McClintock Bay Resort Policy

 

Please Note: We are a PRIVATELY OWNED BUSINESS and REQUIRE ALL GUESTS TO AGREE to the following POLICY, as well as ACKNOWLEDGE that we reserve the right to REFUSE SERVICE TO ANYONE WHO DOES NOT.

“ McClintock Bay Resort and its Employees are not responsible for any personal injuries, damages, losses or theft of personal property, items, or vehicles. Guests/Visitors assume any risks associated with the foregoing during their visit at McClintock Bay Resort and agree to hold McClintock Bay Resort and its Employees harmless of such instances and will indemnify McClintock Bay Resort and Employees against the same. ”

Check-out time (all Sites): 12:00 PM

*If you require a later check-out time please contact us at the store or by calling (867) 334-5534. Additional fees may apply as we must ensure availability for incoming guests - to avoid this we ask that you please plan a punctual departure.

Site Changes: Every guest has booked a specific site. If you wish to change your site upon arrival please consult us in-person by visiting the store or call (867) 334-5534. You must inquire before moving sites, as this may not be possible due to other guests’ reservations and site maintenance.

Tenting & Vehicles: Tent camping is ONLY permitted in designated areas. A maximum of 1 tent add-on is allowed per RV site with an additional cost of $10 per tent, per night. There is a maximum of only 1 RV and 1 other vehicle per RV sites if space allows - extra vehicles are subject to an additional charge. DO NOT park your vehicle, trailer, boat etc. on an adjacent site as it may be reserved, use of more than one site will result in additional charges.

Terrain & Wildlife: We are located in a natural wildlife area home to many wild predatory animals, DO NOT feed any animals you may encounter and constantly supervise all children and pets. The sand bank is subject to erosion, DO NOT CLIMB UP OR DOWN THE BANK, there is a staircase to access the beach.

*In the following: “Resort” refers to McClintock Bay Resort, “guests” refers to those WITH a reserved site, “visitors” refers to those WITHOUT a reserved site, “pets” refers to non-service animals.*

Resort Terms & Conditions

While at the Resort guests/visitors are:

  1. Responsible for any damage or injury caused by themselves, their children or pets, and their additional visitors;

  2. Prohibited to consume alcohol anywhere except for their reserved site;

  3. Prohibited from smoking/vaping in any Resort buildings, please use the Resort’s designated smoking areas and ash/butt disposal (“Butt Buckets”);

  4. To have open fires ONLY in designated site fire pits or fire rings (propane grills and propane fire pits are allowed);

  5. Prohibited from vandalism of any kind (regardless of age) including removal or cutting of tree branches - such actions may result in dismissal from the Resort;

  6. To keep sites (including fire pits/rings and tables) and common-use areas clean.

  7. To dispose of all trash/recycling into the Blue Shed ONLY - located at the East end of the Main Lodge (doors marked “Garbage/Recycling”);

  8. Prohibited from leaving trash out overnight AND after checking-out;

  9. Completely and independently responsible for the behaviour and whereabouts of any minors (under 18 years of age) in their care.

 

Quiet Hours & Generators

While at the Resort guests/visitors must:

  1. Be courteous of all the Resort’s guests and their sites;

  2. Respect daily quiet hours from 10:00 pm to 8:00 am;

  3. Only use generators from 9:00 AM to 11:00 AM and 6:00 PM to 8:00 PM; generators must be no more than 65 decibels.

  4. Refrain from any excessively loud noise during all hours (such as yelling, loud music, and barking/whining pets).                                                                                                                                                                          

Additional Visitors

Guests at the Resort are responsible for informing their additional visitors of this Policy and ensuring appropriate actions and behaviours.

  1. Profanity, violence, or indecency towards any other guests, visitors, or Employees of the Resort will result in immediate eviction from the premises.

  2. Obnoxious behaviour of ANY KIND is prohibited.

  3. Visitors must register in-person at the store upon arrival, and leave by 9:00 PM.

  4. The Resort has a Visitor Fee of $10 per adult and $5 per child (under the age of 12).

  5. Each site has a maximum capacity of 6 individuals (combination of guests and/or visitors).

  6. If you are hosting a group event (more than 6 individuals) an Expanded Site Capacity Permit must be signed and obtained in advance either in-person at the store or by calling (867) 334-5534 - additional fees will apply.

Resort Safety 

For everyone’s safety please abide by the following protocols observed by the Resort, and if you see or encounter any problems please contact the Main Office immediately at (867) 334-5534. 

  1. NO LIFEGUARD ON DUTY, USE BEACH AT YOUR OWN RISK.

  2. Glass containers of any kind are NOT ALLOWED on the beach, docks, or stairs to access the beach.

  3. Use of illegal substances is prohibited.

  4. Use of fireworks, firearms, air guns, BB guns, paintball guns, slingshots, or archery equipment of any kind or type is prohibited.

  5. The Resort has a strict speed limit of 10 km/h (6 mi/h); motorcycles must be at idle speed.

  6. A valid driver’s license is REQUIRED to operate any motor vehicle while on the Resort.

  7. DO NOT PARK ON OR BLOCK ANY PORTION OF THE ROADWAY/PATH.

  8. The Resort adheres to and maintains all Territorial and local laws, which are applicable to ALL guests/visitors.

Pet Policy

The following applies to all guests and visitors of the Resort accompanied by a pet of any kind (this does not include service animals):

  1. The Resort reserves the right to refuse service to anyone whose pet is NOT considered suitable for the peace and safety of our guests.

