RELEASE, INDEMNIFICATION AND HOLD HARMLESS AGREEMENT
In consideration of participating in campgfound activities, and for other good and valuable consideration, I hereby agree to release and discharge from liability arising from negligence, LTSE Corp DBA Whiskey Creek Campground, its owners, directors, officers employees, agents, volunteers, participants, and all other persons or entities acting for them (hereinafter collectively referred to as "Releasees"), on behalf of myself and my children, parents, heirs, assigns, personal representative and estate, and also agree as follows:
I. I acknowledge that participating in campground activities involves known and unanticipated risks which could result in physical or emotional injury, paralysis or permanent disability, death, and property damage. Risks include, but are not limited to, broken bones, torn ligaments or other injuries as a result of falls; burns from campfires; drowning in pools or other bodies of water; falls from play equipment or caused by uneven surfaces; medical conditions resulting from physical activity; and damaged clothing or other property. I understand such risks simply cannot be eliminated, despite the use of safety equipment, without jeopardizing the essential qualities of the activity.
2. I expressly accept and assume all of the risks inherent in this activity or that might have been caused by the negligence of the Releasees. My participation in this activity is purely voluntary and I elect to participate despite the risks. In addition, if at any time I believe that event conditions are unsafe or that I am unable to participate due to physical or medical conditions, then I will immediately discontinue participation.
3. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Releasees from any and all claims, demands, or causes of action which are in any way connected with my participation in this activity, or my use of their equipment or facilities, arising from negligence. This release does not apply to claims arising from intentional conduct Should Releasees or anyone acting on their behalf be required to incur attorney's fees and costs to enforce this agreement, I agree to indemnify and hold thern harmless for all such fees and costs.
4. I represent that I have adequate insurance to cover any injury or damage I may suffer or cause while participating in this activity, or else I agree to bear the costs of such injury or damage myself. I further represent that I have no medical or physical condition which could interfere with rny safety in this activity, or else I am willing to assume -and bear the costs of - all risks that may be created, directly or indirectly, by any snch condition,
5. In the event that I file a lawsuit, I agree to do so solely in the state where Releasees' facility is located, and I further agree that the substantive law of that state shall apply.
6. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.
By signing this document, I agree that if I am hurt or my property is damaged during my participation in this activity, then I may be found by a court of law to have waived my right to maintain a lawsuit against the parties being released on the basis of any claim for negligence.
I have had sufficient time to read this entire document and, should I choose to do so, consult with legal counsel prior to signing. Also, I understand that this activity might not be made available to me or that the cost to engage in this activity would be significantly greater if I were to choose not to sign this release, and agree that the opportunity to participate at the stated cost in return for the execution of this release is a reasonable bargain. I have read and understood this document and I agree to be bound by its terms.
SITE POLICIES
CHECK-IN: 2pm
CHECK-OUT: 1pm
Early arrivals and late departures are subject to additional fees.
Use of campground amenities and participation in any campground activity is at the risk of the registered camper and visitor.
Camping rates include 4 INDIVIDUALS per site.
Any addit!onal adult or child Is an extra $10.00 a person per night.
Children age 10 and under must be supervised ln the restrooms by an adult. Parents or guardians will be held responslble for actions of their children, wards, visitors and themselves. They will also be held financially liable for damage caused by their children or wards. Children (15 years old & under) must be back at their own sites by 10:00PM.
ALL non-camping visitors MUST register at the store and purchase a $10.00 day visitor pass.
Visitors are the registered camper's responsiblllty.
Visiting hours END at 11PM.
Camping rates include 1 primary unit plus 1 tent per site. The primary unit can be a trailer, RV, pop-up camper, truck camper, tent, etc.
No more than 2 vehicles are allowed per site.
Additional parking is available by the Lodge, do NOT park your vehicle on another campsite.
All motorized vehicles are to be driven by licensed operators only.
Speed limit is 5MPH.
Watch for children.
QUIET TIME: 11pm-8am
All radios and exterior lights must be turned off
Campfires are allowed ONLY in fire rings.
Do NOT leave fire unattended.
Do NOT move fire rings.
Do NOT put trash in fire rings.
Firewood Is for sale at the camp store.
One picnic table Is provided for each campsite, you may move It anywhere on your site.
Do NOT move it to another site.
Do NOT deface the tables.
CLEAN your campsite before you check out, leave it in same or better condition as it was when you arrived.
Put your trash in the dumpster.
Do NOT leave empty bottles and cans at your site.
PLEASE RESPECT FELLOW CAMPERS, WORKERS AND CAMPGROUND PROPERlY
Property ls under 24 hour video surveillance.
No one under the age of 21 is to consume alcohol on Whiskey Creek premises.
No bows/arrows. No BB Guns, slingshots, paint guns, or other projectile devices of any kind, FireWorks are not permitted.
Do NOT deface property such as trees, buildings, tables, etc.
Do NOT screw or nail things into the trees.
PET POLICIES
Pets must be kept on a leash at all times.
Clean up after your pet.
Pets are not permitted in buildings or pond.
Do not leave your pet unattended.
No noisy pets, please!
SWIMMING AREA POLICIES
WARNING: NO LIFEGUARD on duty, everyone swims at their own risk in pool and pond area. Chlldren under 18 MUST be accompanied by an adult.
Any non-swimmer must NOT be left unattended .
Catch and release fishing ONLY at dockside of the pond.
NO GLASS containers allowed in bathrooms, pool area or near pond.
NO food or drink in pool area. SHOWER before entering pool.
NO SHOES allowed in pool area.
Swimmer MUST use a different bathing suit for pond swimming to pool swimming.
Bathing suits only.
Please do NOT put babies In the pool that are not potty trained or with disposable diapers.
PROPERTY ORV TRAIL/TRACK/PLAYGROUND RIDING POLICIES
All property trails are for the use of registered campers ONLY.
A Whiskey Creek Trail Permit Pass must be purchased and displayed on each vehicle
RIDE AT YOUR OWN RISK
ALL USERS MUST WEAR A HELMET
NO DRINKING AND DRIVING
NO RIDING from 9pm- 9am
Children under the age of 12 MUST have adult supervision
DRIVE SLOWLY through ALL camping areas. One warning will be issued, second time will be asked to no longer ride at Whiskey Creek Campground.
STAY ON TRAILS, do not make your own, no riding through other campsites or on any grass.
NO fishtails, donuts or riding laps around camping.area.
NO riding around the pond or on Whiskey Hills OlscGolf Course.
NO DOUBLE riding on quads
NO DRAG RACING
OBEY ALL POSTED SIGNS and PROPERTY BOUNDARIES.
Keep in mind riding at Whiskey Creek ls a privilege and can be taken away at any time.
Please respect the rules and the grounds.
HORSE RIDING POLICIES
RIDE AT YOUR OWN RISK
Horse droppings MUST be cleaned up from the campsite and campground roads. Also, please help keep the rest of the grounds clean by picking up after your horse and placing droppings in designated areas. NO spreading of droppings ln woods.
ALL horses MUST be picketed or corralled OFF the campsite.
If picketing trees, make sure your horse isn't damaging the tree or its roots.
Please try to keep horse off of actual campsite as much as possible, and when riding please stay off grass areas.
Keep in mind allowing horses to camp here at Whiskey Creek Is a privilege and can be taken away at any time.
