Trestle View RV Park and Campground, Ohatchee, Alabama
This agreement is binding for the entirety of the agreement, and in the event Renter decides to terminate this agreement at any time prior to the agreement end date, Renter will be responsible for paying the balance owed for the duration of the lease of lot. Renter may upgrade lot rent terms only at time of renewal of the lease. NO MONEY WILL BE REFUNDED to anyone wishing to leave before the end of the term of the lease, or to anyone who is asked to leave due to disorderly conduct or lease violation. Renter has no authority to sublet or sell the agreement to any other Renter. At the end of this agreement, Renter has the option to 1) leave with a 30-day written notice; 2) allow the agreement to roll over into another 12-month term; or 3) rent on a month-to-month basis with an increase of an additional $50 per month to stated lease amount and continued payment until a new agreement is signed.
-All payments must be paid by the 1st of the month or incur a late fee of $50 after the 5th. No lot rental fees will be allowed 30 days in arrears. Habitual late payments will result in non-renewal of lot rental. All unpaid debts are reported to the credit agencies, and any eligible income will be garnished until debt is satisfied to the full extent of the law.
-RV/Tiny Home is subject to being towed off premises at Renter’s expense after 32 days’ lot rent arrears.
-Renter agrees to give 30 days’ written notice when terminating agreement or additional month’s rent will be required.
-An annual maintenance fee of $375 (typically, subject to change) is required (prorated) at signing of lease and due in June annually thereafter.
-Renter is responsible for applying for electrical service with Coosa Valley Electric Cooperative. TV does not supply power. Water service is included in lot rent.
-It shall be the obligation of the Renter to notify TV of any changes in cell number, address, work number, or email address within 10 days of change. In addition, TV shall be authorized to demand proof of employment, verification of income, and to require Renter to submit to criminal background check. Any criminal activity by Renter, Renter’s family, or invitees to property is grounds for immediate termination of lease without refund of monies. No person found to have been convicted of sexual offense shall have a lease with TV nor be allowed to visit any TV property.
-Renter may not “sub-rent” nor “sub-lease” the assigned RV/Tiny Home lot on TV property. If Renter should decide to sell his RV/tiny home, the lot rent is not transferrable. Any new tenant will be required to sign a new agreement and pay for the year. If Renter decides to leave before the term of this agreement is satisfied, all monies paid in advance will be forfeited. Renter may not rent nor loan his RV/Tiny Home to another person while it is located on TV property. Tenant owner-financed negotiated sales of RV/Tiny Homes are not permitted on property.
-In the event of a breach of this agreement or a violation of the Rules and Regulations of TV, TV may terminate this agreement in person or upon written notice to the site Renter at the address listed below at which time Renter shall promptly pay all sums due TV and remove RV/Tiny Home from the premises. If Renter fails to pay outstanding rent owed, Renter understands that TV may take possession of the RV/Tiny Home and its contents and sell for payment of debt without further notice to Renter. Any tenant whose agreement is terminated or non-renewed, or should break his agreement, said tenant will be prohibited from access of the property, considered trespassing, and subject to local law enforcement efforts.
-It is mutually agreed that TV shall not be liable for the safekeeping or condition of the RV/Tiny Home or equipment appurtenant thereto, and the RV/Tiny Home owner must carry his or her own insurance. TV shall not be liable for any damage or loss to RV/Tiny Home, equipment, or any property whatsoever, from any cause whatsoever, or for injury to the owner or Renter, guests, or invitees.
-TV reserves the right to amend the posted Rules and Regulations from time to time, and Renter agrees to abide by same. A copy of the current Rules and Regulations shall be posted onsite at the bath house.
-Waiver of any one condition by TV shall NOT be deemed to be a continuing waiver.
-To insure peace and privacy of every tenant and guest, children are not permitted to trespass on another’s property.
-Renter shall hold harmless TV from all costs, losses, or expenses incurred, or for any damage caused by Renter, Renter’s Family or invitees to the TV property and facilities, and shall further indemnify and hold harmless TV from any claims, judgements or damages sought or awarded to any other persons making any claims or lawsuit against TV for injuries or damages alleged to have been caused by the Renter or Renter’s family or invitees.
-Any damage to the common areas caused by heavy vehicles moving off the road will be the responsibility of the Renter who caused the damage to repair or pay for TV to repair.
-If Renter is not present, no guests may occupy or otherwise use the RV/Tiny Home lot without management’s consent.
-Renter shall acquaint all guests with TV Rules and Regulations. Renter is responsible for the actions and behavior of guests.
-Only household pets are allowed. No outside pets permitted. Pets must be kept on a leash when not on Renter’s lot unless pet remains with owner when walking. ALL SOLID WASTE MUST BE REMOVED AND DISPOSED OF PROPERLY IN COMMON AREAS AND WHERE OTHERS MAY WALK. Only dogs that are not a nuisance, do not bark excessively, and show no aggression towards other dogs and people are allowed to remain in the RV/tiny home park. Animals entering another lot without permission is grounds for a violation.
