupancy of the Lake Livingston RV Resort property, facilities, amenities, pool, (collectively, the Premises) and any dangers and hazards associated with acts of nature such as changing weather conditions; high winds; thunder and lightning; temperature fluctuations; falling trees; tree limbs, ice; or encounters with wildlife.

 

I HEREBY AGREE TO INDEMNIFY, SAVE AND HOLD HARMLESS Lake Livingston RV Resort Management, and each of them, from any loss, liability, damage or cost (including attorney fees) they  may incur due to injury (including death), damage or loss of property relating to use of the Premises by me, my children, and/or my invitees/guests or due to any incidents that may occur during my stay. I understand that, although Lake Livingston RV Resort Management makes every reasonable effort to provide a secure environment, the security of my person, my belongings, and all the people registered in my party is my sole responsibility.

 

As a courtesy, our employees, if requested, may assist with directing you to your designated campsite. It is your sole responsibility to ensure that the site will accommodate your specific trailer/RV and that you will not hit any branches, bollards, trees, etc. when positioning your RV on the campsite.  You agree to indemnify and hold JesMikJer Investments, LLC, d/b/a Lake Livingston RV Resort, its owners and agents (collectively, “Lake Livingston RV Resort Management”) harmless from any loss, liability, damage or cost

(including attorney’s fees) that may result from an employee assisting or directing you onto a campsite. Furthermore, you release, waive, discharge and covenant not to sue Lake Livingston RV Resort Management for any-and-all liability, loss, or property damage relating to an employee assisting/directing you to your site.

 

I understand that I am and remain personally liable to pay the total amount of my reservation prior to my scheduled check-in date, or at such an earlier date communicated to me. If I fail to pay the total due, I agree that JesMikJer Investments, LLC d/b/a Lake Livingston RV Resort, may charge any remaining balance (in addition to any damage charges or other amounts owed under these Terms and Conditions) to any credit or debit card on file with my reservation. Any amounts due after 30 days will be subject to the maximum late charge permitted under state law.

 

The Premises are privately owned, and LAKE LIVINGSTON RV RESORT MANAGEMENT RESERVES THE RIGHT TO REFUSE SERVICE to anyone for any reason except for those prohibited by law. Lake Livingston RV Management reserves the right to require any person or party it deems necessary, to leave the campground based on violations of Park Rules or behavior management deems inappropriate or

disturbing to others. Harassment or mistreatment of our staff or other guests, including but not limited to, racist comments or hate speech, will not be tolerated under any circumstances. I have read this notice and agree with it as well as all Lake Livingston RV Resort Rules and regulations. In addition, I understand that I am responsible for the actions of all people registered with my party, including any children, and any guests that visit during my stay. On behalf of each person with my party, I grant Lake Livingston RV Resort and its affiliated entities and promotional partners the right to include any photograph, video and other visual portrayals of each person in my party in any medium and for any purpose.

 

I UNDERSTAND ALL THE PARK RULES, POLICIES AND DISCLAIMER SPECIFIED AND AGREE

TO WAIVE ALL LIABILITY TOWARD LAKE LIVINGSTON RV RESORT, OWNERS, INVESTORS,

MANAGEMENT AND EMPLOYEES.

 

I HAVE READ, UNDERSTAND AND ACCEPT THE ABOVE RULES, POLICIES, AND DISCLAIMER

ABOVE.

 

PET POLICY AND ANIMAL WAIVER

 

I hereby agree with the following regulations and conditions relating to my pet while camping at JesMikJer Investments, LLC, d/b/a Lake Livingston RV Resort with my pet.

 

• Excluded Areas. I agree to keep my pet out of the following areas including, but not limited to buildings, pool area, laundry room and propane office.

 

• Excluded Dogs. I agree that the Campground has the sole discretion to exclude some dogs. The basis for exclusion may include, but is not limited to the following:

a. breed-specific exclusions.

b. due to their young age are exempted from state or local law vaccination requirements.

c. are sick;

d. are in heat;

e. are aggressive, vicious, dangerous or potentially dangerous;

f.  require muzzling; or

g. are easily frightened or sensitive, resulting in disruptive behavior (such as fighting or biting) in    response to a stimulus.

 

• Supervision. I agree to keep my pet on a leash or in a carrier while in all public areas of the Campground. I further agree to have my pet with me or a designated individual always and understand that I may not leave the pet unattended at the campsite, nor in an idling vehicle (see above). I agree to prevent noise or any other disturbance by my pet, in the interest of other guests at the Campground.

 

• Vaccinations. I represent and warrant that my pet is up to date on all vaccinations (including rabies and distemper) and flea treatments. Copies of current vaccination papers must be presented to Campground management.

 

• Disturbances. I agree that, should my dog create any disturbances, which cause complaints to be made to the management by other guests or employees of the Campground, at the request of a Campground employee, I will immediately make OTHER arrangements to house my dog elsewhere outside the Campground.  Additionally, I understand and agree that if I do not find an alternative housing for my pet after being asked to do so, I will be asked to leave the Campground and will not be issued a refund.

 

• Assumption of Risk and Release. I understand that my permission to have my dog at the Campground with me is a privilege and not a contractual right.  Such permission is expressly conditional upon my adherence to the terms of these rules and other rules in effect at any given time. I understand that the Campground may revoke such permission at any time for any reason.

 

Additionally, I hereby assume all responsibility for risk, injury, damage, or other harm that may occur while my dog is at the Campground or caused by my dog. Further, I hereby knowingly and voluntarily expressly release and discharge the Campground, its owner, its agents, its parent companies, members, managers, directors, officers and employees (“Released Parties”) from any and all claims, damages, liabilities, injuries, demands, or causes of action, both present and future, whether known, unknown, anticipated or unanticipated, that me or my guests or invitees may have against any of the Released Parties arising out of or incident to my dog’s presence in the Campground, whether arising from any act or omission, whether negligent or otherwise, of me, my dog and/or any guest or invitee. I further agree to

indemnify each of the Released Parties for any and all such claims, damages, liabilities, injuries, demands, or causes of action, including costs, expenses, and attorney’s fees arising as a result of or related to the presence of the dog at the Campground. This provision shall be enforceable

to the fullest extent of the law.

 

• Acknowledgment. By signing below, I acknowledge that I have read the foregoing Assumption of Risk & Release and fully understand its provisions and implications. My execution of this Release is entirely voluntary and intended to be binding on my heirs, executors, legal representatives and assigns.

 

I have read this PET POLICY AND ANIMAL WAIVER and understand it is my responsibility to abide by the Rules. I further understand that only registered campers are allowed to have pets, not my guests or invitee’s. It is my responsibility to ensure that my guests and invitees also comply with the Rules. Failure to adhere to the policies and rules set forth herein may result in my removal from the Campground without a refund.

 

Whether in Person or Electronic Signatures: You agree that your electronic signature, whether digital or encrypted, is intended to authenticate the Terms and Conditions contained herein and to have the same force and effect as manual signatures.  Delivery of a copy of this Agreement or any other document contemplated hereby bearing an original or electronic signature by email transmission in “portable document format” (“.pdf”) form, or by any other electronic means intended to preserve the original graphic and pictorial appearance of a document, will have the same effect as physical delivery of the paper

document bearing an original or electronic signature.
