Misty Morning Campground

Seasonal Agreement

 

This agreement, made and entered into by and between Misty Morning Campground, hereinafter

referred to as "Campground" and site tenant jointly and severally, hereinafter referred to as seasonal.

NOW THEREFORE, the parties hereto freely and voluntarily enter into the following agreement:

Seasonal Camper(s) is defined as up to two adults that are married/partners or live in the same household and dependent children aged 17 and younger that also live in the same household.

NOT A LEASE

This agreement is a contract which is binding on both Campground and Seasonal. This agreement is not a lease of real estate. Seasonal is not a tenant. This agreement is, for legal purposes, a license to use the property of Campground, designated as site _______  on the conditions which are stated in this Agreement. Seasonal Camper(s) may not claim Campground as their permanent address, voting address or any other place of residence. Seasonal may not have a mailbox or receive mail at the campground.

TERM OF AGREEMENT

Camping Season: April 1 - October 31st,. Depending on uncontrollable variables such as weather.

If Seasonal chooses to move out before end of agreement, no refunds will be given for any reason. Seasonal is liable for any balance owed on contract and must be paid in full before moving out. Any sale or early removal of camping unit will immediately void Seasonal's agreement with no refunds or pro-rations. Contract can be terminated at the discretion of Campground without a refund for Seasonal violations of rules, such as but not limited to non­ payment, unruly behavior, physical or verbal fighting, and disorderly conduct. Camping units will have to be removed from park within 7 days of termination notification.

Seasonal shall not, voluntarily, involuntarily or by operation of the law, assign the whole or any part of said campsite or any personal property located thereon or permit any other persons to occupy the same. Any attempt to assign or the same without prior written consent of Campground shall cause this Agreement to be deemed null, void and of no further effect immediately. Acceptance of payment of seasonal fee, in whole or in part, from any other person by Campground shall not be deemed to be a waiver of any of the provisions of this Agreement or to be consent to the assignment.

Check In / Check Out


Check in is at 2 PM MST and entitles you to your site until 2 PM the day after check in. Early check in is not permitted. The guests who paid for the site the night before you has paid for their
site until noon. We will not ask a guest to leave so that you can check in early. If you will be
arriving in the area early, please make arrangements until your site opens up at noon. We do not
have a waiting area for those checking in early. Check out time is 2 PM. You do not need to
contact the office for check out, unless you need to pay for an after-hours check in.
Late check-ins are allowed at any time, please just contact the park for instructions.
If you are staying in our park for a month or longer, we require an agreement to be signed.

CAMPING UNITS

No sale(s) of units are allowed on site. All camping units older than 10 current model years are restricted for Seasonal. Contact the office for further details.

Open Fires
Open fires are not allowed in our park. Fires must be in firepits or designated fire rings. We have
portable fire pits available for guests to rent for the night. Firepit rental is $2 each per night and
you must place the fire pit over the gravel or concrete, so that the heat from it does not damage
the grass.

PETS

We are a pet friendly Campground. Friendly pets that are current with their vaccinations are welcome. Seasonal is responsible for cleaning up and disposing of pet's waste. Pets should NOT be left unattended at site(s) or tied to trees. Temporary pet fencing, first, must be approved by Campground and NOT to exceed a l0'xl0' area on Seasonal site (if Seasonal site accommodates as such). Pets must be always on a leash, that is no longer than 6 ft. No pets are allowed in the common areas of the Campground (Pool, Playground, Recreation Center, Office, Etc.). Larger dog breeds must be approved by management. All pets must be recorded with Campground office; Breed, size, name and number of pets (limited to 2)that will be staying with Seasonal NO EXCEPTIONS! Guest is not permitted to bring pets onto the grounds.

Pet Vaccinations
Due to Insurance Requirements, all pets must be vaccinated in our park. Please make sure your
pet’s shots are up-to-date and copy of vaccinations are given to campground.

Pets Not Allowed on Furniture
If you are staying in one of our campers or cabins, pets are not allowed on the furniture.
For any incidents, that will be a $25.00 charge per occurrence.

Barking
Excessive barking is not tolerated and disturbs your neighbors. Please note that excessive
barking may result in you being asked to leave without refund.

