In consideration of the services of The Resort at Erie Landing, their officers, agents, employees, stockholders and all other persons or entities associated with those businesses (herein collectively referred to as "Resort at Erie Landing"), I agree as follows:

ACKNOWLDGEMENT OF RISK

Although The Resort at Erie Landing has taken reasonable steps to provide me with the appropriate and skilled guides so I can enjoy an activity for which I may not be skilled. The Resort at Erie Landing has informed me these activities are not without risk. Certain risks are inherent in each activity and cannot be eliminated without destroying the unique character of these activities. These inherent risks are some of the same elements that contribute to the unique characteristic of these activities and can be the cause of loss or damage to my equipment, or accidental injury, illness, or in the extreme cases, permanent trauma, or death. The Resort at Erie Landing. does not want to frighten me or reduce my enthusiasm for these activities, but believes it Is important in advance what to expect and to be informed of the inherent risks. The following describes some but not all those risks.

(Swimming, sporting activities, other activities.... etc.)

I am aware that all activities entail risks of injury or death to any participant. I understand the description of these inherent risks is not complete and that other unknown and unanticipated inherent risks not specifically identified. My participation in this activity is purely voluntary, no one Is forcing me to participate, and I elect to participate of and with full knowledge of the inherent risks.

I acknowledge that engaging in this activity may require a degree of knowledge or skills and knowledge different than other activities and that I have responsibilities as the participant. I acknowledge that the staff at The Resort at Erie Landing has been available to explain more fully to me the nature and activity.

I certify that I am fully capable of participating in this activity. Therefore, I assume and accept full responsibility for myself, including all minor children in my care, custody, control, for bodily injury, death or loss of personal property and expenses as a result of those Inherent risks and dangers, not specifically identified, and, as a result of my negligence in participating in this activity.

SWIM NOTICE:

1.     NEVER SWIM ALONE. A minimum of two (2) adults 18 years of age or older must be present whenever the swimming facility is in use. With at least one adult remaining on the beach.

2.     THERE IS NO SUBSTITUTION FOR ADEQUATE SUPERVISION. Children under the age of 16 years of age must be accompanied to the swim facilities by a parent by a parent or guardian, (an adult who is responsible for the children and their behavior)

3.      IN AN EMERGENCY, NOTIFY THE CAMPGROUND MANAGEMENT AND CONTACT HELP AS SOON ASPOSSIBLE. A free telephone is provided at the at al swim locations.

4.     ONLY USE THE SWIMMING FACILITIES DURING POSTED HOURS OF OPERATION.

5.    DO NOT DRINK ALCOHOL AND SWIM

PHOTO RELEASE

I hereby irrevocably grant The Resort at Erie Landing permission to use my likeness in photographs and/or other audio-visual materials in any and all publications, including website entries and printed materials, including the right to edit, alter, copy, exhibit. publish, or distribute the photo for all lawful purposes. without payment or any other consideration. In addition, I waive the right to inspect or approve the finished product, including written or electronic copy, wherein my likeness appears, and I waive any right to royalties or other compensation arising or related to the use of the image. I understand and agree that these materials will become the property of The Resort at Erie Landing.

I have read clearly understood and accepted the terms and conditions stated herein and acknowledge that this agreement shall be effective and binding upon myself, my heirs, assigns, personal representatives, and estates for all members of my family, including minor children.

WARNING: Under Ohio law, there is no liability for an injury to or death of a camper or visitor to this campground if that injury or death results from the risk inherent to camping. Inherent risks to camping include, but are not limited to, the risk of injury inherent to land features, equipment, animals, or the negligent actions of the camper or visitor. You are assuming the risk of participating in camping

The management reserves the right to evict any day user, guest, camper or group of campers for any cause.
