Twisted Pines Stay Agreement
The entire monthly payment (if electing to pay monthly) is due on the same day of each month. A penalty of $50.00 will be assessed for initial late payment and $30 each day after. After 3 days of non-payment, utilities will be shut off and the Guest(s) will be asked to leave. Example: Guest arrives on the 21st of the month: the next month payment will be on the 21st of the following month, and each month thereafter. Payments will only be accepted electronically (CashApp, Zelle, PayPal), we accept all major debit/credit cards as well. Any fees in making an electronic payment are to be incurred by guests.
1. Default: Any failure by Guest(s) to pay rent or other charges promptly when due or to comply with any other term or condition of this agreement shall, at the option of Owner, promptly terminate this tenancy and forfeit all rights of Guest(s) under this agreement.
2. Assignment and Subletting
The Guest(s) agrees to use the premises for parking of one recreational vehicle and 2 vehicles only. The guests understands that the site cannot be sublet or assigned without prior written permission from the owners. Occupancy of the recreational vehicle is limited to 2 people.
3. Maintenance and Redelivery of RV Spot
Guest(s) shall keep and maintain the RV Spot in a clean and sanitary condition at all times, and on the expirations or earlier termination of the stay shall surrender the RV spot to Owner in as good condition as when received, ordinary wear and tear and damage by the elements expected.
4. Indemnification
With this property being privately owned, the Guest(s) accepts terms and occupancy privileges with the understanding that he/she does hereby release the RV park owners, it's management, officers, and employees, of all liability for loss or damage to property and injury to Guest(s) or their guests arising or of the Guest(s)'s or guests use of the facilities and agrees to indemnify the Park, it's management, officers, and employees, against claims resulting from loss or damage to property or injury to the Owner, their guests, or any member of their family unless caused by gross negligence or willful misconduct of Owner. Guest(s) Shall further indemnify, defend, and hold Owner harmless from any and all claims and damages (including reasonable attorney's fees and costs) arising from any breach or default in the terms of this agreement or arising from any act, negligence, fault, or omission of Guest(s) and form and against any and all cost, reasonable attorney's fees, expenses, and liabilities incurred on or about such claim or any action or proceeding brought on such claim. In case any other action or proceeding shall be brought on such claim. In case any action or proceeding shall be brought against Owner by reason of any such claim, Guest(s), on notice from Owner, shall defend it at Guest(s)'s expense by counsel approved in writing by Owner. Be aware this property falls in a flood plain and the Owner is not responsible for any losses or damage caused by nature or any act of God including floods, rains, tornados, hail, winds, fire, etc.
5. Park Rules & Policies
The Guest(s) acknowledges that he/she has been furnished a copy of all campground rules and regulations, and agrees to abide by them same as they may be amended from time to time. ____________________ (Initial)
6. Utilities
Water, trash, sewer, electricity are included in the rent provided by Owner, however misuse of utilities at your site could result in an additional fee.
7. Insurance
Guest(s) agrees to carry his/her own liability and comprehensive insurance and vehicle registration during the term of this lease.
8. Default
In the event that the Guest(s) defaults on any term of this lease, including terms of lease payment, usage, or violation of the rules and regulations of 3131 FM 1252, the Owner shall have the right to eject the Guest(s) with 3 days written notice to the Guest(s) of its right to cure the default. Notice of the right to cure the default shall be deemed delivered to the Guest(s) when sent by the Owner by email, or personally delivered to the Guest(s) whose name or names appear on this lease in person with a signed receipt for the same. In the event that the Guest(s) is ejected and refuses to leave, the Owner may proceed by forcible entry and detainer for the removal of the Guest(s) and the recreational vehicle. Any eviction by the Owner shall not be the sole remedy and the Owner shall be entitled to recover any past due payments with interest at 12% per annum on the past due amount from the date it was due, together with any and all other unpaid fees, expenses, and reasonable attorney's fees and costs. The Guest(s) agrees that jurisdiction of any action and venue is in the Gregg County District Court.
9. Expiration of this Agreement
Upon expiration of this Agreement, the Guest(s) agrees to vacate the recreational vehicle together with all other personal property of the Guest. In the event the Recreational vehicle and personal property is not removed, the landlord shall have no liability for any damages thereto. Guest may not leave personal property on the site without the express written permission of the Owner or upon execution of a storage agreement with the Owner or the vehicle and personal property may be removed by Owner.
10. Closing
This document contains the entire agreement between the Owner and the Guest(s), no other representation or inducement, verbal or written, has been made which is not contained in this lease. This agreement is severable, if one portion is invalid, the remaining portion shall, nevertheless, remain in full force and effect.
If I am asked to vacate the property I agree to do so immediately. This agreement can be terminated by either party without specific notice.
RV Park Policies
Park Policies and Rules were put in place to assure the park remains a safe, clean, and quiet park for everyone to enjoy. These rules are to ensure the welfare of all campers staying with us. All guests are subject to the same rules and it is your responsibility to follow them.
