Welcome to Matagorda RV Park! We are pleased to have you as our guest. This document outlines the terms and conditions of your stay, as well as the park rules designed to ensure a safe, enjoyable, and respectful environment for all tenants and visitors. By reserving and/or occupying a site at Matagorda RV Park, you automatically agree to abide by all terms, conditions, and rules set forth herein.


1 PARTIES:
This Terms and Conditions Agreement ("Agreement") is entered into by and between Matagorda RV Park (“Park”, "Park Management”, "We”, “Us”, or "Our") and the site occupant(s) ("Guest," "You", or "Your").


2 PREMISES:
The Park leases to the Guest the recreational vehicle (“RV”) site specified during reservation ("Site") for the purpose of stationing a recreational vehicle.


3 CHECK-IN / CHECK-OUT:
3.1 Check-In Time: 2:00 PM CDT Early check-in is generally not permitted. Please make arrangements if arriving early as waiting areas may not be available.
3.2 Check-Out Time: 11:00 AM CDT. Late check-out may be possible if arranged in advance with the office and may incur additional fees. Prompt departure is appreciated to prepare for incoming guests.
3.3 Late Arrivals: Permitted. Please contact the Park office for instructions if arriving after office hours.


4. SITE ASSIGNMENT AND CHANGES:
You will be assigned a specific site that you pick up during your online reservation. If you wish to move to a different site after completing your online reservation, please check with the office first. Site changes are subject to availability and Park Management approval due to reservations and maintenance. Do not move sites without prior authorization.


5. PARK RULES AND REGULATIONS:
5.1 General Conduct & Responsibility:
5.1.1 Guests and their visitors are responsible for any damage or injury caused by themselves, their children, and/or their pets.
5.1.2 Guest assumes any and all risks associated with staying at the Park and agrees to hold Matagorda RV Park harmless from and indemnify Matagorda RV Park against the same.
5.1.3 The Park is not responsible for personal injuries or damage, loss, or theft of any personal property or vehicle. Keep your valuables locked and secured.
5.1.4 Park Management reserves the right to evict any person(s) who does not comply with these rules and policies without refund.
5.1.5 All RVs must be less than fifteen (15) years old at the time of reservation. Guests owning a RV older than fifteen years old must submit pictures of the RV to Park management via email and must receive written approval before moving their RV inside the Park.
5.1.6 All RVs must be in good working order and appearance. Park Management reserves the right to refuse access to any RV deemed unacceptable.
5.1.7 All sites are to be kept neat, clean, and free of clutter for the duration of your stay. Storage is not permitted under or around your RV or picnic table, except with written approval from Park Management.
5.1.8 Please be respectful of your neighbors. Do not walk or drive through occupied or vacant sites. Use designated roads, sidewalks, and paths.
5.1.9 Any activity deemed obnoxious, profane, or violent towards other guests or Park staff will result in immediate eviction without refund. Harassment or mistreatment of staff or other guests, including racist comments or hate speech, will not be tolerated.


5. 2 Utility Connection Liability Disclaimer
Matagorda RV Park provides utility connections (including electricity, water, and sewer) for guest use on an as-is basis. The Park shall not be held liable for any damage or loss to Guest RVs, vehicles, equipment, or personal property resulting from utility connections, including but not limited to fluctuations in voltage, power surges, water pressure, sewer backups, or guest misuse of connections. Guests are solely responsible for using appropriate surge protectors, pressure regulators, and proper connection techniques to protect their property. By connecting to the Park's utilities, guests assume all associated risks and liabilities.

