NOTICE OF RISK INVOLVED IN OUTDOOR RECREATION AND WAIVER OF LIABILITY
There’s nothing like outdoor spaces and recreation. But the things which make the outdoors fun also make the outdoors unpredictable and sometimes risky.  Our Campground is pleased to offer camping, bicycling, pedal cart rentals, hiking, kayak/sup rentals, Jump Pad, playground equipment and swimming experiences to individuals seeking the fun and challenge of outdoor recreation.  As part of making outdoor experiences available to you, Skillet Creek Campground (referred to in this document as “Campground”) wants to assure you have been advised of the risk of injury or damage associated with outdoor recreation.
We have always found the rewards of outdoor recreation -- emotional and recreational -- far outweigh the risks. Training, patience, and prudence mitigate the risk.  But we need to be sure all our guests are aware of the risks posed by outdoor activities.
The Campground provides a camping experience.  We also offer bicycling, pedal cart rentals, hiking, kayak/sup rentals, Jump Pad, playground equipment and swimming experiences.  Our guests need to be aware that the Campground is outdoors and is a natural environment.  Water recreation may occur on bodies of water over which the Campground has no control.
  For that reason, the guest experience involves:
    Terrain which has highly varied contours, drop-offs, crevices, rocks, trees, and other materials, places, or objects.
    The presence of wild animals which are not tame and are not safe for humans to approach because they may be aggressive or carry infectious or venomous agents.
    Water which may not be safe to drink, flows rapidly or is dangerous to swim in or otherwise use.
    Weather conditions which may change suddenly, including wind, cold, heat, rain, snow, or ice.
    Use of bicycles, trails, pedal carts, kayaks, sups, Jump Pad, playground equipment and swimming areas which require skill and strength, and the ability to swim.
These conditions are what make the outdoors an invigorating and enjoyable experience.  But they also challenge recreational participants to prepare, beware and take care of themselves.  The Campground does not provide guides or rescue services.  Every guest is responsible for their own safety.
It is not possible to eliminate risk.  For that reason, the State of Wisconsin has adopted a law which provides that guests assume the risk of the activities they decide to undertake.  We want to be sure our customers are aware of those laws.  Customers who should not participate in our recreational activities if they are uncomfortable with the limitations on our liability resulting from the law.  If you decide to participate, you are taking on all the risks of the recreational activities. 
ACKNOWLEDGEMENT
By signing my name below, I agree that 
1.    I have been given this “NOTICE OF RISK INVOLVED IN OUTDOOR RECREATION AND WAIVER OF LIABILITY.” [the “Notice”].
2.    I have been asked by Campground to read the entire Notice. 
3.    I have had the chance to ask questions about the Notice.  
4.    I have asked Campground to allow me to participate in outdoor recreation.  I am aware that Campground will not make access to the recreational opportunity available unless I agree to this Notice.
5.    I am aware there are other ways in which I might engage in camping or outdoor recreation.
6.    This Notice has informed me that there are risks and dangers associated with outdoor recreation.  
7.    I have decided that the benefits to me of participating in outdoor recreation outweighs the risks.  
8.    I agree that I assume all risk of participation in outdoor recreation to the extent provided by Wisconsin law.
9.    To the extent permitted by applicable law, I waive all liability of Campground and release Campground from any claims I might make if I am injured.
10.    I waive any right to trial by jury on any issue involving Campground.
11.    I will adhere to all Campground Rules.

I HAVE READ THIS NOTICE.  I AM SIGNING FREELY AND VOLUNTARILY.  I AM AWARE THAT BY SIGNING THIS AGREEMENT, I ACKNOWLEDGE I ASSUME ALL RISK OF INJURIES WHILE PARTICIPATING IN OUTDOOR RECREATION ACTIVITIES.