Renter Maintenance Requirements
-Renter shall be responsible for all maintenance of the site and shall keep the site in a clean and uncluttered condition. The RV/Tiny Home occupying the space shall be kept in a neat, clean, and repaired condition at all times. Any condition of the Renter’s RV/Tiny Home or RV/Tiny Home rental site that does not comply shall be considered by TV as a “nuisance” and if not cleaned, corrected, or remedied to TV’s satisfaction within 72 hours shall be grounds for termination of lease with forfeiture of all monies paid through the month of notice. Should TV be required to incur clean up, disposal, or site repairs related to any such nuisance or violation, the Renter shall pay for these expenses as well as attorney fees, court costs, etc.
-Preexisting or new patio, porch, deck, and piers cannot be moved. Renter is responsible for maintaining the lot and any decks attached to the lot. This includes cutting grass and any weed eating required. As a courtesy to the Renters, TV has provided a battery-operated push mower, weed eater, and blower which are located behind the bath house. BATTERIES MUST BE RETURNED TO CHARGERS AFTER USE AND ALL TOOLS CLEANED OF DIRT AND GRASS. An additional monthly lawn fee of $20 will be assessed for lots not maintained.
-Renter will make no alterations or additions to the lot. To avoid damage to underground utilities, Renter must have park management’s consent before digging or driving stakes into the ground. Renter shall bear the cost of repairs to any utilities damaged by Renter.
-Air conditioner or evaporative cooler in RV/Tiny Home must be in good operating condition and must not make excessive noise that will disturb neighbors.
-Only one (1) structure (RV/Tiny Home) may be placed on each lot. RV models 2010 years or older are subject to management approval and tenant must provide pictures of all four sides of unit with application.
-Anything stored in the common area must be labeled with name and lot number visible at all times. Any item without identification is in jeopardy of being towed at owner’s expense. Items not specifically used pertaining to life in the RV park by Renter are prohibited. Extra utility trailers, vehicles, etc., are subject to management approval.
-No permanent structures shall be allowed on lots. Temporary decks and canopies are permitted.
-Nothing unsightly in appearance may be stored on the lot or under the RV/Tiny Home.
-Nothing is allowed to be tied around or affixed to any trees.
-No outside clothes lines permitted.
-Firepits are allowed at campsites only as allowed by local authorities during burning season for the burning of wood only. No household garbage, trash, boxes, etc., can be burned.
Flood Water
-Renter has been informed that all RV/Tiny Home lots are located in designated flood zone. Renter is obligated to monitor lake levels and remove RV/Tiny Home and all property from lot before lake reaches flood level. TV reserves the right to shut off power in the event of a flood. When power is shut off due to flood, it will remain off until service units are completely dry and safe for power restoration. TV is not responsible for any perishables lost due to power outage. In the event of a flood, Renter may have only hours’ notice and should keep this in mind when setting up lot. In the event of a flood, Renter is required to 1) remove everything from lot that will float down river, and 2) cap sewer when disconnecting RV. The Alabama Shoreline App Smart Lakes is a valuable tool for phones.
Disposal Service
-TV has provided both septic hook-ups on RV/Tiny Home lots and a dump station located at the bath house for the discharge of all grey and black water waste at no additional cost. Any tenant releasing unapproved waste matter on the grounds will be guilty of a federal violation and will be required to vacate the property immediately.
-A dumpster is provided for RV/Tiny Home Renter use. Only bagged household garbage may be placed in dumpster; no construction debris, building materials, or large items such as mattresses allowed in dumpster. No outside garbage may be brought in from another location, and non-renters/guests are not allowed to use dumpster. Any Renter or their guests violating this rule shall be fined $500.00. Nothing shall be placed on the ground around the dumpster.
-Renter will care for sewer system by NOT placing grease, coffee grounds, or other inappropriate items such as water resistance objects in sewer system (including but not limited to facial tissue, disposable diapers, paper towels, sanitary napkins, tampons or applicators, cotton balls, etc.) Renter is responsible for payment of repairs for clogs due to misuse. The septic system has NOT been designed to handle individual washing machine usage, therefore RV/Tiny Home units with washing machines are prohibited from using them while on the property. Violation will be grounds for agreement termination.
Parking and Storage
-Only two (2) vehicles permitted per campsite. All vehicles must be registered with management.
-All guests must register with management via text to (205) 201-1398. Guests must adhere to same policies, guidelines, rules and regulations as tenants, and are the responsibility of the tenant. Guest parking will be arranged at guest check-in and available at multiple locations throughout the property.
-No parking on roads. Common area parking is provided for guests and/or additional vehicles.
-Park speed limit is 10 mph and strictly enforced. Careless, unsafe, and excessive speeding will result in tenant loss of parking privileges and/or camping agreement cancellation
-Park roads are not to be used to play sports, games, or for gathering. Additional recreation space for activities has been provided.
