Guest Agreement to Abide by Park Rules

I agree, and shall cause my children, invitees and guests, to abide by: (1) the park rules published at www.rvorangegrove.com; (2) posted at the Orange Grove RV Park property (hereinafter, the “Premises”); (3) otherwise communicated in any manner by Moss Point RV Park H, LLC, Moss Point RV Park M, LLC, or any of their employees, agents, or representatives (hereinafter, the “Park”); or (4) contained within these Terms & Conditions, or (collectively, the “Terms”).

Refund and Cancellation Policy

I further understand and agree that the Park does not give credit or refunds due to the discomforts of nature. The Park’s refund policy varies, depending on the timing of the cancellation notice in advance of the reservation date, as follows:

Our cancellation policy may vary depending on the season and length of stay. We recommend reviewing our cancellation policy during the booking process or contacting our staff for specific details. Generally, we require a minimum notice of [24 hours] prior to your scheduled arrival for cancellations to avoid any penalties. Cancellation policies are designed to ensure fair and equitable treatment for all guests while allowing us to manage our reservations effectively.

Waiver and Indemnity

As a participant in a recreation activity, I am responsible for acting within the limits of my ability and heeding all warnings regarding participation in the activity. I will maintain control of myself and any equipment while participating in the activity and will refrain from acting in any manner that may cause or contribute to injury to myself or to others.

I HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE the Park, from any and all liability to me, my children, my invitees/guests, personal representatives, and heirs for any loss or damage on account of injury to person (including death) or loss or damage to property relating to, or arising out of, use and occupancy of the Premises or the Park’s property, facilities, golf carts, amenities, pools, and hot tubs and any dangers and hazards associated with acts of nature such as changing weather conditions; high winds; thunder and lightning; temperature fluctuations; falling trees; tree limbs, ice; or encounters with wildlife.

I HEREBY AGREE TO INDEMNIFY, SAVE AND HOLD HARMLESS the Park, and each of them, from any loss, liability, damage or cost (including attorney fees) they may incur due to injury (including death), damage or loss of property relating to use of the Premises by me, my children, and/or my invitees/guests or due to any incidents that may occur during my stay. I understand that, although the Park makes every reasonable effort to provide a secure environment, the security of my person, my belongings, and all persons registered in my party is my sole responsibility.

As a courtesy, the Park, if so requested, may assist with directing you to your designated campsite. It is your sole responsibility to ensure that the site will accommodate your specific trailer/RV and that you will not hit any branches, bollards, trees, etc. when positioning your RV on the campsite. You agree to indemnify and hold the Park harmless from any loss, liability, damage or cost (including attorney’s fees) that may result from an employee assisting or directing you onto a campsite. Furthermore, you release, waive, discharge and covenant not to sue the Park for any and all liability, loss, or property damage relating to an employee assisting/directing you to your site.

I acknowledge that the Premises are privately owned and the Park RESERVES THE RIGHT TO REFUSE SERVICE to anyone for any reason except for those prohibited by law. The Park reserves the right to require any person or party it deems necessary to leave the campground based on violations of the Terms or any behavior management reasonably deems inappropriate or disturbing to others. Harassment or mistreatment of our staff or other guests, including but not limited to, racist comments or hate speech, will not be tolerated under any circumstances. I have read this notice and agree to it as well as all other Terms. In addition, I understand that I am responsible for the actions of all persons registered in my party, including any children, and any guests that visit during my stay. On behalf of each person in my party, I grant Orange Grove RV Park and its affiliated entities and promotional partners the right to include any photographic, video and other visual portrayals of each person in my party in any medium and for any purpose.

Payment Agreement

I understand that I am and remain personally liable to pay the total amount of my reservation prior to my scheduled check-in date, or at such earlier date communicated to me. If I fail to pay the total due, I agree that the Park may charge any remaining balance (in addition to any damage charges or other amounts owed under these Terms and Conditions) to any credit or debit card on file with my reservation. Any amounts due after 30 days will be subject to the maximum late charge permitted under state law.

Penalties for Violation of Terms and Other Defaults

If I allow my vehicle, recreational vehicle, mobile home, and/or personal property to remain on the Premises after the period of my reservation has expired or my permission to remain on the Premises has been revoked due to a violation of the Terms or any other reason, I consent to the Park charging me the maximum daily rate allowable by Mississippi law for the period that my vehicle, recreational vehicle, mobile home, and/or personal property remains on the Premises.

I hereby agree and consent that, in the event my vehicle, recreational vehicle, mobile home, and/or personal property remains on the Premises after the period of my reservation has expired or my permission to remain on the Premises has been revoked due to a violation of the Terms or any other reason,, the Park may tow, immobilize, remove, and/or publicly auction said vehicle, recreational vehicle, mobile home, and/or personal property from the Premises to the full extent the same is allowed under Mississippi law.

I further consent that the Park may terminate water service, power service, and other services to my vehicle, recreational vehicle, mobile home, and/or personal property if it remains on the Premises after the period of my reservation has expired or my permission to remain on the Premises has been revoked due to a violation of the Terms or any other reason.

