Rules, Regulations & Liability Waiver

Welcome to Smoky Mountains Hidden Stills RV Campground! We are excited to have you as our guest and want to ensure that your stay is enjoyable and safe. To provide a pleasant experience for all visitors, we ask that you adhere to the following rules and regulations. By entering and using our facilities, you acknowledge and agree to comply with these guidelines, as well as the liability waiver outlined below.

Guests & campground visitors agree to comply with all the rules. Violation of the rules shall be deemed a breach of this Agreement.

A Guest is defined as the trailer owner or owners that are 21 years of age or older.
This contract agreement is by and between Smoky Mountain Hidden Stills RV Campground LLC (hereby known as SMHS) and Signers of this Agreement.

Upon termination of this Agreement, if a guest fails to Check Out from said campsite/Lot on scheduled time and date as agreed upon, (SMHS), shall have the right to remove all the guest’s personal property, including without limitation the unit, from said campsite. By signing this agreement, guests’ grant (SMHS), a lien upon said personal property for the actual and reasonable costs of removal and storage. The storage fee shall be $50.00 dollars (plus tax) per day or portion thereof. Guests shall pay all costs, expenses and reasonable attorney & fees that may be incurred or paid. A Unit is defined as a Recreation Vehicle Industry Association (RVIA) approved recreational vehicle including Class A, B, CRV Motorhomes, Travel Trailers, Fifth Wheels, or Pop-up Campers.

 All trailers must be inspected and be in excellent condition prior to placing them on a campsite within our park. All types of trailers and park model trailers must be 15 years or newer unless prior approval is given by (SMHS).

Campground Rules & Regulations

 

Check-In & Check-Out

  • Check-in time is 2:00 PM. Check-out time is 1:00 PM. Late check-out must be approved in advance.
  • Cancellation of your reservation on the day of or within 7 days in advance of your stay will result in a partial or no refund. Management reserves the right to determine a refund.
  • Cancellation of your reservation 8 to 14 days in advance of your stay will result in  a refund of half of your total stay. Cancellations 15 or more days will receive a 100% refund, minus $15.00 set-up fee. All refunds are at the discretion of management.
  • There will be no refunds after you have checked in, for inclement weather, failure to follow the Rules & Regulations, or disorderly conduct.  Manager/Owner reserves the right to have discretion on all refunds. 

     

 

Quiet Hours

  • Quiet hours are 11:00 PM – 8:00 AM. Please respect your fellow campers by keeping noise levels to a minimum. Adults must supervise their minor children. Minors (under the age of 21) are prohibited from occupying said campsite without their parent or legal guardian present.

 

Campsite & RV Regulations

  • All RVs must be in good condition and comply with local codes and regulations.
  • One RV and one vehicle are allowed per site unless otherwise approved by management.
  • No permanent structures, decks, or modifications to the campsite are allowed.
  • Guests have an opportunity to inspect said campsite upon arrival.
  • Placement of Guest’s trailer on site is determined by the gravel pad and utility access.
  • The campsite is designed for one unit only.
  • Guests state that the unit to be parked on said campsite shall be used exclusively for camping or recreational purposes only, and will not be used as Camper’s principal residence, (unless long-term placement has been granted)
  • All the trailers must be skirted if guest stores anything under said trailer.
  • It is highly recommended that the Guests have an RV water regulator on their trailer.
  • Guests shall maintain liability, fire, wind, and other hazard insurances upon their personal property situated upon said campsite and for their acts or omissions occurring while occupying said campsite. (SMHS) shall not be liable for the loss or damage to any property of Guests & campground visitors by interruption of electrical service, by theft or otherwise, by trees, bushes or other growing vegetation.
  • Guests shall quietly and peacefully return said campsite in a good condition upon leaving.
  • Guests shall keep said campsite, and all personal property located thereon in a state of cleanliness and healthy sanitation and shall comply with all ordinances and regulations of the State of Tennessee, United States, and any authorized agency of said governmental bodies.
  • Guests are responsible for keeping said site maintained in a clean, neat, and safe condition always. If a campsite is not maintained, SMHS) has the right to charge the guest a $20.00 dollars maintenance fee for each occurrence.
  • The primary registered guest (1) is responsible for the registration of all visitors entering the campground.
  • If said visitor is not included in the application, Guest (1) will be responsible for paying a fee of $15.00 for each visitor. Said fee shall be due and payable upon demand.
  • None of the Guest’s visitors may stay or visit the campground unless one adult (21 or older) family member on the original registration form is present.
  • Authorization must be given, prior to Guest operating a golf cart on campground, Guest must provide (SMHS) with proof of liability insurance. No golf cart shall be operated after dusk unless the same is equipped with adequate lights. Only licensed drivers shall be permitted to operate said golf cart on campground. Golf carts must be properly maintained.
  • We understand that travel can be unpredictable but due to the safety of our campers and staff, check-ins after sunset are not permittable, and may incur a $25 fee depending on how late after dark you arrive. We have the right to refuse entry after dark due to liability. If you will not be able to arrive before dark, you may not be able to Check In. Please call the office prior to arrival.

Speed Limit & Parking

  • The speed limit throughout the campground is 5 MPH and is strictly enforced.
  • Parking is only allowed in designated areas. Do not park on the grass or block roadways at any time. Overflow parking is provided as necessary.
  • No vehicles are allowed on the easements or in non-designated parking spots.
  • All visitors’ vehicles must be parked in designated parking areas.
  • Due to emergency vehicle access, there is no parking on any of the campground roads at any time.
  • All vehicles must be parked in designated campsite areas. Overflow parking is provided as needed.

