DEFINITIONS
“Land” means the property legally owned by the Licensor
“Site” means the area on the Land that is being temporarily Licensed by the Camper.
“Term” means from the commencement date to the end date where the Licence of Occupation is active.
“Licence” means this Licence of Occupation.
“Visitors” means any persons invited onto the Land by the Camper.
“Licensor” means the owner of the Land described as “THE PARK @ Crown Isle” or a manager who is authorized to act on behalf of the landowner.
“Camper” means the person obtaining a temporary Licence to use a portion of the Land known as a Site.
RECITAL
The Licensor owns the property described as “THE PARK @ Crown Isle” (the “Land”) and is offering a Licence for those who wish to temporarily occupy the Land for the sole purpose of the outdoor recreational activity known as camping.
NOW THEREFORE
The Camper hereby agrees and understands that:
1. This Licence is not a lease agreement, nor is a lease agreement or the terms of a lease agreement implied anywhere within this Licence nor has it been implied in person.
2. This Licence is for the sole purpose of the recreational activity known as “Camping.”
3. The Schedule “A,” Schedule “B” and Schedule “C” attached herein make up an integral part of this Licence and must be always abided by the Camper and their Visitors, in full, when on the Land.
4. In the event that the Camper or one of their Visitors fail to comply in full with any part of this Licence, including its attached Schedule “A”, Schedule “B” or Schedule C”, may result in, at the sole discretion of the Licensor, the Campers Licence being cancelled, effective immediately, with no refund due.
5. Sublicensing or capitalizing in any way from any part of the Land is strictly prohibited and will result in the Licensor immediately issuing notice to cancel the Campers Licence, effective immediately, without notice, and with no refund due.
6. This Licence is bound to the Camper and is not transferrable at any time, in any way, for any reason whatsoever.
7. This Licence has defined start date and an end date (the “Term”) and it is expected and enforced that the Site occupied by the Camper is to be left in a vacant and clean condition by the end of the Term of the Licence by the sole organization, sole labor, and sole efforts of the Camper. No effort is to be made on behalf of THE PARK @ Crown Isle to clean a Site left vacant by a Camper at the end of the Term.
8. RV's Must be 2004 or newer.
TERMS AND CONDITIONS FOR RV PARK
SCHEDULE “A"
GENERAL
1. The maximum number of RVs per site is one.
2. RV’s must be backed into their campground site.
3. Tents are not permitted anywhere on the property.
4. The speed limit is 5 km/h.
5. Quiet time is from 10:00 p.m. to 8:00 a.m. and is strictly enforced.
6. Noise considered to be disruptive to our neighbors, even outside of quiet time, is strictly prohibited.
7. The RV Park assumes no responsibility for the personal property of the Camper the Campers Guests.
8. No alcohol consumption by minors (under the legal age of 19) is allowed.
9. Any drunk/disorderly persons will be removed from the premises.
10. Smoking is only permitted in designated smoking areas defined on the “Schedule C” Map.
11.The garbage dumpster is for GUESTS STAYING AT THE RV PARK. Please note, residential garbage disposal only! For example, no construction or renovation materials.
It is unlocked and available for garbage disposal from 9:00 am to 5:00 pm daily.
Propane tanks and disposal are the guests' responsibility. Propane tank drop off should be done at Comox Valley waste management center at 3699 Bevan Rd, Cumberland.
Any guest dumping propane tanks on or in the dumpster will be billed the cost of removal and disposal. This is approximately $75.00.
The dumpster site is monitored, so please be respectful of our regulations.
VEHICLES
1. The maximum number of vehicles per site is one. Cars, trucks, and motorcycles are all considered vehicles. Additional vehicles must be parked in the overflow area (subject to an additional charge).
2. Absolutely no parking on roadways.
GUESTS
1. Campers must register all their guests with the RV Park Manager immediately upon their arrival.
2. The Camper is always fully responsible for the actions and behavior of their Guests when on the Land.
3. Occupancy per site should never exceed 4 persons and 2 pets at one time. For special exceptions, such as extra guests or pets, permission must be received from the RV Park Manager in advance.
4. All the Campers extra guests, if any, are to leave the property no later than 10:00pm and return no earlier than 8:00am the next day.
SEPTIC SYSTEM
1. Do not flush personal hygiene wipes/baby wipes/wet wipes, even if the product packaging says it is flushable/biodegradable. The septic system at The Park is not able to handle such products without clogging.
CAMPGROUND APPEARANCE
1. Campers are responsible for keeping their site free of trash or unsightly items.
2. Campers are responsible for obtaining a post office box to receive their mail. No mail is to be delivered to THE PARK @ Crown Isle. Mail delivered to THE PARK @ Crown Isle will be sent back immediately without notice of attempted delivery.
