Lundy Lake Resort
LUNDY LAKE RESORT RULES & RENTAL AGREEMENT
As the primary registered guest/renter, you assume full liability for yourself and your entire party, including any invitees/visitors/guests/children during your stay. The primary registered guest is responsible for ensuring all Lundy Lake Resort (“resort”) rules, posted signs, and local/state/federal laws are shared with and adhered to by your entire party and/or visitors to your cabin/site(s) during the time of your stay, including any rules communicated in any manner by resort personnel, and financially liable for any fees and charges incurred during the stay by the party, including but not limited to extra person/pet/vehicle fees, store/tab purchases, damage and replacement fee/costs, and rule violations. Any remaining unpaid balance at the end of stay will be charged to the card(s) on file upon/after checkout.
All visitors, upon entering the premises, agree to assume all risks associated with recreating in a rustic resort in the wilderness and “adventure at their own risk”. All visitors are required to be self-insured (medical, auto, etc.) and assume full liability for their actions while at Lundy Lake Resort. Lundy Lake Resort and Lundy Lake Resort members, owners, employees, associates and contractors are not responsible for any damages, medical incidents, injuries, accidents, or losses to visitors/guests/property. Visitors assume full personal responsibility while recreating and agree to use common sense and caution. Visitors who are uncomfortable or unable to navigate or assume the risk associated with recreating in the wilderness and/or in rustic/primitive conditions are advised to not stay at Lundy Lake Resort. Hazards include but are not limited to:
- Uneven ground/surfaces, stairs/steps, rocks/gravel, branches, leaves
- Water/mud/snow
- Plants/trees including some allergens and poisonous plants (ex: stinging nettle)
- Wildlife including some predators and pests (coyotes, bears, mountain lions, squirrels, bugs)
- Natural disasters including snow/rock/mud slides, wildfire, earthquakes
- Weather events (temperature fluctuations, rain, hail, snow, heat, thunder, lightning, high winds, falling trees and limbs, etc.)
- Mining townsite remains including rusty relics and vintage broken glass; Fishing/sportsmen remains including fish hooks
- High elevation (7800-8000 ft, consult with your doctor prior to arriving and take care to acclimate prior to exertion)
GOLDEN RULES:
- Make Smokey the bear proud. Be bear and fire aware.
- When in doubt, ask.
- Mistakes happen. Please report all incidents immediately so we can take care of it and/or replace supplies as necessary.
- Leave no trace!
BUSINESSES, ORGANIZATIONS AND GROUPS: If you are completing a reservation on behalf of a business or organization or group, please include the entity name with your registration. Each organization/business serves as the primary guest and assumes liability for all party members/visitors; agrees to fully indemnify Lundy Lake Resort, members, owners, employees, associates and contractors in any and all occurrences of loss, damages, injuries and/or death. By registering, each organization represents for itself, its guests, clients, visitors, employees, representatives, agents and assigns that it carries active Commercial Form General Liability Insurance. We recommend that this waiver and rules be shared with each participating member of your organization/group.
SUBLETTING: Unless explicitly granted an exception in writing by resort management: assignment of the short term rental/lease or subletting the property in whole or part is prohibited, including from sharing or renting out the property through services such as AirBnB, VRBO, ticket or event sales, resale, transfers etc, If you wish to transfer your reservation to a family or friend, please let management know; we can transfer the reservation to the new person via the correct process by updating the primary guest contact information, card on file, and signed terms and conditions agreement.
PETS: We want a safe place for everyone to explore with their adventure buddies, human and dog alike. All pets must be registered with Lundy Lake Resort and will be charged a corresponding pet fee per stay per pet (excluding service animals). By bringing your pet onto Lundy Lake Resort premises you take full responsibility for the safety of your pet and the actions the pet takes. Your pet must be under supervision at all times, either secured via leash or under control via recall training. Please keep in mind your pet’s safety and needs when they are in a new environment and around other pets, animals and wildlife (note: predators including bears, mountain lions, coyotes are present). For everyone’s safety, if your animal does not “play nice” with other people, kids, dogs, etc. we ask that you do not bring them. Aggressive animals will be asked to leave. As the pet caregiver you agree to pick up after your pet every time, throughout Lundy Canyon and Lundy Lake Resort. Pet owners who do not pick up after their pet may be charged a cleanup fee of $10 per incident and/or asked to leave depending on the severity and frequency of infraction. Sorry, no horses, mules or livestock (no exceptions.)