5. 3 Utilities and Pedestal Use
5.3.1 Electrical Use:
5.3.1.1 Guests are responsible for understanding your RV's amperage requirements. Usage over the provided amperage (e.g., 30/50 AMP) can trip breakers.
5.3.1.2 Notify Park Management immediately of any electrical issues. Guests are not permitted to diagnose or work on Park electrical pedestals due to safety and insurance requirements.
5. 3.2 Water Use
5.3.2.1 Guests are responsible for using a pressure regulator to protect Guest’s RV’s plumbing system from high water pressure. Sudden surges or inconsistent pressure can occur and may damage unregulated connections.
5.3.2.2 Notify Park Management immediately of any water supply issues or leaks. Guests are not permitted to tamper with or modify Park water hookups. All hoses and fittings must be in good condition and leak-free.
5.3.3 Sewer Use
5.3.3.1 All sewer connections must be sealed and properly fitted using approved hoses and connectors. Open sewer hoses or improper fittings are not permitted.
5.3.3.2 Guests are responsible for ensuring that black and gray water is discharged only through designated sewer connections.
5.3.3.3 Flush only RV-safe toilet paper and waste—no wipes, feminine products, grease, or foreign materials. Improper use may result in site damage fees or immediate termination of stay. Notify the office of any backups or drainage issues immediately.
5. 4 Vehicle and Parking Rules:
5.4.1 Speed Limit: The Park speed limit is 5 MPH. This is strictly enforced for the safety of all guests, children, and pets.
5.4.2 Parking: Each registered site includes parking for one (1) RV and one (1) tow/toad vehicle, unless otherwise specified.
5.4.2.1 Do not park vehicles, trailers, or boats in adjacent sites, on grass, in roadways, or in any manner that blocks traffic or access to other sites or Park facilities.
5.4.2.2 Extra vehicles, boats, or trailers may require an additional fee and must be parked in designated overflow parking areas as directed by Park Management. Storage for these items may be available for a fee.
5.4.3 Vehicle Operation: Only persons with a valid driver’s license may operate any motor vehicle in the Park, including golf carts, scooters, etc.
5.4.4 ATVs, Dirt Bikes, Motorcycles, Golf Carts: Operation of Off-Highway Vehicles (OHVs) within the Park is restricted to travel to and from your site only. Joyriding within the Park is prohibited. Motorcycles must be operated at idle speed when traveling through the Park.
5.5 Pet Policies:
5.5.1 Registration & Limits: All pets must be registered and received written Park Management approval before arrival. A maximum of two (2) pets per site is permitted. Park Management reserves the right to refuse service to anyone whose pet is deemed unsuitable for the Park environment. No exotic, oversized, or aggressive pets are permitted.
5.5.2 Matagorda RV Park does not permit the following dog breeds, whether purebred or mixed, due to safety and insurance liability concerns: American Pit Bull Terriers, Staffordshire Bull Terriers, American Staffordshire Terriers, Rottweilers, Doberman Pinschers, German Shepherds, Belgian Malinois, Chow Chows, Akitas, Alaskan Malamutes, Siberian Huskies, Presa Canarios, Dogo Argentinos, Cane Corsos, Fila Brasileiros, Tosa Inus, Bullmastiffs, Boerboels, Wolf hybrids, and any dog with a known history of aggression or biting.
5.5.3 Leash Policy: Pets must be kept on a leash (not exceeding 6 feet in length) and under the direct control of a responsible adult at all times when outside the RV.
5.5.4 Waste Disposal: Guests are responsible for immediately cleaning up after their pets and disposing of waste properly in designated receptacles. Do not allow pets to deposit waste on other guests' sites or common areas. Failure to clean up after your pet may result in fines or eviction.
5.5.5 Unattended Pets: Pets may not be left unattended outside the RV at any time. Do not tie pets to trees, posts, or Park property. Leaving pets unattended can be dangerous due to weather, power outages, etc.
5.5.6 Prohibited Areas: Pets are not allowed in Park buildings (including restrooms, laundry, office), pool areas, or playgrounds, with the exception of certified service animals.
5.5.7 Vaccinations: All pets must have current vaccinations. Proof of vaccination may be required.
5.5.8 Barking/Noise: Excessive barking or other pet-related noise that disturbs other guests is not tolerated. Continued disturbances may result in eviction.
5.5.9 Liability: Guests are solely responsible for any damage or injury caused by their pet(s).
5. 6 Safety and Emergency Procedures:
5.6.1 Severe Weather: In case of severe weather, seek shelter in designated areas (e.g., restrooms, laundry room, or as posted). Please bring pets with you.