-Golf carts are permitted; drivers must be 16 years of age or older. Please ensure young drivers exercise proper road etiquette and safety measures at all times. No go-carts, 4-wheelers, or any other recreational vehicle not used for transportation allowed.
-Renters will not drive on or park in another Renter’s lot.
-No vehicle leaking oil or any substance shall be permitted to park on premises. No inoperable vehicles will be allowed to remain on property.\
Rules and Regulations
Trestle View RV Park and Campground is a family-oriented community. All residents shall at all times exhibit common courtesy and respect to other renters, Trestle View management and staff. All renters pledge to abide and uphold policies, guidelines, rules, and regulations of Trestle View as outlined in this document and any future amendments or addendums to it. Violations to these rules and regulations will result in the termination of your signed rental agreement.
- Registration: All guests must register themselves and ANY guests visiting. Management reserves the right to deny registration of any person entering the property at any time.
- Parking: Each rented RV lot is allowed one (1) RV / tiny home, and two (2) cars per site. Cars include anything smaller than a ¾ ton truck. Larger vehicles will need approval from management.
- Pets: MUST be on a leash at all times when outdoors, except when in dog park. Pets cannot be left unattended and are not allowed in any park building, pool, or playground areas. Disruptive or aggressive pets will not be permitted. OWNERS MUST PICK UP AFTER THEIR PETS! Management reserves the right to refuse any animal it deems dangerous, disruptive, or a threat to other visitors.
- Golf Carts/ATVs: No one under the age of 16, without a driver’s license, is allowed to operate a motorized vehicle on our property. We DO NOT allow 4 Wheelers. Golf Carts and ATVs must be registered with park management as well as providing proof of insurance showing liability coverage. Registration of golf carts or ATVs can be revoked at any time.
- Laundry: Laundry machines are available for use at the shower facility. Clotheslines are prohibited. NO PETS OR SMOKING ALLOWED IN LAUNDRY.
- Mail: We recommend obtaining a PO BOX from the most convenient post office in Ohatchee. Having mail sent to the campground automatically releases Trestle View RV Park and Campground as well as its owners and management from all liability associated with your mail or package deliveries. No member of management or employee may sign for any package.
- Garbage: DO NOT LEAVE BAGGED GARBAGE OUTSIDE OF YOUR CAMPER. A dumpster is provided for your use and is located across from the common area. No garbage is allowed in fire pits or to be burned on site. Cigarette butts are not to be thrown on the ground but disposed of properly.
- Boats and Trailers: On site boats and trailers must be approved by management and must be parked in designated areas.
- Quiet Hours: 10:00 pm to 7:00 am. Please be considerate of others. No disorderly conduct will be tolerated. No gathering in common areas will be permitted during quiet hours. Park Management will from time to time extend these hours for observed holidays and park gatherings.
- Freezing Temperatures: If temperatures drop below freezing, ensure insulated covers are in place and leave water dripping to prevent pipes bursting.
- Alcoholic Beverages: All alcoholic beverages are to be contained inside your camper, on your campsite or off premises. No open containers with alcohol permitted on property outside of tenant lot. Tenants are expected to abide by all City, County, State and Federal laws with regards to the consumption of alcohol while on the premises of Trestle View RV Park and Campground. Absolutely NO intoxication will be permitted on site.
- NO ILLEGAL DRUGS NO EXCEPTIONS. USE, DISTRIBUTION OR CONSUMPTION ON TRESTLE VIEW PREMISES WILL RESULT IN THE IMMEDIATE TERMINATION OF YOUR AGREEMENT.
- Absolutely NO FIREARMS are to be discharged on the RV Park or campground premises.
- No businesses are allowed to conduct physical activity on the premises. This includes but is not limited to retail sales, food sales or prep, manufacturing, and distribution activities.
- Tenants who have previously breached their agreement, have been required to leave the property, not fulfilled their agreement, or have not complied with the terms outlined herein are not permitted back on to the property, even as a guest of another tenant. Violators will be considered trespassers and turned in to local law enforcement.
- Signor is responsible for all charges during their stay. Failure to pay charges by due date will result in immediate termination of your camping agreement. Violaters will be considered trespassing and local law enforcement will be notified.
Release of Liability:
By entering and utilizing the facilities at Trestle View RV Park and Campground, all renters, guests, and invitees acknowledge and agree that the park, its owners, management, employees, and agents (collectively, the “Released Parties”) shall not be liable for any loss, damage, injury, or harm—whether personal, property-related, or otherwise—that may occur on the premises, regardless of the cause, including but not limited to negligence, accident, or the acts or omissions of any party. All individuals are responsible for securing their own insurance coverage as deemed necessary. This release and waiver of liability apply to all claims, including those arising from the acts, omissions, or negligence of the Released Parties, and shall remain in full force and effect during and after the use of the park facilities.
