I agree and shall cause my children, invitees, and guests, to abide by the Park Rules, including those rules and policies published at yeagercreekrv.com, posted at the Premises, or otherwise communicated in any manner by The Park at Yeager Creek Management (collectively, “Yeager Creek” Management).

I understand and agree that The Park at Yeager Creek does not give credits or refunds due to the discomforts of nature, travel delays, early departures, or schedule changes. All terms, policies, rates, and discounts are subject to change without notice and at any time.

As a participant in a recreation activity, I am responsible for acting within the limits of my ability and heeding all warnings regarding participation in the activity. I will maintain control of myself and any equipment while participating in the activity and will refrain from acting in any manner that may cause or contribute to injury to myself or to others.

I HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE The Park at Yeager Creek LLC, d/b/a Yeager Creek RV Resort, its owners and agents (collectively, Yeager Creek Management), from any and all liability to me, my children, my invitees/guests, personal representatives, and heirs for any loss or damage on account of injury to person (including death) or loss or damage to property relating to, or arising out of, use and occupancy of the Yeager Creek property, facilities, amenities, the creek (including, but not limited to, fishing) (collectively, the Premises) and any dangers and hazards associated with acts of nature such as changing weather conditions; high winds; thunder and lightning; temperature fluctuations; falling trees; tree limbs, ice; or encounters with wildlife.

I acknowledge and agree that the camping at Yeager Creek RV Resort is in the great outdoors and as a result, has inherent risks due to its topography and natural creeks, which pose additional risks to me and my guests, including the risk of tripping, falling, and/or drowning, and I HEREBY AGREE TO INDEMNIFY, SAVE AND HOLD HARMLESS Yeager Creek Management, and each of them, from any loss, liability, damage or cost (including attorney fees) they may incur due to injury (including death), damage or loss of property relating to use of the Premises by me, my children, and/or my invitees/guests, or due to any incidents that may occur during my stay. I understand that, although Yeager Creek Management makes every reasonable effort to provide a secure environment, the security of my person, my belongings, and all persons registered in my party is my sole responsibility. I agree that I, my children, and/or my invitees/guests will exercise reasonable care for our own safety and the security of other persons in the park. I acknowledge that nothing contained in this service agreement requires The Park at Yeager Creek, LLC (Yeager Creek RV Resort) to provide any security device, security measure, or security personnel. I acknowledge that Yeager Creek RV Resort makes no express or implied warrant of safety or security against criminal activity.

As a courtesy, our employees, if so requested, may assist with directing you to your designated campsite. It is your sole responsibility to ensure that the site will accommodate your specific trailer or RV, and that you will not damage any branches, bollards, trees, rocks, etc. when positioning your RV on the campsite. You agree to indemnify and hold The Park at Yeager Creek LLC, d/b/a Yeager Creek RV Resort, its owners and agents (collectively, “Yeager Creek Management”) harmless from any loss, liability, damage or cost (including attorney’s fees) that may result from an employee assisting or directing you onto a campsite. Furthermore, you release, waive, discharge, and covenant not to sue Management for any and all liability, loss, or property damage relating to an employee assisting/directing you to your site.

The Premises are privately owned and THE YEAGER CREEK MANAGEMENT RESERVES THE RIGHT TO REFUSE SERVICE to anyone for any reason. Yeager Creek Management reserves the right to require any person or party it deems necessary, to leave the campground based on violations of rules and policies or behavior or actions management deems inappropriate, disrupting, or disturbing to others. Harassment or mistreatment of our staff or other guests will not be tolerated under any circumstances. I have read this notice and agree to it as well as all Yeager Creek rules and regulations. In addition, I understand that I am responsible for the actions of all persons in my party, including any children, and any guests that visit during my stay. 

I understand that I am and remain personally liable to pay the total amount of my reservation prior to my scheduled check-in date. If I fail to pay the total due, I agree that The Park at Yeager Creek LLC may charge any remaining balance (in addition to any damage charges or other amounts owed under these Terms and Conditions) to any credit or debit card on file with my reservation. Any amounts due after 30 days will be subject to the maximum late charge permitted under state law.

The Park at Yeager Creek, LLC (Yeager Creek RV Resort) agrees to provide you service for your recreational vehicle (RV) on ONE of our designated RV sites. ANY RIGHT GRANTED TO YOU IS THROUGH A REVOCABLE LICENSE, WHICH MAY BE REVOKED AT ANY TIME. UNDER NO CIRCUMSTANCES SHOULD YOU CONSIDER YOURSELF A TENANT WITH A LEASE.

Any guest found in violation of any of the terms, conditions, rules, or policies, whether written or verbal, is subject to immediate expulsion from the property at the sole discretion of management. Guests who are asked to leave forfeit the balance of their reservation and may not be allowed to return the property.

Additional Terms & Conditions

Reservations: Guests must be 21 years of age or older to reserve a campsite. Reservations must be paid in full with a valid major credit card (Visa, MasterCard, Discover) prior to arrival. 

Cancellations: Cancellations two weeks before the first day of the reservation will result in a full refund, minus a $25 Cancellation Fee, to your original payment method. Reservations canceled at least one week prior to but less than two weeks before the first day of the reservation will result in a 50% refund minus a $25 Cancellation Fee. Cancellation of monthly reservations will result in the Application Fee and Deposit being forfeited in addition to the $25 Cancellation Fee. There will be no refunds for reservations canceled less than one week before your scheduled arrival date, or in the case of no-shows, and the total amount of your reservation fee will be forfeited to The Park at Yeager Creek. Special Events - No refunds for cancellations less than 3 weeks from date of special event arrival. No cancellation fee incurred.

