Terms & Conditions

By accepting this reservation, I agree, and shall cause my children, invitees, and guests to abide by The Dam Park Rules and policies published at www.thedampark.com, posted at the premises, or otherwise communicated in any manner by The Dam Park management. As a guest of The Dam Park, you acknowledge your understanding of your monetary obligations and your obligation to abide by the rules set forth below.

Monthly Rates: A minimum of stay of 31 nights is required to benefit from monthly rates. If a guest departs prior to 31 days, the stay will be adjusted to a weekly/daily rate as applicable.

Deposit: All reservations less than a month will be required to pay in full. Monthly sites require a non-refundable $150.00 deposit at the time of reservation.

General Policies:

·         Check in Time: Any time after 2:00 PM. Upon arrival, all guests must register at the Dam Park General
Store. Early check-in at 10:00AM may be available for an additional $15.00 fee.

·         Check out Time: Any time before 12:00 PM. Late check-out may be available at 4:00 for an additional $15.00 fee.

·         RV, Tent Sites, and Add-ons:

o   You must be 21 years of age to reserve an RV or Tent Site. Furthermore, you must be 21 years of age to reserve an add-on.

o   All RV & Tent Sites include daily Dam Park passes for registered guests. Any additional guests may purchase a daily Dam Park pass in the general store.

·         After Park Hours Arrivals: We highly recommend that guests plan to arrive before The Dam Park General Store closes at 6:00PM, to receive the best service possible. However, in the circumstances of arriving after the general store closes, please contact us at (830) 282-0662 so we can provide the best service possible upon arrival.

·         As a guest at The Dam Park, I understand all RV sites have a maximum occupancy of 4 individuals. The total number of guests includes children. Rates are based on occupancy, maximum number of guests per RV site is of 8 individuals. each additional guest or invitee over the maximum number of 4 occupants will be charged an additional $5.00 a night.

·         Furthermore, I understand my RV must be within 15 years of age. Exceptions will only be granted with permission by The Dam Park prior to making a reservation.

·         The maximum number of guests per camping site is 4 individuals. Furthermore, I understand that there is a 7-day maximum number of days guests can stay at a tent camping site.

Cancellation Policy:

The Dam Park refund policy differs depending on the timing of your cancellation notice in advance of the reservation date as follows:

• RV & Tent Sites:
  • If a reservation is cancelled more than 3 days prior to the arrival date we happily issue a full refund, minus a non-refundable $35.00 transaction fee.
  • A cancellation of a reservation made less than 2 days prior to the arrival date; the full amount of the reservation payment is forfeited to The Dam Park. Fees apply per RV Site.
  • Monthly reservation deposit of $150.00 is non-refundable.
• Add-Ons:
  • If a reservation is cancelled more than 2 days prior to the arrival date we issue a full refund, minus a non-refundable $10.00 transaction fee.
  • For a cancellation of a reservation made less than 24 hours the full amount of the reservation payment is forfeited to The Dam Park.

Please contact our General Store Office at 830-282-0662 during normal business hours to process your cancellation request. For reservations paid with a credit card, cash refunds will be credited to the credit card on file with respect to reservation.

Day Pass Policy: The Dam Park is open to the public. Park passes are included in RV & tent camping site reservations for all registered guests. For all other guests who DO NOT have an RV or tent site reservation, daily park passes and waivers must be purchased and signed inside the General Store. Daily Pass wrist bands must be always worn while on The Dam Park property.

Refund Policy:

·         The Dam Park does not give refunds or credit for RV/tent camping sites or daily park passes due to any discomforts or acts of nature, weather conditions, voluntary departures, or evictions. There are no refunds after check-in.

No Show Policy:

·         Any guest that has not arrived within 24 hours on the first day of their reservation and has not contacted The Dam Park staff will be considered a cancellation, and the full amount of the reservation payment will be forfeited to The Dam Park.