Fires & Firewood

  • Campfires are permitted only in designated fire rings.
  • For the safety of everyone at (SMHS) please put out your fire before you go to bed, and
    NEVER LEAVE YOUR FIRE UNATTENDED at any time.
  • Firewood may not be brought in from outside the area due to pest control regulations.
  • The state of Tennessee prohibits the entry of out-of-state firewood unless it has been certified, heat-treated and is properly labeled. (SMHS) offers certified treated firewood for sale upon request.
  • Please refer to local fire hazard warnings prior to starting fires in designated areas.

Pets

  • Pets are permitted and dogs must be on a leash when not on Guest’s site. Never leave pets unattended.
  • Owners are responsible for cleaning up after their pets. Pet stations are located throughout the campground for your use.
  • Aggressive or excessively noisy pets may be asked to leave.
  • All pets must be current with a vaccination card.

Trash & Cleanliness

  • All garbage must be disposed of in the designated campground dumpster daily, or when leaving the campground at Check Out.
  • Any garbage can on Guest’s site must have a bear proof lid.
  • Campsites must be kept clean and free of debris.
  • Management has a right to charge a cleaning fee if garbage is found left on the Campsite upon your departure.
  • Littering is not prohibited.

Alcohol & Smoking

  • Alcohol is permitted but must be consumed responsibly.
  • Smoking is only allowed in designated areas.

 

Behavior & Conduct

  • Disorderly conduct, excessive noise, or disruptive behavior will not be tolerated.
  • Illegal activities are strictly prohibited.
  • Guests and Visitors shall never use said campsite for any illegal activity.
  • Guns or weapons of any sort are strictly prohibited in any public area of the campground.
  • There will be no trespassing on any of the surrounding neighboring properties.
  • Minor children shall be restricted to campsite at 11:00 p.m. and prohibited off campsite after that time without the accompaniment of an adult 21 years or older.

Wildlife & Nature Conservation

  • Do not feed or approach wildlife.
  • Respect nature by not damaging trees, plants, or other natural features.
  • ABSOLUTELY NO CLIMBING ON THE TREES, NO CLIMBING ON
    THE ROCKS, OR SWIMMING IN THE CREEK FOR SAFETY PORPOSES

 

Campground Waiver of Liability Release Form

The undersigned hereby waive, release and forever discharge Smoky Mountain Hidden Stills RV Campground, its affiliates, managers, members, agents, attorneys, employees, staff, volunteers, heirs, executors, administrators, representatives, predecessors, successors and assigns from any claims resulting from physical or personal injury, pain, suffering, illness, disfigurement, temporary or permanent disability, loss or death, and any property damage that may occur caused by fire, theft, vandalism, water or land-related accidents, natural events or any other occurrences or mishaps.

We are here of our free will, and entirely at our own risk. We understand that these injuries or outcomes may arise by our own or others’ negligence or conditions on the premises or the conditions or our use of amenities offered at the premises or related to travel to and from the premises. Nonetheless, we assume all related risks, both known and unknown. Smoky Mountain Hidden Stills RV Campground is not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity. I fully understand that this is a release of liability, and I agree to voluntarily give up or waive any right that I otherwise have to bring legal action against Smoky Mountain Hidden Stills RV Campground, for any personal injury or property damage whatsoever for negligence on the part of Smoky Mountain Hidden Stills RV Campground, its agents and employees. This waiver and release of liability shall remain in effect for the duration of my presence at the premises.

I acknowledge that camping has many hazards and that there are risks that cannot be eliminated, particularly in a wilderness environment. I hereby acknowledge that Smoky Mountain Hidden Stills RV Campground is not responsible for any theft, loss or damage incurred during my stay. My signature below confirms that I have read and agree to abide by all rules and policies at Smoky Mountain Hidden Stills RV Campground. I also understand that I can be asked to leave the property, without a refund, for failure to follow the said rules and policies. A copy of which is posted on site at Smoky Mountain Hidden Stills RV Campground.

We further agree to indemnify, defend and hold harmless Smoky Mountain Hidden Stills RV Campground, against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney’s fees and any related costs.

By accepting this reservation, Guest hereby waives, releases and discharges and covenants not to sue Smoky Mountain Hidden Stills RV Campground, (SMHS), for all claims and liability for personal injury, accidents, property damage, or any other claim arising out of or in connection with Guests’ use of the Rental/Property. Further, Guest agrees to defend, indemnify, and hold harmless (SMHS) from all losses, claims, expenses and demands, including attorneys’ fees, that (SMHS) may incur arising out of or in connection with Guests’ use of the Rental/Property. Guest further agrees to be responsible and liable for the actions and safety of every person in their group. (SMHS) reserves the right to remove any renter, occupant or guest who is subject to a lifetime registration requirement under a State sexual offender registration program.

I also hereby consent to photographs and videos taken of me and all parties listed below during our stay at Smoky Mountain Hidden Stills RV Campground for purposes of event documentation and promotion of Smoky Mountain Hidden Stills RV Campground. Names will not be published. My signature confirms that I have a valid rabies certificate for any pets in my party as required by law. A copy will be provided if necessary.

By staying at Smoky Mountain Hidden Stills RV Campground, you agree to abide by these rules and regulations. Failure to comply may result in the removal from the campground without a refund. Thank you for choosing Smoky Mountain Hidden Stills RV Campground. We hope you enjoy your stay!
