Sky Lake RV Resort, Springfield, Ohio

Terms of Use (Rules & Regulations) The undersigned and all members of his/her party, hereinafter referred to as “Licensee” acknowledges RELEASE OF LIABILITY through this License, Release and Indemnity Agreement (“the Agreement”), and wishes to utilize and enjoy certain real property located in Springfield, Ohio owned by Sky Lake RV Resort, LLC (“Owner”). For good and valuable consideration, the receipt and sufficient of which is hereby acknowledged Owner grants a non-exclusive, temporary, and revocable license to Licensee to enter upon real property located in Springfield, Ohio operated by Owner as an RV Park subject to the terms and conditions set forth.

1. Sky Lake RV Resort is a travel park offering camping on a temporary basis, NOT a residential community. The licensee agrees to maintain a separate permanent residence for the duration of Licensee’s stay. This license does not create a tenancy or residency or any other real property right in favor of the Licensee. The licensee and/or guests’ reservation is a temporary reservation at will for so long as the reservation is paid in advance as required and is subject to compliance with the rules and regulations of the park. Upon violation of any rules in the Rules and Regulations by the Licensee including without limitation, failure to pay balance on reservation for a period of 3 days after such is due, Owner may, at its option, immediately terminate the reservation, disconnect all utilities, and remove the Licensee and Licensee’s property. Licensee agrees that he/she shall be responsible for payment of all delinquent balances, late charges, towing and storage charges. Licensee shall have no liability to Owner for any damage to any of Licensee’s property resulting from such removal and/or storage. If such reservation is terminated by Owner, all advance rents and security deposits of Licensee will be forfeited to Owner. Licensee’s guests must register at the office upon arrival at the park. If any Licensee has more than 4 persons per RV unit, there will be an additional charge of $5 per day per person for each excess person charged to the Licensee’s reservation.

2. Site fees are due in advance when reservation is made. If staying over 30 days the first month and deposit equal to first month is due at time of reservation then each month after due on the first of the month. After the third of the month a $25 late fee will be charged to the card on file. If balance is not paid by the 7th Owner reserves the right to tow/remove Licensee’s RV and other property. Rates quoted upon reservation are subject to change without notice. There will be a 3% convience fee each month for monthly credit/debit card payments.

3. Sub-letting of any RV lot or renting of any RV unit by Licensee and/or guests’ is prohibited. Placing of “For Sale” signs in or around any RV unit is prohibited. If Licensee abandons a site, the reservation may be terminated at Owner’s option and Owner may exercise all rights upon termination of reservation.

4. No refunds will be made on advance payments if Owner terminates a reservation for reasons described above.

5. Owner is not responsible for any loss due to fire, windstorm, flood, accident or theft. The Park does not maintain insurance on the property, trailers, contents, etc. of the Licensee or their guests. Licensee’s and guests assume ALL risk of loss or damage to person or property and must carry their own insurance for use in any claims.

6. Licensees are REQUIRED to check in ONLINE prior to arriving at the park

7. Check out time is at 11:00 am, check in time is 1pm. Any reservation that stays past 1pm without management approval is subject to an added fee equal to a one-night stay. Any personal items, trash, pet excrement or cigarette butts left on the site upon check-out will incur an additional charge of $25.00 to the Licensee's card on file. If the Licensee checks-out with any balance due on their account the Owner reserves the right to charge the card on file. You will be emailed a receipt.

8. Owner reserves the right to reject any RV unit which is not compatible with units in the park. Units must be RVIA certified and no older than 10 years. 

9. Any structure, deck, patio, pavilion, etc., requires written approval from management. Management reserves the right to remove any structure that has not been approved. No hot tubs, pool, water slides, etc are allowed. 

10. No converted buses are permitted in the park. No RV’s over 15 years old are permitted. RV must meet health code and appearance standards. Licensee’s RV must remain in good condition through length of stay or Licensee may be asked to leave the site.

11. Any items on the site, in management’s opinion, that cause a negative impression of the site or park are subject to removal. If Licensee does not comply with removal of such items Licensee will be asked to vacate the park.

12. Licensee acknowledges if their RV is being stored at Sky Lake RV Resort or if the Licensee is not physically present these rules and regulations still apply.

13. Visitors of Licensees are required to check in before entering the park. All visitors are required to purchase a day pass at the cost of $5.00/person and are required to make the pass visible. No guest, invitee, or visitor of a Guest may camp or sleep outside in their cars or tents.

14. Children 16 years and younger must always be supervised by an adult. Children under 16 shall not be permitted in any common or recreation area of the park unless accompanied by the owner of the RV unit they are visiting, their parents or a responsible adult. Parents are responsible for their children’s safety and conduct as well as any injuries and/or damages that they may incur or cause. Unsupervised children who cause disruption for other guests will be asked to leave the park with their entire group.