VEHICLES AND GUESTS: Reservation base rates include a limited number of vehicles and persons included in the base rate price. All vehicles staying overnight must be registered with Lundy Lake Resort and pay any additional vehicle fees. Overnight guests must also be registered and charged corresponding additional person fees. We value honesty; guests/groups that are found “hiding” or misleading Lundy Lake Resort about their number of guests/vehicles may not be invited to return. The boat launch and street parking is for day use only unless explicit permission is granted by a resort official.
ACCESSING YOUR SITE AND PARKING: As a courtesy, our employees, if so requested, may assist with directing you to your designated campsite. It is your sole responsibility to ensure that the site will accommodate your specific trailer/RV and that you will not hit any branches, bollards, trees, etc. when positioning your RV on the campsite. You agree to indemnify and hold Lundy Lake Resort, its owners and agents (collectively “Lundy Lake Resort management) harmless from any loss, liability, damage or cost (including attorney’s fees) that may result from an employee assisting or directing you onto a campsite. Furthermore, you release, waive, discharge and covenant not to sue Lundy Lake Resort management for any and all liability, loss, or property damage relating to an employee assisting/directing you to your site. If trees/bushes require trimming for you to access your spot, please ask prior to cutting vegetation.
SECURE BELONGINGS AND TRASH: There are no bear boxes on premise. It is the guests’ responsibility to secure belongings in a bear- and wildlife-safe manner (ex: bear safe coolers/crates, locking doors). You are opting to stay in the wilderness; Lundy Lake Resort is not responsible for property/personal damages/injuries/loss due to wildlife intrusion/interfaces. Trash is picked up every evening around nightfall. Should you need to dispose of trash after evening trash service, we ask that you dispose of the trash directly in the bear-safe dumpster (not trash cans near your site). Keep your site clean and use products like Lysol/bleach/clorox on used cooking/food surfaces and entry windows/doors/tents as a deterrent best practice. For everyone's safety, irresponsible or neglectful guests that do not make efforts to secure their site or take part in "bear baiting" may be cited or expelled. Do not feed bears; it is dangerous. Reference USFS guides for bear and wildlife safety in the Eastern Sierras and Inyo National Forest.
FISH CLEANING: Fish cleaning is only permitted in designated fish cleaning stations. Absolutely no fish cleaning in cabins, at spigots, in the lake/stream, restrooms or other non-designated areas (it makes a mess and attracts bears/bugs). Violations may result in a cleaning or repair fee based on impact.
RESORT PROPERTY: Cabin contents (ex: furniture, linens, kitchenware, games, etc.) may not be removed from the inside of the cabin. Campsite property (ex: fire safety kits, fire rings, picnic tables,etc.) must also stay on site. Any missing or damaged resort property will result in an additional corresponding replacement and/or repair fee for the item. No guest is permitted to alter any building, resort property, path, road, tree or vegetation in any way without explicit permission from a Lundy Lake Resort official. Any alterations will be considered vandalism and pursued as such.
SMOKING: Absolutely no smoking inside or within 20 feet of any facility/cabin. Smoking indoors or near a building will result in a minimum $300 violation fee and temporary or permanent expulsion from premises. In addition to the minimum violation fee, you will be held personally and financially responsible for any and all damage and full new item replacement costs for structures, paint/walls, linens/fabrics, beds/furniture, etc. and deep cleaning required as a result of smoking indoors. Smoking is only permitted at designated campfire rings; cigarettes must be fully extinguished and safely disposed of IN the ring; no ‘flicking’ of cigarettes.
FIRES and BARBEQUES: Campfires are a privilege, not a right. Fires are only permitted in established fire rings. No fuel ignition/use (lighter fluid, gasoline, etc.) is permitted. No large “bonfires”. No fires during red flag warnings or high wind weather events. Guests are advised to follow USFS campfire standards and practice the upmost safety when having a fire. The person who lights the fire/barbeque/stove is responsible for ensuring the surrounding area is clear of debris/flammable hazards and ensuring the fire is fully extinguished at the end of use. A bucket of water, shovel, extinguisher, and responsible/attending person near the ring is required for any active fire/stove/barbeque. NO unattended fires or barbecues, ever. Fully extinguish your fire prior to going to bed. Firewood is available for purchase at the general store and in town - leave the forest and campsite alone - no cutting any live trees/vegetation for wood. We recommend anyone who has a campfire to complete training and obtain a California Campfire Permit. Be advised, we take fire SERIOUSLY and give guests all tools needed and information to make informed, safe decisions and actions, so, NO EXCUSES: Any guest/party that fails to follow all fire safety rules will at a minimum loose campfire privileges, but depending on severity of infraction, may be reported to authorities, charged with attempted arson, and/or expelled temporarily or permanently from premises. RESTRICTED ITEMS: Absolutely no firearms or fireworks are permitted on or to be fired on Lundy Lake Resort property. No hunting. No off-roading. No use of poison (poison even intended to deter rodents can kill our eagles, dogs, and mountain lions further up the food chain). Absolutely no candles (other than citronella candles on outdoor picnic tables under supervision) due to fire risk.
