Visitors Acknowledgement of Risk
In consideration of the services of the Campground, their officers, agents, employees, affiliates, partners, and stockholders, and all other persons or entities associated with those businesses, I agree to the following:
Admission to the Campground is at my own risk. The Campground will not be responsible for any loss, damage or injury sustained by me or my invitees and visitors while at the Campground. The Campground may provide assistance; however, such act is not an admission of liability. I will not hold the Campground, their officers, agents, employees, stockholders, and all other persons or entities associated with those businesses liable for any damage, theft, or injury to person or property occurring within the premises.
Although the Campground has taken reasonable steps to provide me with an enjoyable environment so I can participate in various activities for which I may not be skilled or experienced, the Campground has informed me these activities are not without risk. Certain risks are inherent in each activity and cannot be eliminated without destroying the unique character of these activities. These inherent risks are some of the same elements that contribute to the unique character of these activities and can be the cause of loss or damage to my equipment, or accidental injury, illness, or in extreme cases, permanent trauma or death. The Campground does not want to frighten me or reduce my enthusiasm for these activities, but believes it is important for me to know in advance what to expect and to be informed of the inherent risks.
I am aware that Campground activities entail risks of injury or death to any participant. I understand the description of these inherent risks is not complete and that other unknown or unanticipated inherent risks may result in injury or death. I assume and accept full responsibility for the inherent risks not specifically identified. My participation in the activity of camping and all available Campground activities is purely voluntary, no one is forcing me to participate, and I elect to participate despite these risks and with full knowledge of the inherent risks.
I acknowledge that engaging in the activity of camping and engaging in any other various Campground activities may require a degree of skill and knowledge different than other activities and that I have responsibilities as a participant. I acknowledge that the staff of the Campground has been available to fully explain the nature and physical demands of this activity and the inherent risks, hazards, and dangers associated with this activity.
I certify that my family and I are fully capable of participating in the activity of camping and all activities the Campground has to offer. Therefore, I assume and accept full responsibility for myself, spouse, including all minor children and guests and visitors in my care, custody, and control, for bodily injury, death or loss of personal property and expenses as a result of those inherent risks and dangers, not specifically identified, and, as a result of my negligence or willful acts in participating in this activity. I shall indemnify and save harmless the Campground, and their officers, agents, employees, affiliates, partners, and stockholders, and all other persons or entities associated with those businesses, against any and all damages to property or injuries to or death of any person or persons, and shall defend, indemnify and save harmless the Campground, and their officers, agents, employees, affiliates, partners, and stockholders, and all other persons or entities associated with those businesses, from any and all claims, demands, suits, actions or proceedings of any kind of nature, of or by anyone whomsoever, in any way resulting from or arising out of my (including all minor children in my care, custody, and control) or my guest's and visitor’s participation in any of these Campground activities.