Animal Waiver

I hereby agree to the following regulations and conditions relating to my pets, including dogs, cats, or other domestic animals, while camping at the Premises with my pet(s).

Excluded Areas. I agree to keep my pet(s) out of the following areas including, but not limited to, food and beverage areas, the pool and pool deck, playgrounds and pavilions.
Excluded Breeds. I agree that the Park has the sole discretion to exclude any pet or breed of pet. The basis for exclusion may include, but is not limited to the following: breed-specific exclusions (No Rottweiler, Pit Bulls, Dobermans, German Shepherds, or Wolf mixes); due to their young age are exempted from state or local law vaccination requirements; are sick; are in heat; are aggressive, vicious, dangerous or potentially dangerous; require muzzling; or are easily frightened or sensitive, resulting in disruptive behavior (such as fighting or biting) in response to a stimulus.
Supervision. I agree to keep my pet(s) on a leash or in a carrier while in all public areas of the Premises. I further agree to have my pet(s) with me or a designated individual at all times. I agree to prevent noise or any other disturbance by my pet(s), in the interest of other guests at the Premises.
Vaccinations. I represent and warrant that my pet(s) is/are up to date on all vaccinations (including rabies and distemper) and flea treatments.
Disturbances. I agree that, should my pet(s) create any disturbances, which cause complaints to the Park upon notice from the Park, I will immediately make arrangements to house my pet(s) elsewhere outside of the Premises. Additionally, I understand and agree that if I do not find alternative housing for my pet(s) after being asked to do so, I will be asked to leave the Premises and will not be issued a refund.
Assumption of Risk and Release. I understand that my permission to have my pet(s) at the Premises with me is a privilege and not a contractual right. Such permission is expressly conditional upon my adherence to the terms of these rules and other rules in effect at any given time. I understand that the Park may revoke such permission at any time for any reason. Additionally, I hereby assume all responsibility of risks, injury, damage, other harm that may occur while my pet(s) is/are at the Premises or caused by my pet(s). Further, I hereby knowingly and voluntarily expressly release and discharge the Park, its owner, its agents, its parent companies, members, managers, directors, officers and employees (“Released Parties”) from any and all claims, damages, liabilities, injuries, demands, or causes of action, both present and future, whether known, unknown, anticipated or unanticipated, that me or my guests or invitees may have against any of the Released Parties arising out of or incident to my pet(s)’ presence on the Premises, whether arising from any act or omission, whether negligent or otherwise, of me, my pet(s) and/or any guest or invitee. I further agree to indemnify each of the Released Parties for any and all such claims, damages, liabilities, injuries, demands, or causes of action, including costs, expenses, and attorney’s fees arising as a result of or related to the presence of the pet(s) at the Park. This provision shall be enforceable to the fullest extent of the law.

General Provisions

ARBITRATION: All actions, disputes, claims and controversies under common law, statutory law or in equity of any type or nature whatsoever, whether arising before or after the date of these Terms & Conditions are executed, and whether directly or indirectly relating to: (a) my stay at the Park, these Terms & Conditions, and/or any amendments and addenda hereto, or the breach, invalidity or termination hereof; (b) any previous or subsequent agreement between the parties; and/or (c) any other relationship, transaction or dealing between the parties (collectively the “Disputes”), will be subject to and resolved by binding arbitration pursuant to the Arbitration Rules of U.S. Arbitration & Mediation, (www.usam.com) if so requested by the Park. I fully understand and acknowledge that arbitration is only mandatory at the request of the Park. In the event that the Park demands arbitration, any award or order rendered by the arbitrator may be confirmed as a judgment or order in any state or federal court of competent jurisdiction, which includes within the federal judicial district of the residence of the party against whom such award or order was entered.

Governing Law; Jurisdiction and Venue. This Agreement shall be interpreted, construed and governed according to the laws of the State of Mississippi. The parties agree that, in the event the Park does not elect to arbitrate any Disputes, jurisdiction for said disputes is proper only in the State and Federal Courts situated in Jackson County, Mississippi. The parties further agree that the State and Federal Courts situated in Jackson County, Mississippi. shall be the sole and exclusive venue of any actions related or arising from this Agreement in the event that the Park does not elect to arbitrate, and both parties waive the right to assert any defense to jurisdiction and venue contrary to this provision, including waiving the right to assert forum non conveniens.

Survival. All of the terms, provisions, conditions, representations, warranties, covenants, and agreements contained in this Agreement shall survive the consummation of the purchase and sale of the Property on the Closing Date.

Your refusal or failure to sign the Terms and Conditions constitutes an understanding that your presence on the property is unauthorized.

I hereby acknowledge that I have read these Terms & Conditions and understand it is my responsibility to abide by the Terms & Conditions. I further understand that it is my responsibility to ensure that my guests and invitees also comply with the Terms & Conditions. Failure to adhere to the policies and rules set forth herein may result in my removal from the Park without a refund.