GUESTS

Seasonal is responsible for the conduct of their daily and overnight guests and shall be liable for any personal injuries or property damage arising from the actions of such guests. Only the persons named in this Agreement or permitted guests may lodge in the camping unit. Seasonal may not list the camping unit or campsite on a sharing site. Additional requirements may be sent to Seasonal via e-mail in the beginning of the season and/or at contract signing and are subject to change. Guests' vehicles must be parked in designated guest/overflow parking areas.

Campground reserves the right to accept or reject anyone on the property. If Seasonal's guests are found to be unruly, violators of campground guidelines and/or show disregard of proper campground etiquette/respect toward other Seasonal(s), will be asked to leave campground immediately. Campground is allowed to revoke/terminate Seasonal's agreement immediately.

PLAYGROUND

 No smoking, glass containers, food, alcohol, pets, running and/or jumping in park/ playground area.

Children under the age of 8 require supervision by responsible party 13+. Any damages or vandalism will be assessed and charged to appropriate account.

SITE APPEARANCE, RESTRICTIONS, AGREEMENT AND TERMS

Seasonal will be responsible for the maintaining and upkeep of the site. Regular mowing, trimming and weeding is required. Campground may mow and weed seasonal’s site at a $50.00 charge if seasonal neglects site maintenance, charges will be added to Electrical bill. All decks are required to be maintained. Deck stain/paint color must be approved by Campground. No enclosures, roofs, tarps or carports. No permanent structures are permitted on site. No outdoor carpets or pallet decking. Campground must be informed before any changes or improvements are made to seasonal site, this includes building of decks, landscaping, etc. Plastic tubs/garbage bins must have locking lid and should NOT be visible; they must be stored in a shed, on your deck or in storage compartments within your camper. Nothing should be stored under campers at any time such as: lawn mowers, bikes or plastic bins. Wood piles should be stacked orderly and 8” off the ground; No piles of scrap lumber are allowed on site.

Gazebos, platforms or other non-permanent free-standing structures must be approved by Campground. Storage sheds are to be rubber made or equivalent (Nothing built). Storage sheds may be no larger than 8'xl0’. Nothing is allowed in or on the trees; screws, nails, hooks, etc., are damaging to the trees. If deemed, neglect/disregard to this Campground policy is cause for the damage to any tree and removal of a tree on the site is necessary, Seasonal will be charged for the removal of tree(s).

Clotheslines
Clotheslines are not permitted in our park. (if needed, please use drying rack).

Vehicles

Only two vehicles arc allowed per site violators will be fined $35 per occurrence per day. Additional vehicles may park in visitor parking areas. Vehicles should NOT be parked on other vacant Seasonal or overnight sites. Utility trailers/boat trailers etc., are not permitted to be stored at site. If you bring a utility trailer or boat & trailer, they must be parked in visitor parking and returned to your residents when you leave. (Campground designated visitor parking areas are for visitors and seasonal overflow). For Sale signs and political signs may NOT be posted anywhere on site. Do NOT chop or cut any trees, seedlings, plants or shrubs, violators will be fined.

RV Sites

Seasonal’s RV rear must be within 5’ of electrical pole and the tongue must be pointing outward towards your road. Seasonal’s site is for 1 RV only any tents that are set up on seasonal’s site will be billed per tent per night at current rates.  Seasonal’s sites are not storage sites for other campers or boats, storage fess will apply.

Seasonal site boundaries are determined by Campground. No fencing of any kind or any dividers between sites is permitted. Seasonal may NOT use the Campground's address to forward mail or deliver packages. *Any & All improvements made to a Seasonal(s) site become the property of Misty Morning Campground, including but not limited to landscaping, gravel, decks/patios at the time the agreement is expired or terminated.

ELECTRICITY

Each camping unit is to be plugged into its own electric box on Seasonal's campsite. There is a fee for the electric usage. Electric bills will be read 1st Monday of the month. Dates are subject to change due to holiday weekends. Please check with office to stay up to date on bills. Past due bills will accrue a S15.00 per month late fee. If Seasonal's electricity bill is delinquent, in addition to other remedies, Campground may disconnect the electricity to the campsite. Camper shall pay a reconnect charge to Campground of$35.00. If a Seasonal is going to be gone for an extended period, it is the Seasonal's responsibility to notify the Campground and plan for payment to avoid late fees and termination of electric service.

WATER 

Water is $8.00 per Month per site for Seasonals and $20 per Month for Longterm however excessive use will result in a $35.00 fine added to your electrical bill, excessive being more water usage than normal on a daily basis.