15. All Licensees and their guests must observe the speed limit of 5 miles per hour within the park.

16. Amenities may only be used by the Licensee and their invited guests who have paid the guest fee. Children visiting the Licensee may use the amenities only under the supervision of an adult. All recreational facilities are used at Licensee's own risk. Owner will not be responsible for personal injury or property damage to the Licensee, his/her family (including pets) or guests.

17. There is no swimming in the lakes, Owner shall have no liability for any activities taking place on or around the lakes. Furthermore, participation in any recreational activities in or around the lakes are done so at the full risk of the individual taking part in the activity and agrees to hold harmless the Owner and any of its subsidiaries or its officers.

18. Kayaking, Paddleboarding and small fishing boats require the purchase of a day pass. Any boating/kayaking/paddleboarding without limitation requires the use of life jackets. Life jackets WILL NOT be provided by Sky Lake and are the responsibility of the user to furnish.

19. NO LIABILITY. To the extent permitted by law, Licensee, Licensee’s family, and any guest of Licensee hereby indemnifies, releases, and agrees to protect and hold harmless Owners, Officers, Members, Managers, Employees, Operators and agents from and against all claims, causes of action, and/or liability arising out of or related to Licensee’s use of the site, property and/or and condition thereon, without limit and without regard to the causes or causes thereof or the gross negligence of RV park parties.

20. All pets must be pre-approved by the Owner. No aggressive breeds (as determined by Owner) shall be allowed in the park, including without limitation, Pitbull’s, Rottweilers, Akitas, Chows, Dobermans, etc. Those with pets must keep them on a leash when outside. Pets cannot be left outside unattended. No pet fences/kennels are allowed. Pet excrement must be removed promptly and properly disposed of by the pet owner. Failure to pick up pet excrement will result in a $25 fine. No more than 2 pets allowed.

21. A sewer hose seal (rubber donut or threaded connector) for your sewer hose is required on all sewer hookups. Do not jam your sewer hose all the way down into the inlet as it can prevent flow from other sites and possibly stop up the line. Sewage and greywater must not run on the ground. No permanent sewer or water connections made of hard pipe are allowed. Black tank valves must remain closed except when dumping. Licensee is responsible for any clogging in the sewer line from their RV to the main sewer line. If the cause of the stoppage is found to be the Licensee’s fault, the cost of the plumbing bill to clear the line will be billed or added to the Licensee’s card on file. The cost of repair or damage to utilities or damage to facilities or buildings caused by the Licensee, their dependents or guests will be charged to the Licensee.

22. The park will not be held responsible or liable for any damage done to a Licensee’s RV due to power surges. At no time is a Licensee, their visitors, or third parties allowed to work on utility pedestals.

23. We recommend the use of a water pressure regulator. During the winter months, Licensees are responsible for keeping their water hoses thawed from the water spigot to their RV. Must use a heated water hose (no exceptions).

24. Any winter stay will require the use of a factory on board propane heater with dedicated 50-gallon propane tanks or larger. No electric heaters allowed.

25. Household appliances may not be used/stored outside of the RV.

26. All Licensees’ must keep their lot clean and free from rubbish/trash/items at all times. Inoperative and/or unregistered automobiles/RVs must be removed from the park within 3 days of notice. No storage of any kind is permitted around or under a RV unit.

27. All garbage must be wrapped and placed in the trash receptacles provided by the park. No garbage is allowed to be stored outside for any period of time. Household cooking grease must be disposed of as garbage and not poured down drains. Disposal of hazardous waste, oil, fuel, etc. within the park or in disposal containers provided by the park is strictly prohibited. All persons needing to dispose of the same must contact the necessary governmental authorities and make all necessary arrangements to dispose of the same. Littering will not be tolerated, violators will be fined and banned from the premises.

28. No alcoholic beverages are permitted in common area buildings, on the lakes or any/all recreational areas without Owner’s approval.

29. No campfires can be left unattended and all fires must be fully extinguished.

30. Outside decorative lights are to be used only at Christmas or with Management’s permission.

31. Quiet time is from 10:00 pm to 8:00 am. Licensee and Licensees’ guests agree and acknowledge that the peaceful enjoyment of the park is paramount and that Owner reserves the right to terminate Licensee’s reservation and remove any persons who threaten or disturb the peaceful enjoyment of other Licensee’s.

