I/We have received and understand the Campground Rules and agree to be bound by all. I understand that there is no supervision by the campground at the water access, pavilion facility or playground.

I understand that failure to abide by these rules may result in the immediate removal from the campground of myself, my guests or anyone in my care. The campground is a seasonal camping facility only and not a year-round facility. As such, camper is advised that laws relating to manufactured home parks, including but not limited to, New York real property §§233 and 233-a do not apply to the campground. Camper, guests and anyone in camper’s care are subject to New York real property §233-b.

I grant permission to Port Bay Campground LLC., to use my image and likeness (photographs and/or video) for any print or social media outlets. I hereby waive any right to inspect or approve the finished photographs or electronic matter that may be used in conjunction with them now or in the future, whether that use is known to me or unknown, and I waive any right to royalties or other compensation arising from or related to the use of the image. I have read this release before signing below, and I fully understand the contents, meaning and impact of this release. I understand that I am free to address any specific questions regarding this release by submitting those questions in writing prior to signing, and I agree that my failure to do so will be interpreted as a free and knowledgeable acceptance of the terms of this release.

Ihereby waive, release and forever discharge Port Bay Campground LLC, its affiliates, managers, members, agents, attorneys, employees, staff, volunteers, heirs, executors, administrators, representatives, predecessors, successors and assigns from any claims resulting from physical or personal injury, pain, suffering, illness, disfigurement, temporary or permanent disability, loss or death, and any property damage that may occur caused by fire, theft, vandalism, water or land-related accidents, natural events or any other occurrences or mishaps. We are here of our free will, and entirely at our own risk. We understand that these injuries or outcomes may arise by our own or others’ negligence or conditions on the premises or the conditions or our use of amenities offered at the premises or related to travel to and from the premises. Nonetheless, we assume all related risks, both known and unknown. Port Bay Campground LLC, is not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity. I fully understand that this is a release of liability and I agree to voluntarily give up or waive any right that I otherwise have to bring legal action against Port Bay Campground LLC, for any personal injury or property damage whatsoever for negligence on the part of Port Bay Campground LLC, its agents and employees. This waiver and release of liability shall remain in effect for the duration of my presence at the premises.

We further agree to indemnify, defend and hold harmless Port Bay Campground LLC, against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney’s fees and any related costs.