Fireworks and Firearms
Fireworks and firearms are strictly prohibited in our park. The prohibiting of fireworks includes
sparklers, smoke bombs, aerials, and firecrackers. The prohibiting of firearms includes all guns
including air soft, BB, and pellet guns. If these items are seen outside of your RV, you will be
asked to leave immediately without a refund.

 

PUMPING

Campground has a Honey Wagon service. This service is available at a rate and/or a wheel call, $35 will be billed monthly. Contact the office to schedule and pay for pumping services. Payment is due in full before service is scheduled with Seasonal. Pump-outs are done weekly, every Monday and Tuesday. This is subject to change due to holiday weekends or weather. Requirements for Honey Wagon service: Black tank chemicals in use and detected when pumping (if black tank chemical is NOT visible, pumping will NOT be completed, and service suspended until remedied). Only marine/recreational vehicle grade paper use.

Gray tank is not permitted to be released or dumped on ground and is a violation of Indiana State Code and is a finable offense any seasonal that is found in violation will receive a fine of $35.00 added to electrical bill no exceptions.

Trash Disposal and Recycling
Trash cans are located throughout the park. Please tie trash bags completely closed and put your
trash completely in the trash container. If the first can is full, please find another container.
Please do not place your trash on the ground. Woodland creates like possums and racoons are
attracted to left out or disposed of food and while we think they are cute and wonderful animals,
we don’t want you to find a surprise night visiting racoon at your site because of incorrectly
disposed of trash! Do not dispose of wires, oil, furniture, mattresses, or any toxic waste or
chemicals in our trash cans. Trash is emptied once per day. Times may vary due to maintenance
scheduling requirements throughout the day.

A dumpster is available in the center of the park behind playground. Please do not dispose of any motor oil, cooking oil, wires, furniture, mattresses, or any toxic or hazardous waste items. Failure to adhere to this rule may result in charges for disposal fees. If you are recycling, we currently recycle cardboard and aluminum. Please bring any recycling items to our store or garage for drop off.

Campground provided dumpsters. Household and other large items are not allowed in the trash. Waste management will not take these items. Items include grills, awnings, tires, hoses etc. This area is monitored, and item(s) fore mentioned will be returned to site and a $25.00 violation fee will be assessed to electric billing.

STORAGE

There are storage units available at an additional cost of $30.00 per month. There is trailer and boat storage available and cost $30.00 a month, slots are limited and it is the responsibility of seasonal to do the upkeep on each slot, campground will charge seasonal to mow and weed eat slot.

GOLF CARTS

All Seasonal(s) golf carts must be registered with the Campground office. Golf cart liability insurance is required. The office must have copy of the insurance card on file. All golf carts must have operating head lights and operators must have valid driver's license. CHILDREN ARE NOT ALLOWED TO DRIVE GOLF CARTS - NO EXCEPTIONS! Electric and/or gas golf carts permitted (however, gas carts need to be mufi1ed). Quads (ATV's), side by sides, dirt bikes, 3 wheelers, mopeds, motorized scooters etc., are NOT permitted in the campground. Golf carts are only allowed on gravel roads, not sidewalks or walking paths Speeding and racing will NOT be tolerated. A $25.00 fee charged for a required annual sticker (placed visibly on the golf cart registered) due at time of Golf cart registration. *Golf cart guidelines are subject to change at the discretion of Campground.

GENERAL GUIDELINES & RESTRICTIONS

 

For Safety and Enjoyment for All Guest:

•          The speed limit is 5 MPH in the campground during all hours. Please abide by this speed limit for everyone's safety. DRIVE SLOWLY AND WATCH FOR CHILDREN. Fines will be given.

•          Seasonals must check in at office upon entering the campground.

•          Seasonal(s) RVs must be kept clean over the course of the camping season. If your camper needs a wash the Campground will place a reminder sticker on your camper.

•          Absolutely NO digging

•          Do not leave trash on the ground in front of or on top of dumpsters.

•          State Law prohibits draining of gray water onto the ground. Violators will be fined.

•       Display or use of Fireworks by Seasonal(s) is not permitted in the Campground.

•          Tampering or adjusting Campground property, playground equipment, utilities or facilities is not permitted.

•          Campground may mow and weed seasonal’s site at a $35.00 charge per occurance, if seasonal neglects site maintenance weekly, charges will be added to Electrical bill.