5.6.2 Emergency Contact: Long-term and Seasonal tenants are required to provide emergency contact information. This information will be kept private and used only in emergencies or if requested by law enforcement.
5.6.3 Reporting Concerns: If you observe any activity you believe to be of concern, please call Park Management immediately. No soliciting is allowed in the Park.
5.6.4 Calling 911: If you need to call 911 for an emergency, and time allows, please also notify the Park Management so staff can assist emergency personnel in locating your site.
5.7 Quiet Hours:
5.7.1 Quiet hours are from 9:00 PM to 7:00 AM
5.7.2 All guests are expected to be courteous to others. Loud music, disruptive noise, or inconsiderate behavior is not allowed at any time. Violators may be warned once and then asked to leave without a refund.
5.8 Trash Disposal and Recycling:
5.8.1 Please dispose of all trash in designated dumpsters or trash cans located throughout the Park.
5.8.2 All trash must be bagged and tied securely before placing it in receptacles. Do not leave trash outside your RV overnight.
5.8.3 Do not dispose of hazardous materials (e.g., motor oil, cooking oil, wires, furniture, mattresses, toxic waste, chemicals) in Park trash containers. Violators may be charged for disposal fees.
5.8.4 If recycling is available, please follow posted guidelines for sorting and depositing recyclable materials (e.g., cardboard, aluminum) at designated drop-off locations.
5.9 Visitors:
5.9.1 All visitors must register with Park Management prior to arrival and pay any applicable fees. Registered guests are responsible for ensuring their visitors are properly registered and adhere to all Park rules.
5.9.2 Park Management reserves the right to limit the number of visitors per site.
5.9.3 Day visitors must depart by 10:00 PM. Overnight visitors must be registered and may incur additional fees. Visitors are not permitted to bring pets.
5.9.4 Visitor parking is in designated areas only.
5.10 Use of Amenities (Pool, Laundry, Restrooms, Playground):
5.10.1 Pool & Playground (if applicable):
5.10.1.1 Hours: 9:00 AM to Dusk/8:00 PM.
5.10.1.2 NO LIFEGUARD ON DUTY. Use at your own risk.
5.10.1.3 Children under 14 years of age must be accompanied and supervised by a responsible adult at all times in the pool, playground, and all common areas of the Park.
5.10.1.4 No glass containers, food, or alcohol in the immediate pool area or in the pool itself.
5.10.1.5 No running, diving, or horseplay in the pool area.
5.10.1.6 Proper swim attire is required (no cut-offs). Children in diapers are not allowed in the pool unless wearing approved swim diapers.
5.10.1.7 Loud music and rough play are not permitted.
5.10.1.8 Do not climb Park trees.
5.10.2 Laundry (if applicable):
5.10.2.1 Open 24/7 (unless otherwise posted).
5.10.2.2 Please do not leave laundry unattended. The Park is not responsible for accidents, theft, or damage to articles.
5.10.2.3 Keep the laundry room clean.
5.10 .3 Restrooms (if applicable):
5.10.3.1 Open 24/7, with temporary closures for cleaning.
5.10.3.2 Please help keep restrooms clean.
5.10.3.3 Children under 12 must be accompanied by an adult.
5.11 Prohibited Items/Activities:
5.11.1 Open Fires: Open ground fires are generally not allowed. Fires must be contained in approved fire pits or designated fire rings. Portable fire pits may be available for rent; place them on gravel or concrete to avoid damaging grass. Always ensure fires are attended and fully extinguished before leaving. Guests must comply with any local burn ban status.
5.11.2 Charcoal Grills, Wood Fire Pits, Deep Fryers, Tiki Torches are PROHIBITED.  Propane grills and propane fire pits are generally allowed.
5.11.3 Fireworks and Firearms: Absolutely NO fireworks (including sparklers, smoke bombs) or firearms (including air soft, BB, and pellet guns) are permitted in the Park. Violators will be asked to leave immediately without a refund.
5.11.4 Drones: Drones or other remote-controlled machines may not be used at any time on Park property.
5.11.5 Clotheslines: Not permitted.
5.11.6 Washing Vehicles/RVs: Washing of RVs or vehicles is not permitted. 
5.11.7 Repairs: Major repairs to RVs or vehicles are not permitted in the Park. Minor emergency repairs may be allowed with Park Management approval. Mobile RV repair services may be recommended by Park Management.
5.11.8 Paint/Chemicals: The use of paint products or hazardous chemicals (other than normal RV tank treatments) is prohibited.
5.11.9 Tents: Tent camping is permitted only in designated areas/sites. Blowup mattresses, sleeping bags, and cots are not allowed outside the RV or tent.
5.11.10 Mail/Packages: Matagorda RV Park does not allow delivery of mail/packages unless approved in writing by Park Management.