32. Clotheslines are not permitted.

33. No repairing of cars, boats, motors, trailers or any similar disturbing activity on any site.

34. No peddling, soliciting or commercial enterprise will be allowed in the park.

35. Motor bike riding is permitted ONLY for ingress to and egress from the park.

36. Storage Shed: 1 allowed 7x7 Rubbermaid (Ask Management for picture of approved shed)

37. BBQ Grill/Outdoor Cooking Appliances: 1 grill/appliance allowed and may vary in size, if larger than average household grill, please see Manager for approval; some grills may not qualify if too large to be left on site. No indoor household appliances allowed outside.

38. Decorative Yard Art/Pot Plants/Personal Items: Maximum of 5 total mix or match and should be in good taste and well cared for.  Cannot be excessively big or unsightly or where it makes the site appear cluttered.Decorations will need to be in season. If unsure get management approval.

39. Canopy: 1 maximum no larger than 12ft x 12ft. Must remain aesthetically pleasing. No rips/tears/broken canopies.  

40. Patio Dining Sets/Picnic Tables/Swing/Chairs: You may have only1set of patio furniture, picnic table or swing. Folding camping chairs must be in their upright position on the site. Random furniture will not be allowed. 

41. Flags: Maximum of 2 and cannot be larger than 3ft x 5 ft freestanding (nothing can be tied to/hung from trees).

42. Portable Ice Chest and/or Coolers: Maximum of 1 total and should be stored inside storage unit/RV if your site is unattended for more than 3 days.

43. Winter Insulation: You may use silver (not pink) backed insulating boards with the silver side facing out. Skirting must be aesthetically pleasing. No hay or tarps allowed. Must be taken down by April 1st and stored in shed or RV.

44. Decks/Stairs/Ramp/Patios: No decks or patios are allowed unless already on site. If stairs/ramp is needed please send a site plan to management for approval.

45. Children’s Toys/Bikes: Must be stored in RV or shed unless being used. Please do not leave scattered under or around the RV.

46. Firewood: Please keep wood stacked neatly. You may cover with a dark brown tarp if needed.  

47. The Licensee hereby agrees to respect the privacy of his/her neighbor. Licensee and their guests shall fully comply with all statutes, ordinances, health, safety, motor vehicle and fire codes; and the Park Rules and Regulations and revisions and amendments thereto. Failure to so comply shall result in the termination of Licensee’s reservation and removal of the Licensee’s and Licensee’s property from the park.

48. Any deviation of above rules must have prior written approval from management.

49.Management reserves the right to serve a notice to vacate if any deviation of the above listed rules are not followed. 

50. Management reserves the right to amend these rules and regulations at any time. The Park rules and regulations and any revision thereto shall be effective immediately upon proper posting and all Licensee’s shall immediately comply with the same. If a new Park Rule or Regulation or revision thereto is posted which requires the Licensee to remove an improvement, vehicle, trailer, boat, or mobile home or requires the Licensee to make other appropriate preparations and arrangements in order to come into compliance with new revisions thereto, then in such case the Licensee shall have ten (10) days from the date of posting of the rule or regulation in which to come into compliance. The failure of the Licensee to receive a copy of the rules or see a posting of the rules shall not be a defense to full compliance with the park rules and regulations or any amendment thereto which is posted within the park.

Cancellation Policy: Reservations canceled 30 days or more from check in date will incur a $25 cancellation fee. Reservations canceled 1 to 3 weeks from check in date will be charged one night’s stay. There is no refund for reservations canceled within 7 days of arrival. For monthly stays (any stay 30 days and over) requires a 30 day notice to cancel reservation. Deposit and Booking fees are non-refundable. THIS PROPERTY IS PRIVATELY OWNED. ALL GUESTS accept camping/use privileges with the understanding that they hereby release the campground, its owners, officers, agents, employees, and assigns, from all liability related to loss or damage to property and/or injury. ALL GUESTS must assume the risks and dangers incidental to the activity of camping or use of the property in an outdoor environment including specifically (but not exclusively), the danger of being injured by insects, animals, being injured while participating in recreational activities or being injured as a result of inclement weather conditions, and agree that Sky Lake RV Resort, LLC and its owners, officers, agents, employees and assigns are not liable for any injuries or property damage resulting from such causes of action or acts of God.

By signing below, Licensee’s electronic signature is the legal equivalent of, and enforceable as and to the full extent of, a hand-written signature whether presented in court (state or federal), arbitration, or otherwise. Licensee also acknowledges and agrees to be legally bound by any and all materials Licensee signs electronically as if signed by Licensee in person. Licensee will not raise any defense or invoke regulatory or statutory claims attempting to invalidate the enforceability of documents based on their deliver to or other third-party verification is necessary to validate Licensee’s electronic signature and the lack of such certification or third-party verification will not in any way affect the enforceability of Licensee’s electronic signature.