RESPECT OUR NEIGHBORS: We have neighbors! From Mono County to Inyo National Forest to Lundy Canyon families, please help us maintain good relationships by respecting their space, properties and no trespassing signs. Complaints by our neighbors, especially regarding trespassing, are taken extremely seriously.
DEPOSIT, PAYMENTS AND BALANCES: 50% payment is due upon reservation. Remaining balance will be completed via Campspot auto-pay 6 weeks prior to the checkin unless paid prior to due date. Please see our cancellation policy for more details.
- Changes/additions to the number of persons/pets/vehicles are due on or before checkin; any unpaid/unregistered people/pets/vehicles will be automatically added to your stay’s balance due.
- Add-ons (boat rentals, store purchases) purchased during time of stay are due at point of sale, or, if granted by resort staff, at check out.
- Checks require an ID and phone number; bounced checks will be charged a $50 fee and require immediate payment via cash, card or transfer.
- The primary registered guest remains personally liable to pay the total amount of the reservation.
- LLR reserves the right to charge unpaid balance/add-ons/fees/tab incurred during stay to the card/payment method on file. If guests fail to pay the total due prior to checkout, Lundy Lake Resort may charge any remaining balance (in additional to any unpaid/unregistered add-ons, damage/infraction fees, store tab, or other amounts owed under these Terms and Conditions) to any payment method on file with the reservation. Any amounts due after 30 days will be subject to the maximum late charge permitted under state law.
REFUNDS, RESERVATION CHANGES AND CANCELLATIONS: View the full cancellation policy here for details on occupancy rates, minimum night stay, cancellations, fees, and refunds.
CABIN SERVICES: Cabins are equipped with linens and bedding; kitchens are stocked with cooking and eating utensils, percolator coffee pots, stove, refrigerator, heater, toilet, shower and charcoal BBQ. Deck chairs are provided for the cabins and not for fishing. Your cabin reservation includes linens (bed sheets, pillows, blankets, towels) for the number of persons registered for your stay. Linen turnover is provided on the 5th day of your reservation by request. New towels are provided on the 3rd day by request. Basic kitchen supplies (pot, pan, silverware, bowls, plates) are provided; if you need preferred or specialty cooking/baking supplies, we recommend you bring your own or ask to borrow from the resort if we have the item(s) in stock. Please understand: Lundy is an off-grid self-sustaining rustic resort; most of our buildings were built in the 1930s... so, please do NOT bring or use high wattage electrical appliances (blow dryers, toasters, microwaves, etc.) - you will blow breakers/fuses. Cabins/buildings and surrounding wilderness are not baby/toddler/dog "proof" nor are they considered "accessible"; parent/guardian/caretaker supervision/discretion is advised. Please refer to the instructions posted in the cabin for checkout steps (ex: clean dishes on drying rack, trash in trash cans,heater thermostat off, door closed, take personal belongings.)
OFF-GRID RESORT NOTICE: As our long-timers know, Lundy is a self-sustaining, off-grid resort. We produce all of our own power/water with great effort and cost. From time to time, there may be short episodes of service (electricity) interruption for generator/infrastructure repair/maintenance. Do NOT rely on resort power for lifesaving/critical devices/tools that require constant power supply. We ask RVers only use their AC when necessary in a community effort to reduce the load on the generator. Excessive power pulls above 30A will result in tripped breakers/blown fuses at your site. Do NOT plug in malfunctioning equipment. If your rig, appliance, A/C, or an item you are plugging in is identified as malfunctioning (ex: short circuiting), we reserve the right to require you unplug it - to protect the resort as a whole - with no refund provided for loss of/reduced power access.
