TEXAS LIVIN’ RV PARK, LLC terms and Policies


 

  1. Consumption of Alcohol

Underage drinking, or drug use will be reported to the police, and offenders will be banned from the resort. It is illegal in the State of Texas to drive a motorized vehicle under the influence of drugs or alcohol. Excessive use will not be tolerated. IT IS ILLEGAL IN THE STATE OF TEXAS TO DRIVE A MOTORIZED VEHICLE AROUND TEXAS LIVIN’ RV PARK PROPERY WITH AN OPEN CONTAINER OF ALCOHOL.   1. Discharge of firearms/fireworks

The discharge of any kind of firearm/ firework is strictly prohibited at Texas Livin’ RV Park

  1. Criminal Trespass Notice

PURSUANT TO SECTION 30.07, PENAL CODE (TRESPASS BY LICENSE HOLDER WITH AN OPENLY CARRIED HANDGUN) A PERSON LICENSED UNDER SUBCHATER H, CHAPTER 411, GOVERNMENT CODE (HANDGUN LICENSING LAW) MAY NOT ENTER THIS PROPERTY WITH A HANDGUN THAT IS CARRIED OPENLY). _____ RV Guest Initial

  1. Termination

RV Guest understands, this RV Site  Agreement will remain in effect and RV Guest will be liable to pay rate as set in the agreement whether or not the RV Guest occupies the site or maintains a recreational vehicle at the RV site for their term of this RV Site Agreement unless the RV Guest sells the recreational vehicle to a purchaser who is approved by TLRP management and who executes a new RV Site Rental Agreement. Additionally, TLRP management may terminate this RV Site Agreement at any time. TLRP retains the exclusive right to determine the suitability of any RV Guest. TLRP management may remove or cause to be removed (to include notifying local law enforcement) from the resort, any guest or other individual who, while on the property of TLRP, disturbs the peace and comfort of other TLRP guest, who causes physical harm to TLRP facilities, or who fails to pay  the  rate agreed upon by the time agreed upon. TLRP management may also disconnect utilities, or take other actions as provided by law. ______ RV Guest Initial

  1. Liability

TLRP is a privately-owned resort. The use of TLRP facilities is at the user’s own risk. Guest are responsible for their visitors. TLRP assumes no responsibility or liability for the safety and security of RV guest/campers/vehicles/visitors. TLRP is not responsible for loss or damage to RV Guest or visiting guest property due to theft, vandalism, fire, electrical, or act of God. Registered RV Guest and all other user of TLRP property expressly assumes all risk of such loss or damage and must carry their own liability insurance. _____ RV Guest Initial

  1. Indemnification

RV Guest and/or resort guest shall indemnify and hold harmless TLRP, its officers, and employee from all claims, liability, and expenses, including but not limited to attorney and other professional fees, for injury to persons, loss of life, or damage to property arising out of the RV guest exercise of his/her right hereunder. _____ RV Guest Initial

  1. Reservation of Rights

Texas Livin’ RV Park (TLRP) is a privately-owned resort. TLRP reserves the right to amend these rules, and regulations, without prior notice to residents or guests. TLRP at its discretion, reserves the right to refuse entry on TLRP to any person and to remove current guest without refund. TLRP also reserves the right to refuse accommodate current and returning guests that have violated TLRP rules, and regulations or has vacated resort without paying all fees. ______ RV Guest Initial

  1. Interpretation

  1. Rules and Regulations

RV Guest(s) is subject to and agrees to comply with all “TLRP Rules and Regulations” , a copy of which is attached incorporated within by reference. TLRP may modify the rules and regulations from time to time at its discretion. RV Guest(s) hereby acknowledges that failure to comply with all TLRP rules and regulations will constitute a default of this RV Site  Agreement and will cause for immediate removal from the resort. ______ RV Guest Initial

