Terms & Conditions

These Terms and Conditions, including the Cancellation Policy, the Refund Policy and the Rules and Regulations set forth below (collectively, “Terms and Conditions”), are part of the agreement between the Guests and Sundowner Princeton, LLC (“Sundowner”), pertaining to  use and occupancy of the Sundowner RV Park (the “Park”).  By making this reservation and/or occupying or using the Site or any part of the Sundowner RV Park, Guests agree to these Terms and Conditions.  

Waiver, Release and Indemnity:  ALL GUESTS HEREBY WAIVE, RELEASE AND DISCHARGE SUNDOWNER, AND AGREE TO DEFEND, INDEMNIFY AND HOLD SUNDOWNER HARMLESS FROM (AND COVENANT NOT TO SUE SUNDOWNER WITH RESPECT TO), ANY AND ALL CLAIMS, CAUSES OF ACTION, DAMAGES AND LIABILITY WHATSOEVER, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, ACCIDENTS, PROPERTY DAMAGE AND ANY OTHER TYPES OF CLAIMS ARISING OUT OF, RELATING TO, OR IN CONNECTION WITH GUESTS’ USE OR OCCUPANCY OF THE SITE, THE SUNDOWNER RV PARK (the “PARK”) OR ANY SERVICES OR AMENITIES FURNISHED OR MADE AVAILABLE AT THE PARK (“CLAIMS”), INCLUDING BUT NOT LIMITED TO ANY CLAIMS CAUSED BY OR RESULTING FROM OR ARISING FROM, IN WHOLE OR IN PART, SUNDOWNER’S NEGLIGENCE OR THE NEGLIGENCE OF ITS EMPLOYEES, CONTRACTORS, SUBCONTRACTORS AND SERVICE PROVIDERS.  All persons who are eighteen (18) or more years of age and are part of a Guest’s group must register as a Guest and, for purposes of these Terms and Conditions, will be considered to be a Guest.

Rules and Regulations:  The Sundowner RV Park Rules and Regulations are set forth below and are part of these Terms and Conditions.  All Guests and members of the Guests’ group, including children, must comply with the Rules and Regulations at all times.  

Violation of Terms and Conditions:  In the event that any Guest or member of a Guest’s group violates any of these Terms and Conditions, the Guests and their group will, at Sundowner’s request, immediately vacate the Site and the Park, and there will be no refund of any fees or other monies paid by Guests.

Vacating the Site and the Park:  Guests will vacate the Site and the Park immediately upon the earlier of (a) the end of their reserved stay, (b) the end of the period for which the Guest has paid all applicable fees and charges, (c) failure to pay any required fees, or (d) upon Sundowner’s request or instruction as a result of violation of any of the Terms and Conditions or law enforcement personnel’s request or instruction.  Sundowner may enforce this provision and the other Terms and Conditions through injunction if necessary.     

Site number and location changes:  Your Site number and location is subject to change at any time, unless a site lock fee was paid at the time of booking.

Utilities:  Water, metered electricity, septic system connections, cable TV and high-speed internet are available.  Guests staying seven (7) or more days will be charged $0.10 (ten cents) per kilowatt-hour of electricity.  Guests requesting cable TV will be charged a $150 deposit for the cable TV receiver (refundable upon return of the receiver in the same condition as when furnished with the receiver) plus a fee of $50 for each 30 day period (or part thereof) during which the Guest is furnished with the receiver. Guests are responsible for protecting their RV, camper and other equipment (“Guests’ Equipment”) from freeze damage; Sundowner shall have no responsibility or liability for frozen, burst or broken pipes or plumbing in Guests’ Equipment.  Guests are responsible for making proper sewer connections using positive sewer seals at both ends of sewer hose, in compliance with applicable law and ordinances. 

Site Rates:  Unless otherwise agreed via a new, paid reservation and registration, if Guests remain at the Site or in the Park beyond the last date of their most recent reservation, they will pay Sundowner fees at the same rate as was being charged during the period of their reservation, but this provision does not grant the right of any Guest to remain at the Site or in the Park beyond the last date of their reservation, or beyond the dates for which they have paid, or beyond Sundowner’s request or instruction that the Guests vacate the Site and the Park.  Guests wishing to extend their stay beyond the last day of their reservation are encouraged to extend their reservation or make a new reservation in advance, as space may not be available beyond the date of their existing reservation.

Late Payment Fees and Past Due Accounts:  In addition to any other fees or charges, a late fee of ten dollars ($10) per day will be charged for any past due payment for use or occupancy of the Site.  

Mailbox Key Fees:  In the event that a Guest loses their mailbox key, and does not turn it in on their move-out date, there will be a fee of $80 for the replacement of the lock.

Pet Policy:  Pets must be walked on a leash, cleaned up after and may not disturb other guests.  Pets and the pets’ conduct are the responsibility of the Guest.  Management reserves the right to restrict or prohibit noisy, disruptive or aggressive dogs or breeds, but the following breeds are not allowed in the Park:  Pit bull breeds (including American Bully, Pit Bull Terrier, American Staffordshire Terrier and Staffordshire Bull Terrier), Rottweiler, German Shepherd, Husky (including Siberian Husky), Malamute, Doberman Pinscher, Chow Chow and any Wolf-dog hybrid.  Upon check-in, Guests must complete and sign a Pet Registration Form which identifies your dog’s breed and furnish veterinarian records reflecting current vaccinations for each pet.  Dogs may not be left leashed, chained or tethered outside the Guest’s RV or camper overnight or while unattended by their owner.  Pets are never allowed to run free in the Park.  No snakes or exotic animals may be kept in, or brought into, the Park.  If the Park offers a dog park as one of its amenities, any use by Guests will be at the Guests’ and their dog’s sole risk and responsibility. 