COMMUNICATION NOTICE: There is no LTE/cell service in Lundy Canyon. Drive 3-4 miles East down Lundy Lake Road (around the BLM fire station) to begin receiving service. We recommend guests (especially with kids) bring handheld radios for family/group communication, consider satellite phones or "In Reach" type devices, and always keep another person informed of your plans/whereabouts when exploring the backcountry.
LAKE USE: You are welcome to launch your boat, kayak or tube at the boat launch for no additional fee. Please be prepared to anchor your boat on shore (not the dock, which is reserved for resort rentals). Please do not leave your boat trailers by the boat launch as it takes valuable parking/launching space away from other guests. Lundy is a “no wake lake” perfect for small motorized fishing boats, kayaks, SUPs, fishing tubers and more. This is not a lake for jet skis, waterskiing, speed boats, etc. Practice safe water practices and be courteous of other guests while having fun! RESPECT AND KINDNESS: We reserve the right to refuse service to anyone and enter any Lundy Lake Resort facility at any time. Harassment or mistreatment of our staff or other guests, including but not limited to, racist comments or hate speech, will not be tolerated under any circumstances.

- Be Advised: Failure to vacate your campsite/cabin by checkout time and date of your reservation is rude and negatively impacts other reservation holders that have a right to the space for the full dates of their reservation. Blocking roads, driveways, and access to other sites is also unacceptable. Overstaying or abandoning property/vehicles may result in private party impoundment, relocation, towing fees, storage fees, overstay fee, and/or additional night stay fees. If you overstay in a reserved spot, you will likely be towed at your expense so we may grant access to the reservation holder. If the spot is available, you will be charged the price of the site reflecting the number of days stayed. Reservation holder is fully responsible for all fees and costs associated with towing and storage of vehicles in cases of impoundment/relocation due to overstay or blocking roads/access.

VACATION RENTAL LIABILITY WAIVER

I, ______________ (“Releasor”), a visitor to and short term vacation renter of the property commonly known as Lundy Lake Resort located in Lee Vining, CA (the “Property”) HEREBY RELEASE, WAIVE, DISCHARGE, HOLD HARMLESS AND COVENANT NOT TO SUE Lundy Lake Resort and their members, principals, agents, contractors, associates, officers, employees, lease/license holders and representatives (collectively “Releasees”) as well as the land owners/operators of the Property. As a participant in a recreation activity, I am responsible for acting within the limits of my ability and heeding all warnings regarding participation in the activity. I will maintain control of myself and any equipment while participating in the activity and will refrain from acting in any manner that may cause or contribute to injury to myself or to others. I acknowledge and agree:
- The Property is rugged, historic and rustic - located in the wilderness, overlooking and near Lundy Lake
- The property is not fenced and there are public and private roads that service cars, hikers, motorcycles and bikes
- I am also aware that my stay at the Property involves risks that may result in serious bodily injury and/or death. Some of the risks include, but are not limited to, drowning, falling, sports injury, slips, trips, falls, cuts, adverse weather conditions, wildlife encounters, the acts or omissions of guests or visitors on the Property during my stay, and the condition of the Property. I understand that the description of the risks in this Release of Liability, Waiver of Claims and Assumption of Risk (the “Document”) is not complete and that other risks or events that are known or unknown, anticipated or unanticipated may result in serious bodily injury and or/death.
- In consideration of being permitted to rent and stay at the Property, I agree on my own behalf, my family, any and all guests, and invitees that I am fully responsible for any and all risks of injury or death.
- I understand and acknowledge that being in or near the lake and mountains present various risks and hazards. I assume all such risks associated with being near or in the lake/mountains/rivers, including the obligation to notify all guests of such risks.
- I agree to fully and forever release and discharge, and not to sue Releasees for any injuries or damages, including bodily injury or property damage that may result from or be related in any way to my rental and stay at the Property. I further agree to indemnify and defend Releasees, through their own choice of counsel, against any and all claims arising out of or related in any way to my rental of the property, including claims by third parties.
I ACKNOWLEDGE THAT I HAVE READ THIS ENTIRE DOCUMENT AND THAT I UNDERSTAND ITS TERMS AND AGREE TO BE BOUND BY THEM. I UNDERSTAND THAT THIS DOCUMENT APPLIES TO AND SHALL BE EFFECTIVE AND BINDING UPON ME, MY HEIRS, ASSIGNS, PERSONAL REPRESENTATIVE, ESTATE, AND ALL MEMBERS OF MY FAMILY, MINORS, INVITEES, AND OTHERS IN MY CARE, CUSTODY OR CONTROL, AND AGREE TO ADVISE ALL SUCH INDIVIDUALS OF THIS DOCUMENT AND CAREFULLY SUPERVISE THEIR USE OF PROPERTY.