  1. Changes in Rules, Standards of Maintenance, Services, And Equipment or Physical Improvements

Texas Livin’ RV Park’s rules, regulations, and standards of maintenance of physical improvements in the resort, together with services (including utilities), equipment and physical improvements within the resorts may be changed from time to time as deemed necessary by the resort owner. _____ RV Guest Initial

  1. Acknowledgement

RV Guest(s) acknowledge that he and/or she have read, understood and received copies of the RV Site Rental Agreement, together with a copy TLRP rules, and regulations, and further, that he and/or she have read and understand each of these documents. RV Guest(s) understands that by executing this RV Site Rental Agreement, he and/or she will be bound by the terms and conditions thereof. ____ RV Guest Initial

  1. Disclaimer

TLRP is a privately-owned resort.  The resort provides its services, including but not limited to its sites, utilities, lawn care, irrigation, and amenities on an “as is” basis and makes no representations or warranties of any kind, either express or implied.  By staying at, or using TLRP facilities, you agree to these terms and that under no circumstances will TLRP be liable for direct, indirect, incidental, accidental or any other type of damages resulting from your use of any part of TLRP.  This includes, but not limited to loss, damage, or injury caused in whole or in part by TLRP, its owners, operators, officers, managers, members, employees, and agents by our negligence or things beyond our control. ______ RV Guest Initial

 

Rules and Regulations Pets

  1. AT NO TIME WILL TLRP ALLOW PETS TO BE TIED UP OR UNSUPERVISED. TLRP does not allow for dog houses, kennels, fences or crates to be setup outdoors. RV guests may utilize a small portable pen to keep their pet in while outside; however, the RV guest must remain outside with their pet and the portable pen must be taken down immediately afterwards. TLRP reserves the right to deny a guest to have a pet on TLRP property if said pet poses a threat to the health and safety of TLRP staff/guests. All pets must be kept on a leash when outside and must be indoors by 11pm. Non-house pets (including farms animals) are prohibited under any circumstances. Strange and exotic pets are not permitted. Each pet must be indoors by 11pm. Each pet must be licensed and inculcated/vaccinated. Pets are not allowed inside any TLRP facility building(s)

 

All guests must clean up after their pet(s). TLRP reserves the right to assess a $15 per occurrence fee if you fail to clean up after your pet(s). If your pet damages TLRP property you will be liable for said damage (no exceptions). Barking, excessive noise or other pet behavior that disturbs other Guests is not permitted. If TLRP becomes aware of such behavior, management will notify you and request that you act to correct the problem behavior. If such behavior continues after the second notice you receive from management, you will be required to remove the pet from the resort within 24 hours. Pets are not permitted to be tied or chained to trees within the RV Park.

  1. REGISTRATION SERVICE DOGS: Of any breed belonging to a guest are permitted at TLRP.

 

Guest agrees to indemnify, and hold harmless TLRP owners, principals, shareholders, partners, directors, managers and employees from and against any and all claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys’ fees) arising out of or in connection with your pet residing or being located at TLRP, including without limitation, the claims of any third parties related to death, bodily injury or damage to persons or property caused by your pet. If your pet displays threatening or aggressive behavior which TLRP in its sole discretion, deems to be dangerous or problematic, you agree you will promptly leave TLRP upon request with no recourse against TLRP and no claim for reimbursement or compensation from TLRP. Failure to strictly comply with these Pet rules and regulations will constitute default of this agreement.  Also, your failure to disclose and identify existence of your pets to TLRP management will constitute default of the agreement 

and TLRP will be entitled to all remedies set forth herein.  Registered Guest of TLRP must notify their visitors/guests that their pets are not allowed on TLRP property. 

 

As the below signed Recreational Participant, I wish to enter the premises of TLRP for recreational purposes, including, but not limited to camping, lodging, hiking, fishing, physical activities, and water activities. 

 

I agree to abide by the Rules & Regulations of TLRP, and to be responsible for my family and all members of our party’s conduct and activities.  

