  RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT
The parties to this release and waiver of liability and indemnity agreement are, Leslie County RV Park, LLC., with an address of 26369 Highway 421, Hyden, Kentucky 41749 (hereinafter referred to as the "Releasee") and the UNDERSIGNED, his or her personal representatives, heirs, companions and next of kin of the UNDERSIGNED (hereinafter collectively referred ot as the "Releasers"). The Undersigned is identified by name and address indicated below. In consideration of being able to enter into the Leslie County RV Park, LLC's premises and use the same or any associated premises, THE UNDERSIGNED, for himself or herself, and his or her personal representatives, heirs, and next of kin, with knowing and willing consent of his or her PARENT or LEGAL GUARDIAN as attested by signature of the same fi the UNDERSIGNED is below the age of 18 years, acknowledges, agrees and represents that he
or she, or wil immediately upon entering the confines of the area, and will continuously thereafter, inspect said confines and all portions thereof which he or she enters and which he or
she comes into contact, and he or she further warrants that his or her entry upon said confines constitutes acknowledgement that he or she has inspected said confines and that he or she finds
and accepts hte same as being reasonably suited for hte purpose for his or her use, and eh or she does further agree and warrant that, if, at ay time he or she is within or about the confines and he or she feels or believes anything ot be unsafe, he or she will immediately leave the confines and advise Leslie County RV Park, LLC., of the condition(s) which he or she believes to be unsafe.
The UNDERSIGNED further hereby covenants not ot sue, releases, waives, and discharges the Releasee from any and al liability, his or her personal representatives, assigns, heirs, companions, and next of kin for any and all loss or damage, and any claim or demands therefore on account of injury to the person or property or resulting in death fi the UNDERSIGNED or any person accompanying the UNDERSIGNED or permitted by the UNDERSIGNED to use his property on the premises of the Leslie County RV Park, LLC., whether caused by the negligence of the Releasee or otherwise while the UNDERSIGNED or his or her companions is or are ni or upon the premises for any purpose or reason.
The UNDERSIGNED further hereby assumes full responsibility for and risk of any
bodily injury, death or property damage or loss to himself or herself or any of his or her property or companions due to the negligence of the Releasee or otherwise while ni or upon the premises or while participating ni or observing any activities occurring within the confines of the premises for any reason. The UNDERSIGNED agrees to indemnify and hold harmless the Releasee from any loss, liability, damage, or cost which they may occur due to the presence of the UNDERSIGNED or any of his or her companions ni or upon the confines for any reason whether caused by the Releasee or otherwise.
The UNDERSIGNED on his or her own behalf, his or her estate, personal
representatives, executors, administrators, and assigns agrees to indemnify and hold harmless the

 Releasee in the event of any claim made against them or/and of them related in any manner or arising directly or indirectly from the released claims, or any of them or the effects thereof fi it is alleged or proven that any such claims arise from negligence, including gross negligence, or wrongdoing on the part of the released.
The UNDERSIGNED understands that this waiver is intended to be as broad and inclusive as permitted by the laws of the Commonwealth of Kentucky and agrees that fi any portion is held invalid, the remainder of the waiver will continue ni full force and effect. It is also agreed that this RELEASE, WAIVER OF LIABILITY AND INDEMNITY AGREEMENT wil be construed in accordance with the laws of the Commonwealth of Kentucky.
The UNDERSIGNED has read, comprehended, and now voluntarily signs this RELEASE AND WAIVER OF LIABILTY AND INDEMNITY AGREEMENT, and fuly agrees that no representations, statements, or inducements apart from the foregoing writen agreement had ben made. The UNDERSIGNED has read this form and fuly understood that by signing this form, hte UNDERSIGNED si giving up legal rights and/or remedies which may otherwise be available.