Recreational Activity Policy:

·         I will maintain control of myself and any equipment while participating in the activity and will refrain from acting in any manner that may cause or contribute to injury to myself or to others. I am responsible for acting within the limits of my ability and heeding all warnings regarding participation in the activity.  Day Pass Waiver must be signed by all participating guests in the

Firearms Policy:

·         I agree, and shall cause my children, invitees, and guests to obey all federal, state, and local laws regarding the ownership and possession of firearms. Firearms are prohibited in any property building or common areas. The exception is that I, my children, invitees, or guests may have a firearm in a locked, private vehicle in parking areas if permitted by law. The discharge of firearms, BB guns, air guns/rifles, fireworks or any similar devices are strictly prohibited at The Dam Park.

SMS Privacy Policy:

·         The Dam Park will not share or sell subscriber information with 3rd parties for their direct marketing purposes. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will no be shared with any third parties. By selecting the Checkbox on the Confirmation Booking page guests agree to receive marketing SMS. Guests may receive an SMS prior, during, or after their stay at The Dam Park. Reply STOP to opt out. Standard message and data rates may apply.

Pet Policy & Waiver:

·         I HEREBY AGREE to the following regulations, rules and conditions relating to my dog staying at MKTW, LLC d/b/a The Dam Park with my dog. A maximum of 2 dogs per site is strictly enforced.

·         Vaccinations. I represent and warrant that my dog is up to date on all vaccinations (including rabies and distemper) and flea treatment.

·         Excluded Dogs. I agree that The Dam Park has the sole discretion to exclude dogs. The basis for exclusion may include but is not limited to the following: breed-specific exclusions; due to their young age are exempted from state or local law vaccination requirements; are sick; are in heat; are aggressive, vicious, dangerous, or potentially dangerous; require muzzling; or are easily frightened or sensitive, resulting in disruptive behavior such as biting or fighting in response to a stimulus.

·         Excluded Areas. I agree to keep my dog out of the following areas including, but not limited to, food and beverage areas, restrooms, and on-site general store.

·         Supervision. I agree to keep my dog on a leash or in a carrier while in all public areas of The Dam Park. I further agree to always have my dog with me or a designated individual and understand that I may not leave the dog unattended.  I understand that The Dam Park does not allow pens or portable fences. I agree to prevent noise or any other disturbances by my dog, in the interest of other guests at The Dam Park. I agree to clean up after my dog and properly dispose of all excrement to a proper dog disposal bin.

·         Disturbances. I agree that, should my dog create any disturbances, which cause complaints to be made by management by other guests or employees of The Dam Park, at the request of an employee, I will immediately plan to house my dog elsewhere outside of the park. Additionally, I understand and agree that if I do not find alternative housing for my pet after being asked to do so, I will be asked to leave The Dam Park and will not be issued a refund.

·         Assumption of Risk and Release. I understand that my permission to have my dog at The Dam Park with me is a privilege and not a contractual right. Such permission is expressly conditional upon my adherence to the terms of these rules and the rules in effect at any given time. I understand the The Dam Park may revoke such permission at any time for any reason. Additionally, I hereby assume all responsibility for risks, injury, damages, demands and other harm that may occur while my dog is at The Dam Park or caused by my dog. Furthermore, I hereby knowingly and voluntarily expressly release and discharge The Dam Park, its owner, its agents, its parent companies, members, managers, directors, officers and employees from any and all claims, damages, liabilities, injuries, damages, demands or causes of action, both present and future, whether known or unknown, anticipated or unanticipated, that me or my guest or invitees may have against any of the released parties arising out of or incident to my dogs presence at The Dam Park, whether arising from any act or omission, whether negligent or otherwise, of me, my dog and/or any other guest or invitee. I further agree to indemnify each of the released parties for all claims, damages, liabilities, injuries, damages, or cause of action including costs, expenses, and attorney fees arising because of or related to the presence of the dog at The Dam Park. This provision shall be enforced to the fullest extent permitted by law.

·         Acknowledgement. By signing this below, I acknowledge that I have read the foregoing Assumption of Risk and Release and fully understand its provisions and consequences. My execution of this release is entirely voluntary and intended to be binding on my heirs, executors, legal representatives, and assigns.