I understand and acknowledge that there are inherent risks involved in participating in recreational activities, including, but not limited to the following:

 

            Swimming in the pond is prohibited and is against the rules at Texas Livin’ RV Park,          LLC, TLRP is not responsible for any drowning, snake bites or any other injuries that might occur in or around the pond.

Injuries caused by submerged stumps, limbs, rocks, debris and other things, natural as       well as manmade, including water features and pipes;

Injuries and harm caused by other participants;

I understand injures associated with recreational and water  activities include, but may not be limited to serious personal injury, death, paralysis, burns, broken limbs, amputations and blindness.  

I hereby confirm that I am over the age of 18 and competent to enter into this Recreational Use Contract, and that I and all members of my family are in good health and capable of engaging in recreational and water sports activities.  I hereby agree to personally assume all risks associated with my participation in recreational and water  activities at TLRP, and for any harm, injury, or damage that may befall me or my family member as a result thereof, whether foreseen or unforeseen. 

In return for being permitted to enter TLRP, I AGREE to all things RELEASE and COVENANT NOT TO SUE TLRP and their owners, employees, agents, members, partners, officers, directors, representatives, successors, or assigns. (collectively, the “Parties”), of and from any and all injures and damages to me or any member of my family, in any way arising out of or related to your participation in camping, lodging, recreational activities, water sports and other activities at TLRP, including those injuries and damages caused by the negligence, sole negligence or fault of TLRP and their owners, employees, agents, members, partners, officers, directors, representatives, successors or assigns (collectively, the “Parties”), or caused by any defects in the premises or products used,  or located on the premises.  

I further AGREE to DEFEND, INDEMINIFY and HOLD HARMLESS TLRP and their owners, employees, agents, members, partner, officers, directors, representatives, successors, or assigns (collectively, the “Parties”), of and from any and all claims, demands, liabilities, debts, obligations, liens, lawsuits and causes of action or liabilities or any kind or nature whatsoever, that mat be asserted by me or any member of my family as a result of any accidents or injuries, including death, arising out of or resulting from or in any manner relating to our activities at TLRP.  

Including injures and damages caused by the negligence, sole negligence or fault of TLRP and their owner, employees, agents, members, partners, officers, directors, representative, successors or assigns (collectively, the “Parties”), or caused by any defects in the premises or products used, rented or located on the premises.  

It is expressly AGREED that the RELEASE AND INDEMNITY AGREEMENT set forth herein is intended to be as broad and inclusive as is permitted by the laws of the State of Texas, and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.  

GUEST LICENSE AGREEMENT RULE AND REGULATIONS

GENERAL:  TLRP is a privately-owned resort.  TLRP reserves the right to amend the rules and regulations without prior notice to guests/customers.  TLRP, at its discretion reserves the right to refuse entry on the report to any person.  TLRP reserves the right to refuse to accommodate current and returning guests/ customers that have violated TLRP rules and regulation and /or have vacated the resort without paying all fees.  TLRP will not tolerate any offensive activity of any sort that could interrupt and /or adversely affect the enjoyment of other parties utilizing the resort.  In the event of such burden, obnoxious or offensive activity, in the judgement of TLRP management, the parties for such activities will be required to leave the resort immediately, without refund. 

INDEMNITY AND WAIVER OF LIABILTY: Guests/Customers shall indemnify and hold TLRP and their owners, employees, agents, members, partners, officers, directors, representatives, successors, assigns (collectively, the “Parties”) harmless from and against any and all claims, demands, costs and expenses, including reasonable attorney’s fees, arising from any and all damages or injuries caused by fire, water, wind, civil strife, or acts of God, owner and /or customer actions or inactions (or those of their employees, agents, or invitees), or any other related to Customer’s use, or occupation of the RV site or facilities.  ACCORDING TO TEXAS PENAL CODE 31:04 (b), Under the Texas Theft of Service Law, any guest(s) who leaves without paying for site service who refuses to pay for site service when due is subject to criminal prosecution.  TLRP is providing utility service hook-ups for your RV, TLRP requires full payment in advance.