All guests are expected to comply with all statutes, ordinances, and requirements of all municipal, state, and federal authorities now in force, or which may hereafter be in force, pertaining to the premises. Be aware that this property falls in a flood plain and the property owners are not responsible for any losses or damage to guest property caused by nature or any act of God including floods, rains, tornados, hail, wind, fire, etc.
Occupancy: Occupancy rates are based on 2 adults and 2 vehicles per RV site. Any additional occupancy will be added to the application and will be charged the additional rate depending on the length of your stay. All fees for overnight guests must be paid online at the time of check in.
All payments are due at the time of check-in unless previous arrangements have been made with management.
All payments are nonrefundable.
Visitors: All guests and their visitors are subject to the same rules and it is the guest’s responsibility to inform their visitors and make sure that all rules are followed during their visit. If you are notified by management that you or your visitor are in violation of any rule and you continue to not comply, you and or the guest will be asked to leave immediately. Any damage or destruction of any property will be paid for by the responsible party.
Pets: Pets are allowed in the park on a case by case basis. Pets MUST be disclosed prior to move in or as soon as possible if acquired after move in. Failure to do so will result in a fine in addition to the pet fee and could result in termination of agreement and ejection. Pets must not be left outside unattended at any time, and must be kept on a leash at all times when outside your trailer. It is your responsibility as a guest to pick up after your pet and place all solid pet waste in a plastic bag and properly dispose of it. Do not leave pet waste on the ground. No aggressive dogs are allowed in the park. Excessive barking or any signs of aggression will not be tolerated and guests will be asked to remove their animal from the property if it becomes a problem.
Guest(s) must keep all vaccinations current.
Checkout: At the time of check-out campers are required to clean up their site before leaving and must notify management of their departure. Trash must be placed in the dumpster or there will be a $50 disposal fee.
Renewal Term: It is the intent of both parties that this agreement is on a month-to-month basis and this agreement, and all stipulations herein, shall remain in full force and effect for so long as the Guest occupies said premises
Notice of Photography and Video Recording
I understand that photography, audio and video recording may occur on these premises for security purposes and give my consent to be recorded.
RV Park Rules
1. Quiet time must be respected between the hours of 9:00 pm and 8:00 am Sunday through Thursday and 11:00 pm to 8:00 am Friday and Saturday. No loud music or parties are allowed. Please be considerate of guests who might sleep in on weekends. Loud, disorderly, or unlawful conduct will not be tolerated and will result in guests being asked to leave the park immediately.
2. Guests must keep their RV site neat and clean at all times.
(You may have plants, BBQ grills/smokers, and lawn furniture on your site, but please keep everything else out of sight.)
All trash must be placed in the trash cans immediately. Do not ever leave full trash bags outside your RV. No tires, furniture, car batteries, oil, antifreeze, or other hazardous materials are allowed to be dumped in the trash cans. All trash must be bagged and tied, and boxes must be broken down – failure to do so may result in a fine.
3. Parents must be with their children at all times. Never leave your child unattended. You and only you are responsible for the conduct and safety of your children.
4. No parking in empty RV spaces. Parking in empty RV spaces without prior approval will result in additional charges. Only 2 vehicles allowed per lot. No big rigs are allowed inside the park.
5. There is absolutely no Vehicle/RV/Motorcycle washing allowed in the park at any time.
6. Alcohol use must and shall be done responsibly! ALL BEER CANS, BOTTLES, LIDS, CUPS, ETC. must be picked up and thrown in the trash can immediately. In addition, drunken and disorderly conduct will not be tolerated and result in proper measures being taken to ensure the safety of all guests.
7. Smoking is allowed in personally owned RVs and outside, but please do not throw cigarette butts on the ground. This is not only a fire hazard, but it is also littering.
8. Disorderly conduct, drunkenness, illegal drugs, obscene language, obnoxious, disruptive or vulgar behavior will not be tolerated and will result in immediate eviction without refund. In addition, the possession, sale or manufacturing of illegal drugs or drug paraphernalia within the RV park is prohibited and will result and immediate removal. Any and all suspected illegal activity will be reported to the local law enforcement agency.
9. Excess use of electricity or water on any site will result in additional charges.
10. Makeshift Clotheslines are not allowed. Electric Space Heaters, Cheater Boxes, or Pigtails are also not allowed. In addition, Owner is not responsible for any electrical components on RV's. Furthermore, guests must make sure that there is a positive sewer c-seal at both ends of the sewer hose.
11. ABSOLUTELY NO FIREWORKS ALLOWED AND NO OPEN FIREARMS DISPLAYED!
These rules were created to assure that Twisted Pines located at 3131 FM 1252 remains a safe, clean, quiet RV Park and that all of our campers may have a comfortable experience during their stay.