•          State Law prohibits out of State firewood. Only local firewood may be brought into the campground. All firewood is to be bought from campground store.

•          Bike riding in the campground is not allowed after dark due to it being a safety hazard. Please do not have children use the front entrance area and steep hill (in the middle) of the campground as these are high traffic areas.

•          Radios and loud noises must be kept at a level that does not offend neighbors.

•         Children under the age of 8 years old must be accompanied by an adult when using the bathhouses. {Parents are responsible for their children and their safety. Do not leave your children unattended).

•          Quiet Time is between the hours of 11:00pm and 8:00am. Fines will be issued.

•          Children under the age of 18 should be accompanied by an adult after 10pm.

•          NO smoking in ANY campground buildings.

•          No ATV's, motorized scooters, mopeds, or other motorized vehicles will be allowed on

the grounds.

•          Seasonal may NOT use the campground's address to forward mail or deliver packages.

We do not give credit or refunds due to the discomforts of nature. The fun continues rain or shine. Our cancellation policy varies depending on the timing of your cancellation notice in advance of the reservation date.

For Lodging Rentals:
3+ WEEKS:
Refund less $25 cancellation fee or full refund issued in camp credit

2+ WEEKS:
50% of Reservation issued in camp credit

LESS THAN 2 WEEKS:
Full reservation forfeited

For Campsites: 
2+ WEEKS
Refund less $25 cancellation fee OR full refund issued in camp credit

1+ WEEKS
50% of reservation issued in camp credit

LESS THAN 1 WEEK
Full reservation forfeited

Boat/Storage Rentals

Full reservation forfeited

 

 

RELEASE OF LIABILITY

Campground cannot assume responsibility for injury, accident or losses to Seasonal or guests. Seasonal and guests assume all risks and danger incidental to the activity of camping in an outdoor environment and agrees that Campground and its owners, employees, and agents are not liable for injuries or property damage resulting from such causes. Seasonal acknowledges agreement, confirms and complies recorded by their signature to this agreement.

ENFORCEMENT AND PENALTY

Citations will be given if guidelines are not followed. Once 3 violations have accrued, Campground will have the right to evict within a 24-hour period. No refunds will be issued. Campground will not tolerate disrespect towards nightly campers, other seasonal campers or staff Sample reasons for dismissal or termination: fighting, misdemeanors, felonies, theft, destruction of property, blatant disregard of restrictions and guidelines outlined in agreement. Campground reserves the right to refuse campsite rental to anyone. Prices and rules may change without notice.

 

EXISING PERMANATE STRUCTURES

Seasonal’s that have permanent structures will be responsible for all assessed taxes and up keep.

ACKNOWLEDGEMENT AND SIGNATURE

 

 

I agree to the conditions and provisions of this Agreement and agree to comply with them. I further agree to inform the other members of the seasonal site (including minor children) and my guests of the requirements of this Agreement and be responsible for their behavior and demeanor at Campground. I understand that admission to Campground may be terminated by Campground, at any time in the sole discretion of Campground.

With full understanding and in agreement, this Campground being privately owned and as such private property, enter into this agreement release the Campground, its officers and employees of all liability for loss or damage to property and injury of/to all Seasonal(s) person/persons arising out of Seasonal(s) use of its camping facilities and agrees to indemnify the campground, its officers and employees against claims resulting from loss or damage to prope1ty or injury to the person of any member of the family or guest of the Seasonal arising out of the use of its campground and facilities. Seasonal(s) agree to use the Campground for camping ONLY and does certify that the site(s) cannot be sublet.

Seasonal(s) agrees to read and comply with all Campground Rules, Guidelines, Regulations and Restrictions as clearly outlined in Agreement, posted in the Campground office and/or on the premises. Seasonal(s) will pay all utilities and other services in timely manner.

Seasonal(s) agrees to carry his/her own liability and comprehensive insurance and vehicle registration during the terms of this Agreement. Seasonal(s) will provide the name of his/her agent and/or insurance company.

Seasonal(s) agrees to pay, in full or 10% down for next camping season with remainder of balance due April 01st  for site(s) of the Agreement, the amount of $ ____________ in advance with remaining balance of $___________ for site(s) #___________ (due by April 1 of current camping season) understanding a late fee of $35 per Month will be added until Agreement amount is paid in full thereafter April 1 of camping season).

Agreement is April 1 to Oct 31 of same year.

Monthly campers agree to pay $_____________ per month plus electrical.