No Sublease or Assignment:  Guests may not sublease or assign any rights to use the Site or the Park.                                                                                                                    Check-In/Check-Out Times:  Check-in time is 2:00 p.m. and Check-out time is 11:00 a.m.  

Background Check:  Sundowner may, at its discretion, conduct a background check on any all Guests.  All Guests (a) consent to such background check, (b) agree to furnish Sundowner with all information (including but not limited to full name, driver’s license number, email address, home address and social security number) requested by Sundowner for the purpose of conducting such background check, and (c) agree to pay Sundowner a fee of twenty-five dollars ($16.95) for such background check if Sundowner requests payment of such fee.  Sundowner reserves the right, in its sole and absolute discretion, to refuse the use of any Site or any part of the Park by, and/or to remove from the Site and the Park, anyone who (1) is subject to a registration requirement under a State or Federal sex offender registration program or law or (2) has been convicted of any actual or attempted felony or misdemeanor, in either case involving a crime of violence or theft or drug offense, and if Sundowner exercises such right, no amounts paid by any Guest or any member of a Guest’s group will be refunded.  If any such person is asked or instructed by Sundowner or law enforcement personnel to vacate the Site and the Park, such person shall do so immediately.  Prospective Guests are encouraged to make their reservations and furnish the information mentioned in item (b) above well in advance of their Check-in date, as delay in completion of the background check may delay your Check-in and admission to the Park.     

Cancellation Policy

For Reservations for Periods of One Month or Less:  Payment for the full duration of the reservation, plus a $150 deposit is required at the time of the reservation.  If a reservation for a period of one month or less is cancelled more than 2 weeks before the scheduled arrival date, Sundowner will refund these amounts or (at Guest’s request, if space is available) change the dates on the reservation. If the reservation is cancelled within 2 weeks prior to the scheduled arrival date, there will be no refund of any amounts paid.    

For Reservations for Periods Longer than One Month:  Payment for the first month of the reservation, plus a $150 deposit is required at the time of the reservation.  There will be no refunds upon cancellation of stays booked for more than one month, unless the reservation is cancelled at least 2 weeks before the scheduled arrival date.  Payment for the second month and each subsequent month of the reservation is due and payable in full on or before the first day of the second month and each such subsequent month.  Guests with reservations for periods longer than one month are required to confirm to Sundowner (either by email sent to sundownerrvpark@gmail.com or in writing delivered to the office located at the Park) their departure date at least seven (7) days prior to the last day of their reservation, and if Guest fails to do so, the deposit will not be refunded. 

“Month” means a calendar month beginning on the day of the month that is the first day of the period of the reservation.   

The $150 deposits referred to in this Cancellation Policy are also subject to the Refund Policy below.

Refund Policy

There will be no refunds (a) for weather condition, voluntary departure, acts of nature, acts of God, or (b) if any Guest is required to vacate the Park for violation of the Terms and Conditions, or (c) if any Guest fails to pay fees or charges in full, when due.  Any amount refunded will be refunded in the same form that it was originally paid.  All refunds processed via credit/debit card will only be processed through the original credit/debit card used.  

Rules and Regulations

Neat and Clean:  Guests must keep the Site neat, clean, trash-free, and sanitary at all times.  Any items left outside the RV or camper must be kept neat and the Site kept uncluttered.  Guests must leave the Site clean, and in as good condition as when they arrived. If staff has to pick up trash left on a site after the guest has left, the guest will be charged a $50.00 cleaning fee.   No outdoor clotheslines are allowed.    

Only Park on Your Site: You and your guests may park only on the Site you paid for. Parking on any other Sites or locations within the park (whether or not vacant) is prohibited.

No Digging Holes/Driving Stakes: Digging and placing stakes anywhere in the park is prohibited. We have fiber optic internet cables and other cables and lines buried in the ground and they could easily be broken by shovels or stakes.

Generators: Generators are allowed to be run during the times of 10:00 AM through 6:00 PM. Generators may not run during any other time unless power at the park is compromised.

Self-sufficient RVs and campers:  All RVs and campers must be self-contained; makeshift or temporary showers, tents, or other similar temporary facilities are not permitted                       Noise and Compliance with Laws:  Quiet time is 10:00 p.m.  Noise must be kept to a minimum during quiet time.  Please treat your neighbors as you would want to be treated.  

All Guests must obey all applicable laws and ordinances.  No illegal drugs are allowed in the Park.  Any person who displays or uses disorderly conduct, drunkenness, obscene language, or violent, offensive, disruptive or obnoxious conduct may be asked to vacate the Site and the Park, and if any such person is asked or instructed by Sundowner or law enforcement personnel to vacate the Site and the Park, such person shall do so immediately.                                      

Deposit:  Any deposit paid by Guests may be used or applied by Sundowner to unpaid fees and charges, cleanup costs, damages, and/or costs or expenses paid or incurred by Sundowner as a result of Guests’ violation of these Terms and Conditions.  No interest will accrue or be paid on any deposits.                                                                                                                               Trash:  The Site must be kept free of trash.  All trash must be placed in the on-site dumpster.  All boxes placed in the dumpster must be broken down.  Only Guests’ ordinary household trash may be placed in the dumpster.  No furniture, large metal objects, plants, or similar items may be placed in the dumpster.  No trash from off-Site locations may be placed in the dumpster.           No guns, knives or other weapons may be publicly displayed in the Park.  Fireworks are not permitted in the Park.                                                                                                                Group Size and Parking:  No more than six (6) people, including children, may occupy any one Site.  Up to two vehicles (in addition to your RV or camper) may be parked at any one Site, but only if your Site has adequate space.  No vehicles may be parked outside the boundary of your Site, or so as to block any part of any of the driveways in the Park.