MOTOR BOAT AND KAYAK/PADDLE RENTALS: As the reservation holder, you take responsibility for your watercraft and the safety of persons in your boat. Educate yourself on how to safely operate a small fishing boat and watercraft safety prior to usage.
- Make sure everyone has and is using their life jacket/personal floatation device as required, and ask for additional safety devices when/if needed. 18+ adults on motorboats may self-opt-into using a floatation seat cushion en lieu of wearing a vest. Minors under 18 and all kayakers/paddlers of all ages MUST wear a life jacket.
- Use common sense (be aware of and avoid rocks and other hazards, you should not stand/put weight in your boat on the shore as it will damage the boat, do not smoke near the boat fuel tanks as that is a fire risk, do not stand in the boat as you can fall and injure yourself, do not lean over the boat as you can fall out of the boat into the water, do not put your hands in the water near the moving propeller as you may get injured by the sharp blades, lift your anchor all the way prior to moving your boat or you will get the anchor stuck and cause motor damage, give other boaters and (shore and lake) fisherman space, do not speed or create wake watch for tubers/kayaks/swimmers/dogs/beavers...)
- You are also responsible for properly using equipment to avoid damages to the boats and motors. The reservation holder is also responsible for any damages and/or losses to equipment (ex: boat, motor, anchors, life preservers, oars).
- In the event your anchor gets stuck, DO NOT CUT IT OFF as it will result in a replacement fee; instead, tie the stuck anchor's rope to an extra life preserver and alert the resort of the issue for us to collect. If we are able to successfully retrieve your anchor, there will be no replacement fee.
- Refunds are not awarded due to weather or nature.
In the event of a thunderstorm or lightning: For your safety, all boaters MUST return to shore/dock and disembark from vessels. Boaters must stay off the lake until at least 30 minutes has passed since the last thunder and/or lightning activity. - Please be respectful of Resort property and report any issues immediately to resort staff and ask for help as needed. If you are unsure how to operate an outboard motor, please ask a resort teammate for assistance/training, we would be happy to help walk you through things!
- All rentals are for adults 18+. Motor boats may have minors riding in them under the supervision and with permission from their guardians, but an adult 18+ must be driving/in control of the boat at all times.
- Vessel person and weight limits: Motor boats accommodate UP TO and NO MORE THAN: 3 adults OR 2 adults 2 children OR 1adult 3 children. Kayaks are 1 person up to 275lb total weight limit (person and gear)
- Absolutely no “towing” or attempting to water ski/tube with the motor boats. Towing any weight or person behind a boat may result in capsizing, sinking, property damage, injury, or death. The boats are meant for navigating the lake and fishing from, not as a toy or water sport tool.
- Waiver required, no exceptions
- Keep a safe and respectful distance from other boaters and fishing lines
- Lundy Lake Resort is not responsible for injuries, lost or damaged property - make sure you are prepared to keep your personal items on board and not fall in the lake!
- You agree to be respectful of other boaters, fishers, and swimmers. For your safety and everyone’s peace, please keep a lookout for fishermen’s lines and do not disturb/cross active lines. If you are not fishing and are out for a fun “joy ride” we recommend to not go near popular fishing spots like the inlet/mouth.
- Paddle sports can be physically demanding and dangerous.
- Anyone using this watercraft may be at risk of serious injury or death.
- LLR recommends that the renter obtain certified watercraft and first aid training, and carry first aid and safety/rescue equipment.
- Consult a physician prior to beginning your paddle sport training.
- This watercraft is intended for recreational use only.
- Kayaks and paddle rentals are not intended for mechanical propulsion.
- Scout unfamiliar waters; portage where appropriate.
- Never use this watercraft in rough, stormy, or white water conditions.
- This watercraft is not intended to be used as a lifesaving device.
- Always wear a Coast Guard approved personal flotation vest.
- Do not allow minors to use this watercraft without adult supervision.
- Do not use in areas where dangerous or strong current flows can overcome your ability to control your direction or destination.
- Never use drugs or alcohol before or during operation of this watercraft.
- Always paddle with a buddy in case you require emergency help.
- Never use in cold water that may cause hypothermia.
- Always wear a helmet when appropriate.
- Check your equipment prior to each use for signs of wear or failure.