6 DAMAGES:
Guest is responsible for all damages to Park property, including the assigned Site, utilities, landscaping, and amenities, caused by Guest, their family, guests, or pets. Costs for repair or replacement will be billed to the Guest.


7 INDEMNIFICATION AND LIMITATION OF LIABILITY:
7.1 Guest agrees to indemnify, defend, and hold harmless Matagorda RV Park, its owners, management, employees, and agents from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorney's fees) arising out of or in connection with:
7.1.1 Guest's use or occupancy of the Site or Park facilities.
7.1.2 Any injury to persons (including death) or damage to property occurring on the Site or within the Park due to the actions or omissions of Guest, their family, guests, or pets.
7.1.3 Any breach of this Agreement by Guest.
7.1.4 Hazards associated with acts of nature, wildlife, or other conditions inherent to an outdoor environment.
7.2 Matagorda RV Park shall not be liable for any loss or damage to Guest's personal property, including RVs, vehicles, or their contents, due to fire, theft, accident, vandalism, acts of God, or any other cause. It is recommended that Guests maintain appropriate insurance coverage.


8 DEFAULT AND EVICTION:
Failure to pay reservation fees for any type of site reservation (short-term guests, long-term guest and seasonal guests) or other charges when due, or violation of any terms of this Agreement or Park Rules, shall constitute a default. Upon default, Park Management may, at its option, terminate this Agreement and require Guest to vacate the premises immediately, without refund. Park Management also reserves the right to refuse service or require any person or party to leave the Park for behavior deemed inappropriate, disturbing to others, or in violation of Park rules.


9 CANCELLATION AND REFUNDS:
9.1 Daily, Weekly and Monthly Stays are subject to our cancellation policy. 
9.1.1 Cancellations made 30 days prior to arrival will receive a full refund minus a $10 transaction fee. 
9.1.2 Cancellations made 14-29 days prior to arrival will receive a 75% refund.
9.1.3 Cancellations made 7-13 days prior to arrival will receive a 50% refund
9.1.4 Cancellations made within 6 days of arrival will result in forfeiture of the entire payment.
9.2 No refunds will be given for early departure on daily, weekly, or monthly rates.
9.3 No refunds will be given for early departure due to weather or discomforts of nature.
9.4 No refunds will be given if evicted for rule violations.


10 AMENDMENTS:
Park Management reserves the right to amend or add to these Park Rules and Regulations at any time. Notice of such changes will be posted in the Park office or otherwise communicated to Guests. Continued occupancy after notice of changes constitutes acceptance of the new rules.


11 GOVERNING LAW:
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas.


12 ENTIRE AGREEMENT:
This document, including any referenced addenda (such as a specific long-term lease agreement if applicable), constitutes the entire agreement between the parties and supersedes all prior discussions, agreements, or understandings.


13 ACKNOWLEDGEMENT AND AGREEMENT:
By reserving and/or occupying a site, I acknowledge that I have read, understand, and agree to comply with all terms, conditions, and rules set forth in this Terms and Conditions. I understand that I am responsible for the actions and compliance of all persons in my party, including any children and any guests that visit during my stay.