I have read this Animal Waiver and understand it is my responsibility to abide by the rules posted above. I further understand that it is my responsibility to ensure that my guests and invitees also comply with The Dam Park Rules. Failure to adhere to the policies and rules set forth herein may result in my own removal from The Dam Park without a refund.

RV Site RULES:

·         Quiet Hours & Curfew: The Dam Park enforces quite time between 10:00PM – 7:00AM daily. No loud music, televisions, loud talking, etc. The use of generators is prohibited during quiet times. Children under the age of 16 may not leave their campsite after 10:00PM unless going to or from the general store or are accompanied by an adult.

·         Occupancy: The maximum number of registered guests including visitors allowed per site is 6 without prior approval from management.

·         Daily Visitors: Visitors are required to register at the Dam Park General Store upon arrival. Park passes are required for park access.

·         Children: We love our little guests here at The Dam Park and welcome them always. Safety and the well-being of children is a priority at our park. Children under the age of 14 must always be chaperoned by an adult. Children under the age of 6 must wear a life jacket if participating in pond or river activities. No active lifeguards on duty.

·         Speed Limit: The speed limit is 5mph at The Dam Park.

·         Motorized Vehicles: We do allow golfcarts with valid insurance card. Absolutely no motorized vehicles are allowed beyond all posted places in the park. No golf carts allowed during quiet hours.

·         RV Restrictions: All RVs must be currently registered and maintained in good condition. No converted buses or trailers are allowed. RVs that are older than 15 years old must be approved by The Dam Park management before making a reservation.

·         Site Appearance: Outdoor furniture is allowed to be neatly located on your patio or front portion of your RV pad. Free-standing shade structures such as screen rooms, canopies, tarps, decks, steps, fences, or tents are not permitted. No outside storage is permitted. This rule will be strictly enforced to maintain the beautiful appearance of the park.

·         Watercraft, Cargo, and Utility Trailers: Cargo, watercraft, and utility trailers are not allowed at camping sites. Additional parking for such trailers may be available for an additional fee.

·         Vehicles & Parking: Only one vehicle per site is permitted. Additional parking passes may be purchased in the general store for $10.00. Parking is only permitted in front of your own RV site.

·         RV Washing: If you would like to wash your RV please contact the General Store to purchase a pass to do so.

·         Packages & Mail: When ordering please include the Site number on your order. The General Store will accept packages on behalf of guests. However, we will not hold packages or forward mail after a guest departure. The Dam Park assumes no responsibility for damaged packages.

·         Accidents: We understand that accidents happen. All accidents or problem incidents MUST be reported to management at the General Store.

·         Smoking: Smoking is not permitted in any common areas of The Dam Park. This includes the patio, cabanas, and 20ft from The Dam Park General Store and Food Truck area.

Laundry Room RULES:

·         Laundry room machines are for guest use only and are coin operated.

·         Price: $2.00 per load – Washing and Drying  

·         Hours: Preferred operating hours 9:00AM – 10:00PM. Open and accessible 24/7

·         Usage: Please do not overload machines. Only use HE detergent in HE rated machines. Clean lint tray after each use. Please remove clothes immediately after each cycle is complete.

·         Do Not: wash pet beds or leave children unattended.

·         Liability: The Dam Park is not responsible for lost, stolen, or damaged items. Please report any broken or malfunctioning machines to the general store.

The Dam Park RULES:

·         Park Hours: Park access hours are determined by daylight. Entrance hours are 30 minutes before sunrise. Exit hours are 30 minutes after sunset.

·         Access: The Dam Park is open to the public for recreational purposes. Park passes are required for entrance into the downhill park. Daily passes for guests who do not have an RV reservation or tent camp site reservation can be obtained in the general store for $20.00 per adult and $10.00 per child. Wristbands are required for park access.

·         No Glass: Absolutely no glass containers or bottles are allowed in the downhill park area.