Check-In and Check-Out: Check-In is available between 1pm and 6pm daily, and Check-Out time is by 11am on the last day of your reservation. Early/late check-ins and late check-outs are available on a case-by-case basis and may incur an additional fee. Please call or text us at 512.265.6568 with your anticipated arrival and departure times to ensure that a staff member will be available to assist you.

Children: Well-behaved children of all ages are welcome on the premises with continuous adult supervision. Minors under the age of 18 must be accompanied and supervised by a parent or guardian who is responsible for them and their behavior at all times (including in areas such as, but not limited to, the clubhouse, restrooms, showers, laundry room, walking trails, fire pits, or elsewhere on the property). THERE IS NO SUBSTITUTE FOR ADEQUATE SUPERVISION.

Property Access: Certain areas of the property are available for the enjoyment of our guests. These areas include those surrounding all campsites and along the creek and pond; clearly marked trails throughout the property; areas around grills, picnic tables, and fire pits*; and specific buildings on the property, including the clubhouse, showers, restrooms, and laundry room. Gated areas and unmarked trails are off-limits at all times. Swimming, wading, or the use of any type of watercraft in the creek or pond is prohibited at all times. Fishing is prohibited at all times in the pond on the Yeager Creek property. Hunting any animals on the property is prohibited at all times. Video surveillance by guests is prohibited.  

*NOTE: Due to extreme weather conditions, a burn ban may be in place at certain times. Please text us at 512.265.6568 or check the bulletin board in the clubhouse for the current burn ban status before starting any non-containerized fires. Further, due to the delicate and unique nature of the plants and wildlife on the premises, burning outside firewood is prohibited. Please use the firewood located in or next to the fire pits or contact us for assistance.

Animal Waiver

I hereby agree to the following regulations and conditions relating to household pet(s) while camping at The Park at Yeager Creek LLC, d/b/a Yeager Creek RV Resort (“Campground”).

I agree to keep my pet(s) out of the areas including, but not limited to, the area near cabins or rentals; food and beverage areas; the pond and creek; and all buildings, such as the clubhouse and bathhouse (inclusive of restrooms, showers, and laundry facilities). I agree that the Campground has the sole discretion to exclude animals.The basis for exclusion of any animal may include, but is not limited to, animals who are: of specific breeds, exempt from state or local law vaccination requirements due to age or infirmity; currently experiencing illness; currently in heat, or expected to come into heat during the reservation period; are aggressive, vicious, dangerous or potentially dangerous; easily frightened or sensitive, resulting in disruptive behavior (such as fighting or biting); and those animals who require muzzling for their safety and the safety of others. I agree to keep my pet(s) on a leash or in a carrier while in all public areas of the Campground at all times. I further agree that I or another responsible party will accompany and supervise my pet(s) when outside of  my RV, vehicle, or tent at all times.  I understand that I may not leave my pet(s) unattended leashed/chained or crated outside of my RV, vehicle, or tent at any time. I agree to prevent noise or any other disturbance by my pet(s), including, but not limited to, barking and pet feces, in the interest of other guests at the Campground. I represent and warrant that my pet(s) are current on all vaccinations (including rabies and distemper), as required by local and state authorities, and flea treatments. Should my pet(s) create any disturbances which cause complaints to be made to the management by other guests or employees of the Campground, I agree to immediately make arrangements to house my pet(s) elsewhere outside the Campground for the duration of my reservation. Additionally, I understand and agree that if I do not find alternative housing for my pet(s) after being asked to do so, I will be asked to leave the Campground and will forfeit the balance of my paid reservation.

Assumption of Risk and Release: I understand that permission to have my pet(s) at the Campground with me is a privilege and not a contractual right. Such permission is expressly conditional upon my adherence to the terms of these conditions and other rules in effect at any given time. I understand that the Campground may revoke such permission at any time for any reason. Additionally, I hereby assume all responsibility of risks, injury, damage, other harm that may occur while my pet(s) are at the Campground or those caused by my pet(s). Further, I hereby knowingly and voluntarily expressly release and discharge the Campground, its owner, its agents, its parent companies, members, managers, directors, officers, and employees (“Released Parties”) from any and all claims, damages, liabilities, injuries, demands, or causes of action, both present and future, whether known, unknown, anticipated or unanticipated, that  I or my guests or invitees may have against any of the Released Parties arising out of or incident to my pet(s)’ presence in the Campground, whether arising from any act or omission, whether negligent or otherwise, of me, my pet(s) or any guest or invitee. I further agree to indemnify each of the Released Parties for any and all such claims, damages, liabilities, injuries, demands, or causes of action, including costs, expenses, and attorney’s fees arising as a result of or related to the presence of my pet(s) at the Campground. This provision shall be enforceable to the fullest extent of the law.

By signing below, I acknowledge that I have read the foregoing Assumption of Risk & Release and fully understand its provisions and implications. My execution of this Release is entirely voluntary and intended to be binding on my heirs, executors, legal representatives, and assigns.

I have read this Animal Waiver and understand it is my responsibility to abide by the Rules. I further understand that it is my responsibility to ensure that my guests and invitees also comply with the Rules. Failure to adhere to the terms, conditions, policies, and rules set forth herein may result in my removal from the Campground without a refund.