3. Business operations of any kind, including advertisements or for sale signs are strictly prohibited.
4. There are to be no structures added to the property, including porches, decks, fences, and sheds.
5. Tree, shrub, or plant removal of any kind is prohibited.
6. No bird seed or feeding wildlife of any kind is allowed.
7. Clotheslines or outdoor cloth drying of any kind is prohibited.
8. Trash is to be disposed of in the 2 Ton dumpster (Blue), visible on the “Schedule C” Map.
9. RVs are to be in presentable condition. This means presentable in appearance. RVs are to be clean, painted without rust, and with no other appearance defects in sight.
PETS
1. Vaccinations must be up-to-date. Pets must be identified by a name tag clearly displaying the contact information of the Camper or a guest in contact with the Camper.
2. Campers must carry pet waste disposal bags & clean up after their pet immediately after mess is created anywhere on THE PARK Land, bushy areas included.
3. Pets must be on a leash and may not be left unattended at any time.
4. Pets making noise must be removed from the property immediately.
5. Pets showing aggressive behavior will be asked to leave the property immediately and/or will have the SPCA notified.
6. Maximum 2 pets per site.
7. All pets brought to the RV Park are to be approved by the Licensor prior to entering the RV Park.
FIRE SAFETY
1. Fireworks are prohibited.
2. The use of accelerants such as gas and kerosene are prohibited.
3. Garbage, including plastics and foods, must be disposed of in the trash and not be burned.
4. General fire rules and local bylaws are to be strictly observed.
POLICIES
1. We do not give credits or refunds due to discomfort of nature, weather, or for early departure.
2. Bookings cannot be extended at any time or for any reason whatsoever. New bookings can be made after 24 hours of the Site being left in a vacant condition and advertised as vacant on THE PARK @ Crown Isle Website for other guests to have the option to book.
3. All rules are to be always observed. Failure of a Camper or of their visitors to comply with the above rules, at the discretion of the Licensor, will result in the Campers booking canceled, effective immediately, and with no refund.
4. All local, Provincial, and Federal laws must be obeyed.
5. In the event of an emergency please immediately call 911. If the emergency does not relate to health or safety, please contact the RV Park Manager.
ASSUMPTION OF RISKS, WAIVER AND RELEASE OF CLAIMS, AND INDEMNITY AGREEMENT
SCHEDULE “B”
DEFINITIONS:
In this Agreement, “Land” shall, without limitation, include any premises, land, buildings, facilities, vegetation, owned or leased by Crown Isle Park and Play Ltd. dba THE PARK @ Crown Isle.
In consideration of THE PARK @ Crown Isle allowing my own and my visitors’ entry onto the property, our use and enjoyment of certain of its property, I agree, on behalf of myself, my heirs, assigns, personal representatives and next of kin, that:
1. I ASSUME AND ACCEPT, WITHOUT LIMITATION, ALL RISKS AND DANGERS associated with my or my visitors’ use and enjoyment of the property.
2. I ASSUME FULL RESPONSIBILITY for understanding and following the rules set out in the attached “Schedule A,” “Schedule B”, and “Schedule C” herein, and safe practices associated with the use and enjoyment of the property and for my own and my visitors’ personal safety.
3. I WAIVE ANY AND ALL CLAIMS that I have or may in the future have against THE PARK @ Crown Isle and its directors, officers, employees, agents, and representatives arising from or connected directly or indirectly, with my own or my visitors’ presence at, or use and enjoyment of, the property.
4. I RELEASE THE PARK @ Crown Isle from any and all liability for any loss, damage, injury, or expense that I, or my next of kin may suffer or incur by reason of my own or my visitors’ presence at, or use and enjoyment of, the property, INCLUDING NEGLEGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER ANY APPLICABLE OCCUPIERS’ LIABILITY LEGISLATION ON THE PART OF THE PARK @ CROWN ISLE OR OTHER PARTICIPANTS, OR ANYONE ELSE.
5. I WILL INDEMNIFY AND HOLD HARMLESS THE PARK @ CROWN ISLE from any and all liability for loss, damage, injury, or expense suffered or incurred by me or anyone else, including my visitors, in connection with my own or my visitors’ presence at, or use and enjoyment of, the property.
I HAVE READ THIS DOCUMENT THOROUGHLY.
I UNDERSTAND THAT, BY SIGNING THIS DOCUMENT, I GIVE UP MY IMPORTANT LEGAL RIGHTS, INCUDING THE RIGHT TO SUE.
I AKNOWLEDGE I AM NOT RELYING UPON ANY ORAL OR WRITTEN REPRESENTATIONS OR STATEMENTS MADE BY THE PARK @ CROWN ISLE WITH RESPECT TO THE SAFETY OF THE PROPERTY OR PARTICIPATING IN ANY ACTIVITY OTHER THAN WHAT IS SET FORTH IN THIS AGREEMENT.
I UNDERSTAND THAT THE PARK @ CROWN ISLE IS RELYING ON MY FULL RELEASE AND WAIVER OF ALL CLAISM WHEN PERMITTING MY USE AND ENJOYMENT OF THE PROPERTY AND MY PARTICIAPTUION IN ANY OF THE ACTIVITIES.