·         Texas fish and Wildlife Regulations: A Texas fishing license is required to fish anywhere on The Dam Park Property. All guests must adhere to all Texas fish and wildlife regulations. We will not be held responsible for any negligent fishing. Please contact our local Texas Game Warden if you suspect any wrongdoing while fishing in our park. The Dam Park is also home to lots of wildlife in our area including deer. Please refrain from feeding or shooting deer in the park.

·         Cabanas: First come, first serve. All trash must be placed in garbage bins upon leaving.

·         Pond: The Pond is strictly catch and release. Swimming is allowed in the pond. Children under the age of 6 are required to wear a life vest when participating in water activities including but not limited to swimming in the Guadalupe River and Pond. No active lifeguards are on duty.

·         Grills & Firepits: All grills and firepits must be always attended. Please keep any flammable objects away from grills and firepits. Clean grills after each use and place trash in trashcans. Fires in pit must be completely out before leaving.

·         Pets: All pets must always be on a leash. Please scoop the poop and see our pet policy and waiver for more information.

·         Children: All children under the age of 16 must always be accompanied by an adult. Children under the age of 6 are required to wear a life vest when participating in water activities including but not limited to swimming in the Guadalupe River and Pond. No active lifeguards are on duty.

I HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE MKTW, LLC, d/b/a The Dam Park, its owners and agents, from any and all liability to me, my children, my invitees/guests, personal representatives, and heirs for any loss or damage on account of injury to person (including death) or loss or damage to property relating to, or arising out of, use and occupancy of The Dam Park property, facilities, and any dangers and hazards associated with acts of nature such as changing weather conditions; high winds; thunder and lightning; temperature fluctuations; falling trees; tree limbs, loose debris from river, ice; or encounters with natural wildlife.

I HEREBY AGREE TO INDEMNIFY, SAVE, AND HOLD HARMLESS The Dam Park Management, and each of them from any loss, liability, damage, or cost (including attorney fees) they may incur due to and/or my invitees/guests or due to any incidents that may occur during my stay. I understand that, although The Dam Park Management makes every reasonable effort to provide a secure environment, the security of my person, my belongings, and all persons registered in my party is my sole responsibility.

As a courtesy, our employees, if so, requested may assist with directing you to your designated RV site. It is your sole responsibility to ensure that the site will accommodate your specific trailer/RV and that you will not hit branches, bollards, trees, etc. when positioning your RV on the site. You agree to indemnify and hold MKTW, LLC d/b/a The Dam Park, its owners, and agents harmless from any loss, liability, damage, or cost (including attorney fees) that may result from an employee assisting or directing you onto an RV site. Furthermore, you release, waive, discharge and covenant no to sue The Dam Park Management for all liability, loss, or property damage relating to an employee assisting/directing you to your site.

The premises are privately owned, and THE DAM PARK MANAGEMENT RESERVES THE RIGHT TO REFUSE SERVICE to anyone for any reason except for those prohibited by law. The Dam Park Management reserves the right to require any person or party it deems necessary, to leave the park based on violations of Park Rules or behavior management deems inappropriate or disturbing to others. Harassment or mistreatment of our staff or other guest, including but not limited to, racist comments or hate speech, will not be tolerated under any circumstances. The Dam Park reserves the right to remove any occupant or guest who is subject to a lifetime registration requirement under a state sexual offender registration program. I have read this notice and agree to it as well as all The Dam Park Rules and regulations. In addition, I understand that I am responsible for the actions of all persons registered in my party, I grant The Dam Park and its affiliated entities and promotional partners the right to include any photograph, video, and other visual portrayals of each person in my party in any medium for any purpose.

I understand that I am and remain personally liable to pay the total amount of my reservation prior to my scheduled check-in date, or at such an earlier date communicated to me. If I fail to pay the total due, I agree that MKTW, LLC d/b/a The Dam Park may charge any remaining balance (in addition to any damage charges or other amounts owed under these terms and conditions) to any credit or debit card on file with my reservation. Any amounts due after 30 days will be subject to the maximum late charge permitted under state law.