  2. The Resort allows a maximum of 2 pets per site.

  3. Pets must be kept on a leash or lead (unless on the beach and accompanied by their owner) and never left unattended.

  4. Pets must be kept under control - no excessive barking, whining, or aggression towards guests/visitors of the Resort whatsoever, any of these may result in dismissal from the Resort without refund.

  5. Owners are responsible for proper cleanup and disposal of pet excrement, failure to do so may result in dismissal from the Resort without refund.

  6. Pets are only allowed inside of designated buildings.

  7. If you are staying in a cabin there is an additional Pet Fee of $35 and requirement that all pets must be secured in a kennel/enclosure if they are being left alone in a cabin.

  8. The Resort is NOT responsible and will not be held accountable for any injury or damage caused by pet(s) - owners are responsible for the actions and behaviours of their pet(s).

 

Terms & Conditions can change anytime without notice - but the Resort tries to be consistent with updating its Policies so that all guests are newly informed and up-to-date.

 

“I acknowledge that I have read and accepted all Terms, Conditions, and expectations explained in the above Policy, and will respect and abide by such. I also acknowledge that McClintock Bay Resort is a privately owned business and reserves the right to evict or refuse service to any person(s) who do not comply with this Policy, and that if given an eviction notice a refund WILL NOT be issued.”

RELEASE OF LIABILITY, WAVIER OF CLAIMS AND INDEMNITY AGREEMENT WARNING

By agreeing to the Terms and Conditions you are agreeing to this Wavier,

you will waive certain legal rights, including the right to sue.

Please read carefully.

1. This is a binding agreement; therefore, clarify any questions or concerns before agreeing. Participating in a McClintock Bay Adventures sanctioned activity (onsite at 62 Swan Haven Drive), includes but is not limited to Canoe/Kayak/Paddleboard rentals, Swimming/water play, RV parking, cabin rentals, Fat Bikes, Kicksleds, Etc.

Disclaimer

2. McClintock Bay Adventures and its agents, employees, volunteers, and representatives (collectively the “Organization”), and their Insurers, are not responsible for an INJURY, DAMAGE, INCLUDING DEATH, PROPERTY DAMAGE, EXPENSE, LOSS OF INCOME OR LOSS OF ANY kind suffered by a participant during, or as a result of, the activities, caused in any manner whatsoever including, BUT NOT LIMITED TO, THE NEGLIGENCE OF THE ORGANIZATION OR ITS INSURERS

Description of Risk

3. I am participating voluntarily in the Activities. In consideration of my participation, I hereby acknowledge that I am aware of the risks, dangers, and hazards associated with or related to the Activities. THE RISKS, DANGERS, AND HAZARDS INCLUDE, BUT ARE NOT LIMITED TO, INJURIES FROM:

a) Changing water flow, currents, wave action, boats’ waves, terrain obstacles, unstable surfaces, lightning, variance and extremes of wind, and temperature;

b) Failure to properly use any piece of equipment or from the mechanical failure of any piece of equipment;

c) Collision with any of the following: other participants, the watercraft, other watercraft, man-made or natural objects;

d) My sense of balance, physical coordination, ability to operate equipment, swim, and/or follow directions;

e) Drowning including but not limited to, equipment failure or entanglement, falling out of boat/watercraft into the cold water, capsizing or being knocked unconscious in the water, exposure to the elements, hypothermia, and/or drowning, fatigue, chills, and/or dizziness;

f) The presence of insects and marine life forms;

g) Heat or sun-related injuries or illnesses, including sunburn, sunstroke, or dehydration; and

4. Furthermore, I am aware:

a) I am expected to wear an approved Personal Flotation Device when on the water;

b) That my risk of injury is reduced if I follow all rules established for participation.

Release of Liability and Disclaimer

5. In consideration of McClintock Bay Adventures allowing me to participate, I agree;

a) The sole responsibility for the Participant’s safety remains with the Participant;

b) To ASSUME all risks arising out of, associated with, or related to my participation;

c) To WAIVE all claims that I may have now or in the future against the Organization or its Insurers;

d) To freely ACCEPT AND FULLY ASSUME all such risks and possibility of personal injury, death, property damage, expense, and related loss, including the loss of income, resulting from my participation in the activities, of McClintock Bay Adventures; and

e) To FOREVER RELEASE McClintock Bay Adventures and its Insurers from all liability for all claims, demands, actions, damages ( including direct, indirect, special, and/or consequential), losses, actions, judgments, costs (including legal fees) (collectively, the “Claims”) which I may have or may in the future, that might arise out of, result from, or related to my participation in Activities, even though such Claims may have been caused by any manner whatsoever, including but not limited to, the negligence, gross negligence, negligent rescue, omissions, carelessness, breach of contract and/or breach of statutory or care of McClintock Bay Adventures or its Insurers.

6. I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND AND READ THIS AGREEMENT, THAT I HAVE EXECUTED THIS AGREEMENT VOLUNTARILY, AND THAT THIS AGREEMENT IS TO BE BINDING UPON MYSELF, MY HEIRS, SPOUSE, CHILDREN, PARENTS, GUARDIANS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, AND LEGAL OR PERSONAL REPRESENTATIVES.
